SUBJECT: Consider Conditional Approval of Hauling Excess Soil
From Tracts 4975, 4976, 4977, and 4980 to Archstone
Communities Site, Residential Planned Development
Permit No. 97 -01 and Other Locations Within the City
of Moorpark.
BACKGROUND
The tentative maps for Tracts 4975, 4976, 4977 and 4980 have
been approved by the City Council. The conditions of approval
for the tentative map for the tracts contain various
requirements to limit nuisances caused by hauling soil, both on-
site and off -site. The City Engineer approved the grading plan
for Tract 4975 on June 15, 2000, Tract 4976 on March 28, 2000,
Tract 4977 on August 4, 1998, and Tract 4980 on January 21,
1999. The earthwork quantities do not include the deposits of
alluvial soils that were removed and blended with other on -site
soils, and then re- compacted. The grading plans for each of the
tracts stated, "No import or export of soil was required tc
complete the projects."
City Council approval of the Archstone Communities project,
Residential Planned Development 97 -1 included conditions to
limit nuisances caused by hauling soil, both on and off -site.
The attached recommended conditions are appropriate to address
these issues if approval of this request is granted by City
Council.
DISCUSSION
The developers of Tracts 4975, 4976, 4977, and 4980, and the
Archstone Communities project have proposed that sufficient soil be
exported from Tracts 4975, 4976, 4977 and Tract 4980 to the Archstone
Communities site to allow for construction of the apartment project.

Additionally, Lennar Communities and Richmond America have requested
approval to export their excess soil to other locations within the
City of Moorpark.
Grading for Tract 4975 is underway, and the soils on the site
have had less shrinkage than was anticipated. This combined with
unexpected amounts of rocky soils has resulted in more volume of
soils than had been anticipated at the time of tentative map
approval. Grading for Tract 4976 is largely complete; however,
during grading the developer discovered that there would be a
surplus of soil on this tract. Grading for Tracts 4977 and 4980
is complete except for removal of soil generated by excavation
of footings and trenches for the proposed dwelling units.
Grading for the Archstone Communities site is about sixty
percent (60 %) complete. Before grading, the earth on the site
was a loose sandy alluvial soil. At the time of preparation of
the exhibits for the Residential Planned Development, the
project engineers estimated that compaction of the existing
soils would cause the volume of the soil to shrink. The actual
shrinkage has exceeded expectations.
An additional location to dispose of the excess soil is the Arroyo
Vista Park site. A ten -acre portion of Arroyo Vista Park on its
easterly undeveloped section, that was previously graded, can be
enhanced by the import of 40,000 cubic yards of soil.
The following Table "A" summarizes the grading, export and
import quantities for each of the involved tracts.

Soils engineering is not an exact science. The determination of
bulking and shrinkage of soils is highly dependent on the
terrain, subsurface conditions and the number, density and
location of the exploratory pits, trenches and borings made by
the Geotechnical Engineer. Acceptable levels of error in uniform
conditions are commonly accepted as plus or minus ten percent
(100) of the total quantity of the earthwork being moved. In
more broken terrain, locations where remedial grading is
necessary or when unusual soils are encountered, the expected
range of error can increase dramatically.
Staff has brought this item before the City Council in
accordance with the revision to the Engineering Policies and
Standards approved by the City Council during the October 6,
2000 meeting. The policy requires, in part, that unanticipated
offsite import /export operations be approved by the City
Council.
Staff has prepared conditions of approval for the haul operation
which are proposed to be imposed as a requirement for haul route
approval by the City Engineer and Director of Community
Development. Issues considered include; the original conditions
of approval for both tracts, impacts the haul operation will
have on traffic, safety issues for motorists and pedestrians,
noise, dust, tracking of soil onto City streets, school traffic
and damage to City streets. The proposed conditions are attached
as Exhibit W.
STAFF RECOMIIMNDATION
Staff recommends
that the
City Council
authorize
the City Engineer

Director of Community Development to
approve:
1.

5. Hauling up to 60,000 cubic yards of soils from either, or a
combination of both Tracts 4975 and Tract 4976 to the Archstone
Apartments project; and
6. Hauling up to 40,000 cubic yards of soils from either, or a
combination of both Tracts 4976, 4977 and Tract 4980 to Arroyo
Vista Park or other sites within the City as approved by
the City Engineer and the Director of Community
Development.

EXHIBIT `A'
a) Prior to start of the import operation each developer wishing to
import or export soil from these sites shall prepare an
application for approval of the haul route, obtain an
encroachment permit, pay appropriate fees and shall post a cash
deposit in the amount of $500.00 per working day of the haul
route approval period to pay for costs of and associated with
damage remediation, street cleaning and administering,
inspecting and monitoring this permission to haul. Upon the
certification by the City Engineer, that the haul operation is
completed and that all damages to City facilities and all costs
to the City, and its agents and contractors, have been paid the
unused portion of the deposit will be refunded. Should costs
accruing to the City due to its remediation, cleaning,
administration, monitoring or inspection of the haul operations
exceed the deposit amount the developer hauling soil shall cease
operations and cause additional funds to be to be deposited at
the City within 10 days of written demand by the City.
b) Truck trip counts and yardage hauled shall be tallied as the
trucks leave each export site and as the trucks enter each
import site. A true copy of the tally sheets shall be delivered
to the City Engineer or his designee at the end of each working
day that the hauling occurred.
c) No soil shall be transported to or from any site except as
specified herein.
d) The conditions of the permit, haul route, times and dates of
operation, signage or traffic control are subject to revocation
or revision by the City Council.
e) A minimum of three minutes of headway shall be allowed between
truckloads. The maximum number of highway legal haul units used
to haul the soil shall be no more than those needed to maintain
the minimum headway.
f) The route of the haul to the Archstone Apartments site from any
of tracts 4975, 4976 or 4980 shall be from the subject tract
thence northerly on Science Drive to New Los Angeles /Los Angeles
Avenue; thence westerly on Los Angeles Avenue to Moorpark
Avenue; thence southerly on Moorpark Avenue to the Archstone
Apartments site. Empty haul trucks shall retrace the haul route.

g) The route of the haul to Arroyo Vista Park site from any of
tracts 4975, 4976, 4977 or 4980 shall be from the tract thence
northerly on Science Drive to New Los Angeles /Los Angeles
Avenue; thence westerly on Los Angeles Avenue to Tierra Rejada
Road; thence southerly on Tierra Rejada Road to Countrywood
Drive; thence easterly on Countrywood Drive to the Arroyo Vista
Community Park. Empty haul trucks shall retrace the haul route.
h) No changes to the approved haul route, times and dates of
operation, dust control, signage or traffic control shall be
made without approval of the City Engineer and Community
Development Director.
i) Hauling operations shall be conducted during daylight hours only
between the hours of 8:00 a.m. and 5:00 p.m. Monday through
Friday, excluding Saturday, Sunday or City holidays.
Notwithstanding the preceding block of operating hours no haul
operations shall occur on any route passing any school during
the time period including 30 minutes before and after the start
or stop of any session at that school. Hauling operations from
the Tract 4976 site shall be conducted between the hours of 9:15
a.m. and 3:05 p.m. and 3:45 p.m. and 5:00 p.m.
j) Appropriate traffic warning signs and devices and a flagger
shall be provided at the entrances to the public way. The
flagging operation shall be directed to controlling the entrance
of the trucks used to haul the soil on and off the public
street. An additional flagger /crossing guard shall be provided
at the southeast corner of Moorpark Avenue and New Los Angeles
Avenue between the hours of 7 :45 a.m. to 8:50 a.m. and 2:30 p.m.
to 3:35 p.m. Mondays through Thursdays, inclusive and between
the hours of 7:35 a.m. to 8:50 a.m. and 12:45 p.m. to 1:50 p.m.
on Fridays when haul operations are underway. This
flagger /crossing guard shall provide assistance to the regular
crossing guard provided by the City by providing enhanced
direction and guidance to pedestrians and haul trucks entering
and exiting the project area at the intersection of New Los
Angeles Avenue and Moorpark Avenue.
k) Disruption of traffic on public streets due to the haul
operation shall be reduced to the maximum extent practical.
1) All portions of the haul route and intersecting streets within
500 feet of the haul route shall be swept continuously during

haul operations. No less than two street sweepers shall be in
operation over the portions of the haul route within City
jurisdiction during haul operations and for 30 minutes after the
haul operation hours.
m) Haul operations shall be suspended on rain days. The suspension
shall continue until soils on both the export and import sites
have dried sufficiently that the haul truck tires do not pick up
the soils.
n) The soil shall be wetted to optimum moisture (ASTM D -1557)
before loading. Each haul truck shall have all soil cleared from
surfaces outside the bed before traveling on a public street.
The tires of the haul trucks shall be cleaned of adhering soil
before traveling on any public street. The soil may be covered
by tarps during the haul as an alternate to wetting the soil to
optimum moisture.
o) On -site haul routes and soil moisture conditioning measures
shall be such to eliminate tracking or blowing soil onto City
streets or adjoining property from the loading, hauling, dumping
or distributing portions of the operation. Onsite operations
shall be coordinated to avoid passage of haul trucks over wet
soils that might adhere to the tires of the haul units.
p) Excepting as specified herein, these conditions shall not
displace, vitiate or negate any condition of law, permit or
approval pertaining to any property involved, whether inside our
outside of the City of Moorpark, or the operation of vehicles on
public streets.
q) A copy of this document shall be on the import and export sites
during all hauling operations.
