MINUTES OF THE CITY COUNCIL
Moorpark, California October 11, 2018
A Special Meeting of the City Council of the City of Moorpark was held on October 11,
2018, in the Community Center of said City located at 799 Moorpark Avenue, Moorpark,
California.
1. CALL TO ORDER:
Mayor Parvin called the meeting to order at 5:04 p.m.
2. ROLL CALL:
Present: Councilmembers Mikos, Pollock, Simons, Van Dam, and
Mayor Parvin.
Staff Present: Troy Brown, City Manager; Kevin Ennis, City Attorney;
Deborah Traffenstedt, Assistant City Manager; Maureen
Benson, City Clerk; Ron Ahlers, Finance Director; Jeremy
Laurentowski, Parks and landscape Director; Sean Corrigan,
City Engineer/Public Works Director; and Irmina Lumbad,
Deputy Finance Director (arrived at 6:35 p.m.); Maureen
Benson, City Clerk and Blanca Garza, Deputy City Clerk (left
at 6:10 p.m.).
3. PLEDGE OF ALLEGIANCE:
City Engineer/Public Works Director Sean Corrigan led the Pledge of Allegiance.
4. PUBLIC COMMENT:
None.
5. REORDERING OF, AND ADDITIONS TO, THE AGENDA:
None.
6. PRESENTATION/ACTION/DISCUSSION:
A. Consider of a Resolution Declaring the City’s Intent to Transition to
District-Based Elections with a Separate Directly Elected Mayor, Outlining
the Specific Steps to be Taken to Facilitate the Transition, and Estimating
a Time Frame for Action Pursuant to Elections Code Section 10010 as
extended by Agreement; and Approve an Agreement with a Prospective
Plaintiff for Extension of the Time Period for Specified Steps Provided by
Item: 10.C.

the California Voting Rights Act. 1) Adopt Resolution No. 2018-3755
declaring the City’s intent to transition to district-based elections; and 2)
Approve the Agreement between the City and Mr. Shenkman and his
prospective plaintiffs entitled “Agreement for Extension of Time Period for
Specified Steps Provided by the California Voting Rights Act.”
Mr. Ennis gave a PowerPoint presentation on the process of transitioning
from an at-large to a district-based election system including the tentative
timetable, subject to final edits by the City Manager. He discussed the
benefits of the agreement with Mr. Shenkman for extending the time
period for the required steps including public hearing process provided the
by the CVRA.
Mr. Ennis introduced Douglas Johnson and Robert McIntyre of National
Demographics, who will perform the district composition demography
work. Mr. Johnson responded to Council questions and concerns
regarding the history of Mr. Shenkman’s lawsuits challenging at-large
elections and the range of monetary awards he has received through
settlements or winning the court cases.
David Ross, a Moorpark resident, spoke in opposition to Mr. Shenkman’s
actions and confirmed that the City Council has no choice but to avoid a
costly lawsuit by moving forward with the district–based election process.
MOTION: Mayor Parvin moved and Councilmember Mikos seconded a motion to
adopt Resolution No. 2018-3755 declaring the City’s intent to transition to district-
based elections; and 2) Approve the Agreement between the City and Mr.
Shenkman and his prospective plaintiffs entitled “Agreement for Extension of
Time Period for Specified Steps Provided by the California Voting Rights Act.”
The motion carried by unanimous voice vote.
AT THIS POINT in the meeting, the Mayor requested the City Council take a recess and
announced when the meeting reconvenes the remaining items on the agenda will not be
televised. The time was 6:10 p.m.
The City Council meeting reconvened at 6:35 p.m. with all Councilmembers present.
B. Workshop Discussion Regarding Advantages and Disadvantages of
Community Facilities District (CFD) Versus Landscape and Lighting
Maintenance District (LLMD. Staff Recommendation: 1) City staff
recommends the use of CFDs for city government services instead of
LLMDs when entering into new development agreements; and 2) Provide
direction to City staff regarding which financing method the Council
prefers: Community Facilities District (CFD) or Landscape and Lighting
Maintenance District (LLMD).

Mr. Brown introduced Michael Medve, Project Manager for Willdan
Financial Services, 27368 Via Industria, Temecula, California and David
Fama, Attorney from Jones Hall and Associates, 475 Sansome Street,
San Francisco, California who provided an in-depth presentation on the
advantages of a Community Facilities District over that of a Landscape
Maintenance District. They responded to Council questions and concerns.
AT THIS POINT in the meeting, Councilmember Pollock left. The time was 7:40
p.m.
CONSENSUS: It was the consensus of those Councilmembers present to direct
staff to schedule an agenda item to discuss the advantages and disadvantages
of Community Facilities Districts versus Landscape and Lighting Maintenance
Districts at a regular City Council meeting.
7. CLOSED SESSION:
None was held.
8. ADJOURNMENT:
Mayor Parvin adjourned the meeting at 7:51 p.m.
