SUBJECT: CONSIDER RESOLUTION NO. 2000- TO ENABLE THE
ENFORCEMENT OF THE CALIFORNIA VEHICLE CODE IN THE
PRIVATELY OWNED PARKING FACILITIES AT ARCHSTONE
COMMUNITIES /MOORPARK APARTMENTS (ASSESSORS PARCEL
NUMBER 506 -0- 050 -275)
EXECUTIVE SUMMARY
This presents for consideration at a public hearing, a
resolution making the privately owned parking facilities at
the southerly terminus of Moorpark Avenue subject to
certain provision of the California Vehicle Code (CVC).
DISCUSSION
A. Authority
The City enforces Section 21107.8 (Private Parking
Facilities) of the CVC in a number of privately owned
parking areas within commercial/ industrial property and
multi- family residential developments. Enforcement of
the CVC on private property requires the adoption of a
resolution by the local agency (Exhibit A) at the
request of the property owner.
B. Request
The City is in receipt of a letter (Exhibit B) from
Archstone Communities requesting that the California
Vehicle Code be enforced in their parking facilities.

C. Notice
A notice of this Public Hearing (Exhibit C) was sent to
the property owner, as required by CVC section 21107.8
(c) .
D. Effective Date
The effective date of the Resolution is the date of the
first occupancy permit.
STAFF RECOMMENDATION
Adopt Resolution No. 2000- declaring the privately
owned parking facilities at Archstone Communities /Moorpark
Apartments be subject to certain provisions of the
California Vehicle Code.

RESOLUTION NO. 2000-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF MOORPARK, CALIFORNIA, FINDING AND
DECLARING CERTAIN PRIVATE PARKING FACILITIES
AT ARCHSTONE COMMUNITIES / MOORPARK APARTMENTS
(ASSESSORS PARCEL NUMBER 506 -0- 050 -275)
SUBJECT TO THE PROVISIONS OF THE CALIFORNIA
VEHICLE CODE
WHEREAS, Section 21107.8 (Private Parking Facilities)
of the California Vehicle Code (CVC) provides for the
enforcement of said code in privately owned and maintained
parking facilities held open for public use, upon receipt
of a request for such enforcement from the property owner;
and
WHEREAS, the owner of certain property has provided
the City with a written request for such enforcement; and
WHEREAS, the property to be subject to such regulation
is located at the southerly terminus of Moorpark Avenue
(Assessors Parcel Number 506 -0- 050 -275) and shown on the
map attached as Exhibit `11); and
WHEREAS, pursuant to the requirements of said code, a
public hearing has been held on the matter and the owner of
the affected property was notified of said hearing at least
ten (10) days prior to the date thereof.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
MOORPARK DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. That, pursuant to CVC Section 21107.8
(Private Parking Facilities), privately owned parking
facilities located at the southerly terminus of Moorpark
Avenue (Assessors Parcel Number 506 -0- 050 -275), which are
held open for public use, shall be subject to Sections
22350 (Basic Speed Law), 23103 (Reckless Driving), 23109
(Speed Contests), Division 16.5 (Off Highway Vehicles) and
other applicable provisions of the California Vehicle Code.

SECTION 3. That said signs shall be placed and
maintained by the property owner and shall comply with the
Resolution No. 2000- requirements set forth in Section
21107.8 (b) of the California Vehicle Code.

In response to your letter dated February 23, 2000, about parking enforcement at
Archstone Communities/Moorpark Apartments, the City of Moorpark will hold a public
hearing regarding your request.
THIS IS TO NOTIFY YOU THAT, Pursuant to Section 21107.8 (c) of the California
Vehicle Code (CVC), a public hearing on this matter will be held on Wednesday, March
15, 2000, at 6:30 p.m. in the City Council Chambers located at 799 Moorpark Avenue,
Moorpark, California.
You are invited to attend and be heard at the meeting. It is not required that you attend. If
the item is approved, we will contact you regarding the requirements and specifications
