EXECUTIVE SUMMARY
This presents for approval a Resolution making certain changes to
Assessment District AD84 -2 and confirming the assessments for
Fiscal Year 2000/01.

B. General Information

Assessment District 84 -2 was formed in 1984 pursuant to the
provisions of the "Landscaping and Lighting Act of 1972." This
assessment district was established to allow for the funding of
street lighting and parkway /median landscape maintenance and
improvement expenses through the levying of assessments as
provided for in the act. The City must annually act to levy the
lighting and landscape maintenance assessments. Said
assessments have been levied each year since the formation of
the district.
There are two types of assessments generally described as
follows:
• Citywide Assessments: assessments applied to all of the lots
in the City; and
• Zone Assessments: assessments applied to properties within
certain zones of benefit to fund maintenance and /or
improvements which benefit those properties.
Citywide Assessments
There are two types of expenses funded by two distinct Citywide
assessments: street lighting costs and certain parkway and
median landscape maintenance costs.
1. Street lighting costs are distributed to all of the
properties within the City by means of a formula designed to
spread said costs on the basis of benefit. The benefit
spread formula identifies a number of factors (including
lighting intensity, lighting security, people use, etc.)
which are associated with benefits derived, and then weighs
those factors by land use as a means to determining benefits
derived.
2. Citywide landscape maintenance costs are spread via a People
Use formula in which twenty -five percent (25 %) of the total
Citywide landscape maintenance costs is allocated to non-
residential properties and the remaining seventy -five
percent (75 %) is allocated and spread to residential
properties. These allocated costs are spread to both non-
residential and residential properties by a "people -use"
benefit formula based on the land use of each parcel being
assessed.

D. Zone Assessments
Landscape maintenance costs for each Zone of Benefit are
spread, according to certain formulas, to each lot within that
Zone. Storm debris basin maintenance cost for certain Zones of
Benefit, are spread evenly to selected lots within those Zones,
deemed to derive benefit from such maintenance. In addition to
these maintenance costs, certain Zones may receive an
improvement assessment to fund approved improvements to be
funded by the assessment for those zones. Details on the spread
formula or methodology for each Zone of Benefit, is set forth
in the Engineer's Report.
DISCUSSION
A. Approved Engineer's Report
On April 5 the City Council approved the Engineer's Report for
AD84 -2 for FY 2000/01. A copy of that report is attached as
Exhibit 1. A summary of some of the information in that report
is as follows:
1. Method and Rates of Assessment: Provides a description and
explanation of the methods and formulas used to calculate
and spread the total assessment amounts to all of the
affected lots.
2. Description of Improvements: Provides a description of all
of the improvements maintained by the District.
3. Zone 12 Assessment Calculations: Sets forth information
describing how the Zone 12 assessments were calculated.
4. Assessment Amounts: Sets forth the assessment amount for
various land uses.
5. Boundary Maps: Contains the "Boundary Map, City of Moorpark
Lighting and Landscaping Maintenance Assessment District No.
AD84 -211, which show the boundaries of the entire Assessment
District as well as the boundaries of each Zone of Benefit.
These maps, along with the Ventura County Assessor Maps
pertaining to properties within the City of Moorpark,
constitute the AD84 -2 Assessment District Boundary Maps.
6. Changes to Report: Certain changes to the Engineer's Report
are recommended to be approved by the City Council prior to
the adoption of the Resolution setting the assessments for
FY 1999/00. Those changes have been incorporated into the
copy of the Engineer's Report attached as Exhibit 1. A
summary of the changes is discussed below.
B. Recommended Changes to Engineer's Report
As mentioned above, it is recommended that the City Council
approve certain changes to the Engineer's Report approved on
April 5. Those changes are listed in Exhibit 2.

C. Fund Balances
Attached as Exhibit 3 are charts which summarize the projected
fund balances for the District.
As mentioned in the April 5 staff report, each year the final
Engineer's Report could be amended to direct that an adjustment
be made to the amounts actually levied. Said adjustment to the
"levied" amount only, would not reduce the amount of the
assessment and said assessment amounts would remain at that
"unchanged" level for the next and successive years. Such
adjustments could be made to lower the amount of a projected
year -end balance for any given Fund, when and if it was
determined that said projected year -end balance was excessive.
As described in Exhibit 3, certain Funds are projected to have
a positive year -end balance in June 2001. However, it is not
recommended that any of the amounts levied be adjusted downward
and, and that all projected year -end Fund balances be held as a
contingency reserve for future unforeseen expenses.

E. Assessments Unchanged
Except for the increase to the Zone 12 (see Section G) , the
Engineer's Report proposes no new or increased assessments for
AD 84 -2 for FY 2000/2001. All other assessment amounts are the
same as last year.
F. Zones of Benefit
1. General: There are no new Zones of Benefit proposed to be
added in FY 2000/2001. A list of all of the Zones of Benefit
is as follows:

2. Zone Landscape Maintenance Assessment: The properties
within each of the Zones of Benefit are assessed for the
maintenance of certain designated landscaped areas deemed
to be of benefit to the properties within that zone.
3. Storm Drain Debris Basin Maintenance: A portion of Zone 2,
5 and 10 are assessed for the maintenance of debris basins
along the south boundary of the City.
4. Improvement Assessment: The lots within Zone 2 have in
past years been assessed a $10 per lot improvement
assessment for a future project to construct parkway
landscaping on the north side of Tierra Rejada Road, east
and west of Southhampton Road. It is proposed that this
improvement assessment be assessed again in FY 2000/2001.
With the FY 2000/2001 assessment, the total funds
available in FY 2000/2001 for this construction project
will be $39,672 [$34,672 + $5,000 appropriated for
Project No. 80191.

G. Zone 12: Carlsberg Specific Plan

1. The City Council has authorized staff to accept and maintain
the improvements to be funded by the Zone 12 assessment [as
described in the Engineer's Report (Exhibit 1)] upon
completion of certain prerequisites as approved by the City
Council and provided to the developer.
2. One of the prerequisites was the approval of the Zone 12
assessment via Mail Ballot, as required by Proposition 218.
3. The Resolution of Intent [Resolution No. 2000 - 16881, adopted
January 5, 2000, stated the City Council's intent to
increase the Zone 12 assessment from zero to an amount
sufficient to fund the maintenance of the Zone 12
improvements.
4. On March 1, 2000, the City Council adopted Resolution No.
2000 -1711 setting May 3, 2000, as the date of a public
hearing to consider the proposed increase to the Zone 12
assessment.
5. On March 1 the City Council also took the following actions:
a) approved an "excerpt" from the Engineer's Report
describing the Zone 12 improvements and the assessments;
b) approved the Public Hearing Notice for the May 3 public
hearing, which defined and explained the improvements,
the assessment amounts, the duration of the assessment,
the reason for the assessment, and the basis upon which
the assessment amounts were calculated;
c) approved the form of the Mail Ballots sent to the owner
of each of the affected properties.
6. The Mail Ballots received were tabulated and the results
presented to the City Council at the public hearing on May
3. The ballots were in favor of the assessment.
7. On May 3, 2000, the City Council adopted Resolution No.
2000 -1734 certifying the results of the Mail Ballots and
directing that the final Engineer's Report for AD84 -2 for
FY2000 /2001 include the Zone 12 assessments.
Public Hearing
The "Landscaping and Lighting Act of 1972" (Streets and
Highways Code) requires a public hearing to be held prior to
the annual levy of assessments for�the purpose of receiving
input and to hear any protests to the proposed assessments.

Consistent with past City practice public hearing notices were
not mailed to the owner of each affected property. Two years
ago it was determined that, since the amounts of the
assessments were not being changed, the cost of mailed public
hearing notices was not justified.
Attached as Exhibit 4 is a copy of the Public Hearing Notice
for AD84 -2. Said Notice was published and posted as required by
law. Said Notice sets the date of the public hearing as June 7,
2000, which is the first City Council meeting in June, as
required by law.
The Public Hearing Notice cites the assessment amounts set
forth in the Engineer's Report. The City Council may revise the
final assessment amounts any time prior to the adoption of the
Resolution in June setting the amount of the assessments,
provided the assessments do not exceed the amounts cited in the
Public Hearing Notice.
RECOMMENDATION
Staff recommends that the City Council take the following actions:
1. Open the public hearing, receive testimony and close the public
hearing.
2. Approve the changes to the Engineer's Report listed in Exhibit
2 of this report.
3. Adopt the attached Resolution No. 2000- (Exhibit 5) making
certain changes to AD84 -2 and confirming the assessments for
Fiscal Year 2000/01.

SECTION 1 AUTHORITY FOR REPORT
This report is prepared pursuant to City Council Resolution No. 2000 -1688, adopted January 5,
2000, to extend this District for the fiscal year commencing July 1, 2000 and ending June 30, 2001
in compliance with the requirements of Article 4, Chapter 1, "Landscaping Act of 1972 ", being Part
2 of Division 15 of the California Streets and Highways Code and Proposition 218 which allows
existing assessment districts to continue as long as rates and methodology remain the same.
The District will provide electrical energy for public lighting facilities and for operation and
maintenance of public lighting within the city. In addition, the District will provide for installation
and/or maintenance of erosion and flood control related public landscaping within the public right -
of -way.
. SECTION 2 DEFINITION OF TERMS
Assessment Rate - The assessment rate is the number assigned to each land use category. The
assessment rate for a Level 1 Single Family Residential lot (land use code 1) is 1 for lighting
assessment and 4 for erosion and flood control related landscape assessment. Assessment rates for
other parcels in other land use categories, including publicly owned parcels, a re proportioned to
these basic rates. These assessment rates remain unchanged.
Methodology - The methodology is the formula used to derive the assessment rates of each land use
category. The methodology has not been changed in several years.
EDU [Equivalent Dwelling Unit] - For the purpose of determining the amount of the Zone 12
assessment to be levied upon public properties within Zone 12, each category of public property has
been assigned an Equivalent Dwelling Unit [EDU] factor.

SECTION 3 METHOD AND RATES OF ASSESSMENT
Except for the changes to the Zone 12 assessment described below, the methodology and assessment
rates used for Assessment District No. AD -84 -2 have not changed for the past several years, and are
based on how the facilities being maintained provide benefits as part of the system of streets which
serve the City of Moorpark.
Lighting
The benefits of street lighting are for the convenience, safety and protection of people and the
security or protection of property, property improvements and goods. The intensity or degree of
illumination provided can have a bearing on both.
The single family home - Level 1 has been selected as the base unit for the spread of assessments.
By definition, the single family home - Level 1 is a single family home located on a street that has
existing streetlights. An assessment rate of 1.00 has been assigned to the base unit, which is
composed of benefit factors, which correspond to the following types of benefit.
People Use - People related benefits 0.50
Security Benefit - Property protection 0.25
Intensity - Degree of illumination 0.25
Assessment Rate: 1.00
Parcels in other land use categories, including publicly owned parcels, were then rated by
comparison with the basic unit. (See the following table.)
People Use - People related benefits
1. Reduction in night accidents and attendant human misery.
2. Reduced vulnerability to criminal assault during hours of darkness.
3. Promotion of business operations during evening hours.
4. Increased safety on roads and highways.
Security Benefit Property Protection
1. Reduction in vandalism and other criminal acts, and damage to
improvements.
2. Reduction in burglaries.
Intensity: Intensity or degree of illumination provided on streets varies with type of
street, date of installation and the use of the property adjacent thereto.

Landscaping
The landscaping element of the spread formula recognizes that all properties within the City benefit
from the maintenance of the landscaping within public rights -of -way and easements. These benefits
include improved safety resulting from a regular tree trimming program and improved street
sweeping capabilities resulting from trimming trees which may otherwise interface with street
sweeping operations.
The method of spreading maintenance costs is based upon the assessment rates, and the assessment
rates are determined by the "people use" attributed to each land use within the City. This method
was chosen because the benefit received is directly proportionate to the number of people generated
by each land use. Recognizing that residential land uses within the City derive a higher degree of
benefit than non - residential land uses, the formula was subdivided into two main groups, with
residential land uses contributing in 75% of the assessment and non - residential uses being assessed
for the remaining 25 % of the maintenance costs.
The single family home has been selected as the base unit for the spread of assessment. An
assessment rate of 4 has been assigned by the base unit. Parcels in other land use categories,
including publicly owned parcels, were rated by comparison with the basic unit. (See the following
table.)
The "people use" factors utilized in determining assessment rates and in the assessment district
spread formula are shown in Appendix `B ".
Zone 12: Carlsberg Specific Plan
a. Assessment Allocation: The maintenance costs for Zone 12 are allocated to the approved
ultimate land uses within Zone 12 as follows:
b. Exempt Properties: It has been determined that Water Utility and Flood Control properties
receive no benefit from the proposed improvements. Accordingly, all such properties shall
be exempt from the Zone 12 assessment. In addition, in that the portion of the total
assessment allocated to the Institutional Properties is spread to only lots 3 and 4 of Tract
4974, the slope adjacent to Spring Road [AP #512 -0- 270 -065 is exempt.

c. Equivalent Dwelling Units [EDIT]: A portion of the assessment allocated to Residential
properties has been allocated to each public property within Zone 12, based upon the
applicable number of EDUs for that public property. The EDUs assigned to various
categories of public properties within Zone 12 are as follows:

d. Annual Increase to Total Assessment Amount:
1. Base Year: The Base Year Total Assessment Amount for Zone 12 is the amount
stated in the Engineer's Report for FY 2000/2001, said amount being $229,961.49.
2. Annual Increase: In years subsequent to FY 2000/2001, the Total Assessment
amount for Zone 12 may be increased to cover maintenance cost increases.
3. Basis of Increase: The amount of any increase to the Total Assessment for Zone 12
shall be based upon the increase to the Consumer Price Index (CPI) for all Urban
Consumers for the Los Angeles Metropolitan Area, for the calendar year ending the
December prior to the Fiscal Year of the proposed assessment.
4. Deferred Action: Each year when the amount of the Total Assessment for Zone 12 is
determined, said amount may or may not be increased, as provided above, at the sole
discretion of the City.
5. Assessment of Deferred Increase in Subsequent Years: Any increase to the Total
Assessment for Zone 12 may include any increase deferred in any and all prior years.
In such event, the approved Total Assessment may not exceed the Base Year Total
Assessment Amount, adjusted to reflect the change in the CPI between the Base
Year and the effective year of the proposed assessment.
[Example: If the CPI increases 5% Year 3, but the assessment for Year 3 is
increased by only 3 %, the remaining 2% increase may be added to the
assessment in any subsequent year.]
6. Increase Determined Invalidity: In the event any increase to the Total Assessment
amount is held to be invalid or unconstitutional by any court of competent
jurisdiction, such decision shall not affect the validity of the Base Year Total
Assessment for Zone 12.
SECTION 4 DESCRIPTION OF IMPROVEMENTS TO BE MAINTAINED
This report covers the period of July 1, 2000 through June 30, 2001. An updated report is prepared
each year to reflect updated annual costs and changes in parcelization.
The improvements to be maintained in this District include all City -owned and Southern California
Edison (S.C.E.) -owned streetlights as well as all medians and street trees within public rights -of -way
within the boundaries of the city.

Lighting maintenance shall include, but is not limited to, energy costs, removal, repair, replacement
or relocation of light standards, poles, bulbs, fixtures and all appurtenances. Servicing of S.C.E.
owned lights as defined in Section 22538 of the Streets and Highways Code shall be furnished by
the Southern California Edison Company or its successors, or this servicing shall be as authorized by
the Public Utilities Commission, State of California. Maintenance of City -owned lighting
improvements shall be furnished by the City.
Landscape maintenance for erosion and flood control shall include, but is not limited to, watering,
fertilizing, mowing, weed control, shrubbery, tree removal and pruning, removal and replacement of
dead growth, maintenance of irrigation facilities and other necessary work.
In addition, the cost to maintain improved areas within certain Zones of Benefit will be borne by
owners of property within said zone. Those Zones of Benefit are generally described as follows:
1. Tract No. 2851: Maintenance costs associated with landscaping in the Ventura
County Flood Control Easement and portions of the interior tract entry areas. The
obligation upon these 75 lots is pursuant to a condition of development.
2. Tract No. 2865: Cost for maintenance of specific landscape areas and debris basins
within the tract, including landscaping at Christian Barrett & Spring Roads; Tierra
Rejada landscaping, and Peach Hill Road landscaping on east side between Christian
Barrett and Tierra Rejada Roads, and the entry monument sign at Christian Barrett
and Spring Road. Also, an additional assessment for the improvement of parkway
landscaping on the north side of Tierra Rejada Road east and west of Southhampton
Road. The obligation upon the lots within this tract is pursuant to a condition of
development.
3. Tract No. 3032: Maintenance costs associated with landscaping an entry monument
at Buttercreek Road and Los Angeles Avenue. This cost to be spread to the 265 lots
within the tract.
4. Tract No. 3274: Maintenance costs associated with landscape areas along Williams
Ranch Road parkway adjacent to Peach Hill drain channel and Edison entries within
PC -3. This cost will be borne by the 129 lots within the tract.
5. Tract Nos. 3019 & 3525: Maintenance costs associated with debris basins and
landscaping the Tierra Rejada Road slope and parkway areas and parkway on the
west side of Peach Hill Road between Williams Ranch and Tierra Rejada Roads
within Tract Nos. 3019 and 3525. The cost is to be spread to the 217 lots within the
tracts.
6. Tract 3306: Cost for maintenance of landscape areas within Tract 3306 at the
westerly terminus of Inglewood Street. The cost is to be spread to the 22 lots within
the tract.

7. Los Angeles Avenue Parkway: Maintenance costs associated with landscaping the
parkway on the north side of Los Angeles Avenue between Gabbert Road and Shasta
Avenue will be borne by all industrial lots northerly of Los Angeles Avenue,
southerly of Poindexter Avenue, easterly of Gabbert Road, and westerly of Shasta
Avenue.
8. Home Acres Buffer Area: Maintenance costs associated with the buffer area at the
west end of the West Ranch area, is to be split 50 -50 between the residential
properties within the West ranch area and the area outside the City known as Home
Acres. That portion of this Zone of Benefit with the City consists of the residential
areas within Tract 4340, 4341, 4792 and a portion of tract 4342. This area is
bounded on the north by the Arroyo Simi, on the east by Tierra Rejada Road and the
Commercial property at the corner of Tierra Rejada Road and Mountain Trail Street,
on the south by Tracts 4637, 4342 -5 and the City boundary and on the west by the
City Boundary.
9. Condor Drive Industrial Park: Maintenance costs associated with the parkway
located at the northwest corner of Los Angeles Avenue and Virginia Colony Place
will be borne by the developed parcels within the Industrial park on Condor Drive
(Tract 3492).
10. PC -3: Maintenance costs associated with landscaping and debris basins within this
area will be borne by all properties within the Mountain Meadows Planned
Community (PC -3). The landscaping to be maintained consists of the Peach Hill
Wash Linear Park, the slope along the north side of the Peach Hill Wash and the
downstream flood control facility located just east of Mountain Trail Street and
certain parkways on Tierra Rejada Road.
11. Tract 4174: Maintenance costs associated with landscaping within this area will be
borne by all properties within the tract.
12. Carlsberg Specific Plan: Maintenance costs associated with certain landscape
improvements as described in the Boundary Map for Zone 12 included in Appendix
"E ". The cost for the maintenance of these improvements will be borne by all of the
properties within Zone 12 as defined in said Boundary Maps and generally described
as that area bounded by the Route 23 freeway, Tierra Rejada Road, Spring Road, the
Arroyo Simi and New Los Angeles Avenue.
Due to the manner in which water and electrical meters were constructed, the
utilities (water and electrical) for certain improvements maintained by the Zone
12 assessment are provided by the Property Owners Association / Homeowners
Association (POA/HOA) for the adjacent property. Also, the utilities for certain
other improvements maintained by one or more POA/HOA are provided by the
Zone 12 assessment. A diagram illustrating this reciprocal arrangement is set
forth in Appendix E (Boundary Maps) on Page 7.1.

Plans and specifications for the irrigation, landscaping and lighting of streets, parks and easements,
and other authorized improvements within the City are on file in the Department of Public Works.
The lighting locations and specifications for Edison -owned lights are on file with the Southern
California Edison Company. Reference is hereby made to said plans and specifications for the exact
location and nature of the landscape and lighting improvements. Said plans and specifications by
reference are hereby made a part of this report.
SECTION 5 ASSESSMENT ROLL
All parcels of real property affected are listed on the "Assessment Roll ", Exhibit "A," which will be
on file in City Hall with the City Clerk, and is made a part hereof by reference. These parcels are
more particularly described in maps prepared in accordance with Section 327 of the Revenue and
Taxation Code which are on file in the office of the Ventura County Assessor in the County
Government Center Administration Building, 800 S. Victoria Avenue, Ventura, California and
which are also made a part hereof by reference.
SECTION 6 COST ESTIMATE
The City staff recommendation for the District budget is shown in Appendix 'D" of this report.
The costs attributed to landscaping and the costs attributed to lighting will be separately appointed,
according to the formula, and added together to constitute the total assessment for each parcel.
CONCLUSION
In conclusion, it is our opinion that the assessments within Lighting Maintenance Assessment
District No. AD -84 -2 are apportioned by a formula that fairly distributes the net cost in accordance
with the benefits that are received. The assessment rates and methodology remain the same for the
past several years.

Notes:
1. In addition to the landscape charge on the previous table, 75 lots within Tract No. 2851 are
assessed an additional landscape maintenance assessment for a portion of the Ventura
County Flood Control Easement immediately north of Campus Park Dive, as well as portions
of the parkway landscaping at the entrance to and within the interior of Tract 2851. The
additional per lot assessment is $129.37. The obligation upon these lots is pursuant to a
condition of development.
2. In addition to the landscape charge on the previous table, 622 lots within Tract 2865 are
assessed an additional landscape maintenance assessment for the maintenance of specific
landscape areas and debris basins within the tract. The landscaped areas include certain
parkways, the Tierra Rejada Road slope and streetscape areas, and the monument sign within
the tract. Also, an additional $10 assessment will be levied upon each lot to fund the future
construction of parkway landscape improvements on the north side of Tierra Rejada Road
east and west of Southhampton Road. The additional per lot assessment is $116.47. Forty-
eight (48) lots are assessed an additional $29.17 per lot for the maintenance of the debris
basins. The obligation upon these lots is pursuant to a condition of development.
3. In addition to the landscape charge on the previous table, 265 lots within Tract No. 3032 are
assessed an additional landscape maintenance assessment for the maintenance of an entry
monument at Butter Creek Road and Los Angeles Avenue and landscaping on the south side
of Pepper Mill Street. The additional per lot assessment is $11.62.
4. In addition to the landscape charge on the previous table, 129 lots within Tract No. 3274 are
assessed an additional landscape maintenance assessment for the maintenance of the
landscaped barrier in Williams Ranch Road at the Edison power lines, and the parkway
landscaping on both sides of Williams Ranch Road east and west of the Edison Easement.
The additional per lot assessment is $49.48. The obligation upon these lots is pursuant to a
condition of development.
5. In addition to the landscape charge on the previous table, 217 lots within Tract Nos. 3019
and 3525 are assessed an additional landscape maintenance assessment for the maintenance
of the Tierra Rejada Road slope and parkways, including the entry statements at Pheasant
Run Street, and the parkway on the west side of Peach Hill Road between Williams Ranch
and Tierra Rejada Roads. The additional per lot assessment is $107.56. Seventy -five (75)
lots are assessed fef an additional $6.67 per lot for the maintenance of debris basins. The
obligation upon these lots is pursuant to a condition of development.
6. In addition to the landscape charge on the previous table, 22 lots within Tract No. 3306 are
assessed an additional landscape maintenance assessment for the maintenance of landscape
area at the westerly terminus of Inglewood Street. The additional per lot assessment is
$42.00. The obligation upon these lots is pursuant to a condition of development. -

7. In addition to the landscape charge on the previous table, 90+ AC northerly of Los Angeles
Avenue, southerly of Poindexter Avenue, and between Gabbert and Shasta Avenues are
assessed an additional landscape maintenance assessment for the maintenance of the parkway
on the north side of Los Angeles Avenue Parkway. The additional assessment amount is
$123.15 per acre.
8. In addition to the landscape charge on the previous table, 492 residential units within Tracts
4340, 4341, 4792 and a portion of Tract 4342 are assessed an additional $15.40 for fifty
percent (50 %) of the maintenance costs for the Home Acres Buffer area. The remaining fifty
percent (50 %) of such costs are recovered via an assessment upon 201 lots in the Home
Acres area, in the amount of $37.69 per lot. This is the total amount of the assessment on the
lots within Home Acres. Said lots are not assessed for Citywide lighting or landscaping.
9. In addition to the landscape charge on the previous table, 49± AC within the Industrial Park
on Condor Drive are assessed an additional landscape maintenance assessment for the
maintenance of the parkway located at the southwest corner of Los Angeles Avenue and
Virginia Colony Place. The additional assessment amount is $27.43 per acre.
10. In addition to the landscape charge on the previous table, 2448 residential lots and one
commercial property within the Mountain Meadows Planned Community (PC -3) are
assessed an additional landscape maintenance assessment for the maintenance of the
landscaping within the Peach Hill Wash Linear Park, the slope along the north side of the
Peach Hill Wash and the downstream flood control facility located just east of Mountain
Trail Street and within certain parkways along Tierra Rejada Road. The additional per lot
assessment for residential properties is $76.55, and the assessment upon the commercial
property at the southwest corner of Mountain Trail Street and Tierra Rejada Road is $615.71
per acre [118.81 ac x 8EDU /ac. = 95 EDU >> x $76.55/EDU = $7,272.25 / 11.81 ac =
$615.71]. Six hundred and sixty -nine (669) lots are assessed an additional $10.84 per lot for
the maintenance of debris basins. The obligation upon these lots is pursuant to a condition of
development.
11. In addition to the landscape charge on the previous table, 9 lots within Tract No. 4174 are
assessed an additional landscape maintenance assessment for the maintenance of parkway
landscaping within the tract. The additional per lot assessment is $337.78.
12. In addition to the above landscape charges, all of the properties within the Carlsberg Specific
Plan are assessed an additional amount for the maintenance of certain parkways, medians and
slope areas, as described in the Boundary Maps set forth in Appendix "E ". The total
assessment amount is allocated to ultimate land use categories in accordance with the chart
set forth in Section 4 of this report. Based upon that allocation chart, the total assessment
amount cited in Appendix 'D' of this report is spread to all of the properties within Zone 12.
The amount of the assessment for each land use category is as follows:
Commercial / Industrial: 98.79 AC $ 139.84 /Acre

$123.15 per acre.

4340, 4341, 4792 and a portion of Tract 4342 are assessed an additional $15.40 for fifty
percent (50 %) of the maintenance costs for the Home Acres Buffer area. The remaining fifty

Virginia Colony Place. The additional assessment amount is $27.43 per acre.
10. In addition to the landscape charge on the previous table, 2448 residential lots and one
commercial property within the Mountain Meadows Planned Community (PC -3) are
assessed an additional landscape maintenance assessment for the maintenance of the
landscaping within the Peach Hill Wash Linear Park, the slope along the north side of the
Peach Hill Wash and the downstream flood control facility located just east of Mountain
Trail Street and within certain parkways along Tierra Rejada Road. The additional per lot
assessment for residential properties is $76.55, and the assessment upon the commercial
property at the southwest corner of Mountain Trail Street and Tierra Rejada Road is $615.71
per acre [118.81 ac x 8EDU /ac. = 95 EDU >> x $76.55/EDU = $7,272.25 / 11.81 ac =
$615.71]. Six hundred and sixty -nine (669) lots are assessed an additional $10.84 per lot for
the maintenance of debris basins. The obligation upon these lots is pursuant to a condition of
development.
11. In addition to the landscape charge on the previous table, 9 lots within Tract No. 4174 are
assessed an additional landscape maintenance assessment for the maintenance of parkway
landscaping within the tract. The additional per lot assessment is $337.78.
12. In addition to the above landscape charges, all of the properties within the Carlsberg Specific
Plan are assessed an additional amount for the maintenance of certain parkways, medians and
slope areas, as described in the Boundary Maps set forth in Appendix "E ". The total
assessment amount is allocated to ultimate land use categories in accordance with the chart
set forth in Section 4 of this report. Based upon that allocation chart, the total assessment
amount cited in Appendix 'D' of this report is spread to all of the properties within Zone 12.
Derivation of the assessment amounts for Zone 12 are shown in Appendix 'H' and
summarized as follows:

ENDING JUNE 30, 2001, AND ORDERING THE
PREPARATION AND FILING OF A REPORT RELATING
THERETO.
WHEREAS, pursuant to the provisions of the "Landscaping an
Lighting Act of 1972" being Division 15, Part 2 of the p Streets
and Highways Code of the State of California, the City Council of
the City of Moorpark, by its Resolution No. 84 -88, adopted May 16,
1984, ordered the formation of the "Moorpark Lighting Maintenance
Assessment District No. AD -84 -2
assessments a ; confirmed and levied the
Jul 1 pproved thereunder for the fiscal year commencing
y , 1984, and ending June 30, 1985; and has confirmed and
levied assessments approved thereunder for each subsequent fiscal
year; and,
WHEREAS, the City Council of the City of Moorpark proposes to
extend the improvements specified in said district for the fiscal July 1, 2000, toathe commencing

WHEREAS, the City Council proposes to assume the maintenance
Of improvements recently installed within Zone 12, said Zone
having been created in 1997 and encompassing the properties withi

WHEREAS, the City Council also proposes to increase the
assessment amounts for the parcels within Zone 12 to fund the cost
of said maintenance.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES
HEREBY RESOLVE AS FOLLOWS:
SECTION 1: Pursuant to Section 22585

connection therewith.
SECTION 2: The assessments proposed to be levied and
collected shall be used for furnishing electric current or energy,
or other illuminating agent for street lights, for the usual
maintenance and operation of said street lights, for the
maintenance of parkway and median landscaping and for other
improvements as specified in Section 1 hereinabove.
SECTION 3: To ensure that the costs and expenses of
maintaining, operating and servicing the street and traffic safety
lighting, and the improvements as specified hereinabove, are borne
by the owners of the property to be benefited thereby, this
Council resolves that the proposed landscape maintenance
assessment district consist of all property within the City.
SECTION 4: The distinctive designation for the assessment
district to be continued pursuant to this resolution shall be
"Moorpark Lighting and Landscaping Maintenance Assessment District
No. AD- 84 -2."
SECTION 5: The City Manager is directed to cause to be
prepared an Engineer's Report, in accordance with Article 4,
Chapter 1, Part 2, Division 15 "of said Streets and Highways Code;
and that upon completion, the report shall be filed with the City
Clerk, who shall then submit the same to the City Council for its
consideration, pursuant to Section 22586 of said Streets and
Highways Code.
SECTION 6: The City Clerk shall certify to the adoption of
this resolution and shall cause a certified resolution to be filed
in the book of original resolutions.

NO. 84 -2" FOR THE YEAR 2000 -2001,
PRELIMINARILY APPROVING THE ENGINEER'S REPORT
FOR ZONE 12 AND PROVIDING FOR NOTICE OF A
PUBLIC HEARING TO CONSIDER SAID REPORT AND
PROPOSED ASSESSMENTS
WHEREAS, by Resolution No. 2000 -1688, the City Council
ordered the preparation of an Engineer's Report for "Moorpark
Lighting and Landscaping Assessment District 84 -2" for Fiscal Year
2000 -2001, in accordance with Section 22500 et. seq. of the
Streets and Highways Code; and
WHEREAS, said Resolution stated the intent of the City
Council to make certain changes to the amount of the assessment
for Zone 12 of said District, said increases to be made in
accordance with the requirements of Article XIII -D of the
California Constitution (Proposition 218); and
WHEREAS, an .excerpt from the Engineer's Report pertaining to
Zone 12, was filed with the City Clerk on the 25 h day of February,
2000; and
WHEREAS, the City Council has reviewed said Engineer's Report
excerpt and wishes to take certain actions relative to said report
and to the levy of the assessments for Zone 12 recommend therein.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES

Moorpark, California 93021 on Wednesday, May 3, 2000, at 6:30 p.m.
for the purpose of the City Council's determination whether the
public interest, convenience and necessity require the
improvements and the Zone 12 assessments required to fund the
maintenance of said improvements.
SECTION 8. The City Clerk is hereby authorized and directed
to cause Notice of the 'hearing ordered under Section 7 hereof to
be given in accordance with law by mailing, postage prepaid, in
the United States mail, and such Notice shall be deemed to have
been given when so deposited in the mail. The mailed Notice shall
be given to all property owners within the Zone 12 of the
District by such mailing by name to those persons whose names and
addresses appear on the last equalized secured property tax
assessment roll of the County of Ventura. The Notice shall
include, but not be limited to, the total amount of the Zone 12
assessment proposed to be levied for fiscal year 2000 -2001, the
assessment proposed for the owner's particular parcel(s) and the
duration thereof, the reason for the assessment and the basis
upon which the amount of the assessment was calculated. Each
Notice shall also contain an assessment ballot, a summary of the
procedures applicable to the completion, return and tabulation of
assessment ballots, and a statement that the existence of a
majority protest will result in�the assessment not being imposed.

The Notice herein provided shall be mailed not less than forty -
five (45) days before the date of the public hearing.
SECTION 9. The City Clerk shall certify to the adoption of
this resolution and shall cause a certified resolution to be filed
in the book of original resolutions.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF MOORPARK, CALIFORNIA, APPROVING THE
ENGINEER'S REPORT FOR, AND DECLARING ITS
INTENTION TO MAKE CERTAIN CHANGES AND TO
ORDER THE ANNUAL ASSESSMENTS FOR THE
MOORPARK LIGHTING AND LANDSCAPING
MAINTENANCE DISTRICT NO. AD -84 -2" FOR THE
FISCAL YEAR COMMENCING JULY 1, 2000, AND
ENDING JUNE 30, 2001, PURSUANT TO THE
LANDSCAPING AND LIGHTING ACT OF 1972, AND
FIXING THE TIME AND PLACE FOR- A PUBLIC
HEARING TO RECEIVE OBJECTIONS THERETO
WHEREAS, by Resolution No. 2000 -1688, the City Council
ordered the City Manager to cause to be prepared an Engineer's
Report for Assessment District 84 -2 for FY 2000/2001, in
accordance with Article 4, Chapter 1, Part 2, Division 15 of the
California Streets and Highways Code; and
WHEREAS, by Resolution No. 2000 -1711, the City Council
approved an Excerpt from said Engineer's Report pertaining to Zone
12; and set May 3, 2000, as the date of a public hearing to
consider an increase to the Zone 12 assessment; and
WHEREAS, pursuant to the requirements of Resolution No.
2000 -1688, the completed draft Engineer's Report; including the
above mentioned Excerpt for Zone 12, was filed with the City Clerk
on 'the 24th day of March, 2000; and
WHEREAS, the City Council has reviewed said Engineer's
Report and wishes to take certain actions relative to said report
and to the levy of the assessments recommended therein.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK
DOES RESOLVE AS FOLLOWS:
SECTION 1. The Engineer's Report for "MOORPARK LIGHTING AND
LANDSCAPING MAINTENANCE ASSESSMENT DISTRICT NO. AD -84 -2" for the
fiscal year commencing July 1, 2000, and ending June 30, 2001,
filed with the City Clerk on the 24th day of March 2000, is hereby
approved.
SECTION 2. That said Engineer's Report includes certain
information pertaining to a proposed increase to the amount of the
assessments for Zone 12, said assessment increase being contingent
upon approval via mail ballots to be received by the City on May
3, 2000.

SECTION 4. That, except as noted in Sections 2 of this
Resolution, the assessment amounts proposed for FY 2000 /2001 have
not changed from the assessments levied in FY 1999/2000.
SECTION 5. That the public interest and convenience require
and it is the intention of the City Council of the City of
Moorpark to make certain changes, to the "MOORPARK LIGHTING AND
LANDSCAPING MAINTENANCE ASSESSMENT DISTRICT NO. AD -84 -2" and to
order the extension of the annual assessments for said district
for the fiscal year commencing July 1, 2000, and ending June 30,
2001, pursuant to the Landscaping and Lighting Act of 1972, and to
levy and collect assessments for certain improvements as described
herein, in accordance with said Act. Said "MOORPARK LIGHTING AND
LANDSCAPING MAINTENANCE ASSESSMENT DISTRICT NO. AD -84 -2" consists
of a single city -wide zone to provide electric current or energy
for public lighting within the City, to install, construct or
maintain any authorized improvements under the Act, including but
not limited to'-one or more of street lights, public lighting
facilities, landscaping, statuary, fountains, and other ornamental
structures and facilities, and any facilities which are
appurtenant to any of the aforementioned or which are necessary or
convenient for the maintenance or servicing thereof, including
irrigation, electric current and energy; and to provide incidental
expenses in connection therewith. Said district also includes
assessments for the improvement and maintenance of the above
described landscaping and related improvements in a number of
zones of benefit.
SECTION 6. That said lighting and landscape maintenance
assessment district shall specifically include the lighting and
landscape sites with all improvements located therein, described
by and heretofore included within "MOORPARK LIGHTING AND
LANDSCAPING MAINTENANCE ASSESSMENT DISTRICT NO. AD- 84 -2."
SECTION 7. That "the foregoing described work is to be located
within said Assessment District, the boundaries of which are more
particularly described on maps included in the aforesaid
Engineer's Report and entitled "Boundary Map, City of Moorpark
Lighting and Landscaping Maintenance Assessment District No. AD-
84 -211, said report and maps being on file in the office of the
City Clerk as of the 24th of March 2000.

SECTION 8. That the proposed maintenance and improvement, in
the opinion of the City Council, is of benefit to, and the City
Council hereby makes the expense of said maintenance and
improvements chargeable upon the district.
SECTION 9. That a full and detailed description of the
improvements, the boundaries of the Assessment District and any
zones, therein, and the proposed assessments upon assessable lots
and parcels of land within said District, is set forth in a copy
of the aforementioned Engineer's Report, a copy of which is on
file with the City Clerk and open to inspection.
SECTION 10. That the proposed assessment amounts are set
forth in Exhibit 'A' attached hereto and made apart hereof.
SECTION 11. That a public hearing of the Moorpark City
Council shall be convened on the 7th day of June 2000, at the hour
of 6:30 p.m., in the Council Chambers of the City Hall of said
City, located at 799 Moorpark Avenue, Moorpark, for the purpose of
receiving oral and written testimony regarding the proposed
assessments for FY 2000/2001.
SECTION 12. That Notice of said pubic hearing is hereby
given. All-persons having any objections to the work or extent of
the assessment district may appear and show cause why said work
should not be done or carried out or why said district should not
be extended for the fiscal year commencing July 1, 2000, and
ending June 30, 2001. . Protests must be in writing,
filed by the property owner with the City Clerk prior to must
conclusion, of the public hearing and such protest shall state all
grounds of the objection and shall contain a description
sufficient to identify the property. A majority protest will cause
the assessment increase to be abandoned.
SECTION 13. All the work herein proposed shall be done in
accordance with the Landscaping and Lighting Act of 1972, being
Part 2 of Division 15 of the Streets and Highways Code of the
State of California.
SECTION 14. The City Clerk shall cause a Notice of Public
Hearing to be given by causing a summary of this Resolution to be
published in the manner required by Part 2 of Division,15 of the
Streets and Highways Code and Section 54954.6 of the Government
Code of the State of California.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK/ CALIFORNIA, CERTIFYING THE TABULATION OF
MAIL BALLOTS RECEIVED PERTAINING TO THE PROPOSED
INCREASE TO THE ASSESSMENTS FOR ZONE 12 OF
ASSESSMENT DISTRICT 84 -2 FOR FISCAL YEAR 2000 -2001
WHEREAS, by Resolution No'. 2000 -1688, adopted on January S,
2000, the City Council ordered the preparation of an Engineer's
Report for "Moorpark Lighting and Landscaping Assessment District
84 -2" [herein DISTRICT] for Fiscal Year 2000 -2001, in accordance
with Section 22500 et. seq. of the Streets and Highways Code; and
WHEREAS, said Resolution stated the intent of the City
Council to make certain changes to the amount of the assessment
for Zone 12 of the DISTRICT, said increases to be made in
accordance with the requirements of Article XIII -D of the
California Constitution (Proposition 218); and
WHEREAS, by Resolution No. 2000- 1711, adopted on March 1,
2000, the City Council approved an excerpt from the Engineer's
Report for the DISTRICT for FY 2000/2001, identifying certain
improvements to be added to Zone -12 of the DISTRICT and
determining the amount of the increase to the Zone 12 assessments
required to maintain those improvements; and
WHEREAS, by Resolution No. 2000 -1721, adopted on April 5,
2000, the City Council approved the entire Engineer's Report for
the DISTRICT for Fiscal Year 2000/2001, which included the
aforementioned excerpt for Zone 12, said report being on file with
the City Clerk; and
WHEREAS, the aforesaid Resolution No. 2000 -1711 (adopted
March 1, 2000) set May 3, 2000, at 6:30 p.m. as the date and time
of a public hearing to consider the proposed added improvements
and increased assessments for Zone 12; and
WHEREAS, said Resolution No. 2000 -1711 further directed that
a Public Hearing Notice, giving notice of said hearing, be mailed
to the owner of each property affected by the proposed assessment
increase, as listed in the last equalized secured property tax
assessment roll of the County of Ventura; and,
WHEREAS, said Resolution further directed that said Public
Hearing Notice define and describe the improvements proposed to be
added to Zone 12, the total assessment proposed for Zone 12, the
amount of the assessment for the parcel owned by the addressee of
the Hearing Notice, the duration of the assessment, the reason for
the assessment, and the basis upon which the amount of the
assessment was calculated; and,

WHEREAS, said Resolution further directed that an assessment
ballot be provided with the Public Hearing Notice to be mailed to
the owner of each affected property, along with a summary of the
procedures for marking and returning the ballot to the City to
indicate support or opposition to the proposed assessment
increase; and;
WHEREAS, said summary of the balloting procedures also
described the minimum requirements for the approval of the
assessment increase and advised that a majority protest would
result in the assessment not being imposed; and
WHEREAS, said Public Hearing Notices, assessment information
and ballots were mailed to the owners of all of the affected .
properties at least forty -five (45) days prior to the date of the'
hearing; and
WHEREAS, said Notice and mail ballots were provided to the
owners of the affected properties in accordance with the
requirements of Article XIII -D of the California Constitution; and
WHEREAS, on May 3, 2000, at the hour of 6:30 p.m. at the City
of Moorpark, City Council Chambers, 799 Moorpark Avenue, Moorpark,
California, 93021, the public hearing was duly and regularly held
as noticed, and all persons interested and desiring to be heard
were given an opportunity to speak and be heard, and all matters
and things pertaining to the levy were fully heard and considered
by this City Council, and all oral statements and all written
protests or communications were duly considered; and
WHEREAS, at the public hearing the Council tabulated the mail
ballots and found that a majority protest as defined by Article
XIII -D of the California Constitution did not exist, and this
Council thereby acquired jurisdiction to order the levy and the
confirmation of the diagram and assessment for Zone 12 of the
DISTRICT, prepared by and made a part of the Engineers Report, to
pay costs and expenses thereof.
NOW, THEREFORE,_THE CITY COUNCIL OF THE CITY OF MOORPARK DOES
HEREBY RESOLVE AS FOLLOWS:
SECTION 1. A majority protest does not exist. The assessment
ballots submitted, and not withdrawn, in opposition to the
proposed assessment do not exceed the assessment ballots
submitted, and not withdrawn, in favor, weighting those assessment
ballots by the amount of the proposed assessment to be imposed
upon the identified parcels for which each assessment ballot was
submitted.

The following is a list of the recommended changes to be made to
the Engineer's Report approved by City Council Resolution No. 2000-
1721, adopted on April 5, 2000.
1. Page 8:A second paragraph is hereby added to #12. Carlsberg
Specific Plan, describing the manner in which utility
costs will be funded for certain of the improvements
with Zone 12, to read as follows:
Due to the manner in which water and electrical meters were constructed,
the utilities (water and electrical) for certain improvements maintained by the
Zone 12 assessment are provided by the Property Owners Association /
Homeowners Association (POA/HOA) for the adjacent property. Also, the
utilities for certain other improvements maintained by one or more
POA/HOA are provided by the Zone 12 assessment. A diagram illustrating
this reciprocal arrangement is set forth in Appendix E (Boundary Maps) on
Page 7.1."
2. Appendix 'E' - Boundary Map [Zone 12 maps] : All of the maps
describing the Zone 12 improvements are hereby deleted and
replaced with new maps more accurately depicting the
improvements to be maintained. The net area of the improvements
to be maintained described in the new maps is equal to or less
than the area of the improvements as described in the deleted
maps.
3. Appendix 'E' - Boundary Maps [Zone 12, Page 7 1]: The maps for
Zone 12 are hereby amended by adding Page 7.1 showing the
reciprocal arrangement for the utility costs for certain
improvements maintained by Zone 12 and by adjacent property
owners.

NOTICE OF A PUBLIC HEARING
PUBLIC NOTICE IS HEREBY GIVEN that the City Council of the
City of Moorpark, California, on April 5, 2000, adopted
Resolution No. 2000 -1721 fixing the date and time of a
public hearing of the Moorpark City Council to be held on
the 7th day of June, 2000, at the hour of 6:30 p.m. in the
Council Chambers of the Moorpark City Hall, located at 799
Moorpark Avenue, Moorpark. The purpose of said public
hearing is to consider making certain changes to, and to
order the annual assessments for the "MOORPARK LIGHTING AND
LANDSCAPE MAINTENANCE ASSESSMENT DISTRICT NO. AD -84 -2" for
the fiscal year commencing on July 1, 2000, and ending on
June 30, 2001, which would provide for the furnishing of
power for and the usual maintenance and servicing of street
lights and the landscape maintenance of public rights -of-
way within the said City.
A copy of Resolution No. 2000 -1721, which is captioned as
follows: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA, APPROVING THE ENGINEER'S REPORT FOR,
AND DECLARING ITS INTENTION TO MAKE CERTAIN CHANGES AND TO
ORDER THE ANNUAL ASSESSMENTS FOR THE "MOORPARK LIGHTING AND
LANDSCAPING MAINTENANCE ASSESSMENT DISTRICT NO. AD -84 -2"
FOR THE FISCAL YEAR COMMENCING JULY 1, 2000, AND ENDING
JUNE 30, 2001, PURSUANT TO THE LANDSCAPING AND LIGHTING ACT
OF 1972, AND FIXING THE TIME AND PLACE FOR A PUBLIC HEARING
TO RECEIVE OBJECTIONS THERETO," is on file with the City
Clerk and open to inspection. A summary of said Resolution
is summarized as follows:
1. That the Engineer's Report prepared for Assessment
District No. AD84 -2 for FY 2000/2001 is approved.
2. That said Engineer's Report includes information
pertaining to a proposed increase to the assessment
amounts for Zone 12, which is the area generally
bounded by New Los Angeles Avenue, the Route 23
freeway, Tierra Rejada Road and Spring Road.
3. That said Engineer's Report may be further modified or
changed, pursuant to applicable State law.

4. That except as noted in Section 3, the assessment
amounts for FY 2000/2001 have not changed from the
assessments levied in FY 1999/2000.
5. That it is the intention of the City Council a) to
make certain changes to Assessment District No. AD 84-
2; b) to order the extension of the annual assessment
for said district for FY 2000/2001; and, c) to levy
and collect assessments for certain improvements
described herein. Said district consists of a single
city -wide zone to provide electric current or energy
for public lighting within the City, to install,
construct or maintain any authorized improvements
under the Act, including but not limited to one or
more of street lights, public lighting facilities,
landscaping, statuary, fountains, and other ornamental
structures and facilities, and any facilities which
are appurtenant to any of the aforementioned or which
are necessary or convenient for the maintenance or
servicing thereof, including irrigation, electric
current and energy; and to provide incidental expenses
in connection therewith. Said district also includes
assessments for the improvement and maintenance of the
above described landscaping and related improvements
in a number of zones of benefit.
6. That said lighting and landscaping maintenance
assessment district includes the lighting and
landscaping sites with all improvements located
therein, described by and included within Assessment
District No. AD 84 -2.
7. That the foregoing described work is to be located
within Assessment District No. AD 84 -2, the boundary
of which is described on a map on file in the City
Clerk's office.
8. That said proposed maintenance and improvement is of
benefit to, and expense for which are chargeable upon,
the district.
9. That a full and detailed description of the
improvements, the boundaries of the District and any
zones therein, and the proposed assessments upon
assessable parcels within said District, is set forth

file with the City Clerk and open to inspection.
10. That the existing assessments, the proposed
assessments and the proposed increases to the
assessment amounts are set forth in Exhibit 'A'
attached hereto and made a part hereof.

that any persons having any objections to the work or
extent of the assessment district may appear and show
cause why said work should not be done or carried out
or why said district should not be extended for the
fiscal year commencing July 1, 2000, and ending June
30, 2001. Protests must be in writing and must be
filed by the property owner with the City Clerk prior
to the conclusion of the hearing. Protests may be
mailed to the City Clerk, City of Moorpark, 799
Moorpark Avenue, Moorpark, CA 93021. Protest shall
state all grounds for the objection and shall contain
a description sufficient to identify the property
being assessed. A majority protest will cause the
assessment increase to be abandoned. For additional

13. That all the work proposed shall be done in accordance
with the Landscaping and Lighting Act of 1972, being
Part 2 of Division 15 of the Streets and Highways Code
of the State of California.

hearing to be given by causing this summary of the
Resolution of Intention to be published in the manner
required by Part 2 of Division 15 of the Streets and
Highways Code and Section 54954.6 of the Government
Code of the State of California.

RESOLUTION NO. 2000-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF MOORPARK, CALIFORNIA, MAKING CERTAIN
CHANGES TO THE "MOORPARK LIGHTING AND
LANDSCAPING MAINTENANCE DISTRICT NO. AD -84 -2"
AND CONFIRMING THE ASSESSMENT FOR SAID
DISTRICT THE FISCAL YEAR COMMENCING JULY 1,
2000 AND ENDING JUNE 30, 2001.
WHEREAS, the City Council of the City of Moorpark, by
Resolution No. 2000 -1688, adopted January 5, 2000, declared its
intention to make certain changes to the "MOORPARK LIGHTING AND
LANDSCAPING MAINTENANCE DISTRICT NO. AD- 84 -211, and to order the
extension of the annual assessments for said district for the
fiscal year commencing July 1, 2000 and ending June 30, 2001; and
WHEREAS, said Resolution No. 2000 -1688 ordered the City
Manager to cause to be prepared an Engineer's Report for
Assessment District 84 -2 for FY 2000/01 in accordance with Article
4, Chapter 1, Part 2, Division 15 of the California Streets and
Highways Code; and
WHEREAS, said "MOORPARK LIGHTING AND LANDSCAPING MAINTENANCE
DISTRICT NO. AD -84 -2" consists of a single city -wide zone to
provide electric current or energy for public lighting within the
City, to install, construct or maintain any authorized
improvements under the Act, including but not limited to one or
more of street lights, public lighting facilities, landscaping,
statuary, fountains, and other ornamental structures and
facilities, and any facilities which are appurtenant to any of the
aforementioned or which are necessary or convenient for the
maintenance or servicing thereof, including irrigation, electric
current and energy; and to provide incidental expenses in
connection therewith; and
WHEREAS, said "MOORPARK LIGHTING AND LANDSCAPING MAINTENANCE
ASSESSMENT DISTRICT NO. AD -84 -2" also consists of a number of
specific zones in order to provide for the assessment of the
properties within said zones for the cost of maintaining certain
specified improvements which benefit said properties; and
WHEREAS, pursuant to the terms of a Joint Powers Agreement
(JPA) between the City of Moorpark and the County of Ventura, the
City Council of the City of Moorpark, by Resolution No. 92 - 860
adopted on June 29, 1992, annexed certain unincorporated area just
west of the City known as Home Acres, to the "MOORPARK LIGHTING
AND LANDSCAPING MAINTENANCE ASSESSMENT DISTRICT NO. AD -84 -2" in
order to implement those provisions of the JPA pertaining to the
construction and maintenance of a buffer area between said
unincorporated area and the West Ranch area of PC -3 (Tracts 4340,
4341 and 4342); and

WHEREAS, in accordance with the provisions of the aforesaid
JPA, it has been determined that said buffer area provides benefit
to both the aforesaid Home Acres area and the West Ranch area of
PC -3, and a Zone of Benefit encompassing said areas was
established to allow for the levy of assessments on the properties
within said Zone of Benefit for the purpose of developing and
maintaining said buffer area; and
WHEREAS, the aforesaid Resolution No. 2000 -1688 [1/5/00] also
stated the intent of the City Council to make certain changes to
the amount of the assessment for Zone 12 of the District, said
increases to be made in accordance with the requirements of
Article XIII -D of the California Constitution (Proposition 218);
and
WHEREAS, by Resolution No. 2000 -1711, adopted on March 1,
2000, the City Council set May 3, 2000, at 6:30 p.m. as the date
and time of a public hearing to consider the proposed added
improvements and increased assessments for Zone 12 and directed
that Mail Ballots and Public Notices on the matter be mailed to
the owners of all properties affected by said assessment increase;
and
WHEREAS, said May 3rd public hearing was convened and the
results of the Zone 12 Mail Ballots were tabulated; and
WHEREAS, finding that a majority protest did not exist, the
City Council adopted Resolution No. 2000 - 1734, on May 3, 2000,
confirming the results of the Mail Ballots supporting the proposed
increase to the Zone 12 assessments and directing that said
assessment amounts be included in the final Engineer's Report for
Assessment District 84 -2 for FY 2000/2001; and
WHEREAS, the City Council, by Resolution No. 2000 -1721,
adopted April 5, 2000, approved the Engineer's Report for the
District and set 6:30 p.m., June 7, 2000, as the time and date of
a public hearing to consider the levy of all of the assessments
for AD84 -2 for FY 2000/2001 ; and
WHEREAS, except for the above described increase to the Zone
12 assessments, the assessment amounts proposed for FY 2000/2001
have not changed from the assessments levied in FY 1999/00; and
WHEREAS, subsequent to the adoption of Resolution 2000 -1721
[4/5/00] approving the Engineer's Report, the City Council has
approved a number of changes to the Engineer's Report as deemed
necessary and appropriate; and

WHEREAS, on June 7, 2000, the City Council held a public
hearing to determine whether said changes to said district should
be made, and whether the annual assessments should be ordered and
confirmed for the fiscal year commencing July 1, 2000, and ending
June 30, 2001; and
WHEREAS, the City Council finds that written protests against
the proposed work or assessment have not been made by owners
representing more than one -half of the area of land to be
assessed; and
WHEREAS, the City Council, having duly received, considered
evidence, oral and documentary, concerning the jurisdictional
facts in this proceeding and concerning the necessity for the
contemplated work and benefits to be derived therefrom, and the
City Council having now acquired jurisdiction to order the
proposed assessments for the fiscal year commencing July 1, 2000,
and ending June 30, 2001.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK,
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. The Engineer's Report for "MOORPARK LIGHTING AND
LANDSCAPING MAINTENANCE DISTRICT NO. AD- 84 -211, filed with the City
Clerk on March 24, 2000, as amended or revised by action of the
City Council, is hereby approved and adopted, and the
improvements, changes to, and extension of the annual assessments
in the Assessment District, in accordance with said report, as
revised, and in accordance with Resolution No. 2000 -1721 approving
said Engineer's Report, is hereby levied for the Fiscal Year
2000/01.
SECTION 2. The City Clerk shall cause the diagram and
assessment, or a certified copy thereof, to be filed with the
County Auditor.
SECTION 3. The City .Clerk shall certify to the adoption of
this resolution and shall cause a certified resolution to be filed
in the book of original resolutions.
