Excerpt From the Engineer's Report for Assessment
District AD84 -2 for FY 2000/2001 Pertaining to Zone 12
of Said District, and the Scheduling of a Public Hearing
to Consider Changes to and the Ordering of the Annual
Assessments for Zone 12
EXECUTIVE SUMMARY
This presents for approval a Resolution taking certain actions
generally described as follows:
• approves an excerpt from the Engineer's Report for Assessment
District AD84 -2 for FY 2000/2001, pertaining to Zone 12;
• sets the date of a public hearing to consider a proposed
increase to the amount of the Zone 12 assessments; and
• directs that mail ballots be provided to the owners of all
affected properties, consistent with the requirements of
Proposition 218.
DISCUSSION
A. Background
Assessment District 84 -2 LAD84 -21 was formed in 1984 pursuant
to the provisions of the "Landscaping and Lighting Act of
1972." This assessment district was established to allow for
the funding of street lighting and parkway /median landscape
maintenance and improvement expenses through the levying of
assessments as provided for in the act. The City must annually
act to levy the lighting and landscape maintenance
assessments. Said assessments have been levied each year since
the formation of the district.

B. Resolution of Intent
On January 5, 2000, the City Council adopted Resolution No.
2000 -1688 initiating the proceedings required to consider the
levy of assessments for AD 84 -2 for FY 2000/2001. On that date
the City Council also selected Charles Abbott & Associates to
prepare the Engineer's Report for the district.
C. Prior Citv Council Direction
By separate action on January 5, 2000, the City Council also
directed staff to proceed with the steps necessary to prepare
and distribute Mail Ballots required in order to increase the
amount of the assessments for Zone 12 from zero to an amount
sufficient to fund future City costs for the maintenance of
certain landscaping within the Carlsberg Specific Plan. That
direction included approval of an Allocation Formula to be
used in determining the amount of the assessments for Zone 12.
D. Areas Other Than Zone 12
In April the City Council will be asked to approve the full
Engineer's Report for AD84 -2 and to set the date of a public
hearing in June to consider the levy of all of the various
assessments called for by that Report.
E. Engineer's Report: Zone 12
Attached as Exhibit 1 is an excerpt from the Engineer's Report
for AD84 -2 for FY 2000/2001, pertaining to the proposed
assessments to the properties within Zone 12. One of the
actions taken by the subject Resolution is the approval of
this Engineer's Report Excerpt.
This excerpt will be incorporated into the full Engineer's
Report to be considered by the City Council in April.
F. Improvements to be Maintained
The scope of the landscaping to be maintained by the City, and
funded by the Zone 12 Assessment, is described in the
Engineer's Report Excerpt attached as Exhibit 1. A summary
list of those improvements is as follows:
• the medians on Science Drive;

• certain parkways within the R -O -W described as follows:
- Science Dr. south of the Commercial /Industrial frontage;
- north side of Tierra Rejada Road;
- east side of Spring Rd. south of the Presbyterian
Church;
• certain slopes beyond the R -O -W described as follows:
- on Science Drive south of the Commercial / Industrial
frontage;
- on the north side of Tierra Rejada Road; and
- on the east side of Spring Road south of the
Institutional lots.
G. Assessment Calculation
Attached as Exhibit 2 are charts which show the manner in
which the Zone 12 assessments were calculated. The total
assessment amount for Zone 12 is $229,961.49. Said assessment
amount has been allocated to properties with approved ultimate
land uses, based upon the Allocation Formula approved by the
City Council on January 5. Said Allocation Formula is set
forth in the Engineer's Report Excerpt (Exhibit 1).
H. Future Increases to Assessment Amount
The total assessment amount may be increased in future years
to cover increases to the cost of maintenance. The language
in the Engineer's Report Excerpt (Exhibit 1) provides that
any such increase may not exceed the increase to the Consumer
Price Index (CPI) between the Base Year (FY 2000/2001) and
the fiscal year of the then proposed assessment. Accordingly,
any deferred increases may be applied in a future year should
the need arise.
I. Affected Properties
Attached as Exhibit 3 is a key map and a list of the
properties to be assessed.
J. Public Property
A portion of the costs allocated to residential properties is
to be assessed upon public properties within Zone 12. As set
forth in the Engineer's Report Excerpt (Exhibit 1), an
Equivalent Dwelling Unit [EDU] factor was assigned to each

category of public property. The language in Exhibit 1 on
this matter is summarized as follows:
1. In that it has been determined that Water Utility and
Flood Control property receive no benefit from the
proposed improvements, said properties are to be exempt
from the Zone 12 assessment.
2. Assessor parcels used for school purposes have been
assigned and an EDU factor of one (1) EDU per parcel.
3. Assessor parcels used for parks purposes have been
assigned an EDU factor of one (1) EDU per parcel.
The amount of the assessments upon public property within
Zone 12 is shown on page 2 of Exhibit 4 and is summarized
follows:
• County Waterworks District No. 1 exempt
Calleguas Municipal Water District exempt
• Ventura County Flood Control District exempt
Moorpark Unified School District $ 772.48
• City of Moorpark $ 772.48

K. City Payment of MUSD Assessment
Unlike the process which led to the approval of the Parks
Assessment District, the Moorpark Unified School District
(MUSD) has not been involved in the development and
application of this assessment. In that the amount of the
assessment is relatively low, it is recommended that the City
pay the assessments to be levied upon school parcels. It
should be noted that even if the City pays the assessment for
any public property, the owner of that public property would
still receive a Ballot and would be entitled to vote on the
proposed assessment. It would be the intent of staff to
advise the MUSD of the City Council's action on this matter.
L. Ballots
Pursuant to Proposition 218, the proposed increase to the
amount of the Zone 12 assessments must be approved by mail
ballots received from the owners of affected properties. A
copy of the Ballots to be mailed to those property owners is
attached as Exhibit 4.

M. Ballot Process
Ballots will be mailed to the owner of record of each of the
properties to be assessed. To be counted a ballot must be
marked, signed and received by the City prior to the end of
the public input portion of the Public Hearing to be held on
this matter. The owner of each affected property receives one
vote for each dollar assessed to that property. Support of the
assessment requires a majority vote from the ballots received.
Failure to receive that majority vote will require that the
City Council abandon the proposed assessment.
N. Public Hearing
It is recommended that a Public Hearing be held on the
proposed assessment increase, on May 3, 2000. Said date will
meet the minimum forty -five (45) day requirement of
Proposition 218. As stated above, Ballots may be presented to
the City any time prior to the close of the public input
portion of the Public Hearing. It is the intent of staff to
announce the results of the tabulation of the Ballots
received, subsequent to the close of that Public Hearing.
O. Public Hearing Notice
Attached as Exhibit 5 is the draft Public Hearing Notice to be
sent, with the Ballots, to the owners of all affected
properties. The Hearing Notice will include, as an Exhibit, a
copy of the approved Engineer's Report Excerpt (Exhibit 1).
P. Resolution
Attached,as Exhibit 6 is a copy of the subject Resolution.
STAFF RECOMMENDATIONS
1. Authorize the City to pay the assessments levied upon parcels
owned by the Moorpark Unified School District for Zone 12 of
AD84 -2.

EDU LEguivalent Dwelling Unitl: For the purpose of determining the amount of
the Zone 12 assessment to be levied upon public properties within Zone 12, each
category of public property has been assigned an Equivalent Dwelling Unit
[EDU] factor.

b. Exempt Properties: It has been determined that Water Utility and Flood Control
properties receive no benefit from the proposed improvements. Accordingly, all
such properties shall be exempt from the Zone 12 assessment. In addition, in
that the portion of the total assessment allocated to the Institutional Properties is
spread to only lots 3 and 4 of Tract 4974, the slope adjacent to Spring Road
[AP #512 -0- 270 -065 is exempt.
Equivalent Dwelling Units [EDUJ: A portion of the assessment allocated to
Residential properties has been allocated to each public property within Zone
12, based upon the applicable number of EDUs for that public property. The
EDUs assigned to various categories of public properties within Zone 12 are as
follows:

d. Annual Increase to Total Assessment Amount:
1. Base Year: The Base Year Total Assessment Amount for Zone 12 is the
amount stated in the Engineer's Report for FY 2000/2001, said amount
being $229,961.49.
2. Annual Increase: In years subsequent to FY 2000/2001, the Total
Assessment amount for Zone 12 may be increased to cover maintenance
cost increases.
3. Basis of Increase: The amount of any increase to the Total Assessment for
Zone 12 shall be based upon the increase to the Consumer Price Index
(CPI) for all Urban Consumers for the Los Angeles Metropolitan Area, for
the calendar year ending the December prior to the Fiscal Year of the
proposed assessment.
4. Deferred Action: Each year when the amount of the Total Assessment for
Zone 12 is determined, said amount may or may not be increased, as
provided above, at the sole discretion of the City.
5. Assessment of Deferred Increase in Subsequent Years: Any increase to the
Total Assessment for Zone 12 may include any increase deferred in any
and all prior years. In such event, the approved Total Assessment may not
exceed the Base Year Total Assessment Amount, adjusted to reflect the
change in the CPI between the Base Year and the effective year of the
proposed assessment.
[Example: If the CPI increases 5% Year 3, but the assessment for
Year 3 is increased by only 3 %, the remaining 2% increase may be
added to the assessment in any subsequent year.]
6. Increase Determined Invalidity: In the event any increase to the Total
Assessment amount is held to be invalid or unconstitutional by any court
of competent jurisdiction, such decision shall not affect the validity of the
Base Year Total Assessment for Zone 12.
Section 4 Description of the Improvements to be Maintained
12. Zone 12: Carlsberg Specific Plan
Maintenance costs associated with certain landscape improvements as described in
the Boundary Map for Zone 12 included in Appendix "E ". The cost for the
maintenance of these improvements will be borne by all of the properties within
Zone 12 as defined in said Boundary Maps and generally described as that area
bounded by the Route 23 freeway, Tierra Rejada Road, Spring Road, the Arroyo
Simi and New Los Angeles avenue.

Appendix "B" Landscape Formula
Notes:
12. Zone 12: In addition to the above landscape charges, all of the properties within the
Carlsberg Specific Plan are assessed an additional amount for the maintenance of
certain parkways, medians and slope areas, as described in the Boundary Maps set
forth in Appendix "E ". The total assessment amount is allocated to ultimate land
use categories in accordance with the chart set forth in Section 4 of this report.
Based upon that allocation chart, the total assessment amount cited in Appendix 'D'
of this report is spread to all of the properties within Zone 12. The amount of the
assessment for each land use category is as follows:
• Commercial / Industrial: $ 139.84 / Acre
• Institutional $1,258.95 / Acre
• Residential $ 386.24 / Lot or EDU

CITY OF MOORPARK
SPECIAL BENEFIT ASSESSMENT
AD84 -2, Zone 12
A. Notice of Public Hearing: A Public Hearing has been scheduled for May 3, 2000, at 6:30
p.m. in the City Council Chambers, at City Hall, 799 Moorpark Avenue, Moorpark, CA, to
consider approval of an increase to the amount of the assessment for Zone 12 of
Assessment District 84 -2. The purpose of this notice is a) to advise those concerned of the
date and time of the public hearing on the matter; b) to describe the purpose and intent of
the proposed assessments; and, c) to explain the ballots which have been provided to the
owners of affected properties.
B. Background: In 1984, a Landscaping & Lighting Maintenance Assessment District
(AD 84 -2) was created to fund costs associated with street lighting and the maintenance of
various landscaped areas within the City. In 1997 Zone 12 of that Assessment District was
established, encompassing that area bounded on the east by the Route 23 freeway, on the
west by Spring Road, on the north by New Los Angeles Avenue and the Arroyo Simi and
on the south by Tierra Rejada Road. Since the formation of Zone 12, the amount of the
assessment has remained at zero. The construction of landscape improvements within that
area has been completed and the City will be considering the possible acceptance and
maintenance of certain specific portions of those landscape improvements.
C. Reason for Assessment: The purpose for Zone 12 assessment is to fund City costs for the
maintenance of certain specified landscaped areas within Zone 12.
D. Engineer's Report Excerpt: Information pertaining to the Zone 12 assessment is set forth
in an excerpt from the draft Engineer's Report for AD84 -2 for FY 2000/2001, attached to
this Public Hearing Notice as Exhibit'A'.
E. Scope of Improvements to be Maintained: The scope of the landscape improvements to
be maintained by the City and funded by the Zone 12 assessment, is described in Boundary
Maps set forth in the Engineer's Report Excerpt attached as Exhibit W.
F. Assessment Amounts: The amount of the total annual assessment for Zone 12 of AD84 -2
for FY 2000/2001, is $229,961.49. The amount of the assessment for each affected
property is shown on the Ballot provided to the owner of that property. In addition, the
amount of the per acre or per lot assessments is set forth in the Engineer's Report Excerpt
attached as Exhibit 'A'.

G. How the Assessment Was Calculated: To determine the amount of the assessments for
each property within Zone 12, the maintenance cost of specified elements of the
improvements has been allocated to the various ultimate land uses within Zone 12. The
costs allocated to each land use was then spread to each property, yielding a per lot
assessment for residential property and a per acre assessment for other properties. More
specific information pertaining to the Method of Assessment for Zone 12 is to be found in
the Engineer's report Excerpt attached as Exhibit'A'.
H. Public Property: A portion of the costs allocated to residential properties will be assessed
upon public properties. Each category of public property has been assigned an Equivalent
Dwelling Unit [EDU] factor. The amount of the assessment for any given publicly -owned
parcel is determine by multiplying the residential per lot assessment by the number of
EDUs assigned to that parcel. Additional information on EDUs and assessments upon
public properties can be found in the Engineer's report Excerpt attached as Exhibit'A'.
I. Exempt Properties: It has been determined that Water Utility and Flood Control
properties receive no benefit from the proposed improvements and are, therefore, except
from the Zone 12 assessment.
J. Duration of the Assessment: The proposed assessment is for the period beginning July 1,
2000, and ending June 30, 2001.
K. Method of Collection: The proposed assessment, if approved, will appear on your
property tax bill for FY 2000/2001.
L. Future Increases: The total assessment amount may be increased in future years to cover
increases to the cost of maintenance. In no instance may any increase exceed the increase
to the Consumer Price Index (CPI) between the Base Year (FY 2000/2001) and the fiscal
year of the assessment. Additional information pertaining to possible future increases to the
amount of the Zone 12 assessment is set forth in the Engineer's Report Excerpt attached as
Exhibit W.
M. Purpose of Ballot: Pursuant to the requirements of Proposition 218, the owners of the
properties affected must approve, by mailed ballot, any proposed increase to any
assessment. Accordingly, the proposed increase of the Zone 12 assessment from zero to an
amount necessary to fund the required maintenance, must be approved in this manner.
N. Balloting Procedures: Ballots have been mailed to the owner of each property to be
assessed. Said Ballots were mailed to the owner of record for each affected property, as
shown on the latest Assessor Roll for the County of Ventura. To express support for or
objection to the proposed assessment, an owner of any affected property should mail or

deliver the Ballot to the City. In order to count, Ballots must be marked, signed and
received by the City prior to the end of the public input portion of the Public Hearing
identified in Section A of this Notice.
O. Ballot Results: The results of the tabulation of the Ballots received will be announced
subsequent to the close of the Public Hearing identified in Section A of this Notice. The
owner of each affected property receives one vote for each dollar assessed to that property.
Support of the assessment requires a majority vote from the ballots received. If that majority
vote is received, the City Council will be asked to approve the Zone 12 assessment for FY
200012001. If that majority is not received, the proposed assessment must be abandoned.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA, DECLARING ITS INTENTION TO MAKE
CERTAIN CHANGES TO, AND TO ORDER THE LEVY OF ASSESSMENTS
UPON THE PROPERTIES WITHIN, ZONE 12 OF THE "MOORPARK
LIGHTING AND LANDSCAPING MAINTENANCE DISTRICT NO. 84 -2"
FOR THE YEAR 2000 -2001, PRELIMINARILY APPROVING THE
ENGINEER'S REPORT FOR ZONE 12 AND PROVIDING FOR NOTICE
OF A PUBLIC HEARING TO CONSIDER SAID REPORT AND PROPOSED
ASSESSMENTS
WHEREAS, by Resolution No. 2000 -1688, the City Council ordered
the preparation of an Engineer's Report for "Moorpark Lighting and
Landscaping Assessment District 84 -2" for Fiscal Year 2000 -2001,
in accordance with Section 22500 et. seq. of the Streets and
Highways Code; and
WHEREAS, said Resolution stated the intent of the City Council
to make certain changes to the amount of the assessment for Zone
12 of said District, said increases to be made in accordance with
the requirements of Article XIII -D of the California Constitution
(Proposition 218); and
WHEREAS, an excerpt from the Engineer's Report pertaining to
Zone 12, was filed with the City Clerk on the 25th day of February,
2000; and
WHEREAS, the City Council has reviewed said Engineer's Report
excerpt and wishes to take certain actions relative to said report
and to the levy of the assessments for Zone 12 recommend therein.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES
HEREBY RESOLVE AS FOLLOWS:
SECTION 1: The Engineer's Report excerpt pertaining to Zone 12
of the "MOORPARK LIGHTING AND LANDSCAPING MAINTENANCE DISTRICT NO.
84 -2" for Fiscal Year 2000 -2001, on file with the City Clerk, is
hereby approved.
SECTION 2: Said Engineer's Report excerpt shall be incorporated
into the Engineer's Report for the entire District, which is to be
considered by the City Council at a later date.
SECTION 3: Said Engineer's Report excerpt may be further
modified or changed, pursuant to the provisions of Section 22630
of the Streets and Highways Code, provided, however, that the
amounts of the assessments provided for therein may not be
increased.

SECTION 4: It is the intent of the City Council to make certain
changes to the amount of the assessment for Zone 12 of "MOORPARK
LIGHTING AND LANDSCAPING MAINTENANCE ASSESSMENT DISTRICT NO. AD-
84-2" for the fiscal year commencing July 1, 2000, and ending June
30, 2001, and to levy and collect said assessments within Zone 12
to install, construct or maintain any authorized improvements
under the Act, including but not limited to one or more of street
lights, public lighting facilities, landscaping, statuary,
fountains, and other ornamental structures and facilities, and any
facilities which are appurtenant to any of the aforementioned or
which are necessary or convenient for the maintenance or servicing
thereof, including irrigation, electric current and energy; and to
provide incidental expenses in connection therewith.
SECTION 5: Zone 12 consists of the lots and parcels shown in
the Boundary Maps included in the aforesaid Engineer's Report
excerpt.
SECTION 6: Reference is hereby made to the Engineer's Report
excerpt for a full and detailed description of the improvements
within Zone 12, the boundaries of Zone 12 and the proposed
assessments upon the lots or parcels within Zone 12.
SECTION 7: A public hearing shall be held before the City
Council in the Council Chambers, located at 799 Moorpark Avenue,
Moorpark, California 93021 on Wednesday, May 3, 2000, at 6:30 p.m.
for the purpose of the City Council's determination whether the
public interest, convenience and necessity require the
improvements and the Zone 12 assessments required to fund the
maintenance of said improvements.
SECTION 8: The City Clerk is hereby authorized and directed
to cause Notice of the hearing ordered under Section 7 hereof to
be given in accordance with law by mailing, postage prepaid, in
the United States mail, and such Notice shall be deemed to have
been given when so deposited in the mail. The mailed Notice
shall be given to all property owners within the Zone 12 of the
District by such mailing by name to those persons whose names and
addresses appear on the last equalized secured property tax
assessment roll of the County of Ventura. The Notice shall
include, buy not be limited to, the total amount of the Zone 12
assessment proposed to be levied for fiscal year 2000 -2001, the
assessment proposed for the owner's particular parcel(s) and the
duration thereof, the reason for the assessment and the basis
upon which the amount of the assessment was calculated. Each
Notice shall also contain an assessment ballot, a summary of the
procedures applicable to the completion, return and tabulation of
assessment ballots, and a statement that the existence of a
majority protest will result in the assessment not being imposed.
The Notice herein provided shall be mailed not less than forty -
five (45) days before the date of the public hearing.

SECTION 9: The City Clerk shall certify to the adoption of
this resolution and shall cause a certified resolution to be filed
in the book of original resolutions.
