NNUMMENN� of ACT /��p✓�; ✓e�� - - -- BY; TO: Honorable City Council FROM: Walter Brown, City Engineer DATE: October 4, 2000 (CC meeting of October 18, 2000) SUBJECT: CONSIDER IMPROVEMENT BOND REDUCTION FOR TRACT 4974 (CONEJO FREEWAY PROPERTIES) BACKGROUND The property is located north of Tierra Rejada Road and is bordered by Tract 4973 to the north (a portion of which has a common boundary formed by Peach Hill Road west of Science Drive), Spring Road to the west and Highway 23 (freeway) to the east. A location map is attached for your reference (Exhibit A) . Vesting Tentative Tract Map 4974 was approved by the City Council on February 19, 1997. Grading of the site commenced on June 3, 1997. DISCUSSION The developer began constructing infrastructure improvements in June 1997. As a condition of approval of the construction, a total of six (6) bonds were required by the City to ensure that all infrastructure work would be completed. The bonds totaled $5,019,506.00. The infrastructure covered by the bonds included: grading, storm drain, landscaping (slopes, parkway and median), a neighborhood park, monuments and street improvements on Science Drive, Tierra Rejada Road and Spring Road. The developer has substantially completed all infrastructure work 1 / 3 C � 0404 Honorable City Council Tract 4974 - Bond Reduction October 18, 2000 associated with these bonds, with the exception of the ::eighborhood park. At the developer's request, this report has been prepared so the City Council can authorize staff to reduce or exonerate the sureties. It is the City's policy that grading and monument bonds are exonerated upon completion of all work and those remaining bonds are reduced to 10° for a one (1) year guarantee period. Durina the winter of 1997 -98 storm waters undermined some of the sidewalks in Tract 4974. In an effort to restore those sidewalks, the developer of the tract placed slurry (liquefied Portland cement concrete) to provide support to the sections of sidewalk that were undermined. After the slurry treatment the City Engineer required the developer to "proof test" the sidewalk by driving a loaded truck on the sidewalk. There were no failures of the sidewalk at that time. In addition to the slurry support and "proof testing" the developer was required to guarantee the sidewalk against damage resulting from the undermining until September 28, 2002. The estimated cost of demolishing and replacing the sidewalk that was undermined is $50,160.00. The bonds that are being reduced by this action before the City Council presently secure that warranty. The reduced amount of the street improvements bond will also be sufficient to secure the replacement of the sidewalk, if required. Unless repairs or replacement are required for the subdivision improvements the final release of the bonds will occur one (1) year after the City Council's action to reduce the bonds. Before full exoneration of the street bonds, which requires City Council approval, the City Clerk requests comment from the City Engineer. As a condition of exoneration the City Engineer will require the developer to provide a replacement bond that will continue to secure the replacement of the affected sidewalk, should replacement become necessary, until September 28, 2002. The amount of the new bond will be $50,160 adjusted by the change in the Engineering News Record (ENR) construction cost index from September 1998 to September 2001. 2/3 C: ,0;(), 405 Honorable City Council Tract 4974 - Bond Reduction October 18, 2000 It is appropriate to reduce the bonds by the amount shown in the following table: TOTALS $5,018,606.00 $1,407,090.00 STAFF RECOMMENDATIONS: 1. Accept the improvements as complete, with the exception of the park. 2 Authorize the City Clerk to exonerate /reduce the aforementioned security deposits in the amounts shown in the above table. All sureties that are reduced to loo shall remain in effect for a one year maintenance period, the exonerations of which are subject to City Engineering and Community Development Department approval, and a replacement surety in the amount of $50,160.00 for damaged sidewalk, at that time.
