-MINUTES OF THE CITY COUNCIL
Moorpark, California January 5, 2000
A Special Meeting of the City Council of the City of Moorpark
was held on January 5, 2000, in the Community Center of said
City located at 799 Moorpark Avenue, Moorpark, California.
1. CALL TO ORDER:
Mayor Hunter called the meeting to order at 5:56 p.m.
2. ROLL CALL:
Present: Councilmembers Harper, Rodgers,
Wozniak, and Mayor Hunter
Absent: Councilmember Evans
Staff Present: Steven Kueny, City Manager; John Nowak,
Assistant City Manager; Cheryl Kane,
City Attorney; and Ken Gilbert,
Director of Public Works.
3. PUBLIC COMMENT:
None.
4. CLOSED SESSION:
Mr. Kueny announced that the City Council would be going
into closed session for a discussion of two cases under
Item 4.A., and Items 4.F., 4.H., 4.J., and 4.K.
Ms. Kane announced for one case under Item 4.A. that the
facts and circumstances creating significant exposure to
litigation, which facts and circumstances are known to
potential plaintiffs, consist of TM Engineering's December
17, 1999 Request for Equitable Adjustment relative to the
Spring Road Bridge Project. Ms. Kane announced for the
second case under Item 4.A. that the facts and
circumstances creating significant exposure to litigation
consist of a written communication dated December 14, 1999
threatening litigation received from H. James Keathley,

Esquire, on behalf of Caz Jairazbhoy, owner of the 7- Eleven
Store in Moorpark Plaza, relative to the Spring Road Bridge
closure.
MOTION: Councilmember Wozniak moved and Councilmember Harper
seconded a motion to adjourn to closed session for a discussion
of two cases under Item 4.A., and Items 4.F., 4.H., 4.J., and
4.K. The motion carried by voice vote 4 -0, Councilmember Evans
absent.

The Council reconvened into open session at 6:23 p.m. Mr.
Kueny announced that two cases under Item 4.A. and Items
4.F. and 4.J. were discussed in closed session and that
there was no action to report.
5. ADJOURNMENT:
Mayor Hunter adjourned the meeting at 6:23 p.m.
