Cx Council Meeting ff= MOORPARK CITY COUNCIL. _ AGENDA REPORT twTO rt TO: Honorable City Councils 'Is �n ',,. a FROM: Wayne Loftus, Director Of Community - Development DATE: April 12, 2000 (CC Meeting Of 4/19/2000) SUBJECT: Consider Status of Lighting Impacts at the Tom Barber Golf Center Located at the Southeast Intersection of Highway 23 and Tierra Rejada Road in the Unincorporated Area of Ventura County (County CUP No. 4915) BACKGROUND The Tom Barber Golf Center is. a golf driving range, which was initiated with Ventura County in 1995, subsequently approved and recently opened for business. During the period of processing by the Ventura County Planning Department, the City of Moorpark sent at least three letters of comment concerning the proposed project dealing with potential environmental impacts related to growth inducement, traffic, water resources, biology and light and glare. Currently, several complaints have been received by the City concerning this project, related to the brightness and orientation of the driving range lights, although this is not a City of Moorpark project. DISCUSSION Based upon the receipt of several complaints concerning this Ventura County approved golf driving range, staff was asked to prepare a status report for City Council consideration. Approved by the Ventura County Planning Commission in 1997, a number of conditions as noted below were included in the adopting, resolution concerning lighting of the facility as follows: 17. GLARE MITIGATION MEASURE: The proposed night -time lighting of:, the project' site could cause adverse impacts relative to glare and its affect on the "Open Space" character of surrounding properties. Therefore, to reduce I the potentially 000 &1 Honorable City Council April 12, 2000 Page 2 adverse impacts to a less than significant level, the permittee shall: a) Incorporate low -level intensity lighting where possible for primary and secondary lighting. b) Incorporate directional ground lighting, and lighting fixtures shall be shielded where possible. c) Limit light pole structures to a maximum height of 35 feet. d) Direct nighttime lighting to be turned off at 10:00 P.M. The Ventura County Planning Department was contacted on April 7, 2000, concerning the lighting issue on this driving range and they responded with a copy of the above condition that is intended to deal with light and glare. They also responded with information concerning knowledge of the situation, that the project developer was making adjustments to the lights to avoid off -site impacts. It was also indicated that night usage had not been commenced; however as of the date of preparation of this report, staff has not been able to verify this comment. The Office of Fourth District Supervisor Judy Mikels was also contacted on April 11, 2000, with additional information received on April 12, 2000, and according to her staff, Supervisor Mikels is very aware of the situation and has asked for a report from the County Planning Department. The developer has been given a deadline of April 19, 2000, to comply with the conditions of approval under the County CUP, or appropriate action will be initiated to resolve the issue, which would include hearings for revocation of the CUP. STAFF RECOMMENDATION Direct staff to work with appropriate County agency to insure continued compliance with the conditions of approval.
