Gilbert, Director of Public Works June 13, 2000 (Council Meeting 6 -21, 2000) Subject: Consider Notice of Completion for the Spring Road Bridge Reconstruction Project DISCUSSION A. Background & Summary The contract was awarded to TM Engineering on February 3, 1999. The bridge was opened to traffic on March 15, 2000. Other work required to complete the project is on- going. In that the project is substantially complete, it is appropriate to proceed with the recordation of the Notice of Completion. B. Project Scope 1. Summary: The subject project called for the removal and replacement of the Spring Road Bridge. A summary of the before and after condition is as follows: 2. Other Factors: a) Support: The old bridge was supported by three rows of piers which tended to inhibit the flow of debris under the bridge during a major storm. The new bridge is supported by a center pier wall designed to prevent the collection of debris. b) Trail Ramp: A ramp was constructed east of and under the bridge, to accommodate a future levee trail system. Conflicts with existing facilities west of the bridge prevented construction of the ramp in that area. spgbrg_cmp �� Spring Road Bridge Reconstruction Notice of Completion June 13, 2000 Page 2 c) Future Channel Improvements: The project was designed and constructed to be compatible with the existing channel as well as the proposed future channel widening project. That future project will include a drop structure immediately upstream of the bridge, lowering the bottom of the arroyo at the bridge approximately eight feet (81). d) Utility Relocation: Water, sewer and gas lines were relocated and placed in utility cells within the bridge. e) Box Culvert (Northwest): A box culvert was constructed on the west side of Spring Road north of the bridge (at the location of a roadside ditch) to allow the project to include the construction of full -width street improvements and a sidewalk in this area. C. Substantially Complete The bridge was opened to traffic on March 15, 2000. Even though the project was not completed on that date, and (at the time of the writing of this report) is still not considered complete, the City received beneficial use of the project on March 15. It is, therefore, appropriate for the City Council to accept the bridge improvements, subject to the completion of remaining punch list items, and approve the Notice of Completion. As you may recall, the City cannot release the retention for the project until thirty -five (35) days after the date of the recordation of the Notice of Completion. It is recommended that the Notice of Completion be recorded to start that clock ticking. Payment of the retention may be withheld until after all of the remaining work is completed. However, it should be noted that failure of the City to make timely payment of the retention subsequent to receipt of beneficial use of the bridge may subject the City to payment of an additional interest charge. D. Work Remaining At the date of the writing of this report, the work required by the contract was still not considered to be complete. Staff is working with the contractor to resolve a few remaining issues regarding restoration of the levee access road and the arroyo upstream of the bridge, to the pre - project condition. E. Restoration at Southeast Corner of Br The final removal of a temporary dirt access ramp and the restoration of the rock rip rap bank near the southeast corner of the bridge was deleted from the contract in order to facilitate other work in the area which was being considered by the City. Claim for Disputed Work The Contractor has submitted a claim for additional compensation for certain work he believes to be beyond the scope of the contract requirements. That claim has been denied. G. Liquidated Damages As you know, the completion of the project was delayed. The bridge did not open on schedule. The City suffered damages as the result of delays believed to be caused by the Contractor. Accordingly, Liquidated Damages have been withheld from the Contractor in accordance with the provisions of the contract documents. Although the contract is technically still not completed, as mentioned above, the bridge was opened to traffic and the City received beneficial use of the project on March 15, 2000. It is the view of staff that Liquidated Damages should be based upon the period of time between the adjusted completion date and the March 15th opening of the bridge. The original completion date was December 19, 1999. Fifty -eight approved days have been added to the contract, extending the completion date to February 15, 2000. The number of days between February 16, 2000 and March 15, 2000, is twenty -nine (29). The amount of Liquidated Damages is $500 per day. The total amount of the Liquidated Damages withheld is, therefore, $14,500. H. Fiscal Impact 1. Construction Contract Summary: A summary of the final construction contract costs is as follows: 2. Quantities: The actual quantity required of some bid items was less than the Engineer's Estimate. Change Orders: The project required a number of Change Orders. A chart attached as Exhibit 1, describes the approved Change Orders. It should be noted that, in that a price could not be negotiated for a number of these Change Orders, the work was actually directed to be performed by force account. 4. Accept the work as complete, subject to final approval by the City Manager of the correction of the remaining deficiency list items. 2. Instruct the City Clerk to record the Notice of Completion for the project. 3.
