SUBJECT: Consider Minor Modification No. 3 to Specific Plan No. 92-
1 (Carlsberg Specific Plan) to.Reduce the Length of the
Trail System (Applicant: Lennar Communities of California)
BACKGROUND
The City Council at their meeting of May 5, 1999, considered this
Minor Modification (as initially reviewed, this request was Minor
Modification No. 2) request.to reduce the length of the trail system
for the Carlsberg Specific Plan along with proposed modifications to
the architectural design standards and a proposed additional
monument sign. These requests were continued to the May 19, 1999,
City Council meeting when all of the proposed modifications were
approved except the trail system request. The trail request was
postponed and continued indefinitely because of changes expected in
the layout of Tract 4975, adjacent to the vernal pool located at the
northwest quadrant of Tierra Rejada Road and Highway 23. Because of
this ,indefinite continuance, for clarity purposes the trail
reduction request has been identified as Minor Modification No. 3.
The responsible State and Federal agencies have now completed their
review of the protection plan for the vernal pool and associated
drainage and have issued a permit to Lennar Communities, therefore
the trail system modification may proceed, as a Minor Modification
to Specific Plan No. 92 -1.
DISCUSSION
The proposed modification of the trail system is in response to a
more complete analysis and recognition of the sensitive biological
issues then had been recognized when the trail was initially laid

out. Additionally, the Ventura County Water District became
concerned over possible vandalism and graffiti to their reservoir
site now including two water tanks and requested deletion of the
trail segment proposed for that portion of the site (Attachment 2).
Where feasible the applicant has proposed a substitute trail to the
initial proposed alignment and where a substitute is not possible is
proposing to pay an in -lieu fee to fund future trail development
elsewhere in the community. The substitution of an in -lieu fee for
deletion of trail footage where there is not a legitimate substitute
trail available was discussed by the City Council on May 5, 1999,
and by consensus was viewed as an equitable alternative to actual
trail construction. At that time, staff provided information
concerning cost factors for trail development ranging from $10.00
per lineal foot for a trail utilizing decomposed granite as the base
and no drainage improvements (materials only) to $17.50, per lineal
foot to construct a trail utilizing decomposed granite and including
drainage improvements. The length of trail to be deleted in 1999 was
approximately 4700 lineal feet which is consistent with the current
proposal of 4670 lineal feet (Attachment 3).
Attached to this report is a map of the project site (Carlsberg
Specific Plan) which illustrates the approved trail (Attachment 4),
the trail segments to be deleted and any proposed alternative trail
segments. The trail segments to be deleted are:
Segment A.
This area is east of Miller Park, in the area between Science
Drive and Highway 23, south of the future industrial land use
designation and has steep topography and dense oak and chaparral
growth, including a significant growth of poison oak. This area
contains a natural seep and is utilized by wildlife as a source
of water and a location for cover.
Segment B.
This trail segment would connect Spring Road and the Arroyo Simi
to proposed Miller Park via the canyon separating the Western
Pacific Housing project (Tract 4980) from Mesa Verde Middle
School.
This area includes a Blue Line Stream and natural growth
including cactus and is being revegetated with naturally
occurring plant species. Additionally, there are significant

drainage improvements being constructed in this canyon, which are
not conducive to the provision of a public trail.
Segment C. - (Not noted on the Plan)
This segment involves elimination of that portion of the trail
that was incorporated in the access road to the reservoir site
in response to concern about vandalism and graffiti noted by
Ventura County. Additionally, because the reservoir site is
fenced, viewing or hiking opportunities would involve additional
topographic disturbance, which could impact the drainage area of
the vernal pool.
The overall estimated length of the trail system required by the
approved Carlsberg Specific Plan (Attachment 5 is approximately
10,520 lineal feet as compared to the reduced trail system (includes
substitute trails where feasible) involving the deletion of
approximately 4,670 lineal feet resulting in approximately 5,850
lineal feet of trail. This lineal distance does not include the
trail segments which are proposed to be designated along the
sidewalk of Science Drive (Miller Drive) which is approximately
2,800 lineal feet. Based upon these proposed modifications to the
trail network to reduce the lineal footage of the trail, the
resulting system would incorporate approximately 5,850 lineal feet
of newly developed trail including a trail that will parallel a
portion of the graded road to the reservoir facility. The resulting
lineal distance when subtracted from the original City Council
approved trail system of 10,520 feet results in a reduction to 5,850
feet, a difference of 4,670 feet. Based upon the previous consensus
at the City Council Meeting of May 5, 1999, that an in -lieu fee of
$10.00 per lineal foot for deleted trail was adequate, a total fee
of $46,700.00 is required if the modified trail system is approved.
The in -lieu monies collected from this project will be placed into
an account specifically reserved for the construction of future
trails within the City.
STAFF RECOMMENDATION
1. Adopt City Council Resolution No. 2000 approving Minor

RESOLUTION NO. 2000-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA, APPROVING MINOR
MODIFICATION NO. 3 TO SPECIFIC PLAN NO. 92 -1
(CARLSBERG SPECIFIC PLAN) TO REDUCE THE LENGTH
AND CHANGE THE LOCATION OF THE PROJECT TRAILS ON
THE APPLICATION OF LENNAR COMMUNITIES OF
CALIFORNIA.
WHEREAS, on September 7, 1994, the City Council approved
the Carlsberg Specific Plan (Specific Plan 92 -1) and certified
the Subsequent Environmental Impact Report. On September 21,
1994, modifications to the zoning designation of the property
described in the Carlsberg Specific Plan were approved;
WHEREAS, the City Council adopted Resolution No. 96 -1230
approving Tentative Tract Map Nos. 4975, 4976, 4977 and 4980 on
October 2, 1996; and
WHEREAS, on April 8, 1999, Lennar Homes applied for Minor
Modification No. 2 to the Carlsberg Specific Plan (Specific Plan
92 -1) concerning the architectural theme, design and development
standards, signage and trails; and
WHEREAS, at its meeting on May 5 and 19, 1999, and on June
7, 2000, the City Council discussed Minor Modification No 2 (the
trail reduction request is now identified as Minor Modification
No -. 3 for clarity) and conditionally approved the Minor
Modification to the Carlsberg Specific Plan (Specific Plan 92-
1) .
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. The City Council has determined that
approval of this Minor Modification is consistent with the
purpose and intent of the Carlsberg Specific Plan and is not a
substantial or fundamental change and is categorically exempt
from CEQA requirements as a Class 1 exemption for minor
alterations.
SECTION 2. The City Council approves Minor Modification No.
00 to Specific Plan No. 92 -1 on the application of Lennar
Communities of California for a reduction in the location and
number of linear feet of the approved trails system from

approximately 10,520 to 5,400 lineal feet a reduction of 5,120
feet.
SECTION 3. The following conditions shall be complied
with by the applicant within the time frames as noted.
A. Prior to the recordation of Tentative Map 4975, an in-
lieu fee of $46,700 shall be paid to allow a reduction
in the length of the proposed trail system from 10,520
feet to 5,850 feet.
B. Prior to the issuance of the first Zone Clearance for
the first residential unit to be constructed in Tract
4975, a trails plan including cross section,
alignment, signage and erosion control measures shall
be submitted to and approved by the City Engineer and
Director of Community Development.
C. Prior to the issuance of the first Zone Clearance for
the first residential unit to be constructed in Tract
4975, or prior to acceptance by the City of Miller
Park, whichever occurs last, the entire trail network
shall be installed and completed to the satisfaction
of the City Engineer and Director of Community
Development. The trail segment that will connect the
reservoir access road to Tract 4975 may be fenced
temporarily to block access to developed area until
occupancy of homes on Shawnee Street is approved by
the Director of Community Development.

Dear Wavne;
The following information is provided for your use in
conjunction with the staff report at the continued Trails
Minor Modification hearing scheduled for June 7, 2000.
Ue have received all of the required permits and approvals
from The California Department of Fish and Game, 1603; The
Array Corp of Engineers, 401 Clean Uater Acts California
Environmental Protection Agency, Water Quality Certification
401 U.S. Department of Interior Fish and Uildlife Service,
404, and The Mountain Recreation and Conservation Authority
(MRCA).
There have been many meetings, numerous correspondence and
conversations with the agencies while working in concert to
assure the protection of the areas of concern and
endangerment as well as meeting with City Staff and
Council member Uozniak & Harper in an effort to find the best
trail design while working within the specific environmental
parameters and the topographic and biological restrictions.
The agencies have concerns and placed restrictions on any
activity in the area of the Bernal Pool, the associated water
shed, any intrudance on any endangered species or it's
habitat. As ,a result of these restrictions, concerns and
the safety and liability issues, the trail system'submitted
is the best possible solution, we in conjunction with staff
and council, were able to design.
The Trail System as shown on Exhibit #8 of the Carlsberg �1
Specific Plan contains 10,520' lineal feet, of trails. 4`''
ATTACHMENT 3
With the modifications made to adhere to the restrictions and
limitations we had to delete 6,520' lineal feet of the
original trail and have added 1,850, lineal feet of trail;
with an total deletion of 4,670, lineal feet. We are
recommending, and have shown on the attached plans, the
inclusion of 28001 of trail/sidewalk on the east and west
side of Miller Drive that extends from the natural park to
the Simi HrroVo to be designated for use with the Simi Rrrovo
trail when that comes to fruition.
The cost of trail construction, as discussed in the previous
hearing, is $10-00 per foot, the in-lieu fee will be
$46,700.00, paid to the City by Lennar Homes for the required
deletion of 4670, of trails.

specific and monitor the progress of the project to assure
compliance.
