Gilbert, Director of Public Works January 21, 2000 (Council Meeting 2 -2 -00) SUBJECT: Consider Resolution No. 2000- Rescinding Resolution No. 94 -1062, Pertaining to Parking Restrictions on the South Side of Los Angeles Avenue Between Moorpark Avenue and Park Lane and Establishing a No Stopping Anytime Zone Within Said Area RArTMRO TNT) 1. Resolution No. 91 -818 established No Stopping Anytime Zones along the entire length of New Los Angeles Avenue and Los Angeles Avenue, as depicted in the diagram attached as Exhibit 'A', except two areas. One area omitted from that action is the north side of the street just west of Millard Street. The second area omitted from that action was the subject area on the south side of the street west of Moorpark Avenue. 2. In 1994 the City Council adopted Resolution 94 -1062 which established certain revised parking regulations as depicted in the diagram attached as Exhibit 'B' and summarized as follows: a) established a No Stopping Anytime zone along the Los Angeles Avenue frontage of the gasoline station located at the southwest corner of Los Angeles Avenue and Moorpark Avenue; and b) established a "No Parking 11:00 pm to 5:00 am" zone on the south side of Los Angeles Avenue in that area west of the gasoline station and east of the bank at the southeast corner of Park Lane. 3. On January 19, 2000, the City Council discussed the question of establishing a parking prohibition within the subject area. The City Council directed staff to prepare a Resolution to make that change. 0002113 No Stopping: January 21, Page 2 DISCUSSION L. A. Ave. 2000 A. Planned Improvements It should be noted that the developer for the Archstone project is required to construct street improvements along the area in question. Those improvements will include additional pavement width, curb and gutter. That project will also include the restriping of the street to accommodate additional lanes. In order to provide for proper traffic safety, that project would have to include the establishment of a parking prohibition within the area in question. The subject recommended action merely provides for an early implementation of those parking restrictions. B. Right -of -Way City records indicate that all of the street right -of -way in the subject area has been conveyed to the City and /or to Caltrans. The right -of -way line is located approximately at the location of the white wooden rail fence. C. No Private Property Affected The action taken in 1994 was, in part, based upon information indicating that the subject area was not a part of the Caltrans right -of -way. Accordingly, Section 21107.5 of the California Vehicle Code (CVC) was cited as authority for the establishment of parking restrictions within the subject area. In light of the above determination that no private property is affected, reference to that CVC Section, and the public hearing required pursuant to said Section, is not required. The attached draft Resolution makes mention of this change from the authority previously cited. D. Caltrans Approval Pursuant to CVC, it will be necessary to seek and obtain a Caltrans Encroachment Permit prior to removing and replacing the signs currently in place. TR. - fill tr ,■ 4 . wt • 99 MR 26\ -- ^� . p RS 74 •..r 13 RS 90 R5 ,0 TR. 3537-4 .. - [1-77 14 FRE .. : J� rx 000217 RESOLUTION NO. 2000 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, RESCINDING RESOLUTION NO. 94 -1062 PERTAINING TO PARKING RESTRICTIONS ON LOS ANGELES AVENUE BETWEEN MOORPARK AVENUE AND PARK LANE, AND ESTABLISHING A NO STOPPING ANYTIME ZONE WITHIN SAID AREA WHEREAS, Section 22506 of the California Vehicle Code (CVC) provides for the establishment of parking restrictions on a State Highway subject to the approval of Caltrans; and, WHEREAS, pursuant to said Section the City Council adopted Resolution No. 91 -818 establishing a 'No Stopping Anytime" zone along the entire length of New Los Angeles Avenue and Los Angeles Avenue from the Route 23 Freeway westerly to a point west of Butter Creek Road, except certain areas identified therein; and WHEREAS, the City Council later adopted Resolution No. 94- 1062, establishing No Stopping Anytime and No Parking within certain designated times, within one of the areas not addressed in Resolution No. 91 -818, said area being the south side of Los Angeles Avenue between Moorpark Avenue and Park Lane; and, WHEREAS, the City Council now wishes to revise the parking restriction within the area addressed by Resolution NO. 94 -1062; and, WHEREAS, it has been determined that the area in question is entirely within Caltrans right -of -way and that CVC Section 21107.5 pertaining to the establishment of traffic and /or parking regulations on a private road do not apply. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK, DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That upon approval of a Caltrans Encroachment Permit and the installation of signs as provided for by Resolution No. 2000- Resolution No. 94 -1062 shall be rescinded. SECTION 2. A "No Stopping Anytime" Zone is hereby established on the south side of Los Angeles Avenue between Moorpark Avenue an Park Lane. SECTION 3. Said zone shall not apply to Bus Stops, Loading Zones and other such areas designated by Resolution to the City Council for the stopping of vehicles. 00021-3 3 Resolution No. 2000 - Page 2 SECTION 4. Upon receipt of approval by Caltrans, the City Manager shall provide for the installation and maintenance of signs and markings giving notice of said parking prohibition. SECTION 5. The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original resolutions.
