Subject: Amendment of Condition No. 16 of Resolution No. 2000-
1687, [Minor Modification for Pads B & C of Mountain
Meadows Plaza] Pertaining to the Construction of a
Double Left -Turn Lane at the Intersection of Los Angeles
Avenue and Tierra Rejada Road
BACKGROUND
1. Condition 30 of Tract 5081 required the initial developer of
the Mountain Meadows Plaza to design and construct a second
left -turn lane for westbound traffic on Los Angeles Avenue
turning south on to Tierra Rejada Road. The obligation to
comply with those original Conditions of Approval is the
responsibility of the current owner of the primary property
in that plaza - Albertson's, Inc. That property owner has
been working with the City and Caltrans over the past several
months to have those improvements constructed.
2. When the Minor Modification for Pads B & C was approved by
the City Council, the scope of the work required to install
the double left -turn lane was not known. It was determined,
therefore, that the bond posted by the original developer
(now Albertson's) might not be sufficient to guarantee that
these improvements would be constructed. Accordingly, the
applicant for the Minor Modification was also required to
design and construct those improvements, and to post sureties
to guarantee same. That requirement is set forth as
Condition No. 16 of Resolution 2000 -1687.
3. On September 20, 2000, the City Council considered a request
from the applicant for the Minor Modification that Condition
No. 16 be amended to allow the posting of the required bond
to be deferred until the issuance of a Zone Clearance for
occupancy. That request was denied.

DISCUSSION
1. As stated above, Albertson's, Inc is in the final stages of
design for the construction of the double left -turn lane at
Los Angeles Avenue and Tierra Rejada Road. It is anticipated
that a permit for that work will be issued by Caltrans within
the next month.
2. The current draft design provides for the placement of the
double left -turn lane merely by re- stripping the street and
relocating the detector loops. That design implements the
required improvements without the need for any major
modifications to the street improvements or traffic signal
hardware.
3. If that design is approved by Caltrans by way of the issuance
of an Encroachment Permit to construct those stripping and
signal modifications, the original bond [$130,000] filed by
the primary developer would be adequate to guarantee the
construction of those improvements. Accordingly, the
secondary requirements placed upon the applicant for the
Minor Modification [Condition No. 161 would not be necessary.
4. In light of these facts and in order to assist the applicant
for the Minor Modification in timely implementation of that
project, it recommended that that Condition NO. 16 of
Resolution NO. 2000 -1687 be revised to read as follows:
1116. Consistent with the requirements of Condition No. 30 of Tract 5081, the
developer shall be responsible for the design and installation of a
second left turn lane for westbound Los Angeles Avenue traffic turning
onto southbound Tierra Rejada Road. The engineering plans required
for this additional left turn lane shall be approved by the City and
Caltrans prior to the issuance of a Zoning Clearance for Pads B or C.
Also, the developer shall be required to place with the City, adequate
surety to guarantee the design and construction of these
improvements.
Additionally, the above requirements shall be deemed null and void
when and if the City Manager determines that the sureties held by the
City which were posted by the initial developer of the Mountain
Meadows Plaza, are sufficient to guarantee the construction of these
improvements."

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF MOORPARK, CALIFORNIA, AMENDING RESOLUTION
NO. 2000 -1687, BY REVISING CONDITION NO. 16
FOR THE APPROVAL OF MINOR MODIFICATION NO. 7
(PAD B) AND NO. 8 (PAD C) TO MAJOR
MODIFICATION NO. 1 TO COMMERCIAL PLANNED
DEVELOPMENT PERMIT NO. 90 -2 FOR THE
DEVELOPMENT OF RETAIL COMMERCIAL BUILDINGS ON
THE PROPERTY LOCATED AT THE SOUTHWEST CORNER
OF TIERRA REJADA ROAD AND MOUNTAIN TRAIL
STREET.
WHEREAS, on January 5, 2000, the City Council adopted
Resolution No., 2000 -1687, conditionally approving Minor
Modification No. 7 (Pad B) and No. 8 (Pad C) to Major Modification
No. 1 of Commercial Planned Development Permit No. 90 -2, for the
development of certain commercial retail buildings at the
southwest corner of Tierra Rejada Road and Mountain Trail Street;
and
WHEREAS, Condition No. 16 of said approval requires the
developer to provide for the design and construction of certain
traffic improvements; and
WHEREAS, the City Council wishes to revise that Condition of
Approval.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES
HEREBY RESOLVE AS FOLLOWS:
SECTION 1. That Condition No. 16 of Resolution No. 2000 -1687
is hereby revised to read as follows:
16. Consistent with the requirements of Condition No. 30 of
