SUBJECT: Consider Waiving Formal Bidding Requirement for Mulch in City
Parks
DISCUSSION
The City Council approved the amount of $25,000 in the FY 2018/19 Parks Division
operating budget for the procurement of mulch to replenish the planting areas in various
City Parks. Staff solicited quotes from three companies to provide the mulch, including
delivery.
The following are the tree quotes received for this purchase:
Peach Hill Soils $13.50/cu. yd.
CM Top Soil $16.00/cu. yd.
Foothill Soil $16.00/cu. yd.
The lowest quote was provided by Peach Hill Soils. Peach Hill Soils is a nearby
business that resides just outside the City limits on Hwy 118. Their close proximity to
the City has allowed them to be very competitive due to a reduction in delivery costs.
Moorpark Municipal Code (MMC) Section 3.04.130-240 requires formal bidding
procedures be followed prior to purchasing supplies and equipment with a total value of
$15,000 or more. Because the budget for this work exceeds the $15,000 threshold, a
formal bid would need to been initiated for the procurement of the mulch. The primary
difference between the formal bidding procedure and the informal procedure staff
followed is the requirement to notice the bids by advertising in a newspaper of general
circulation. Since staff obtained three quotes for the mulch from three reputable
companies, staff is requesting that the City Council waive the purchasing procedure
outlined in MMC 3.04.130-240. MMC Section 3.04.120 allows the City Council in its

discretion at any time, by a majority vote, to waive purchasing procedures, when such
waiver is not in violation of State law. California law does not provide specific
procedures for purchasing supplies and equipment for cities, so no violation of State law
will occur. It should be noted that the City’s bidding threshold for the procurement of
equipment and supplies has not been updated since 1985. Staff is in the process of
evaluating the City’s purchasing policy to keep pace with the current costs of goods and
services.
FISCAL IMPACT
There is no fiscal impact with this action. Funding for the purchase of the mulch has
already been included in the Fiscal Year 2018/19 budget.
