Gilbert, Director of Public Works 7jj---- DATE: March 24, 2000 (Meeting of 4 -5 -00) SUBJECT: Consider Resolution No. 2000- Approving the Engineer's Report for Assessment District AD84 -2 for FY 2000/2001, Declaring Intention to Make Certain Changes to and Ordering the Annual Assessments for Said Assessment District, and Scheduling a Public Hearing to Consider Said Assessments EXECUTIVE SUMMARY This presents for approval a Resolution approving the Engineer's Report for Assessment District AD84 -2 and setting the date for a Public Hearing to consider the levy of assessments for AD 84 -2 for FY 2000 /2001. BACKGROUND A. General Information Assessment District 84 -2 was formed in 1984 pursuant to the provisions of the "Landscaping and Lighting Act of 1972." This assessment district was established to allow for the funding of street lighting and parkway /median landscape maintenance and improvement expenses through the levying of assessments as provided for in the act. The City must annually act to levy the lighting and landscape maintenance assessments. Said assessments have been levied each year since the formation of the district. As set forth in the Engineer's Report, there are two types of assessments, generally described as follows: • Citywide Assessments: assessments applied to all of the' lots in the City; and • Zone Assessments: assessments applied to properties within certain zones of benefit to fund maintenance and /or improvements which benefit those properties. 00003 ad84- 01.rpt AD84 -2 Engineer's Report March 24, 2000 Page 2 B. Citvwide Assessments There are two types of expenses funded by two distinct Citywide assessments: street lighting costs and certain parkway and median landscape maintenance costs. 1. Street lighting costs are distributed to all of the properties within the City by means of a formula designed to spread said costs on the basis of benefit. The benefit spread formula identifies a number of factors (including lighting intensity, lighting security, people use, etc.) which are associated with benefits derived, and then weighs those factors by land use as a means to determining benefits derived. 2. Citywide landscape maintenance costs are spread via a People Use formula in which twenty -five percent (25 %) of the total Citywide landscape maintenance costs is allocated to non - residential properties and the remaining seventy -five percent (75 %) is allocated and spread to residential properties. These allocated costs are spread to both non - residential and residential properties by a "people -use" benefit formula based on the land use of each parcel being assessed. C. Zone Assessments Landscape maintenance costs for each Zone of Benefit are spread to each lot within that Zone. Storm debris basin maintenance cost for certain Zones of Benefit, are spread evenly to selected lots within those Zones, deemed to derive benefit from such maintenance. In addition to these maintenance costs, certain Zones may receive an improvement assessment to fund approved improvements to be funded by the assessment for those zones. Except for Zones 7 and 9, the total assessment for each zone is distributed equally between the non - exempt parcels within each zone. The total assessment for the industrial areas covered by Zones 7 and 9, is spread to each non - exempt parcel via a per acre assessment. DISCUSSION A. Resolution of Intent On January 5, 2000, the City Council adopted Resolution No. 2000 -1688 initiating the proceedings required to consider the levy of assessments for AD 84 -2 for FY 2000/2001. On that date the City Council also selected Charles Abbott & Associates to prepare the Engineer's Report for the district. ad84- 01.rpt 000004 AD84 -2 Engineer's Report March 24, 2000 Page 3 B. Engineer's Report The draft Engineer's Report is attached as Exhibit 1. This report sets forth the proposed assessment amounts for FY 2000/2001. The report also provides a description and explanation of the Benefit Assessment Formula used to spread the total assessment amounts to all of the lots in the City. C. Boundary Maps The Engineer's Report also includes the "Boundary Map, City of Moorpark Lighting and Landscaping Maintenance Assessment District No. AD84 -2." These boundary maps show the boundaries of Assessment District AD84 -2, and also the boundaries of each Zone of Benefit. These boundary maps, along with the Ventura County Assessor Maps pertaining to properties within the City of Moorpark, constitute the AD84 -2 Assessment District Boundary Maps. Said maps are on file with the City Clerk as required by Sections 22508, 22570 and 22574 of the Streets and Highways Code (Landscaping and Lighting Act of 1972). D. Zone 12: Carlsberg Specific Plan The City Council has approved in concept the City's acceptance and future maintenance of certain landscaping within the Carlsberg Specific Plan (Zone 12). That future action is contingent upon the approval of an increase in the Zone 12 assessment from the current amount of zero, to an amount deemed sufficient to fund City costs for the future maintenance of those improvements. Pursuant to Proposition 218, the proposed increase to the Zone 12 assessment may only be approved if the City receives a majority affirmative vote from the mail ballots received from the owners of the properties to be assessed. , On March 1, 2000, the City Council adopted Resolution No. 2000 -1711 setting May 3, 2000, as the date of a public hearing to consider the proposed increase to the Zone 12 assessment. On May 3 all of the mail ballots received will be tabulated and the results provided to the City Council. Each property owner receives one vote, for each dollar assessed upon his /her property. If the majority vote from the ballots received is in favor of the proposed increase, the City Council will be asked to confirm the Zone 12 assessments set forth in the attached Engineer's Report (Exhibit 1) . If the majority vote from the ballots received is opposed, the proposed assessment increase to the Zone 12 assessment will have to be abandoned and the Engineer's Report revised to reflect that action. In such case, the maintenance of the landscaping in question will have to be assumed by the Homeowners' Association in the area. 000005 ad84- 01.rpt AD84 -2 Engineer's Report March 24, 2000 Page 4 E. All Other Assessments Unchanged Except for the proposed increase to the Zone 12 assessment, the Engineer's Report proposes no new or increased assessments for AD 84 -2 for FY 2000/2001. Any such new or increased assessment would require approval, via mail ballot, similar to the process being followed with regard to the Zone 12 assessment. F. Zone 13: Campesina Park Last year, with the approval of the Parks Assessment District, the Zone 13 assessment was abandoned. There was no Zone 13 assessment in FY 1999/2000 and there is no Zone 13 assessment proposed for FY 2000/2001 or any future year. G. Zones of Benefit 1. General: There are no new Zones of Benefit proposed to be added in FY 2000/2001. 2. Zone Landscape Maintenance Assessment: The properties within each of the Zones of Benefit are assessed for the maintenance of certain designated landscaped areas deemed to be of benefit to the properties within that zone. 3. Storm Drain Debris Basin Maintenance: A portion of Zone 2, 5 and 10 are assessed for the maintenance of debris basins along the south boundary of the City. 4. Improvements: The lots within Zone 2 have in past years been assessed a $10 per lot improvement assessment for a future project to construct parkway landscaping on the north side of Tierra Rejada Road, east and west of Southhampton Road. It is proposed that this improvement assessment be assessed again in FY 2000/2001. With the FY 2000/2001 assessment, the total funds available in FY 2000/2001 for this construction project will be $39,672. I. Fiscal Analysis This report contains no information regarding projected Fund balances for the categories of assessments and expenditures noted above. Those figures will be developed as a part of the upcoming budget process for FY 2000/2001. The staff report to be presented to the City Council at the June 7 Public Hearing will include a Fiscal Analysis of the status of the Funds for Assessment District 84 -2. J. Deficits As you know, with the passage of Proposition 218, the assessment amounts may not be increased without prior approval of all affected property owners via Mail Ballot. Accordingly, in the event the fiscal analysis in the June report indicates that there will be a projected FY 2000/2001 (next year) year- end deficit in one or more of the Funds for the assessment categories noted in Section G above, staff may recommend that that a portion of the expenses which were to be charged to those Funds, be moved to another funding source. Such an action would, in effect, represent a subsidy from other sources to the programs traditionally funded by the AD84 -2 Assessment District. A second alternate would be to carry any deficit into the next year, noting that the deficit may be reduced or eliminated as the result of reduced costs in future years. A third option would be to pursue a future assessment increase via Mail Ballot approval. ad84- 01,rpt AD84 -2 Engineer's Report March 24, 2000 Page 6 K. Surpluses The fiscal analysis to be included in the June report may indicate that there will be a projected FY 1999/2000 (this year) year -end surplus in one or more of the Funds for the assessment categories noted in Section G above. Staff would recommend that such surpluses be carried over to the FY2000 /2001 and future fiscal years to accommodate fluctuations which occur in maintenance costs from year to year. However, if it is determined that the amount of the surplus for any given Fund is excessive, the final Engineer's Report can be amended to direct that an adjustment be made to the amount actually levied. In this way all of the amounts of the assessment for FY 2000/2001 and all future years remains unchanged - while the actual amount levied for certain categories is an amount less than the actual assessment. In this way the Fund balances for each of the assessments can be managed without having to reduce the actual assessment amounts and thereby impair the ability of the City to fund future program cost increases. L. Public Hearing The "Landscaping and Lighting Act of 1972" (Streets and Highways Code) requires a public hearing to be held prior to the annual levy of assessments for the purpose of receiving input and to hear any protests to the proposed assessments. Attached as Exhibit 2 is a copy of the Public Hearing Notice for AD84 -2. Said Notice will be published and posted as required by law. Said Notice sets the date of the public hearing as June 7, 2000, which is the first City Council meeting in June, as required by law. The Public Hearing Notice cites the assessment amounts set forth in the Engineer's Report. The City Council may revise the final assessment amounts any time prior to the adoption of the Resolution in June setting the amount of the assessments. Notices of the May 5 Public Hearing, pertaining to the increase to the Zone 12 assessment, were mailed to the owners of all properties affected by that proposed assessment increase. The assessments to all other properties will not increase. Summary - Table 3 Budget Estimate Boundary Map Assessment Roll Resolutions Zone 12 Assessment Calculations CITY OF MOORPARK Engineer's Report Lighting Maintenance Assessment District No. AD -84 -2 Landscape and Lighting Act of 1972 and Proposition 218 For Fiscal Year 2000 -2001 SECTION 1 AUTHORITY FOR REPORT This report is prepared pursuant to City Council Resolution No. 2000 -1688, adopted January 5, 2000, to extend this District for the fiscal year commencing July 1, 2000 and ending June 30, 2001 in compliance with the requirements of Article 4, Chapter 1, "Landscaping Act of 1972 ", being Part 2 of Division 15 of the California Streets and Highways Code and Proposition 218 which allows existing assessment districts to continue as long as rates and methodology remain the same. The District will provide electrical energy for public lighting facilities and for operation and maintenance of public lighting within the city. In addition, the District will provide for installation and/or maintenance of erosion and flood control related public landscaping within the public right -, of -way. SECTION 2 DEFINITION OF TERMS Assessment Rate - The assessment rate is the number assigned to each land use category. The assessment rate for a Level 1 Single Family Residential lot (land use code 1) is 1 for lighting assessment and 4 for erosion and flood control related landscape assessment. Assessment rates for other parcels in other land use categories, including publicly owned parcels, a re proportioned to these basic rates. These assessment rates remain unchanged. Methodology - The methodology is the formula used to derive the assessment rates of each land use category. The methodology has not been changed in several years. EDU [Equivalent Dwelling Unit] - For the purpose of determining the amount of the Zone 12 assessment to be levied upon public properties within Zone 12, each category of public property has been assigned an Equivalent Dwelling Unit [EDU] factor. 3 000012 SECTION 3 METHOD AND RATES OF ASSESSMENT Except for the changes to the Zone 12 assessment described below, the methodology and assessment rates used for Assessment District No. AD -84 -2 have not changed for the past several years, and are based on how the facilities being maintained provide benefits as part of the system of streets which serve the City of Moorpark. Lighting The benefits of street lighting are for the convenience, safety and protection of people and the security or protection of property, property improvements and goods. The intensity or degree of illumination provided can have a bearing on both. The single family home - Level 1 has been selected as the base unit for the spread of assessments. By definition, the single family home - Level 1 is a single family home located on a street that has existing streetlights. An assessment rate of 1.00 has been assigned to the base unit, which is composed of benefit factors, which correspond to the following types of benefit. People Use - People related benefits 0.50 Security Benefit - Property protection 0.25 Intensity - Degree of illumination 0.25 Assessment Rate: 1.00 Parcels in other land use categories, including publicly owned parcels, were then rated by comparison with the basic unit. (See the following table.) People Use - People related benefits 1. Reduction in night accidents and attendant human misery. 2. Reduced vulnerability to criminal assault during hours of darkness. 3. Promotion of business operations during evening hours. 4. Increased safety on roads and highways. Security Benefit - Property Protection I. Reduction in vandalism and other criminal acts, and damage to improvements. 2. Reduction in burglaries. Intensity: Intensity or degree of illumination provided on streets varies with type of street, date of installation and the use of the property adjacent thereto. 4 000013 Landscaping The landscaping element of the spread formula recognizes that all properties within the City benefit from the maintenance of the landscaping within public rights -of -way and easements. These benefits include improved safety resulting from a regular tree trimming program and improved street sweeping capabilities resulting from trimming trees which may otherwise interface with street sweeping operations. The method of spreading maintenance costs is based upon the assessment rates, and the assessment rates are determined by the "people use" attributed to each land use within the City. This method was chosen because the benefit received is directly proportionate to the number of people generated by each land use. Recognizing that residential land uses within the City derive a higher degree of benefit than non - residential land uses, the formula was subdivided into two main groups, with residential land uses contributing in 75% of the assessment and non - residential uses being assessed for the remaining 25% of the maintenance costs. The single family home has been selected as the base unit for the spread of assessment. An assessment rate of 4 has been assigned by the base unit. Parcels in other land use categories, including publicly owned parcels, were rated by comparison with the basic unit. (See the following table.) The "people use" factors utilized in determining assessment rates and in the assessment district spread formula are shown in Appendix "B ". Zone 12: Carlsberg Specific Plan a. Exempt Properties: It has been determined that Water Utility and Flood Control properties receive no benefit from the proposed improvements. Accordingly, all such properties shall be exempt from the Zone 12 assessment. In addition, in that the portion of the total assessment allocated to the Institutional Properties is spread to only lots 3 and 4 of Tract 4974, the slope adjacent to Spring Road [AP #512 -0 -270 -065 is exempt. 5 00001 c. Equivalent Dwelling Units [EDO: A portion of the assessment allocated to Residential properties has been allocated to each public property within Zone 12, based upon the applicable number of EDUs for that public property. Annual Increase to Total Assessment Amount: 1. Base Year: The Base Year Total Assessment Amount for Zone 12 is the amount stated in the Engineer's Report for FY 2000/2001, said amount being $229,961.49. 2. Annual Increase: In years subsequent to FY 2000/2001, the Total Assessment amount for Zone 12 maybe increased to cover maintenance cost increases. 3. Basis of Increase: The amount of any increase to the Total Assessment for Zone 12 shall be based upon the increase to the Consumer Price Index (CPI) for all Urban Consumers for the Los Angeles Metropolitan Area, for the calendar year ending the December prior to the Fiscal Year of the proposed assessment. 4. Deferred Action: Each year when the amount of the Total Assessment for Zone 12 is determined, said amount may or may not be increased, as provided above, at the sole discretion of the City. 5. Assessment of Deferred Increase in Subsequent Years: Any increase to the Total Assessment for Zone 12 may include any increase deferred in any and all prior years. In such event, the approved Total Assessment may not exceed the Base Year Total Assessment Amount, adjusted to reflect the change in the CPI between the Base Year and the effective year of the proposed assessment. [Example: If the CPI increases 5% Year 3, but the assessment for Year 3 is increased by only 3 %, the remaining 2 % increase may be added to the assessment in any subsequent year.] 6. Increase Determined Invalidity: In the event any increase to the Total Assessment amount is held to be invalid or unconstitutional by any court of competent jurisdiction, such decision shall not affect the validity of the Base Year Total Assessment for Zone 12. SECTION 4 DESCRIPTION OF IMPROVEMENTS TO BE MAINTAINED This report covers the period of July 1, 2000 through June 30, 2001. An updated report is prepared each year to reflect updated annual costs and changes in parcelization. The improvements to be maintained in this District include all City -owned and Southern California Edison (S.C.E.) -owned streetlights as well as all medians and street trees within public rights -of -way within the boundaries of the city. 6 000015 Lighting maintenance shall include, but is not limited to, energy costs, removal, repair, replacement or relocation of light standards, poles, bulbs, fixtures and all appurtenances. Servicing of S.C.E. owned lights as defined in Section 22538 of the Streets and Highways Code shall be furnished by the Southern California Edison Company or its successors, or this servicing shall be as authorized by the Public Utilities Commission, State of California. Maintenance of City -owned lighting improvements shall be furnished by the City. Landscape maintenance for erosion and flood control shall include, but is not limited to watering, fertilizing, mowing, weed control, shrubbery, tree removal and pruning, removal and replacement of dead growth, maintenance of irrigation facilities and other necessary work. In addition, the cost to maintain improved areas within certain Zones of Benefit will be borne by owners of property within said zone. Those Zones of Benefit are generally described as follows: 1. Tract No. 2851: Maintenance costs associated with landscaping in the Ventura County Flood Control Easement and portions of the interior tract entry areas. The obligation upon these 75 lots is pursuant to a condition of development. 2. Tract No. 2865: Cost for maintenance of specific landscape areas and debris basins within the tract, including landscaping at Christian Barrett & Spring Roads; Tierra Rejada landscaping, and Peach Hill Road landscaping on east side between Christian Barrett and Tierra Rejada Roads, and the entry monument sign at Christian Barrett and Spring Road. Also, an additional assessment for the improvement of parkway landscaping on the north side of Tierra Rejada Road east and west of Southhampton Road. The obligation upon the lots within this tract is pursuant to a condition of development. 3. Tract No. 3032: Maintenance costs associated with landscaping an entry monument at Buttercreek Road and Los Angeles Avenue. This cost to be spread to the 265 lots within the tract. 4. Tract No. 3274: Maintenance costs associated with landscape areas along Williams Ranch Road parkway adjacent to Peach Hill drain channel and Edison entries within PC -3. This cost will be borne by the 129 lots within the tract. 5. Tract Nos. 3019 & 3525: Maintenance costs associated with debris basins and landscaping the Tierra Rejada Road slope and parkway areas and parkway on the west side of Peach Hill Road between Williams Ranch and Tierra Rejada Roads within Tract Nos. 3019 and 3525. The cost is to be spread to the 217 lots within the tracts. 6. Tract 3306: Cost for maintenance of landscape areas within Tract 3306 at the westerly terminus of Inglewood Street. The cost is to be spread to the 22 lots within the tract. 7 000016 7. Los Angeles Avenue Parkway: Maintenance costs associated with landscaping the parkway on the north side of Los Angeles Avenue between Gabbert Road and Shasta Avenue will be borne by all industrial lots northerly of Los Angeles Avenue, southerly of Poindexter Avenue, easterly of Gabbert Road, and westerly of Shasta Avenue. 8. Home Acres Buffer Area: Maintenance costs associated with the buffer area at the west end of the West Ranch area, is to be split 50 -50 between the residential properties within the West ranch area and the area outside the City known as Home Acres. That portion of this Zone of Benefit with the City consists of the residential areas within Tract 4340, 4341, 4792 and a portion of tract 4342. This area is bounded on the north by the Arroyo Simi, on the east by Tierra Rejada Road and the Commercial property at the corner of Tierra Rejada Road and Mountain Trail Street, . on the south by Tracts 4637, 4342 -5 and the City boundary and on the west by the City Boundary. 9. Condor Drive Industrial Park: Maintenance costs associated with the parkway located at the northwest corner of Los Angeles Avenue and Virginia Colony Place will be borne by the developed parcels within the Industrial park on Condor Drive (Tract 3492). 10. PC -3: Maintenance costs associated with landscaping and debris basins within this area will be borne by all properties within the Mountain Meadows Planned Community (PC -3). The landscaping to be maintained consists of the Peach Hill Wash Linear Park, the slope along the north side of the Peach Hill Wash and the downstream flood control facility located just east of Mountain Trail Street and certain parkways on Tierra Rejada Road. 11. Tract 4174: Maintenance costs associated with landscaping within this area will be borne by all properties within the tract. 12. Carlsberg Specific Plan: Maintenance costs associated with certain landscape improvements as described in the Boundary Map for Zone 12 included in Appendix "E ". The cost for the maintenance of these improvements will be borne by all of the properties. within Zone 12 as defined in said Boundary Maps and generally described as that area bounded by the Route 23 freeway, Tierra Rejada Road, Spring Road, the Arroyo Simi and New Los Angeles Avenue. Plans and specifications for the irrigation, landscaping and lighting of streets, parks and easements, and other authorized improvements within the City are on file in the Department of Public Works. The lighting locations and specifications for Edison- owned lights are on file with the Southern California Edison Company. Reference is hereby made to said plans and specifications for the exact location and nature of the landscape and lighting improvements. Said plans and specifications by reference are hereby made apart of this report. SECTION 5 ASSESSMENT ROLL All parcels of real property affected are listed on the "Assessment Roll ", Exhibit "A," which will be on file in City Hall with the City Clerk, and is made a part hereof by reference. These parcels are more particularly described in maps prepared in accordance with Section 327 of the Revenue and Taxation Code which are on file in the office of the Ventura County Assessor in the County Government Center Administration Building, 800 S. Victoria Avenue, Ventura, California and which are also made a part hereof by reference. SECTION 6 COST ESTIMATE . The City staff recommendation for the District budget is shown in Appendix "D" of this report. The costs attributed to landscaping and the costs attributed to lighting will be separately appointed, according to the formula, and added together to constitute the total assessment for each parcel. CONCLUSION In conclusion, it is our opinion that the assessments within Lighting Maintenance Assessment District No. AD -84 -2 are apportioned by a formula that fairly distributes the net cost in accordance with the ,benefits that are received.. The additional per lot assessment is $49.48. The obligation upon these lots is pursuant to a condition of development. 5. SECTION 2: The assessments proposed to be levied and collected shall be used for furnishing electric current or energy, or other illuminating agent for street lights, for the usual maintenance and operation of said street lights, for the maintenance of parkway and median landscaping and for other improvements as specified in Section 1 hereinabove. SECTION 3: To ensure that the costs and expenses of maintaining, operating and servicing the street and traffic safety lighting, and the improvements as specified hereinabove, are borne by the owners of the property to be benefited thereby, this Council resolves that the proposed landscape maintenance assessment district consist of all property within the City. A summary of said Resolution is summarized as follows: 1. That the Engineer's Report prepared for Assessment District No. AD84 -2 for FY 2000/2001 is approved. 21. That said Engineer's Report includes information pertaining to a proposed increase to the assessment amounts for Zone 12, which is the area generally bounded by New Los Angeles Avenue, the Route 23 freeway, Tierra Rejada Road and Spring Road. 3 That said Engineer's Report may be further modified or changed, pursuant to applicable State law. 000®7:.x. That except as noted in Section 3, the assessment amounts for FY 2000/2001 have not changed from the assessments levied in FY 1999/2000. 5. That it is the intention of the City Council a) to make certain changes to Assessment District No. AD 84- 2; b) to order the extension of the annual assessment for said district for FY 2000/2001; and, c) to levy and collect assessments for certain improvements described herein. Said district consists of a single city -wide zone to provide electric current or energy for public lighting within the City, to install, construct or maintain any authorized improvements under the Act, including but not limited to one or more of street lights, public lighting facilities, landscaping, statuary, fountains, and other ornamental structures and facilities, and any facilities which are appurtenant to any of the aforementioned or which are necessary or convenient for the maintenance or servicing thereof, including irrigation, electric current and energy; and to provide incidental expenses in connection therewith. Said district also includes assessments for the improvement and maintenance of the above described landscaping and related improvements in a number of zones of benefit. 6. That said lighting and landscaping maintenance assessment district includes the lighting and landscaping sites with all improvements located therein, described by and included within Assessment District No. AD 84 -2. 7. That the foregoing described work is to be located within Assessment District No. AD 84 -2, the boundary of which is described on a map on file in the City Clerk's office. 8. That said proposed maintenance and improvement is of benefit to, and, expense for which are chargeable upon, the district. 9. That a public hearing shall be held on June Council Chambers at the making certain changes assessments for Assessm 2000/2001. of the Moorpark -City Council 7, 2000, at 6:30 p.m. in the Moorpark City Hall to consider in, and to order the annual ent District No. AD84 -2 for FY 12. That this Notice of Public Hearing is given, in order that any persons having any objections to the work or extent of the assessment district may appear and show cause why said work should not be done or carried out or why said district should not be extended for the fiscal year commencing July 1, 2000, and ending June 30, 2001. Protests must be in writing and must be filed by the property owner with the City Clerk prior to the conclusion of the hearing. Notes: A) per acre assessment RESOLUTION NO. 2000- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, APPROVING THE ENGINEER'S REPORT FOR, AND DECLARING ITS INTENTION TO MAKE CERTAIN CHANGES AND TO ORDER THE ANNUAL ASSESSMENTS FOR THE " MOORPARK LIGHTING AND LANDSCAPING MAINTENANCE DISTRICT NO. AD -84 -2" FOR THE FISCAL YEAR COMMENCING JULY 1, 2000, AND ENDING JUNE 30„ 2001, PURSUANT TO THE LANDSCAPING AND LIGHTING ACT OF 1972, AND FIXING THE TIME AND PLACE FOR A PUBLIC HEARING TO RECEIVE OBJECTIONS THERETO. WHEREAS, by Resolution No. 2000 -1688, the City Council ordered the City Manager to cause to be prepared an Engineer's Report for Assessment District 84 -2 for FY 2000/2001, in accordance with Article 4, Chapter 1, Part 2, Division 15 of the California Streets and Highways Code; and WHEREAS, by Resolution No. 2000 -1711, the City Council approved an Excerpt from said Engineer's Report pertaining to Zone 12, and set May 3, 2000, as the date of a public hearing to consider an increase to the Zone 12 assessment; and WHEREAS, pursuant to the requirements of Resolution No. 2000 -1688, the completed draft Engineer's Report, including the above mentioned Excerpt for Zone 12, was filed with the City Clerk on the 24th day of March, 2000; and WHEREAS, the City Council has reviewed said Engineer's Report and wishes to take certain actions relative to said report and to the levy of the assessments recommended therein. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES RESOLVE AS FOLLOWS: SECTION 1. The Engineer's Report for " MOORPARK LIGHTING AND LANDSCAPING MAINTENANCE ASSESSMENT DISTRICT NO. AD -84 -2" for the fiscal year commencing July 1, 2000, and ending June 30, 2001, filed with the City Clerk on the 24th day of March 2000, is hereby approved. SECTION 2. That said Engineer's Report includes certain information pertaining to a proposed increase to the amount of the assessments for Zone 12, said assessment increase being contingent upon approval via mail ballots to be received by the City on May 3, 2000. Resolution No. 2000 - Page 2 SECTION 3. That the aforementioned Engineer's Report may be further modified or changed, pursuant to the provisions of Section 22630 of the Streets and Highways Code. SECTION 4. That, except as noted in Sections 2 of this Resolution, the assessment amounts proposed for FY 2000/2001 have not changed from the assessments levied in FY 1999/2000. SECTION 5. That the public interest and convenience require and it is the intention of the City Council of the City of Moorpark to make certain changes, to the "MOORPARK LIGHTING AND LANDSCAPING MAINTENANCE ASSESSMENT DISTRICT NO. AD -84 -2" and to order the extension of the annual assessments for said district for the fiscal year commencing July 1, 2000, and ending June 30, 2001, pursuant to the Landscaping and Lighting Act of 1972, and to levy and collect assessments for certain improvements as described herein, in accordance with said Act. Said "MOORPARK LIGHTING AND LANDSCAPING MAINTENANCE ASSESSMENT DISTRICT NO. That the foregoing described work is to be located within said Assessment District, the boundaries of which are more particularly described on maps included in the aforesaid Engineer's Report and entitled "Boundary Map, City of Moorpark Lighting and Landscaping Maintenance Assessment District No. AD- 84 -211, said report and maps being on file in the office of the City Clerk as of the 24th of March 2000. That the proposed maintenance and improvement, in the opinion of the City Council, is of benefit to, and the City Council hereby makes the expense of said maintenance and improvements chargeable upon the district. That a full and detailed description of the improvements, the boundaries of the Assessment District and any zones therein, and the proposed assessments upon assessable lots and parcels of land within said District,. is set forth in a copy of the aforementioned Engineer's Report, a copy of which is on file with the City Clerk and open to inspection.
