MOORPARK CITY COUNCIL AGENDA REPORT TO: Honorable City Council FROM: Atanas Beltchev, Information Systems Manager DATE: December 07, 2018 (CC Meeting of 12/19/18) SUBJECT: Consider Amendment No. 3 to Agreement for Professional Services between the City of Moorpark and Nobel Systems BACKGROUND/ DISCUSSION In 2014, the City entered into an Agreement for Professional Geographical Information Services (GIS) with Nobel Systems. Those professional services include: a) subscription to Nobel’s GeoViewer system, which is currently used by the City to provide various types of information to the public (Community View) and City staff (Staff View), and b) optional GIS specialized services to add data and features to the existing system. The Agreement was previously amended twice to extend the term and payment schedule for uninterrupted usage of the system and to extend the City’s ability to request optional services from Nobel Systems. The Agreement will expire on April 14, 2019. The data in Nobel’s GeoViewer system is organized in different sections known as GIS layers. The Community View GIS version available via the City’s website (at no cost to users) and provides the general public with property data without property owner names, and also includes the General Plan Land Use Map and Zoning Map. The Community View GIS is designed to be compliant with the privacy and information disclosure restrictions found in California Government code Sections 6254.21 – 6254.24. The Nobel GeoViewer products are web-based and available on any computer that has internet access. Staff GIS access is controlled by requiring each authorized employee, contractor, or volunteer to have a username and password. Two of the GIS layers that are proposed to be updated at this time are the City’s General Plan Land Use Map and Zoning Map. The last update of the data in each layer was completed in September 2008. The City has had many General Plan Amendment and Rezoning projects approved in the last 10 years. It is appropriate and necessary at this time to update the GIS General Plan and Zoning layers to reflect the changes that have occurred. Having the updated Land Use Map and Zoning Map will assist in moving forward with other General Plan Element update work efforts. Item: 10.G. 79 Honorable City Council 12/19/2018 Regular Meeting Page 2 Additionally, following the update of the Zoning Map layer, a new GIS layer is proposed to be created with this Amendment No. 3 that pertains to regional water quality requirements. On November 2, 2017, the City submitted to the Los Angeles Regional Water Quality Control Board (Regional Board) a letter identifying that it intended to comply with Statewide Trash Provisions by implementing Track 1, which incorporates installation of full capture devices in designated stormwater catch basins located in Priority Land Uses. A Full Capture System is defined as a treatment control, or series of treatment controls, including but not limited to, a multi-benefit project or a low-impact development control that traps all particles that are 5 mm or greater, and has a design treatment capacity that is either: a) of not less than the peak flow rate, Q (which represents “peak flow rate” measured in volume over time), resulting from a one-year, one-hour, storm in the subdrainage area, or b) approximately sized to, and designed to carry at least the same flows as, the corresponding storm drain. The designated Priority Land Uses are defined as high density residential (10 units/acre or more), industrial, commercial, mixed urban, and public transportation stations. The next step of compliance with the Statewide Trash Provisions is to submit to the Regional Board a map identifying the designated catch basins and Priority Land Uses. The map is required to be submitted by February 18, 2019, and the preferred map format is a GIS file. Nobel has provided a proposal to create the GIS file based on the City’s existing storm drain system map and zoning map. Once the map has been completed, staff will return to City Council requesting authorization to submit the GIS map to the Regional Board. Staff is requesting approval of the attached Agreement Amendment No. 3 to authorize Nobel Systems to perform the tasks summarized in this report and incorporated in the attached draft Amendment to the Agreement. The termination language in the Agreement allows the City to terminate with or without cause with 30 days written notice. FISCAL IMPACT No fiscal impact. City’s FY 2018/19 budget includes sufficient funds to cover the costs of the maximum $5,300 amount for Amendment No. 3, for a total Agreement value of ninety thousand eight hundred dollars ($90,800), and no additional appropriation is requested. STAFF RECOMMENDATION Authorize the City Manager to sign Amendment No. 3 to the Agreement for Professional Services between the City of Moorpark and Nobel Systems, subject to final language approval by the City Manager. Attachment: Amendment No. 3 Attachment: Exhibit F Attachment: Exhibit G 80 AMENDMENT NO. 3 AGREEMENT FOR PROFESSIONAL SERVICES BETWEEN THE CITY OF MOORPARK AND NOBEL SYSTEMS This Amendment No. 3 to the Agreement between the City of Moorpark, a municipal corporation (“City”), and Nobel Systems, a corporation ("NOBEL" and/or "CONSULTANT"), for optional GIS services (“Agreement”), is made and entered into the ___ day of December, 2018. RECITALS WHEREAS, on March 14, 2014 the City and NOBEL entered into an Agreement to have the NOBEL provide subscription GeoViewer services; and WHEREAS, on April 10, 2017 the City and NOBEL executed Amendment No. 1 to the Agreement to extend the term and payment schedule for an additional period to April 14, 2018; and WHEREAS, on April 11, 2018 the City and NOBEL executed Amendment No. 2 to the Agreement to extend the term and payment schedule for an additional period to April 14, 2019; and WHEREAS, the City has the need for additional GIS services for updating City General Plan and Zoning Map GIS layers data, and to create a map identifying specific Catch Basins and Priority Land Uses; and WHEREAS, NOBEL has submitted to City a Proposal dated December 5, 2018, which is attached hereto as Exhibit F, in the amount of two thousand dollars ($2,000.00), and additional proposal dated December 6, 2018, which is attached hereto as Exhibit G, in the amount of two thousand eight hundred dollars ($2,800.00); and WHEREAS, the City and NOBEL now desire to amend the Agreement to authorize Nobel to perform optional services to the City as proposed in Exhibit F and Exhibit G, and to increase the total Agreement amount by a value of four thousand eight hundred dollars ($4,800.00), plus a contingency of five hundred dollars ($500.00) for a maximum not to exceed Agreement amount of ninety thousand eight hundred dollars ($90,800.00), by jointly approving Amendment No. 3 to the Agreement. NOW, THEREFORE, it is mutually agreed by and between the parties to the Agreement as follows: I. Section 4.5, SCOPE OF OPTIONAL SERVICES, is added as follows: “City does hereby authorize NOBEL, as an independent contractor, in a contractual capacity to provide optional GIS services to update City General Plan Land Use Map and Zoning Map GIS layers data, as set forth in Exhibit F, and to create a map identifying specific Catch Basins and Priority Land Uses, as set forth in Exhibit G. 81 NOBEL shall perform the tasks described and set forth in Exhibit F and Exhibit G. NOBEL shall complete the tasks according to the schedule of performance which is also set forth in Exhibits F and G. Compensation for the optional services to be performed by NOBEL shall be in accordance with Exhibits F and G. Compensation shall not exceed the amount of four thousand eight hundred dollars ($4,800.00), plus a contingency of five hundred dollars ($500.00), for total Agreement value of ninety thousand eight hundred dollars ($90,800.00) without a written amendment to the Agreement executed by both parties. Payment by City to NOBEL shall be in accordance with the provisions of this Agreement.” II. Remaining Provisions: Except as revised by this Amendment No. 3, all of the provisions of the Agreement shall remain in full force and effect. Publish a new General Plan map with Legend as shown in below screen capture in 8 ½ x 11 size as well as Large size (24 x 36) with the exact same layout. 3. Publish a new Zoning map with Legend as shown in below screen capture in 8 ½ x 11 size as well as Large size (24 x 36) with the exact same layout. Deliverable: Nobel Systems will deliver the Geodatabase, MXD and 2 different size PDF files as part of this project. Nobel will also publish these updated layers in GeoViewer Online. 84 Schedule: Nobel Systems will complete the project within 2 (two) weeks from notice to proceed. Costs: Our lump-sum cost to work on this task will be………………………………………………$1,400.00 Task 2: By using the updated General Map and Zoning layers from Task 1, Nobel Systems will create multiple sub layers of General Map and Zoning based on the types of Zone and Category. This will help City staff to turn on and off each Zone and General Map area individually as shown below. Deliverable: Nobel will publish these individual layers in GeoViewer Online. Schedule: Nobel Systems will complete the project within 2 (two) weeks from notice to proceed. Sincerely, Balaji Kadaba Vice President, Operations Nobel Systems, Inc 86 SCOPE OF WORK City of Moorpark requested Nobel Systems to create a GIS Layer for compliance of the 2015 Statewide Trash Amendment. The details scope of work is listed below. The map must show the existing City’s Storm drain network and calls out specific Catch basins (and inlets) that will require a Full Capture Device in designated “Priority Land Use”. Catch Basins:  Using the City’s “Storm Drain” layer, highlight approximately 166 “catch basins” and “inlets” with a different color than the other catch basins and inlets. For example, yellow.  City staff is currently working on listing out the specific 166 catch basins and inlets that will need to be colored differently than the others. – This will be provided to Nobel by City’s staff.  Existing Storm Drain layer would be used to reflect drain lines of the Catch basins.  Legend would identify the regular Catch basin and Inlet colors (currently green and black, respectively) and the 166 catch basins and inlets that will be required to have a “Full Capture Device” installed. (proposed to be yellow). Priority Land Use:  Take the existing Zoning map and remove all colors that aren’t the following designates: - RPD-10U - RPD-12U - RPD-12.21U - RPD-15U - RPD-16.2U - RPD-16.83U - RPD-19.OU - RPD-20U - C-1 - C-2 - CPD - C-OT - M-1 - M-2 - I  Zoning areas described above then be adjusted, in such a way that there are only 3 colors/designation. - All RPDs would be designated “High-Density Residential - All Cs’ would be designated “Commercial” - All Ms’ and I would be designated “Industrial” 87  In addition to the designated zones above, there are two other sections of the City that need to be included in the Statewide Trash Amendment as a Priority Land Use but they’re not within one of categories above. Please see the below pictures. One is a residential section of the City that is currently designated RPD- 8.4, and this needs to be included as part of the “High-Density Residential” section. The second section is a commercial area of the City that’s currently lumped in as “SP” but needs to be called out as part of the “Commercial” Priority Land Use. 17.11 acres; 191 units; 191/17.11 = 17.11 units per acre Penrose, Elderberry, Courtney Lane, Nightingale, Harvester, Designate as High-Density Residential 88 Moorpark Marketplace/Village @ Moorpark, Patriot Drive area. Designate as Commercial  Legend will include the colors of the Priority Land Uses: Commercial, High- Density Residential, and Industrial.  GIS layer will also be able to print as an overall PDF map that includes a Legend identifying the Priority Land Uses, Storm Drains Inlets, Full Capture Devices, Storm Drain Channels (this is the line that connects the storm drains and shows the flow/direction of the line). Deliverable: Nobel Systems will deliver the Geodatabase, MXD and PDF files as part of this project. Nobel will also publish these updated layers in GeoViewer Online if needed. Schedule: Nobel Systems will complete the project within 2 (two) weeks from notice to proceed.
