BY: -- Mike Mathews, Senior Management Analyst March 1, 2000 (CC Meeting of 03/15/2000) SUBJECT: CONSIDER RESOLUTION NO. 2000- TO ENABLE THE ENFORCEMENT OF THE CALIFORNIA VEHICLE CODE IN THE PRIVATELY OWNED PARKING FACILITIES AT ARCHSTONE COMMUNITIES /MOORPARK APARTMENTS (ASSESSORS PARCEL NUMBER 506 -0- 050 -275) EXECUTIVE SUMMARY This presents for consideration at a public hearing, a resolution making the privately owned parking facilities at the southerly terminus of Moorpark Avenue subject to certain provision of the California Vehicle Code (CVC). DISCUSSION A. Authority The City enforces Section 21107.8 (Private Parking Facilities) of the CVC in a number of privately owned parking areas within commercial/ industrial property and multi- family residential developments. Enforcement of the CVC on private property requires the adoption of a resolution by the local agency (Exhibit A) at the request of the property owner. B. Request The City is in receipt of a letter (Exhibit B) from Archstone Communities requesting that the California Vehicle Code be enforced in their parking facilities. 000011.6 Honorable City Council March 1, 2000 Page 2 C. Notice A notice of this Public Hearing (Exhibit C) was sent to the property owner, as required by CVC section 21107.8 (c) . D. Effective Date The effective date of the Resolution is the date of the first occupancy permit. STAFF RECOMMENDATION Adopt Resolution No. 2000- declaring the privately owned parking facilities at Archstone Communities /Moorpark Apartments be subject to certain provisions of the California Vehicle Code. Attachments: Exhibit A: Resolution No. 2000 - with location map Exhibit B: Letter from Archstone Communities Exhibit C: Public Hearing Notice 00001-1 StaffReporta /ArcAaton• RESOLUTION NO. 2000- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, FINDING AND DECLARING CERTAIN PRIVATE PARKING FACILITIES AT ARCHSTONE COMMUNITIES / MOORPARK APARTMENTS (ASSESSORS PARCEL NUMBER 506 -0- 050 -275) SUBJECT TO THE PROVISIONS OF THE CALIFORNIA VEHICLE CODE WHEREAS, Section 21107.8 (Private Parking Facilities) of the California Vehicle Code (CVC) provides for the enforcement of said code in privately owned and maintained parking facilities held open for public use, upon receipt of a request for such enforcement from the property owner; and WHEREAS, the owner of certain property has provided the City with a written request for such enforcement; and WHEREAS, the property to be subject to such regulation is located at the southerly terminus of Moorpark Avenue (Assessors Parcel Number 506 -0- 050 -275) and shown on the map attached as Exhibit `11); and WHEREAS, pursuant to the requirements of said code, a public hearing has been held on the matter and the owner of the affected property was notified of said hearing at least ten (10) days prior to the date thereof. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That, pursuant to CVC Section 21107.8 (Private Parking Facilities), privately owned parking facilities located at the southerly terminus of Moorpark Avenue (Assessors Parcel Number 506 -0- 050 -275), which are held open for public use, shall be subject to Sections 22350 (Basic Speed Law), 23103 (Reckless Driving), 23109 (Speed Contests), Division 16.5 (Off Highway Vehicles) and other applicable provisions of the California Vehicle Code. SECTION regulations appropriate 2. That the above traffic and parking shall take effect upon the placement of signs giving notice of said regulation. That said signs shall be placed and maintained by the property owner and shall comply with the Resolution No. 2000- requirements set forth in Section 21107.8 (b) of the California Vehicle Code. SECTION 4. effective upon occupancy permit. That this Resolution shall become the date of the first approval of the SECTION 5. The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original resolutions.
