HomeMy WebLinkAboutAGENDA REPORT 2000 0419 CC REG ITEM 11CTO: FROM: DATE: SUBJECT: MOORPARK CITY COUNCIL AGENDA REPORT Honorable City Council ITEM-//- C- Dirk Lovett, Assistant City Engineer Prepared by Scott Lawson, Assistant Civil Engineer April 5, 2000 (CC meeting of April 19, 2000) RESOLUTION OF INTENT TO VACATE A PORTION OF LOS' ANGELES AVENUE EAST RIGHT -OF -WAY AT CONDOR ',DRIVE IN TRACT 3492 (RICE DEVELOPMENT), VACATION No. V- 2000 -1 SUMMARY This document presents for adoption a resolution declaring the City's intent to vacate a portion of Los Angeles Avenue East right -of -way at the northeast corner of the intersection of Condor Drive, Tract 3492. BACKGROUND The portion of said right -of -way is a strip, containing 0.22 acres, of painted asphalt set aside from the path of vehicular travel. This strip was dedicated as part of the Los', Angeles Avenue East right -of -way, which was a state owned highwayy, until its relinquishment to the City on February 25, 2000. Industrial Planned Development Nos. 99 -1 and 99 -2 (f,or two industrial buildings) at the northeast corner of Condor Drive and Los Angeles Avenue East were approved by the City Council on October 6, 1999. The project was approved, subj ect t� conditions, which include improvements to the adjacent street intersection of Condor Drive and Los Angeles Avenue Easti .' The subject strip of land is not necessary to construct the required improvements. The strip of land would serve no practical uses' for the City but would require maintenance expenditures by the City. Therefore, Rice Development, LLC has requested that the City vacate that portion of right -of -way. Staff estimates that City costs to process this vacation will be $5,000. Rice Development, LLC has submitted a $5,000 deposit to cover City costs. DISCUSSION The required improvement of the intersection of Los Angeles Avenue East and Condor Drive, as part of the conditions of development for IPD 99 -1 and 99 -2, requires realignment of the intersection. The realignment is possible within a portion of right -of -way. Therefore, it is appropriate for the City Council to consider the vacation of the unnecessary portion of Los Angeles Avenue East right -of -way at this time. Exhibit "A" is a legal description and drawing of the parcel to be submitted for recording with the County Assessor. Exhibit "B" was drawn to more clearly illustrate the location of the parcel (portion of right -of -way) to be vacated. This drawing shows the parcel in relation to the intersection of Los Angeles Avenue East and Condor Drive. Process Local agencies may vacate public rights -of -way by adoption of a resolution pursuant to the requirements of applicable provisions of the Streets and Highways Codes of the State of California. Those provisions require a public hearing to be conducted and due notification of said hearing to be given. The attached resolution sets the time and date of the public hearing as 7:00 P.M. on the 17th of May. Report of Conformity To satisfy Section 65402 of the Government Code of the State of California, the Planning Commission of the City of Moorpark must also make a finding that the proposed street vacation is in conformance with the Moorpark General Plan. This vacation can be scheduled for the Planning Commission meeting on May 8, 2000. STAFF 1.ECOMMNDATION 1. Adopt the attached Resolution of Intent setting the date of a public hearing to consider the vacation of a portion of Los Angeles Avenue East right -of -way at the intersection of Condor Drive of Tract 3492. 2. Direct the Planning Commission to review the proposed vacation as to conformance with the City of Moorpark General Plan. RESOLUTION NO. 2000- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DECLARING ITS INTENT TO VACATE A PORTION OF THE LOS ANGELES AVENUE EAST RIGHT -OF -WAY, AT THE NORTHEAST CORNER OF THE INTERSECTION OF CONDOR DRIVE, IN TRACT 3492. Vacation No. V- 2000 -1 WHEREAS, a portion of Los Angeles Avenue East right -of -way, in Tract 3492, was relinquished to the City of Moorpark, and; WHEREAS, it has been determined that the said portion of right -of -way will allow for realignment of the intersection of Los Angeles Avenue East and Condor Drive and is otherwise of no interest to the City of Moorpark, and; WHEREAS, it is appropriate, therefore, to consider the vacation of said portion of right -of -way. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That in order to allow for said street improvements, it is the intention of the City Council to vacate a portion of Los Angeles Avenue East right -of -way, at the northeast corner of the intersection with Condor Drive, as generally shown on Exhibit "A ", as the "PORTION OF RIGHT -OF -WAY TO BE VACATED". SECTION 2. That the City hereby elects to proceed with provisions of Part 3, Division Code of the State of California. Council of the City of Moorpark said vacation pursuant to the 9 of the Streets and Highways SECTION 3. That 7:00 P.M. on the 17th day of May, 2000, in the Community Center at 799 Moorpark Avenue in the City of Moorpark, is hereby fixed as the time and place at which a hearing will be held before the City Council, at which time and place all persons interested in or objecting to the proposed vacation may appear and be heard. SECTION 4. The City Clerk is authorized and directed to post notices of said proposed vacation conspicuously along the line of the street to be vacated at least ten (10) days before the date of said hearing. Such notices shall be prepared and posted pursuant to Section 8322 of the Streets and Highways Code of the State of California. SECTION 5. This resolution shall be posted in three public places in the City of Moorpark. SECTION 6. The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original Resolutions.
