Subject: Authorize Reimbursement of Ventura County Flood Control
District (VCFCD) Costs for the Restoration of Certain VCFCD
Facilities Subsequent to the Construction of the Spring
Road Bridge [Project 80151
OVERVIEW
City staff has been working cooperatively with the VCFCD on a
project to remove certain materials from the Arroyo Simi upstream of
the Spring Road Bridge. A portion of that restoration effort is
required by the permit issued to the City for the construction of
the Spring Road Bridge. That portion of the project costs is,
therefore, to be funded by the City.
The costs for the sediment and vegetation removal project were only
recently determined, subsequent to the receipt by the VCFCD of bids
for that work. This report requests retroactive approval of
agreement by the City to pay the City's share of those contract
costs.
DISCUSSION
A. Bridge Project Completion
In June of this year the City Council accepted as complete, the
construction of the Spring Road Bridge, subject to final
approval by the City Manager of certain work which had not yet
been completed.
B. Disputed Work
The Contractor, TM Engineering, disputed requirements of the
VCFCD permit that a) the south levee access road and b) a
portion of the streambed be restored to the "pre- project"
condition. The Contractor has refused to perform that work. At

the date of the writing of this report, this matter remains
unresolved. In light of this fact, the obligation to restore the
VCFCD facilities has reverted to the City. Action to recover
those costs from the contractor will be considered at a later
date.
C. Access Ramp
In addition to the removal of certain materials from the
streambed and the construction of certain repairs to the south
levee road, it is also necessary to remove a dirt access ramp to
the streambed and to restore the rock rip -rap bank beneath that
dirt ramp This dirt access ramp is located near the southeast
corner of the bridge. The City's Contractor was directed to
leave that access ramp in place in order to allow access for the
performance of a pile extraction test. It was subsequently
determined that the pile extraction test was not required. In
that this work was omitted from the contract by the City, the
cost for this restoration work must be borne by the City.
D. Upstream Channel Clearing
The VCFCD also wishes to undertake the removal of certain
vegetation and sediment upstream of the bridge. Accordingly, the
VCFCD agreed to prepare plans, seek bids and award a contract
for that work, plus a portion of the above described restoration
work required by the City's permit. The scope of their contract
is briefly described as follows:

Based upon the quantities of material calculated for each of the
above elements of the work, the City portion is equal to 44.3%
of the total.
E. Deferred Restoration
In that the north levee road is now being used by Security
Paving [the City's Contractor constructing the New Los Angeles
Avenue Bridge Widening Project], the restoration of that levee
road is being deferred at this time and will be constructed by
Security Paving when the bridge widening project is completed.

F. Rock Rip -Rap Restoration
It is not known whether or not the rock rip -rap bank under the
dirt access ramp is in good condition. Should it be determined
after the removal of the dirt access ramp, that rock rip -rap
repairs or restoration work is necessary, a contract change
order will have to be negotiated. The cost of any negotiated
extra for that work would have to be added to the VCFCD
contract, and said additional VCFCD costs would have to be
reimbursed to VCFCD by the City.
G. VCFCD Contract
The results of the bidding process conducted by the VCFCD
yielded a contract for the above described work. A summary of
the cost breakdown of that contract, plus a contingency amount
for rock rip -rap restoration if required, is as follows:

The above described City reimbursement to the VCFCD would be
funded from the Spring Road Bridge Project [Project 80151. There
are sufficient funds remaining in that budgeted Project to fund
those costs.
I. Payment Authorized
In order to avoid delays to the VCFCD process for the review and
award of the contract for the above described work, the City
Manager authorized a letter to be sent to the VCFCD agreeing to
reimburse the VCFCD for the cost of the City's portion of the
required work, as described and defined in this report. Said
letter requested that the VCFCD indemnify the City against any
claims arising out of the VCFCD maintenance contract.
STAFF RECOMMENDATION
Approve prior action by the City Manager to authorize payment to the
VCFCD for certain streambed restoration costs in the Arroyo Simi
upstream of the Spring Road bridge, as described in the agenda
report.
