D# TO: The Honorable City Council FROM: John Brand, Senior Management Analyst 10 DATE: March 23, 2000 (CC meeting of April 5, 2000) SUBJECT: Consider Resolution No. 2000- If Authorizing Submittal of a Three Year (2000/2003) Used Oil Recycling Block Grant Application to the California Integrated Waste Management Board. SUboamy The City Council is being asked to consider adoption of a resolution approving the submittal of the City's application to the California Integrated Waste Management Board (CIWMB) for an Used Oil Recycling Block grant, and authorize the City Manager to execute any agreements, contracts, and requests for payments. BACKGROUND The City has been receiving Used Oil Recycling Block Grants since the program began in 1993. The main purpose of this grant program is to provide funding to local governments to establish used oil collection programs that encourage recycling or appropriate disposal of used oil. To be eligible, a local used oil collection program may include any activity(s) that the City believes will enhance recycling or the appropriate disposal of used oil within their jurisdiction. The main ways used oil is recycled are through the monthly Household Hazardous Waste (HHW) collection events on the first and third Saturdays of each month, and at state - certified used oil collection center. A business applies to the CIWMB to become a certified collection center. The certified centers accept, at no charge, a maximum of 20 gallons of used lubricating oil from a person, per day. A certified center must offer a $0.04 per quart recycling Used oil Block Grant 2000 -2003 CC Meeting of April 5, 2000 Page 2 incentive to "walk -in" clients, or accept "donations" of used oil. Reimbursement need not be given for oil changes done by the certified center. On a quarterly basis, the certified center invoices the CIWMB for the amount of incentive funding given to the public to receive reimbursement. The certification program also includes subsidies from the CIWMB to dispose of contaminated oil - up to $5,000 in disposal costs for one shipment per year. Staff contacted all Moorpark auto repair businesses to solicit interest in the certification process for used oil collection. Currently one local business, Kwik Kar Lube & Tune, 797 Los Angles Avenue, is operating as certified Used Oil Collection Center. A second business, Auto Zone, 455 W. Los Angeles Avenue, has received certification but has not yet begun accepting used oil from the public. Two other Moorpark businesses formerly participated in the program but they have cancelled their certifications with the state. Grant funding will be based on a per capita basis. For the first year of the grant, the City will be eligible for $9,548 plus an additional $740 to promote recycling used oil filters. It is the City's discretion to use the grant funds as deemed appropriate. The funds could be used to purchase equipment, contaminated oil disposal, overhead costs, staff time, public information, and promotional items. Historically the City has used the grants funds for a balanced mix all the expense categories. Many public information activities and promotional item procurements are accomplished regionally by pooling grants funds with the other jurisdictions in the county. The grant application must contain an approved resolution from each City's governing body authorizing submittal of the application and identify the individual authorized to executive any agreements, contracts, and requests for payments. Used Oil Block Grant 2000 -2003 000189 RESOLUTION NO. 2000 -0000 RESOLUTION OF THE CITY OF MOORPARK, CALIFORNIA, AUTHORIZING SUBMITTAL OF A USED OIL RECYCLING BLOCK GRANT APPLICATION TO THE INTEGRATED WASTE MANAGEMENT BOARD, FOR FUNDS FROM THE CALIFORNIA USED OIL RECYCLING FUND UNDER THE USED OIL RECYCLING ACT, AND AUTHORIZING THE CITY MANAGER TO EXECUTE ANY AGREEMENTS, CONTRACTS, AND REQUESTS FOR PAYMENT. WHEREAS, the City of Moorpark recognizes that it is in the public interest to enact and implement an integrated waste management plan to address the state's diminishing landfill space and the potential adverse environmental impacts from inappropriate us of the landfill; and WHEREAS, the people of the State of California have enacted the California Oil Recycling Enhancement Act that provides funds to cities and counties for establishing and maintaining local used oil collection programs that encourage recycling or appropriate disposal of used oil; and WHEREAS, the California Integrated Waste Management Board (Board) has been delegated the responsibility for the administration of the program within the state, setting up necessary procedures governing application by cities and counties under the program; and WHEREAS, the applicant City of Moorpark will enter into an agreement with the State of California for implementation of used oil collection program; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Council authorizes the submittal of an application to the California Integrated Waste Management Board for a 2000/2003 Used oil recycling Block Grant. ®01 Reso 2000 -0000 Used Oil Block Grant Page 2 SECTION 2. The City Council appoints the City Manager, or a designee, is hereby authorized and empowered to execute in the name of the City of Moorpark all necessary application, contracts, payment requests, agreements and amendments hereto for the purpose of securing grant funds and to implement and carry out the purposes specified in the grant application. SECTION 3. The City Clerk shall certify to the adoption of the resolution and shall cause a certified resolution to be filed in the book of original Resolutions.
