Subject: Consider Notice of Completion for the
Spring Road Bridge Reconstruction Project
DISCUSSION
A. Background & Summary
The contract was awarded to TM Engineering on February 3, 1999.
The bridge was opened to traffic on March 15, 2000. All work,
less certain restoration work, was completed in early June. The
outstanding work is the subject of a dispute between the City
and the Contractor. It is recommended that the work completed to
date be accepted and that a Notice of Completion be recorded for
said "completed" work.
B. Project Scope

2. Other Factors:
a) Support: The old bridge was
supported by three rows of
piers which tended to inhibit
the flow of debris
under the
bridge during a major storm.
The new bridge is
supported
by a center pier wall designed to prevent the
collection
of debris.

b) Trail Ramp: A ramp was constructed east of and under the
bridge, to accommodate a future levee trail system.
Conflicts with existing facilities west of the bridge
prevented construction of the ramp in that area.
c) Future Channel Improvements: The project was designed and
constructed to be compatible with the existing channel as
well as the proposed future channel widening project. That
future project will include a drop structure immediately
upstream of the bridge, lowering the bottom of the arroyo
at the bridge approximately eight feet (8').
d) Utility Relocation: Water, sewer and gas lines were
relocated and placed in utility cells within the bridge.
e) Box Culvert (Northwest) : A box culvert was constructed on
the west side of Spring Road north of the bridge (at the
location of a roadside ditch) to allow the project to
include the construction of full -width street improvements
and a sidewalk in this area.
C. Project Status
All of the work required by the contract has been completed
except the restoration of certain Ventura County Flood Control
District (VCFCD) facilities. Those restoration requirements are
the subject of a dispute between the City and the Contractor. It
is recommended that the work completed to date be accepted and
that a Notice of Completion, for the completed work, be
recorded. The recordation of that Notice will allow the City to
release the retention monies, which will in turn allow the
Contractor to bring closure to certain outstanding matters
between the Contractor and his subcontractors and suppliers.
D. Claim for Disouted Work
The Contractor has submitted a claim for additional compensation
for certain work he believes to be beyond the scope of the
contract requirements. That claim has been denied.
E. Liquidated Damages
As you know, the completion of the project was delayed. The
bridge did not open on schedule. The City suffered damages as
the result of delays caused by the Contractor. Accordingly,
Liquidated Damages have been withheld from the Contractor in
accordance with the provisions of the contract documents.
The original completion date was December 19, 1999. Fifty -eight
approved days have been added to the contract, extending the
completion date to February 15, 2000. Although all of the work
has not yet been completed, the bridge was opened to traffic on
March 15, 2000. The number of days between February 16, 2000 and

March 15, 2000, is twenty -nine (29) . The amount of Liquidated
Damages is $500 per day. The total amount of the Liquidated
Damages withheld is, therefore, $14,500.
F. Fiscal Impact

2. Quantity Adjustments: The actual quantity required for some
bid items was less than the Engineer's Estimate. The two
primary areas where less quantities were required was in the
construction of retaining walls and the length of piles
required to construct the bridge.
3. Liquidated Damages: See above discussion of Liquidated
Damages.
4. Change orders: The project required a number of Change
Orders. The chart attached as Exhibit 1 describes each of
the approved Change Orders. It should be noted that, in that
a price could not be negotiated for a number of these Change
Orders, the work required by those Change Orders was
directed to be performed by force account. In such cases the
term used for the work was "Extra Work Order."
5. Total Project Costs: A summary of total estimated project

6. Current Budget Summary: A summary of the current budget for
the project is as follows:

The current budget exceeds the above identified costs. It
should be noted that the above identified costs does not
include possible future costs related to pending claims
and /or legal expenses related to same.
7. Funding Source: The funding sources for the project are

8. Inter -Fund Loan: Full funding of the project required an
inter -fund loan as described as follows:
• Amount: $1,675,105
• From: Fund 2501: L A Avenue AOC Fund
• To: Fund 2502: Spring Rd / Tierra Rejada Rd AOC Fund
It is anticipated that this loan will be re -paid when
sufficient AOC revenues are received from the development of
the properties within the Carlsberg Specific Plan.
STAFF RECOMMENDATIONS
Staff recommends that the City Council take the following actions:
1. Accept the work performed to date as being complete.
2. Direct staff to continue to work with the contractor and the
Ventura County Flood Control District ( VCFCD) to resolve
issues relating to the restoration of VCFCD facilities.
3. Instruct the City Clerk to record the attached partial
Notice of Completion for the project.
4. Authorize the release of the retention upon satisfactory
clearance of the thirty five (35) day lien period and the
approval of the City Manager.
