Subject: Consider Proposal by AT&T Wireless Services to Place
an 80 Ft High Monopole Antenna Near the High Street
Metrolink Station.
BACKGROUND
On December 27, 1999, the City Council was provided with
information concerning a proposal submitted to the City by AT&T
Wireless Services through their agent the Tynan Group to
construct a monopole antenna and supporting facility in the
Downtown Specific Plan Area. Through the initial effort to
determine an appropriate location for the proposed antenna, two
principles were important for the applicant' s engineers to
assess including selecting a site because of signal reception
and responding to aesthetic concerns . Two sites were selected,
City Hall and the south parking lot of the Metrolink Station .
The testing is now complete and the location preferred is the
Metrolink Station parking lot . However, because of limitations
on the term of the current lease of the Metrolink Station
(expires in 2004 with provision for annual renewal) with the
Ventura County Transportation Commission (VCTC) wherein the City
is lessee, this initially preferred location is not feasible at
this time. As a result of the lease limitation that precludes a
sub-lease for a longer period of time than the parent lease,
adjacent city-owned property is now preferred.
DISCUSSION
The initial contact concerning this proposed cellular antenna
was received by the City on October 28, 1999, when the attached
letter and descriptive information, including proposed lease
terms were provided. Since that time the site selection process

has taken place including testing by AT&T Engineers . AT&T
utilized a crane to temporarily hoist testing equipment to a
suitable elevation at each of the two selected locations of City
Hall behind the Senior Center and the south side of the railroad
tracks at the Metrolink Station on High Street . Either of the
locations were concluded as feasible, however, AT&T Engineers
prefer the Metrolink Station because of the strength of the
signal and the lower pole height of 80 feet which can be
achieved. On January 14 , 2000, a letter was received from the
Tynan Group (attached) restating their proposal and lease terms
which was a follow-up to their telephone conversation with staff
on January 14, 2000, confirming preference for the Metrolink
site.
The actual site now proposed is the vacant lot immediately west
of the Metrolink parking lot. The installation will involve an
80' tall monopole antenna and an equipment shelter 12' X 28' in
size, height to be determined. The appearance (design) of the
installation has yet to be determined since the ultimate use of
this vacant lot has not yet been established. It is designated
as C-OT (Old Town Commercial ) by the Downtown Specific Plan,
which allows communications facilities with a Planning
Commission approved Conditional Use Permit . The installation
can be very utilitarian in nature involving the typical modular
light weight concrete building and monopole antenna or it can be
architecturally integrated, consistent with the Downtown design
criteria found in the Downtown Specific Plan, with the equipment
shelter designed similar to the Metrolink ticket kiosk and the
antenna designed to appear as a clock tower or similar
structure. A determination concerning the appearance of this
installation is dependent upon whether it is a permanent
installation (lease term requested is 30 years) or a temporary
installation. Placement of a permanent antenna and equipment
shelter based upon applicant' s lease is a commitment for up to
30 years at the location and of a design as may be approved.
The provision of a "temporary facility" would allow a future
permanent facility to be constructed consistent with a future
use on the property (public or private) and would allow the
tower and equipment shelter to be architecturally integrated
with the site uses once they are known. The applicant is
willing to work with the City on the issue of a permanent (vs. )
temporary facility but does not want to relocate a permanent
installation because of the significant cost to do so.

Attached to this report are several illustrations of monopole
antennas that have been architecturally defined. These examples
represent what can be accomplished architecturally while
facilitating the needs of the carrier concerning transmitting
and receiving signals . Staff has not arrived at a conclusion as
to a preferred architectural conclusion pending a decision by
the City Council on the temporary or permanent status desired
for the facility. A determination concerning a permanent or
temporary facility is dependent on City Council' s interest in
the monopole antenna at the proposed location. As evident from
the attached examples, there is no resemblance between the
architecturally treated antenna and a non-architecturally
treated antenna that has been constructed in the past, including
the AT&T and Cellular One monopole antennae at the Ventura
County Water Works reservoir site near Moorpark College. AT&T
is proposing that a monopole antenna be built inside of an
architectural feature that appears as a church steeple, clock
tower, light fixture or some other architectural solution not
identifiable as a cellular antenna .
The proposed lease terms as initially referenced in the October
26, 1999, letter from the Tynan Group have been modified in
their January 14, 2000, letter but have not to this point been
extensively discussed. The lease terms proposed by AT&T
Wireless Services are:
1 . Lease Term: A five (5) year initial term with five (5)
additional five (5) year terms.
2 . Monthly Rental Amount : Seven Hundred Fifty Dollars
($750) .
3 . Rental Increase: Annually at three percent (30) .
4 . Option Period: Twelve ( 12) months with one (1) additional
nine month option.
S. Option Payment : One Thousand Dollars ($1, 000) for each
option .
6. Taxes/Expenses : Tenant will be responsible for all
applicable taxes, utilities, permitting requirements and
expenses .
The above terms and conditions are in addition to the
construction at the sole cost and expense to AT&T of the
equipment shelter and architectural enhancement of the monopole

antenna as determined by the City Council. If this proposed
installation is viewed as a viable concept, it should be with
the clear understanding that the architectural solution is of
considerable importance and must be consistent with provisions
of the Downtown Specific Plan.
SUbOIARY
City Council can evaluate the options available as a temporary
installation or permanent installation at the subject location.
If the City Council is interested in allowing such a facility on
the Ventura County Transportation Commission property,
modification of the term of the lease would be necessary to
respond to the lease timeframe (total 30 thirty years) requested
by AT&T. AT&T is not opposed to the Ventura County
Transportation Commission location, but because for them, time
is of the essence, there was concern that negotiating a new
lease to include their timeframe would be a lengthy effort for
the City. Without knowledge of the specific future uses at the
subject site or their design features establishing a temporary
antenna and equipment shelter may offer flexibility for future
uses and design elements. An interim " temporary" facility for
the first five (5) years may offer sufficient time to determine
use, architecture or another close by location for the AT&T
installation to insure that it may become a community landmark
as compared to a structure marking the Downtown area. Should
the City Council conclude that an appropriately designed
installation, whether temporary or permanent may be acceptable
at the referenced location, staff should be directed to work on
the details as appropriate including the processing of a
Conditional Use Permit by the Planning Commission and
appropriate lease terms .

I h.ink You for taking the time this morning to discuss AT&T Wireless Services' needs in the
downtown Moorpark area. I'm hopeful that by coming to the City early in the process we
wait rest>]ve many of the concerns that consistently prove problematic with the local
itirisdict ions. Pursuant to our discussion, 1 have included with this letter of intent a map
,ho wing each of the proposed locations for the AT&T Wireless antenna facility and Some
olor copies of the catalogue I made reference to in our discussion. l have also included a color
photograph that clearly shows the typical shelter AT&T Wireless uses at its sites. The pole
�icsagns as ailable provide us with a platform from which we can create a site that all parties can
ive with. The reality of AT&T's specific needs, however, is that the site will be seen to some
plc-rec. It is a line of sight technology.

T& Wireless Services is in need of locating a new wireless antenna facility in the immediate
i,-uiiiv of Los Angeles Avenue (Hwy 118) and Moorpark Avenue (Hwy 23) in downtoR-n
\Ioorp.irk. I am proposing on behalf of AT&T Wireless Services to lease a small portion :-,f
,he Cav property for the purpose of installing and operating a wireless antenna tacility. Fh "
'eltcr of intent is the first step in the process and will further explain the locations we
discussed.
The signing of this Letter of Intent will allow for AT&T Wireless to feel comfortable spending
money in order to move forward with testing the location selected in order to confirm its
ihility to provide the desired coverage in the areas required for this site. This letter will .also
,articulate the general business terms and provide a general platform from which to create .i
I.c.ise. This letter is not a legally binding agreement and will be recognized by both parties
as an act of good faith in moving forward with testing and negotiations with the intentions o`
entering into a long term Lease Agreement in the very near future. The significant husinc�,s
terms are summarized as follows:
I. Lease Term: A Five (5) year initial term with nine (9) additional three (3) y e.ir
terms.
2. Monthly Rental Amount: Approximately Seven Hundred Fifty Dollars (87;--).
Rental Increase: Annually at three percent (3 910).
Option Period: Twelve (12) months with one (1) additional nine (9) month
option.

Although you are more than familiar with the site acquisition/leasing process, 1 would like to

1. A letter of Intent is signed by owner of the property indicating owner's general
.acceptance of the approximate business terms discussed.
_'. A live radio test is conducted to determine the feasibility of locating a facility on
the site and the radio test is evaluated by AT&T's engineers and recommendations

If the site is acceptable, project specifics are codified and negotiations with the
property- owner commence. Preliminary discussions with the local jurisdiction
began,
-t. Upon full execution of the Lease Agreement, and once your use of the property is
resolved, the permitting of the proposed site can begin.

Subject : Potential Proposal Sy AT&T Wireless Services To Place A
Manopole Antenna On City Zoned Property In The Downtown
Specific Plan Area
On October 28, 1999, the City was initially contacted by the Tynan
Group, representing AT&T Wireless Services concerning a potential
manopole antenna site in Moorpark. Only one site is needed in or
near the Downtown Area and the consultant representing the
potential applicant has indicated that they will cooperate in every
feasible way with the City to be sensitive to location and aesthetic
concerns .
Subsequent to the October 28, letter (see attached) several phone
conversations and one office conversation took place. The sites
viewed as feasible both by the Tynan Group because of signal
reception and by the City because of the potential to have an
acceptable aesthetic conclusion were narrowed to somewhere on the
City Hall site and a City owned parcel near the Metrolink staticn .
On December 27, 1999, testing was conducted on the two referenced
sites to determine the geographic desirability and the minimum
height of the antennas. The test results should be available to the
City by January 2000 .
As noted by the letter received on October 28, 1999, the applicant
has outlined terms for a lease agreement if the City is interested
in allowing the facility on City owned property. The terms of the
lease are conceptual and there was no commitment or agreement in an: -
form to embrace any testing results . There was no obligation on the
part of the City for testing to go forward. There was an indication
to the Tynan Group that because of their willingness to develop an

architectural solution which could complement existing or proposed
public buildings or revitalization efforts in the Downtown Area
that there could be interest on the part of the City Council to at
least view a proposal . Based upon this potential interest the Tynan
Group moved forward with the testing of both sites on December 27 ,
1999 .
As illustrated by several pages attached to this memo there are a
number of architectural solutions available which the Tynan Group
would consider if the City concludes that the antenna would be
acceptable on City property. The attached black and white pictures
may not convey the desired detail, therefore, feel free to view the
color illustrations that I have in my office .

Dear Mr. Loftus,
Pursuant to our previous discussions and the Live Radio Tests that were conducted within the
City of Moorpark, the following is a proposal of the general terms and provisions under which
AT&T Wireless would be interested in entering an Agreement.
1. Lease Term: A Five (5) year initial term with five (5) additional five (5) year
terms.
2. Monthly Rental Amount: Seven Hundred Fifty Dollars ($750).
3. Rental Increase: Annually at three percent (3%),
4. Option Period: Twelve (12) months with one (1) additional nine (9) month
option.
5. Option Payment: One Thousand Dollars (S 1,000) for each option.
6. Taxes/Expenses: Tenant will be responsible for all applicable taxes, utilities,
permitting requirements and expenses.
As you have the CD from Telestructures, I did not include with this package anything other
than a Power point rendition of the clock tower application. We are interested in finding a
design that will provide a platform from which all of AT&T's needs can be met wituuuL
compromising the integrity of the aesthetics of the area. I know you feel the same. We are
confident that we can find a design that will work, so long as the height that is required can be
attained. I look forward to seeing this site to its fruition.

SUBJECT: Addendum to Staff Report Concerning AT&T Wireless
Services Request to Place an 80 Ft. High Monopole
Antenna Near the High Street Metrolink Station.
Included as an item on the City Council Agenda for May 3, 2000,
is a request for installation of a wireless service antenna from
AT&T. The staff report refers to a monopole concept employed by
cellular/wireless services . Other options for installations are
available and include more architecturally appealing and
complimentary designs suitable within the Downtown Specific Plan
area. These are examples only of what can be accomplished not a
recommended solution at this time.
Attached to this memo are two design concepts, a bell tower and
a clock tower, which provide a more upscale presentation more
desirable for the Downtown area as we begin the process of
revitalization. The clock tower would be an especially suitable
architectural statement and focus point adjacent to the railroad
and depot area in the Downtown Specific Plan area. These
concept designs would be more consistent with the plan design
guidelines as well .
