Traffenstedt, Acting Director of Community Development =D5"F Prepared by Paul Porter, Principal Plann Date: November 8, 2000 (CC Meeting of 11/15/2000) Subject: Consider Minor Modification No. 1 to Residential Planned Development Permit No. RPD -99 -3 for Modifications to the Building Elevations and Floor Plans, Reduction in Lot Setbacks and Introduction of Single -Story Residences with Lofts for a Property Located on 2.5 acres of Land at the Northeast Corner of Rolling Knoll and Peach Hill Roads (Applicant Wilshire Builders, Inc.) BACKGROUND December 8, 1999 Approval The City Council adopted Resolution No. 99 -1622 on June 16, 1999, approving Residential Planned Development Permit No. RPD- 99-3 and Tentative Tract Map No. 5201 for development of ten (10) single - family detached two-story dwellings (2,900 - 3,000 square feet) on lots with a minimum lot size of 6,193 square feet. The project is located on the northeast corner of Rolling Knoll Drive and Peach Hill Road. City Council Meeting on October 4, 2000 On October 4, 2000, the City Council considered an application for Minor Modification No. 1 to Residential Planned Development Permit No. 99 -3 for modifications to the approved Residential Planned Development. The requested modifications included replacing two of the two -story plans with a single -story elevation (with a loft), increasing the square footage of the homes, modifying the architectural elevations to include a mixture of French Country and Mediterranean, modifications to the garages along Silver Oak Lane, and reductions of rear and sideyard setbacks Minor Modification No. 1 to RPD 99 -3 November 8, 2000 Page 2 At the City Council meeting on October 4, 2000, there was concern expressed regarding the reduction in rear yard setbacks and the size of the homes. The changes in rear and sideyard setbacks were a result of the introduction of a single -story model on six (6) of the ten (10) lots that were originally approved with two -story homes and revising the two -story homes on the remaining four lots to have a larger footprint. The Council took no action on the Minor Modification application at the October 4, 2000 meeting. DISCUSSION In response to the Council's comments, the applicant has submitted a revised plan for the proposed two -story homes to now consist of a floor plan of comparable square footage, but with a reduced footprint. This reduction in footprint corresponds to increased rear yard setbacks on lots 3, 7 and 8 with a minor decrease in setback on lot 4 compared to the approved plan (see Attachment 2, Exhibit 2). On the remaining six lots (lots 1, 2, 5, 6, 9 and 10) , the proposal for the single -story model remains the same as last considered by the Council on October 4, 2000. The applicant has discussed the proposal with neighboring property owners showing them the elevations and setbacks and has obtained a signed petition with the proposed plot plan (see Attachment 2, Exhibit 3). The adjacent property owners prefer the single -story home with reduced setbacks versus the prior approved two -story home with greater setbacks. Comparison of Approved Plan with Applicant's Revised Plan 1. Six (6) of the approved two -story plans have been replaced with a single -story model, which the applicant believes is more marketable than a project with all two -story models. This proposal provides a varied streetscape and reduces massing of garages. 2. The size of the floor plans has changed. The single -story plan has 3,205 square feet and replaces the two -story model that contained 2,929 square feet. The architectural elevations of the homes have been modified to include a mixture of French Country and Mediterranean styles. Each of the elevations will have three distinct color schemes. Each plan will offer two elevations, one of each style, whereas the approved plans were all of the same architecture. 4. Associated with the architectural changes are revisions to the proposed garages, which originally took up a substantial portion of the front elevation. Both of the revised plans have three (3) car tandem garages. This leaves a substantial portion of the front elevations for other architectural features, increasing the front yard articulation and enhancing the streetscape scene with courtyards. 5. As shown at the City Council meeting on October 4, 2000, the sideyard setbacks have been reduced from an overall fifteen (15) feet between homes with the prior approved plan to ten (10) feet between adjacent single -story plans, ten (10) feet between adjacent single -story and two -story plans, and maintaining fifteen (15) feet between adjacent two -story plans. The introduction of the single -story homes serves the purpose of reducing the massing created by all two -story homes. The windows of the proposed homes have been designed so as to maintain privacy. Although the combined sideyard setbacks have been reduced in some cases from fifteen (15) feet to ten (10) feet between residences, the visible massing of the development is reduced as a result of the introduction of the six (6) single -story homes. In addition, windows on the loft of the single - story houses either face another single -story residence or in two situations face a two- story house with offset windows. Pursuant to Section 17.36 of the Municipal Code, second - story structures in the Residential Planned Development (RPD) Zone with windows are required to have a minimum S:ICommun#y DevelopmentlEveryonelCity Council Agenda Reportslcc- 001115 RPD 99-3 (Wilshire Builders Minor Mod Staff Report). doc Minor Modification No. 1 to RPD 99 -3 November 8, 2000 Page 4 sideyard setback on the second story a minimum of ten (10) feet from the property line. However, the Municipal Code allows RPD Zone setback requirements to be modified by the City Council. Existing Property Line Wall along Peach Hill Road and Rolling Drive The applicant has provided additional pilasters along both the Peach Hill and Rolling Knoll Drive street frontages and has agreed to provide caps along the entire length of the wall. In addition, pursuant to the conditions of approval, the area in front of the wall will be landscaped. SUMMARY In summary, the introduction of six (6) single -story homes with lofts and modifications to the two -story floor plans and elevations provides the following: split garages that allow for courtyards at the entryways, an improved street scene, modifications to the floor plans will provide the appearance of having more spacious rooms, and prospective buyers will have the option of purchasing a single -story home or a two -story home. The reduction of the setbacks between residences is mitigated, because the windows in the loft of the single - story houses either face another single -story residence; or in two situations, face a two -story house with offset windows and a sill height of not less than five feet. The revised plan increases the privacy of adjacent properties by reducing the number of two -story homes, and the project has the support of the surrounding property owners. Applicant Packet with Exhibits S:ICommunity DevelopmentlEveryonelCity Council Agenda Reportslcc -001115 RPD 99 -3 (Wilshire Builders Minor Mod Staff Report).doc RESOLUTION NO. 2000- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, APPROVING MINOR MODIFICATION NO. 1 TO RESIDENTIAL PLANNED DEVELOPMENT PERMIT NO. 99 -3 FOR MODIFICATION OF BUILDING ELEVATIONS AND FLOOR PLANS, REDUCTION IN SIDEYARD SETBACKS AND INTRODUCTION OF SINGLE -STORY HOMES WITH LOFTS FOR A 2.5 -ACRE SITE LOCATED AT THE NORTHEAST CORNER OF ROLLING KNOLL ROAD AND PEACH HILL ROAD (APPLICANT: WILSHIRE BUILDERS, INC., APN. 507 -0 -302 -180) WHEREAS, on June 16, 1999, the City Council adopted Resolution 99 -1622 approving: Residential Planned Development Permit No. 'RPD -99 -3 for approval to construct ten (10) two -story (2,900 - 3,200 square foot) homes. Tentative, Tract Map No. 5201 for a subdivision of approximately 2.5 acres into ten (10) residential lots with a minimum lot size of 6,193 square feet; and WHEREAS, on August 24, 2000, Wilshire Builders, Inc. applied for Minor Modification No. 1 to Residential Planned Development Permit No. RPD -99 -3; and WHEREAS, the Director of Community Development referred the matter to the City Council on October 4, and November 15, 2000; and WHEREAS, on October 4, 2000, the City Council considered the application filed by Wilshire Builders, Inc. for approval of Minor Modification No. 1 to Residential Planned Development Permit No. RPD -99 -3 for the modification of the a architectural renderings and floor plans, an introduction vof single -story homes with a loft, and modifications to rear and sideyard setbacks, but took no action on the Minor Modification; and WHEREAS, on November 1, 2000, the applicant resubmitted revisions to the plans for review by the City Council at the City Council meeting of November 15, 2000; and ATTACHMENT 1. smmmm� C00013 Resolution No. 2000- Page 2 WHEREAS, at the meeting on November 15, 2000, the City Council after review and consideration of the information contained in the staff report dated November 8, 2000, reached a decision on this matter; and WHEREAS, this Minor Modification No. 1 to Residential Planned Development Permit No. RPD -99 -3 will not have the potential to cause a significant effect on the environment and qualifies for an exemption from the California Environmental Quality Act. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. Based upon the information and findings presented in this Resolution, accompanying documents and information, the City Council finds that: a. Minor Modification No. 1 to Residential Planned Development Permit No. RPD 99 -3 will not have the potential to cause a significant effect on the environment and qualifies as a Class 5 Exemption (Minor Alterations in Land Use Limitations) pursuant to the California Environmental Quality Act. b. Minor Modification No. 1 to Residential Planned Development Permit No. RPD 99 -3 is consistent with the intent and provisions of the City's General Plan and the City Municipal Code. C. Minor Modification No. 1 to Residential Planned Development Permit No. RPD 99 -3 is compatible with the character of surrounding development. d. Minor Modification No. 1 to Residential Planned Development Permit No. RPD 99 -3 would not be obnoxious or harmful, or impair the utility of neighboring property or uses. e. Minor Modification No. 1 to Residential Planned Development Permit No. RPD 99 -3 would not be detrimental to the public interest, health, safety, convenience, or welfare. f. Minor Modification No. 1 to Residential Planned Development Permit No. RPD 99 -3 is compatible with existing and planned uses in the general area where the development is to be located. 014 Resolution No. 2000 - Page 3 g. Minor Modification No. 1 to Residential Planned Development Permit No. RPD 99 -3 would not have a substantial adverse impact on surrounding properties. SECTION 2. The City Council conditionally approves Minor Modification No. 1 to Residential Planned Development Permit No. RPD -99 -3 for a modification of the approved architectural renderings and floor plans, introduction of single -story homes with a loft, and modifications to building setbacks as submitted in the revised application for Minor Modification received on November 1, 2000. SECTION 3. The City Council approves Minor Modification No. 1 to Residential Planned Development Permit No. RPD 99 -3 subject to the existing Conditions of Approval in Resolution No. 99 -1622 and the following Condition of Approval: "Prior to issuance of a Zoning Clearance for Construction, a revised wall plan shall be submitted for the property line walls adjacent to Peach Hill Road and Rolling Knoll Drive to provide additional pilasters and caps. The caps shall be provided along the entire length of the wall along both streets. There shall be acceptable transitions with existing walls on adjacent properties. The revised wall plan is subject to the review and approval of the Director Of Community Development. Construction of the pilasters, caps, and transitions with adjacent walls shall be completed prior to issuance of a Zoning Clearance for construction of the first dwelling unit.,, SECTION 4. The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original resolutions. PASSED AND ADOPTED this day of ® 2000.
