Gilbert, Director of Public Works & March 29, 2000 (Council Meeting 4 -5 -00) Subject: Acceptance and Maintenance of Certain Parkways on Spring Road [Carlsberg] BACKGROUND In July 1999, the City Council approved the acceptance and future maintenance of the median landscaping on Spring Road between the Arroyo Simi Bridge and Tierra Rejada Road subject to certain conditions noted below. DISCUSSION A. Medians The median landscaping on Spring Road north of Tierra Rejada Road is to be accepted and maintained by the City upon compliance with the following conditions: 1. All work shall be constructed in accordance with the approved plans and specifications; 2. The developer shall provide for the transfer to the City of the water and electrical services for only the median landscaping; 3. The developer shall provide for a two -year maintenance period, to commence on the date the City approves the completion of the installation; 4. The developer shall pay the City $6,000, said amount being equal to the estimated cost for the City to maintain said improvements for a period of one year from the date of the end of the two -year maintenance period; and, 5. The City may accept early "buy -out" of the maintenance period described in Condition #3, at the rate of $500 per month of the time remaining in the maintenance period, said "buy -out" date to be determined solely by the City. 000229 Spring Road Parkway March 29, 2000 Page 2 The City Council is advised that the above conditions have not yet been met and the Spring Road median landscaping has not yet been taken over by the City. B. Parkways As a part of the construction of the median landscaping on Spring Road, the developer of the Carlsberg Specific Plan also constructed parkway landscaping on the east side of Spring Road in the areas shown on the attached diagram (Exhibit 1) . Staff recently became aware of the fact that the developer made no provision for the maintenance of these parkways by the HOAs in the area. The developer also had not requested that this parkway landscaping be included in the landscaping to be funded by the Zone 12 assessment. Apparently the developer assumed that the City would be accepting and maintaining this parkway landscaping along with the median landscaping. C. Zone 12 The AD84 -2 Engineer's Report Excerpt for Zone 12, which was approved by the City Council on March 1, did not include the subject parkways. Accordingly, the Mail Ballots and Public Hearing Notices mailed to the owners of all affected properties, did not identify the maintenance of these parkways as expenses to be funded by the Zone 12 assessment. The public hearing and tabulation of the Ballots for Zone 12 is set for May 3, 2000. D. Annual Cost Estimate As mentioned in the report to the City Council last July, the annual cost for the maintenance of the Spring Road median will be $6,000. The annual cost for the maintenance of the subject parkways is $1,775. E. Acceptance / Conditions It is recommended that the subject parkways be accepted and maintained by the City, subject to the following conditions: 1. All work shall be constructed in accordance with the approved plans and specifications. 2. The developer shall provide for the transfer to the City of the water and electrical services for only the median landscaping. Spring_median _prky 0 0 0 C Spring Road Parkway March 29, 2000 Page 3 3. The developer shall pay the City an amount equal to the cost of the maintenance of the subject parkways for a period of five (5) years [$8, 875] . 4. The maintenance "buy -out" costs, for both the parkways and the median shall be included in those costs which shall be eligible for reimbursement from the Spring Road / Tierra Rejada Road AOC Fund. F. Future Funding As mentioned in the prior report [July 19991 to the City Council, future maintenance costs for the median landscaping will be funded by the Citywide Landscape Assessment for AD84- 2. If the City Council approves the recommended action, the subject parkways will also be funded from this source. The July report to the City mentioned that the added costs associated with the maintenance of the median landscaping is not expected to cause annual expenses to exceed assessment revenues. The City Council is advised that the added costs associated with the maintenance of the subject parkways is also not expected to cause expenses to exceed assessment revenues. However, as also mentioned in the July report, in the event maintenance costs ever do exceed assessment revenues, the City will have to consider providing funding from other sources and /or consider a Citywide Mail Ballot to seek approval of an increase to the assessment. G. Acceptance: Conditions It is recommended below that the developer be directed to proceed with the construction for the Spring Road median landscaping. It is also recommended that, when completed, the subject landscaping be accepted by the City subject to certain conditions. STAFF RECOMMENDATION Direct staff to advise the developer for the Carlsberg Specific Plan area that the subject parkways on Spring Road will be accepted by the City, subject to the conditions set forth in Sections A and E of this report.
