SUBJECT: Authorize a Use Agreement with Moorpark Soccer Club
SUMMARY
The City Council is being asked to consider and approve a Use
Agreement with the Moorpark Soccer Club (previously known as
Moorpark Soccer Express) that addresses the activities of the
Soccer Club including, but is not limited to, the following:
when and which park facilities will be made available to the
Soccer Club, under what conditions park improvements will be
made, who is responsible for specific park maintenance and
repair, setting of a park use fees, and liability issues. The
Use Agreement that the Council is being asked to approve is
similar to the agreements the Council previously approved for
Little League, Girls Softball, Moorpark Basketball Association,
AYSO, and Packer Football.
BACKGROUND
The City has specifically sought agreements with the various
major Moorpark based youth sports organizations that use City
park facilities. The purpose of each agreement is to facilitate
the needs of the youth sports organizations and to aid in
reducing scheduling and use conflicts that can arise from the
large demands placed on the use of the City's park facilities.
The agreements also serve as a means of identifying
responsibility for approved improvements and maintenance and
repair of City parks and other facilities.
Moorpark Soccer Club is affiliated with California Youth Soccer
Association and is a member of the El Camino Real Soccer League.
It has been in existence for approximately 10 years, although it
was inactive between 1996 and 1998. The membership of the Club

is currently around 120 boys and girls. Approximately 90 percent
of the membership consists of Moorpark residents, although
membership is not limited to Moorpark residents.
The Club's primary season runs August through November. They
also participate in a post- season state cup competition between
the months of December and March. Similar to Moorpark Packer
Football, the Club plays competitive games with teams from other
jurisdictions. As a result, they host games in Moorpark
involving non- Moorpark teams. The Club has used Campus Canyon
Park as it's home base for the past two years and would like to
continue to use the park. All their games are played on
Saturdays and Sundays. Practices are typically held on weekday
afternoons.
Previous to the 2000 season, when the Club was known as Moorpark
Soccer Express, an arrangement had been agreed to with the City
whereby Soccer Express used the soccer field at Campus Canyon
Park. It paid for the use of the field for games on the
weekends, since games included non Moorpark teams, and they had
the use of the Park on weekday afternoons for practices at no
cost, since practices involved only Moorpark teams.
As the Club's membership has grown and it's participation in
regional and statewide competitions has increased, the rental
cost of the Campus Canyon soccer field has become too expensive
for the Club. Additionally, the Club has become successful in
increasing the number and percentage of members who live in
Moorpark. As a result, more Moorpark resident benefit from the
activity of Moorpark Soccer Club. It's membership and structure
of competition is very similar to Packer Football. Moorpark
Soccer Club is a legal Moorpark non - profit organization with its
own non - profit identification number. Staff is proposing that
Moorpark Soccer Club be treated similar to Packer Football and
the other youth sports organizations as long as its membership
level is maintained.
DISCUSSION
Staff is proposing the development of a Use Agreement with
Moorpark Soccer Club that is consistent with the Agreements in
place for the other youth sports organizations. It is

recommended that, for the present time, Campus Canyon Park be
approved for use by the Club. It presents the best location for
this type of soccer play since it has a large competitive field,
with permanent field posts and it is not formally used by AYSO.
However, the use of Campus Canyon Park does have one
disadvantage; it lacks off - street parking. Campus Canyon Park
does not contain a parking lot. Parking is limited to on- street
where permitted. The proposed Agreement will include the
following provisions:
• Use of Campus Canyon Park soccer field and the adjacent
turf area as shown on Attachment A. The Club's use of the
park would cover the time period of August 1 through
November 30, Monday through Sunday, between the hours of
9 a.m. and dusk, or 7 p.m., whichever is earlier.
• A use fee of $1.00 per year.
• In order for the Club to retain the rights granted under
the Agreement, it must maintain a membership (players)
that consists of no less than 80 members and at least 80
percent of the membership must live in the City of
Moorpark.
• The Soccer Club will be responsible for striping the
field using a method acceptable to the City.
• Any field maintenance, such as, but not limited to,
weeding, aeration and fertilization, above and beyond
that which is covered by the City's landscape maintenance
contract, if approved by the City, shall be paid for at
the expense of the Club.
• The Club will empty the trash containers located adjacent
to the field at the end of the day on Saturdays and
Sundays.
• The Club will agree to cancel games and practices when
the turf is too wet, as determined by the City, whether
caused by rain or irrigation.
If in the future, parking becomes a problem, the City will work
with Moorpark Soccer Club to identify a potential alternative
park such as Miller Park.
It is proposed that staff be authorized to finalize a Use
Agreement with Moorpark Soccer Club consistent with the

provisions identified in this Agenda Report and with those
contained in the Use Agreements with the other youth sports
organizations. Additionally, the Council is asked to authorize
the City Manager to execute the Agreement on behalf of the City.
STAFF RECOMMENDATION
Authorize the City Manager to finalize a Use Agreement with
Moorpark Soccer Club and to execute the Agreement on behalf of
the City.
