Gilbert, Director of Public Works DATE: April 21 , 2000 (Meeting of 5-3-00) SUBJECT: Consider Resolution No. 2000- Certifying the Tabulation of Mail Ballots Received Pertaining to the Proposed Increase to the Assessments for Zone 12 of Assessment District AD84-2 for Fiscal Year 2000/2001 DISCUSSION A. Background 1 . On January 5 Resolution No. 2000-1688 was adopted initiating the process for the levy of the assessments for Assessment District 84 -2 [AD84-2] for FY 2000/2001 . 2 . On March 1 Resolution No. 2000-1711 was adopted setting May 3 , 2000, as the date of the Public Hearing on the proposed increase to the Zone 12 assessment and the Mail Ballots relating thereto. 3 . On April 5 Resolution No. 2000-1721 was adopted approving the Engineer' s Report for AD84-2 for FY 00/01 and setting June 7 as the date of the public hearing to consider the levy of all of the AD84 -2 assessments for FY 00/01 . B. Public Hearing Notice This pubic hearing has been convened in order to receive input and tabulate mail ballots pertaining to the proposed increase to the amounts of the assessments for Zone 12 of Assessment District 84-2 . Attached as Exhibit 1 is a copy of the Public Hearing Notice mailed to the owner of each affected property, as listed in the last equalized secured property tax assessment roll of the County of Ventura . ad84_01_z12_ballot results 00V' "..- I AD84 -2 : Zone 12 Ballot Results April 21 , 2000 Page 2 C. Engineer' s Report Excerpt Attached to and made a part of each Public Hearing Notice (Exhibit 1) is a copy of the approved Engineer' s Report Excerpt pertaining to Zone 12 . That report excerpt fully explains the improvements to be maintained by the Zone 12 assessment, the amounts of the Zone 12 assessments and the methods used to calculate the assessments . D. Assessment Calculations Attached as Exhibit 2 are charts which show the manner in which the Zone 12 assessments were calculated. The total assessment amount for Zone 12 is $229, 961 .49 . Said assessment amount has been allocated to properties with approved ultimate land uses, based upon the Allocation Formula approved by the City Council on January 5 . Said Allocation Formula is set forth in the Engineer' s Report Excerpt (Exhibit 1) . E. Future Increases to Assessment Amount The total assessment amount may be increased in future years to cover increases to the cost of maintenance . The language in the Engineer' s Report Excerpt (see Exhibit 1) provides that any such increase may not exceed the increase to the Consumer Price Index (CPI) between the Base Year (FY 2000/2001) and the fiscal year of the then proposed assessment . Accordingly, any deferred increases may be applied in a future year should the need arise . F. Affected Properties Attached as Exhibit 3 is a key map and a list of the properties to be assessed. G. Public Property A portion of the costs allocated to residential properties is to be assessed upon public properties within Zone 12 . As set forth in the Engineer' s Report Excerpt (Exhibit 1) , an Equivalent Dwelling Unit [EDU] factor was assigned to each category of public property. The language in Exhibit 1 on this matter is summarized as follows : 1 . In that it has been determined that Water Utility and Flood Control property receive no benefit from the proposed improvements, said properties are to be exempt from the Zone 12 assessment . 000 ad84_01_z12_ballot results I AD84 -2 : Zone 12 Ballot Results April 21, 2000 Page 3 2 . Assessor parcels used for school purposes have been assigned and an EDU factor of one (1 ) EDU per parcel . 3 . Assessor parcels used for parks purposes have been assigned an EDU factor of one (1) EDU per parcel . The amount of the assessments upon public property within Zone 12 is shown on page 2 of Exhibit 4 and is summarized follows : • County Waterworks District No. 1 exempt • Calleguas Municipal Water District exempt • Ventura County Flood Control District exempt • Moorpark Unified School District $ 772 . 48 • City of Moorpark $ 772 .48 $1, 544 . 96 H. City Payment of MUSD Assessment Unlike the process which led to the approval of the Parks Assessment District , the Moorpark Unified School District (MUSD) has not been involved in the development and application of this assessment . Also, the amount of the assessment upon school property is relatively low. Accordingly, on March 1 the City Council approved the payment of the Zone 12 assessment for FY 2000/2001 to be levied upon MUSD property. Staff advised MUSD of the City' s intent to pay the FY2000/2001 assessment . Even though the FY00/01 assessment is to be paid by the City, consistent with the requirements of the law, the Moorpark Unified School District did receive Mail Ballots for the School property within Zone 12 , and have been given the opportunity to vote on the proposed assessment . I . Ballots As mentioned above, mail ballots pertaining to the proposed increase to the Zone 12 assessment were sent to the owners of all of the affected properties . A "generic" copy of the Ballot is attached as Exhibit 4 . J. Ballot Process As required by law and explained in the Public Hearing Notice, in order to be counted a ballot must be marked, signed and received by the City prior to the end of the public input portion of the May 3 Public Hearing . Support of the assessment requires a majority vote from the ballots received. Failure to receive that majority vote will require that the City Council abandon the proposed assessment . K. Ballot Tabulation Attached as Exhibit 5 is a chart showing the tabulation of the ballots received as of 5 : 00 p.m. April 26 . If the final tabulation of the ballots at the close of the public input portion of the Public Hearing is different from the tabulation set forth in Exhibit 5 attached, a revised Exhibit 5 will be provided to the City Council at the close of the public hearing. L. Ballot Results The tabulation of the mail ballots set forth in Exhibit 5 indicates that % of the ballots received are in favor of the proposed increase to the Zone 12 assessment . Accordingly, the City Council has acquired jurisdiction to order the levy of the Zone 12 assessments described in the Ballots and related Public Hearing Notice and Engineer' s Report . M. Resolution Attached as Exhibit 6 is a Resolution certifying the results of the tabulation of the mail ballots and directing that the subject Zone 12 assessments appear in the final Engineer' s Report for Assessment District AD84-2 for FY 2000/2001 . The City Council will consider said report and the levy of all of the assessments for AD84-2 , at a public hearing on the matter which has been scheduled for June 7, 2000 . Notice of Public Hearing: A Public Hearing has been scheduled for Mai• 3, 2000, at 6:30 p.m. in the City Council Chambers, at City Hall, 799 Moorpark Avenue, Moorpark, CA, to consider approval of' an increase to the amount of the assessment forZ.one 12 of Assessment District 84-2. The purpose of this notice is a) to advise those concerned of the date and time Of the public hearing on the platter; b) to describe the purpose and intent of the proposed assessments; and, c) to explain the ballots which have been provided to the owners of affected properties. B. Background: In 1984, a Landscaping & Lighting Maintenance Assessment District (AD 84-2) was created to fund costs associated with street lighting and the maintenance of various landscaped areas within the City. In 1997 Zone 12 of that Assessment District %k as established, encompassing that area bounded on the east by the Route 2; frec%vav, on the west by Spring Road, on the north by New Los Angeles Avenue and the Arrovo Still) and on the south by Tierra Rejada Road. Since the formation of Zone 12. the amount of the assessment has remained at zero. The construction of landscape improvements kvithin that area has been completed and the City will be considering the possible acceptance and maintenance of certain specific portions of those landscape improvements. C. Reason for Assessment: The purpose for Zone 12 assessment is to fund City costs for the maintenance of certain specified landscaped areas within Zone 12. D. Engineer's Report Excerpt: Information pertaining to the Zone 12 assessment is set forth in an excerpt from the draft Engineer's Report for AD84-2 for FY 2000/2001, attached to this Public I learing Notice as Exhibit W. E. Scope of Improvements to be Maintained: The scope of the landscape improvements to be maintained by the City and tilnded by the Zone 12 assessment, is described in Boundary Maps set forth in the Fngineer's Report Fxcerpt attached as F.xhibit W. I Assessment Amounts: The alllotlllt Of the total annual assessment for Zone 12 of'ADS4-2 for FY 2000/2001, is 5229,961.49. The amount of the assessment for each affected property is shown on the Ballot provided to the owner of that property. In addition, the amount of the per acre or per lot assessments is set forth in the Engineer's Report i-,xcernt attached as Exhibit W. Public Hearing Notice Assessment District 84-2 - Zone 12 March 1, 2000 Page 2 C. flow the Assessment Was Calculated: To determine the amount of fllc assessments fur each property within Zone 12, the maintenance cost of specified elcrnlcnts of the improvements has been allocated to the various ultimate land uses within Zone 12. The costs allocated to each land use was then spread to cacti property, yielding a per lot assessment for residential property and a per acre assessment for other properties. More specific information pertaining to the Method of Assessment for Zone 12 is to be found in the Engineer's report Excerpt attached as Exhibit W. 11. Public Property: A portion of the costs allocated to residential properties will be assessed upon public properties. Fach category of public property has been assigned an Equivalent Dwelling Unit [L;DU] factor. The amount of the assessment for any given pubflcly-owned parcel is determine by multiplying the residential per lot asses<nlent h� the number of EDUs assigned to that parcel. Additional information on L:DI;s and assessments upoll public properties can be found in the Engineer's report Excerpt attached as L.x111b11 'A'. 1. Exempt Properties: It has been determined that Watel- Utility and Flood (control properties receive no benefit from the proposed improvements and are, therefore. except from the Zone 12 assessment. 11. Duration of the Assessment: The proposed assessment is for the period ho <gmning July t. 2000, and ending June 30, 2001. K. Method of Collection: The proposed assessment, if appro\cd, \',•ill appear on your property tax bill for FY 2000/2001. L. Future Increases: The total assessment amount may be increased in future years to cover increases to the cost of maintenance. In no instance may any increase exceed the increase to the Consumer Price Index (CPI) between the Base Year (FY 2000/2001) and the tiscal year of the assessment. Additional information pertaining to possible future increases to the amount of the Zone 12 assessment is set forth in the V.ngineer's Report Excerpt attached as Exhibit 'A'. M. Purpose of Ballot: Pursuant to the requirements of Proposition 218, the o\N ncrs of the properties affected must approve, by mailed ballot, any proposed increase to and assessment. Accordingly, the proposed increase of the 'Zone 12 assessment from zero to an amount necessary to fund the required maintenance, must be approved in this manner. N. Balloting Procedures: Rallots have been mailed to the owner of' each property to he assessed. Annual Increase to Total Assessment Amount: I. Base Year: The Base Year Total Assessment Amount for Zone 12 is the amount stated in the Lngincer's Report For FY 2000.12001, said amount being $229,961.49. 2. Annual Increase: In years subsequent to FY 2000/2001, the Total Assessment amount for Zone 12 may be increased to cover maintenance cost increases. 3. Basis of Increase: The amount of any increase to the Total Assessment for Zone 12 shall be based upon the increase to the Consumer Price Index (CPI) for all Urban Consumers for the Los Angeles Metropolitan Area, for the calendar year ending the December prior to the Fiscal Year of the proposed assessment. 4. Deferred Action: Each year when the amount of the 'Total Assessment I'm- Zone 12 is determined, said amount may or may not be increased, a,� provided above, at the sole discretion of the Otv. 5. Assessment of Deferred Increase in Subsequent Years: Any increase to the Total Assessment for Zone 12 may include any increase deferred in any and all prior years. In such event, the appro\ed Total Assessment may nut exceed the Base Year Total Assessment Amount, adjusted to reflect the change in the CPI between the Base Year and the effective year of the proposed assessment. [Example: If the CPI increases 51/, Year 3, but the assessment fur Year 3 is increased by olfly 3%, the remaining 2% increase may be added to the assessment in any subsequent year.] 6. Increase Determined Invalidity: In the event any increase to the Total Assessment amount is held to be invalid or unconstitutional by any coup of competent jurisdiction, such decision shall not affect the validity of the Base Year Total Assessment for Zone 12. Section 4 Description of the Improvements to be Maintained 12. Zone 12: Carlsberg Specific Plan Maintenance costs associated with certain landscape improvements as described in the Boundary Map for Zone 12 included in Appendix "E". Lots 206,252.16 206,252.16 0.00 0.00 Total Residential Assessment 207,797.12 207,024.64 0.00 772.48 99.6% 0.0% 0.4% Total 229,959.76 225,674.81 0.00 4,284.95 Maximum Assmnt. 229,961.49 Percent of Total Votes 98.1% 0.0% 1.9% Total Votes from Ballots Received 225,674.81 Percent of Votes from Ballots Received 100.0% 100.0% 0.0% XXXXXXXXX RESOLUTION NO. 2000 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, CERTIFYING THE TABULATION OF MAIL BALLOTS RECEIVED PERTAINING TO THE PROPOSED INCREASE TO THE ASSESSMENTS FOR ZONE 12 OF ASSESSMENT DISTRICT 84-2 FOR FISCAL YEAR 2000-2001 WHEREAS, by Resolution No. 2000-1688, adopted on January 5, 2000, the City Council ordered the preparation of an Engineer' s Report for "Moorpark Lighting and Landscaping Assessment District 84 -2" [herein DISTRICT] for Fiscal Year 2000-2001, in accordance with Section 22500 et . seq. of the Streets and Highways Code; and WHEREAS, said Resolution stated the intent of the City Council to make certain changes to the amount of the assessment for Zone 12 of the DISTRICT, said increases to be made in accordance with the requirements of Article XIII-D of the California Constitution (Proposition 218) ; and WHEREAS, by Resolution No. 2000-1711, adopted on March 1, 2000, the City Council approved an excerpt from the Engineer' s Report for the DISTRICT for FY 2000/2001, identifying certain improvements to be added to Zone 12 of the DISTRICT and determining the amount of the increase to the Zone 12 assessments required to maintain those improvements; and WHEREAS, by Resolution No. 2000-1721, adopted on April 5, 2000, the City Council approved the entire Engineer' s Report for the DISTRICT for Fiscal Year 2000/2001, which included the aforementioned excerpt for Zone 12 , said report being on file with the City Clerk; and WHEREAS, the aforesaid Resolution No. 2000-1711 (adopted March 1, 2000) set May 3 , 2000, at 6 :30 p.m. as the date and time of a public hearing to consider the proposed added improvements and increased assessments for Zone 12 ; and WHEREAS, said Resolution No. 2000-1711 further directed that a Public Hearing Notice, giving notice of said hearing, be mailed to the owner of each property affected by the proposed assessment increase, as listed in the last equalized secured property tax assessment roll of the County of Ventura; and, WHEREAS, said Resolution further directed that said Public Hearing Notice define and describe the improvements proposed to be added to Zone 12 , the total assessment proposed for Zone 12 , the amount of the assessment for the parcel owned by the addressee of the Hearing Notice, the duration of the assessment, the reason for the assessment, and the basis upon which the amount of the assessment was calculated; and, 0tt�;�".�': RESOLUTION NO. 2000 - Page 2 WHEREAS, said Resolution further directed that an assessment ballot be provided with the Public Hearing Notice to be mailed to the owner of each affected property, along with a summary of the procedures for marking and returning the ballot to the City to indicate support or opposition to the proposed assessment increase; and, WHEREAS, said summary of the balloting procedures also described the minimum requirements for the approval of the assessment increase and advised that a majority protest would result in the assessment not being imposed; and WHEREAS, said Public Hearing Notices, assessment information and ballots were mailed to the owners of all of the affected properties at least forty-five (45) days prior to the date of the public hearing; and WHEREAS, said Notice and mail ballots were provided to the owners of the affected properties in accordance with the requirements of Article XIII-D of the California Constitution; and WHEREAS, on May 3 , 2000, at the hour of 6 : 30 p.m. at the City of Moorpark, City Council Chambers, 799 Moorpark Avenue, Moorpark, California, 93021, the public hearing was duly and regularly held as noticed, and all persons interested and desiring to be heard were given an opportunity to speak and be heard, and all matters and things pertaining to the levy were fully heard and considered by this City Council, and all oral statements and all written protests or communications were duly considered; and WHEREAS, at the public hearing the Council tabulated the mail ballots and found that a majority protest as defined by Article XIII-D of the California Constitution did not exist , and this Council thereby acquired jurisdiction to order the levy and the confirmation of the diagram and assessment for Zone 12 of the DISTRICT, prepared by and made a part of the Engineer' s Report, to pay costs and expenses thereof . NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1 : A majority protest does not exist .
