SUBJECT: Consider Selection of Consultant to Prepare the Project
Design for the Widening of Los Angeles Avenue Between
Spring Road and Moorpark Avenue [Project 80131

One of the objectives of the City is to undertake and complete a
number of projects designed to widen the Route 118 corridor
through the City to accommodate three lanes of traffic in each
direction. The subject project is one of a number of projects
being undertaken by the City toward the achievement of that end.
Other street widening projects have been, or will be, implemented
as a function of the development of properties abutting the Los
Angeles Avenue corridor.

A. Background
On May 3, 2000, the City Council authorized staff to distribute
a Request for Proposals (RFP) to selected civil engineering
firms for civil engineering design services for the subject
project.
B. Construction Project Scope
1. General: The scope and intent of the project is to widen
Los Angeles Avenue within the project limits, to
accommodate six (6) lanes of traffic.
2. Limits: In order to provide

3. Existing Right -of -Way / Travel Lanes: Except at the east
and west ends of the project where full improvements have
already been constructed on the south side of the street,
the existing right -of -way width varies from approximately
90 feet to 110 feet. The street is currently striped for
four (4) twelve feet (121) wide through lanes and a 14 -foot
median.
4. Design Standard: The design standard for Los Angeles Avenue
calls for a curb -to -curb width of one hundred two feet
(1021) within a street right -of -way of one hundred eighteen
feet (1181). Accordingly, the "half- street" dimensions
require fifty -one feet (511) from the centerline to the
curb face, within a "half street" right -of -way of fifty -
nine feet (591).
5. North Side Constraints: The current dimension between the
existing centerline and the north curb is only forty feet
(401). The existing improvements and facilities on the
north side of the street include rear yards of existing
residence, a ten feet (101) high block wall and high
voltage power poles. These existing improvements pose a
significant obstacle to the construction of street widening
on the north side of the street.
6. South Side of Street: For most of the project length along
the south side of the street, full street improvements have
not yet been constructed. In those areas the street right -
of -way line is only fifty feet (501) from the centerline,
leaving an additional nine feet (91) to achieve the
required design width.
7. Conceptual Plan: Noting the above described constraints to
street widening on the north side of the street, Phase 1 of
the design effort will be the development of a conceptual
street alignment plan calling for the shifting of the
centerline eleven feet (111) to the south. This plan, if
ultimately approved, would require the acquisition of
approximately twenty feet (201) of street right -of -way
along the majority of the project area. The additional
twenty feet (201) consists of the eleven 11' required by
the street realignment, plus the additional nine feet (91)
already required on the south side of the street. A more
complete discussion of the design requirements is set forth
below.
8. Design Objectives: The design standards for the Los Angeles
Avenue corridor call for full street improvements which are
generally described as follows
- one 14' painted median
- six -12' travel lanes
- two- 81emergency lane (unpainted bicycle lanes)
- two -8' sidewalk / parkways

C. Design Effort: Scope of Work
1. Phase 1 - Conceptual Plan: Develop a conceptual re-
alignment plan shifting the centerline to the south as
discussed above. Said plan will show all existing and
proposed improvements, as well as existing and proposed
property lines (right -of -way requirements).
2. Phase 2 - Design Alternates: Develop a number of
alternative design alternatives as directed by the City,
designed to reduce impacts to adjacent properties and /or to
provide for acceleration / deceleration lanes as required.
3. Phase 3 - Final Conceptual Plan: Develop the final
conceptual design based upon input provided by the City.
This phase will include the development of legal
descriptions for all of the rights -of -way required. The
final conceptual design will be presented to the City
Council for approval.
4. Phase 4 - PEER: Prepare a Project Engineering Evaluation
Report (PEER) required in order to obtain Caltrans approval
of the project.
5. Phase 5 - Final Design: Develop the construction drawings
(final plans and specifications) for the project.
D. Proposal Evaluation
1. RFP: The Request for Proposals was mailed to thirty -four
(34) firms which were either prime civil engineering firms
or support service firms (geotechnical, surveying, etc).
2. Proposals: Proposals were received from the following civil
engineering firms:
• Boyle Engineering
• Lim & Nascimento Engineering
• Willdan Engineer & Planners
• Korve Engineering
• Charles Abbott Associates
• Robert Bein, William Frost & Associates
All of the Proposals cited utilization of sub - consultants
for various elements of the work (surveying, geotechnical,
etc .) .
3. Evaluation Criteria: As explained in the RFP, the Technical
Proposals were evaluated and ranked prior to the opening of
the Cost Proposals. The Proposals were evaluated by the
Public Works Director and the Interim Deputy City Manager.

(References, Qualifications, Caltrans Experience, Project
Understanding, etc.). The points assigned to the various
criteria placed an emphasis on background and experience in
developing designs for projects similar to the subject
project.
4. Highest Ranked Firm: Subsequent to a thorough review,
evaluation, scoring and ranking of the contents of each of
the Technical Proposals, it was determined that the firm
which ranked the highest was Boyle Engineering.
E. Ouoted Fee Amounts
The total amount quoted in the Fee Proposal submitted by each
firm, is listed as follows:

It should be noted that it is misleading to compare
professional services on the basis of the fee amounts quoted.
The RFP provides only general guidelines for the desired
services. Accordingly, Proposals vary broadly in the methods,
approach and scope of the services to be offered. Since the
services are not comparable, the fees quoted are also not
comparable.
It should also be noted that the final scope of the "desired"
services often differs significantly from the Scope of Work
defined by either the RFP or the Proposals. A refinement of
the final "desired" scope of work comes as the result of the
negotiation process. That negotiation process focuses on the
refinement of the scope of the services and the content of the
contract language. When the final scope of the services is
fully defined, a fair fee is then negotiated using industry
guidelines and standards.
In addition, the discussion and clarification of the fees
quoted for specific elements of the services, often results in
a need to adjust the fee amount upward or downward to
accommodate those adjustments and clarifications.

F. Selection Process
As defined in the RFP, the selection process states that,
subsequent to the evaluation and ranking of the Technical
Proposals, the City would open negotiations with the firm
whose Technical Proposal received the highest ranking. The RFP
goes on to state that should negotiations with the number one
ranked firm be unsuccessful, the City would then commence
negotiations with the next highest ranking firm. Negotiations
would continue with one or a series of firms until a contract
was successfully negotiated. This process is design to secure
services from the best qualified firm, at a cost acceptable to
the City.
G. Negotiations: Final Scope and Fee Amount
Staff has worked with representatives of Boyle Engineering to
develop and refine the Scope of Work, the contract provisions
and the final fee amount. A final package has been developed.
It is recommended that Boyle Engineering be selected to
provide the negotiated services for the negotiated fee amount.

the final negotiated fees, is as follows:

2. Contract Language: No changes have been requested to the
standard professional services contract.
3. Scope of Work [Exhibit 'A' of the Agreement]: Attached as
Exhibit 1 of this report, is a copy of Exhibit 'A' of the
Agreement, which sets forth the full scope of work, fees
and related provisions.
4. Clarifications and Limitations: Certain language has been
include in the Scope of Work at the request of the
Consultant (see Paragraph A -4) to clarify the obligations
of the Consultant with respect to the prosecution of the
work and the use of the work product.

Although an Engineer's Opinion of Probable Construction Costs
has not yet been developed, the preliminary estimate of the
construction cost is $800,000. The above noted design cost of
$71,821 represents 9% of construction cost estimate. That fee
amount is consistent with industry standards.
I. Drainage
There are existing storm drains at each end of the project and
at Millard Street. Drainage will be conveyed to those three
facilities. The Consultant will review existing hydrology data
to confirm that those facilities will be able to handle added
storm flow. The design scope of work assumes that no
additional storm drainage facilities will be required. Should
the hydrology analysis indicate that additional drainage
facilities will be required, the design effort for those added
facilities will be an extra cost.
J. Supports Efforts
Certain support efforts from the City will be necessary,
including securing Litigation Guarantees (Title Reports) for
the properties where additional right -of -way will be required.
In addition, staff will administer as a separate contract, the
preparation of the environmental document for the project.

A. Introduction and General Requirements: The required SERVICES
shall include, but not be limited to the following:
1. Project objectives: The ultimate -width design standard for
the Los Angeles Avenue corridor is as follows
- one 14' painted median
- six -12' travel lanes
- two- 81bicyle lanes
- two -8' sidewalks
- curb -to -curb width: 102'
- Right -of -way width: 1181.
The objective of the PROJECT is to produce plans and
specifications for a construction project which achieves the
basic intent of those design standards within the limits of
the PROJECT.
2. Project Description: The limits of the PROJECT extend from a
point east of Spring Road to a point west of Moorpark Avenue.
The total length of the section is approximately 2300 feet.
The existing right -of -way width for Los Angeles Avenue within
the project limits varies from approximately 90 feet to 110
feet. The street is currently striped for four 12' wide
through lanes and a 14' wide median.
It will be necessary to acquire additional street right -of-
way in order to construct the PROJECT. Existing development
and utility poles on the north side of the street make
widening in this area difficult. It is assumed that the
PROJECT will recommend widening on the south side of the
street as described in the following Concept Description.
3. Concept Description: Due to the constraints posed by existing
improvements on the north side of the street, the initial
preliminary concept plan shall be based upon the following
criteria and assumptions:
a. The centerline shall be shifted eleven feet (111) to the
south consistent with Cross - Section 'D' shown on Exhibit
'A' of the RFP.
b. Tapers and transitions shall be provided for at the east
and west end of the project limits as required to render
the project improvements compatible with existing and /or
proposed ultimate improvements east and west of the
project.
c. All travel lanes shall be twelve feet wide and all other
Caltrans design criteria shall be met.

4. Clarifications and Limitations: The scope and intent of the
contract requirements and scope of work shall be subject to
the following clarifications and limitations:
a. CONSULTANT shall be entitled to rely upon the accuracy of
data and information provided by CITY or others without
independent review or evaluation.
b. Documents, drawings, specifications, and electronic
information /data, including computer aided drafting and
design ("CARD"), prepared by CONSULTANT pursuant to this
agreement are not intended or represented to be suitable
for reuse by CITY or others on extensions of the PROJECT
or on any other project. Any use of completed documents
for other projects and any use of incomplete documents
without specific written authorization from CONSULTANT
will be at CITY'S sole risk and without liability to
CONSULTANT.
c. Electronic data delivered to CITY shall not include the
professional stamp or signature of an engineer or
architect. CITY agrees that CONSULTANT shall not be
liable for claims, liabilities or losses arising out of,
or connected with the decline of accuracy or readability
of electronic data due to inappropriate storage conditions
or duration. By acceptance of electronic data, CITY
agrees to indemnify CONSULTANT for damages and liability
resulting from the modification, use or misuse of such
electronic data.
d. Any Opinion of the Construction Cost prepared by
CONSULTANT represents its judgment as a design
professional and is supplied for the general guidance of
CITY. Since CONSULTANT has no control over the cost of
labor and material, or over competitive bidding or market
conditions, CONSULTANT does not guarantee the accuracy of
such opinions as compared to contractor bids or actual
cost to CITY.
e. CITY agrees that in accordance with generally accepted
construction practices, the construction contractor will
be required to assume sole and complete responsibility for
job site conditions during the course of construction of
the PROJECT, including safety of all persons and property,
and that this requirement shall be made to apply
continuously and not be limited to normal working hours.
CONSULTANT shall not have control over or charge of, and
shall not be responsible for, construction means, methods,
techniques, sequences or procedures, as these are solely

the responsibility of the construction contractor.
CONSULTANT shall not have the authority to stop or reject
the work of the construction contractor.
f. In providing its services hereunder, CONSULTANT shall not
be responsible for identification, handling, containment,
abatement, or in any other respect, for any asbestos or
hazardous material if such is present in connection with
the PROJECT. In the event that CITY becomes aware of the
presence of asbestos or hazardous material at the job
site, CITY shall be responsible for complying with all
applicable federal and state rules and regulations, and
shall immediately notify CONSULTANT, who shall then be
entitled to cease any of its services that may be affected
by such presence, without any liability to CONSULTANT
arising therefrom.
g. CITY will include in the general conditions of any
construction contract, language which states that the
construction contractor is required to hold harmless and
defend the City, Contractor, and their agents, employees
and consultants, from all suits and actions, including
attorneys' fees, and all costs of litigation and judgments
of any nature and description arising out of or incidental
to the performance of the construction contract or work
performed thereunder. The CITY, CONSULTANT, their agents,
employees and consultants shall also be named as
additional insureds in any construction contractor's
insurance policies.
B. Scope of Work [SERVICES]: The required SERVICES shall include,
but not be limited to the following:
1.Phase 1: Preliminary Conceptual Plan
Purpose — To provide an initial draft plan of the proposed
street widening project, consistent with the CONCEPT
DESCRIPTION described above.
a. Kick -off Meeting: Attend a kick -off meeting and follow -
up with a site visit photographically record
conditions.
b. Receipt of Information: Receive from the City any
existing plans, reports, hydrology studies,
geotechnical reports, etc. which are in the City's
possession. Receive from the City Title Reports, and /
or Litigation Guarantees, for each of the properties

where additional right -of -way is anticipated to be
acquired.
C. Surveying and Mapping — Perform a survey for the
project area in sufficient detail to support the
described phases of the design efforts. The mapping
will be done by aerial means and will include as
limits: the full length of the project and width of the
right -of -way with approximately thirty feet (301)
beyond proposed right -of -way. Also, provide
supplemental topography on the south side of the street
to facilitate design. Existing improvements shall be
shown on the mapping. These will be located by first
marking in the field the visible features.
d. Geotechnical and Pavement Investigations - Perform
geotechnical investigations as needed to support
pavement and subgrade design.
• Geotechnical: Review existing Caltrans materials
reports, provide four shallow drill holes (5 to 10
feet deep), perform laboratory testing and analyses
and produce a materials report in Caltrans format.

waiver of encroachment fees for design
investigation work.
• Pavement Investigation: If required, pavement
investigation will be performed as an additional
service.

require two to three plan sheets to be developed to the
geometric submittal stage. At the end of Phase 1 the
submitted plans will be approximately thirty -five
percent (35 %) complete.

2.PHASE 2: Design Alternates
Purpose — To develop certain design alternates to reduce
impacts upon adjacent properties and /or to provide for
acceleration / deceleration lanes as reflected in the Cross -
Sections set forth in the RFP.
a. Plans — Prepare up to two design alternates based upon
direction provided by the City (plan view only).
3.PHASE 3: Final Conceptual Plan
Purpose — To prepare the final alignment and right -of -way
needs plan for the project, including prerequisite to right -
of -way acquisition.
a. Plan(s) — Prepare the final concept plan showing all
existing and future improvements, utility locations and
right -of -way lines. Prepare plan views and typical
cross sections.
b. Key Improvements Identified — Identify, for purposes of
later opinion of probable construction cost, the major
grading, utility relocation, and drainage aspects of
the project. Also identify key street light work (if
any) based upon the City's lighting standards. [Note:
At this stage of design these elements of the project
will not be designed beyond the conceptual level.
C. Right -of -Way — Prepare a chart listing all street
right -of -way parcels to be acquired, the assessor's
parcel number for each affected property, the property
owner and the area of the right -of -way to be acquired.
d. Legal Descriptions. — Prepare legal descriptions for
all street right -of -way and any other easements
required for the project. Preliminary Title Reports
will be secured by the City and provided to the
CONSULTANT at no cost.
e. Opinion of Probable Cost — Prepare an opinion of
probable cost for the construction of the project,
based on the final conceptual plan.
f. Special Conditions — Describe any unique problems or
conditions (i.e. impact upon existing structures) posed
by the project.

g. Draft Report — Prepare a draft report which describes
the design concept, right -of -way requirements and
opinion of cost.
h. Final Draft Report — Upon receipt of comments from the
City, prepare and present to the City the Final Draft
Report on the Conceptual Design. The Final Draft Report
will be presented to Caltrans for review and comment.
All Caltrans' comments shall be incorporated into the
Final Report.
i. City Council Review — Present the Final Draft Report
to the City Council for review and approval.
j. Final Report— Prepare and provide ten (10) copies of
the Final Report which incorporates any comments from
the City Council.
k. Phase 3 Effort: Approval of the Final Report will
constitute approval of the geometrics of the project.
At the end of Phase 3 the submitted plans will be
approximately forty -five percent (45 %) complete.
4. PHASE 4: Project Engineering Evaluation
Report. (PEER)
a. Purpose — To seek and obtain Caltrans approval of the

b. Report — Consultant's work shall be limited to the
preparation of the initial draft of report, consistent
with Caltrans PEER report program guidelines.
C. Data — Traffic accident, traffic volume and other
statistical information required to be included in the
report shall be derived from existing studies and
reports to be provided by the City and /or Caltrans.
d. Work by City - City staff will submit the report to
Caltrans, provide supplemental information to Caltrans
as required, and make revisions to the report as
necessary to obtain Caltrans approval.
e. Additional Work - Any work required to be performed by
the consultant in making revisions to the draft PEER
report, will be paid as an additional service.

5.PHASE 5: Final Design
Purpose — To provide a final set of construction
documents.
a. Utility Coordination — Perform all coordination,
communication and design necessary to show location of
existing utilities on the street plans and to
facilitate the necessary relocation of the conflicting
utilities. It is assumed that the primary work will be
adjusting manholes and vaults, relocation of utility
poles and coordination to give utility companies an
opportunity to install improvements ahead of road
construction.
b. Project Design /Drainage Study — Prepare the design for
the street widening project including asphalt pavement,
curb and gutter, sidewalk, right -of -way wall, and
drainage. The design will be developed in two stages
as follows:
• Preliminary Design — prepare a preliminary final
design based on the final approved concept plan
• Final Design — based on City and Caltrans input on
the Preliminary Design, prepare a Final Design
• Drainage Study - Prepare a Drainage Study [hydraulic
analysis], using the hydrologic data set forth in
the City's Master Drainage Study, to confirm that
the street drainage can be conveyed to the three
existing storm drain systems (one at each end of the
project and one at Millard Street) and that those
existing storm drainage facilities have sufficient
capacity to accept said additional storm flows.
[Note: It is anticipated that storm drain catch
basins and pipes will not be required. The fees
for Task 5b shall pertain to the drainage study
only. If it is determined from that study that a
storm drain is required, or that the capacity of
the existing storm drains will have to be
increased, the design efforts for those new storm
drainage facilities will be paid as an additional
service.]
d. Construction Plans — Prepare construction plans
showing both plan and profile at a scale acceptable to
the City and Caltrans. Include both full and half -
sized sheets. Provide both camera ready and electronic
files (AutoCAD V 12 or later). There will be no
electronic submittal to Caltrans.

e. Specifications and Special Provisions — Prepare
specifications and special provisions for the project.

g. Plan Review: Plans will be submitted to the City for
plan review at the sixty -five percent (65 %) completion
and at ninety -five percent (95 %) completion.
h. Plan Approval: All plan check corrections shall be made
sufficient to secure approval [ "signed" plans] from the
City and from Caltrans.
i.. Other Requirements
• Bid Sheet — Prepare a bid sheet with bid items,
quantities and payment references to Specification.
• Opinion of Probable Cost — Prepare an opinion of
probable cost for the project using the above
described Bid Sheet.
• Schedule — Prepare a time estimate for construction
of the project.
• Coordination — Coordinate the design with City
staff, Caltrans, and other designers working on Los
Angeles Avenue.
• Engineering Responsibility — Final approved plans
shall be stamped and signed by the consulting
engineer as the City Engineer for the project.
j. Matters Not Included : Tasks which are not a part of
this contract include the following:
• pavement investigation;
• environmental document;
• right -of -way acquisition;
• Caltrans encroachment permit application;
• Cooperative Agreements with Caltrans;
• On -site (i.e. private property) improvements
required to accommodate land acquisition [Note: Any
on -site improvements required to accommodate the
construction of the project shall be included in the
Scope of Work] ;
• Design of retaining walls not per Caltrans, City or
APWA standard wall design;
• Landscaping; and
• ISA or lead surveys.

WHEREAS, on June 21, 2000, the City Council adopted the
Budget for Fiscal Year 2000/01; and
WHEREAS, a staff report has been presented to the City
Council requesting a budget increase in the aggregate amount of
$145,228; and
WHEREAS, Exhibit "A ", attached hereto and made a part hereof,
describes said budget amendment and its resultant impacts to the
budget line item(s).
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES
HEREBY RESOLVE AS FOLLOWS:
SECTION 1. That a Budget amendment in the aggregate increase
