BACKGROUND
At a regular meeting of the Moorpark City Council on May 3,
2000, a resident of Moorpark Mobilehome Park testified to
allegedly unhealthful conditions at the park and objected to a
pending request for Standard Space Rent Increase submitted to
the City by the park owner. Council has requested this matter be
agendized for discussion.
DISCUSSION
On, March 30, 2000, the City received a Request for Standard
Space Rent Increase from Moorpark Mobilehome Park, such increase
to be effective July 1, 2000. This request has been submitted
per Section 5.52.050 of the City's Municipal Code. This section
of the Code allows a park owner to increase space rents at a
mobilehome park, based on the increase in the Consumer Price
Index (CPI),* with notification to residents as prescribed in the
Code. The Code does not provide for denying approval of a
standard space rent increase, so long as the park owner has
complied with requirements to notify residents of the proposed
rent increase, submits the application in a timely manner, and
pays the administrative processing fee to the City.
The State's Housing and Community Development Department (DECD}
Division of Codes and Standards has jurisdiction within
mobilehome parks for enforcing State Health and Safety Codes and
regulations under Title 25 of the California Code of

Regulations. The following information on enforcement
activities which have occurred within the last two years was
provided by HCD staff. An inspection of the park and the 28
mobilehomes was conducted on August 11, 1998. The park was
cited for numerous violations and the park owner was given until
October 30, 1998, to correct these conditions. Twenty-seven of
the twenty-eight mobilehomes also received notices of violation,
with the deadline of October 30, 1998, to correct the conditions
for which they were cited. A reinspection conducted December
30, 1998, found the unsafe conditions within the park had been
corrected. However, many coaches still had unsafe conditions.
Letters were sent on February 5, 1999, to fifteen of the twenty-
seven residents originally cited for violations, identifying
violations which remained uncorrected. These residents were
given until March 7, 1999, to correct the continuing problems.
No follow up has been initiated by HCD since that time. Staff
has been assured by HCD staff that an inspection will be
conducted before the end of May 2000.
