WCLUD'na ADoPT11)N OF Re_SO nto 04-00 - 1777 BY: TO: Honorable City Council FROM: Dana Shigley, Administrative Services Direc DATE: September 13, 2000 (meeting of September 20, 2000) SUBJECT: PUBLIC HEARING TO CONSIDER POLICE FACILITY FEE BACKGROUND At the September 6 meeting of the City Council, the Council reviewed information concerning the police facility fee and acknowledged September 20 as the public hearing, as required by Government Code. nr CtITTQ -'^KI As required by the Government Code, all information for disclosure has been available to the public for at least ten days prior to this hearing. This information was also provided to the Council at the September 6 council meeting. The attached resolution will increase the police facility fee as previously presented. Current fees, as established in 1995, are: Single Family Dwelling, per unit $392 Multi- family Dwelling, per unit $254 Mobile Home, per unit $261 Non - Residential, per square foot $0.19 Based on the information previously presented to the Council, the following increased fee levels are recommended: Residential, per unit $677 Non - Residential, per square foot $0.41 000()01 Honorable City Council September 20, 2000 Page 2 STAFF RECOBMNDATION 1. Conduct a public hearing, accepting testimony regarding the police facility fee as necessary. 2. Adopt Resolution 2000- 000002 RESOLUTION 2000- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA RESCINDING RESOLUTION 95- 1112 AND ESTABLISHING A POLICE FACILITY FEE WHEREAS, the City Council desires to construct and /or acquire police facilities in order to better serve the residents of Moorpark; WHEREAS, the City Council has received evidence that the current fees are inadequate to fund such acquisition and /or construction; and WHEREAS, Ordinance No. 206 contemplates that the City Council will determine from time to time the population to be served by a police facility, the service area, the values of the components used to calculate fees, and the administration fee for processing the police facility fee; and WHEREAS, the City Council has made available information concerning the proposed police facility fee in accordance with Government Code Section 66000- 66025; and WHEREAS, the City Council now wishes to rescind resolution 95 -1112 which previously established the police facilities fee and adopt a resolution updating these fees. NOW, THEREFORE, the City Council of the City of Moorpark does hereby resolve as follows: SECTION 1. Resolution 95 -1112. Resolution 95 -1112 is hereby rescinded. SECTION 2. Administration Fee. The administration fee authorized by Ordinance No. 206 shall be $25 per fee payment. SECTION 3. Formula Values. The values assigned to "A ", "C ", "D", "E ", "F ", and "G" set forth in Ordinance No. 206 shall be computed as follows: 000003 Resolution 2000 - Page 2 A. The value "A" is $6,152,000. This number equals the estimated cost in dollars of acquiring a standard police station, including land acquisition, site preparation and fixtures. B. The value "B" is 32,000. This is the total estimated population to be served by the police station in the year construction is anticipated, 2002. C. The value "C" is 3.13. This is the estimated average number of residents per dwelling unit. D. The value "D" is 0.70. This is the estimated portion, expressed as a decimal, of the standard police station needed to provide service to residential buildings. E. The value "E" is 7,273,000. This is the estimated square footage of non - residential space to be served by the police station. F. The value "F" is variable and represents the number of square feet of floor space in the non - residential buildings for which the permit is issued. G. The value "G" is the number 1 minus the value of "D" . This number equals the estimated portion, expressed as a decimal, of the standard police station needed to provide service to non- residential buildings. SECTION 4. Police Facility Fee. The police facility fee shall be paid at the time a building permit is issued and shall be as follows: Residential, per unit $677 Non - Residential, per square foot $0.41 SECTION 5. Effective Date. This resolution shall take effect 60 days after adoption. 000004 Resolution 2000 - Page 3 SECTION 6. Certification. The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original resolutions. Unfominately, we will nor be able to be in attendance at the Council hearing, but we do have some questions as to the proposal to increase this fee and would appreciate your response. Adequate police and fire protection services are absolutely critical elements to the safety and well -being of every community. While new homebuyers subsidize much of the infrastructure in their communities, public safety is a primary concern. And yet, it is disappointing to consider that a reduced amount of new housing units must shoulder a greater proportion of costs for the proposed police facility. What's more disconcerting is the recommendation that multi - family and single - family units pay the same rate, as this will obviously impact affordability. Is it worthy of consideration for the City to help offset these costs for affordable projects? In reanalyzing the funding challenges for the police station, was there any consideration given to working out of the County's East Valley Sheriff Sub - Station? Thousand Oaks appears to be well -sewed by this location, despite its rather large population. It may afford similar benefits for the City of Moorpark as well. We appreciate your consideration of these questions as you determine how to move forward with the important;ob of planninb police facilities for the citizens of Moorpark.
