SUBJECT: Resolution of Intent to Form Assessment District AD -01 -2
[Tentative Tract 4928 (Toll Brothers)]
DISCUSSION
A. Tentative Tract Map 4928 [Toll Brothers]
The property subject to Tentative Tract Map 4928 is generally
located between Walnut Canyon Road and Grimes Canyon Road as
shown on the vicinity map attached as Exhibit 1. A reduced
copy of the Tentative Map is attached as Exhibit 2.
B. Landscape and Related Improvements
The proposed project will include parkway, median and slope
landscaping and related improvements along and adjacent to the
Street "C" -- the major east -west street serving the project.
C. Conditions of Approval: Assessment District Formation
Condition No. 19 of Resolution No. 96 -1197 states that the
aforesaid landscape improvements within and adjacent to Street
"C", shall be maintained by an assessment district. In lieu of
establishing a zone of benefit within an existing assessment
district, it has been determined that a new assessment district
should be formed for this purpose. The developer has deposited
with the City an advance to fund City costs related to the
formation of that new assessment district.
D. Earlv District Formation
The aforesaid Condition No. 19 also states that the landscaping
improvements shall not be accepted for maintenance by the City
until occupancy is granted on the final residential unit or the
golf course, which ever occurs later. Proposition 218, on the
other hand, requires property owner approval of any new or
increased assessment. Accordingly, District formation is being

initiated at this time in order to allow for property owner
approval of the proposed new assessment prior to the
recordation of the Final Map and the sale of lots to third
parties. It is recommended, therefore, that AD01 -2 be formed
and made effective for Fiscal Year 2001/02. When and if
approved by the City Council, the full recommended assessment
would be approved, but the amount actually levied and collected
would be a reduced amount (possibly zero) sufficient to fund
actual anticipated City costs for FY 2001/02.
E. Petition and Waiver
In order to reduce the amount of "red- tape" and costs
associated with the administration of a Proposition 218 Mail
Ballot for the approval of new assessments for new
developments, it is the intent of staff to use a Petition and
Waiver to obtain the needed property owner approval. In
submitting this document to the City the property owner 1)
request that the new assessment district be formed; and 2)
waives all rights conferred by Proposition 218 with respect to
the approval of the new assessment by Mail Ballot. The use of a
Petition and Waiver in -lieu of a Mail Ballot has been approved
by the City Attorney and the Assessment Engineer.
F. Engineer's Report
Attached to the Petition and Waiver as Exhibit `A' will be the
Engineer's Report for the new assessment district. That report
will fully describe the new assessment district, the areas to
be maintained, the method of assessment and the amount of the
assessment.
G. Assessment District: General Description
Prior to directing the City's Assessment Engineer to proceed
with the preparation of the Engineer's Report for AD01 -2, it
would be appropriate to provide the City Council with a summary
of the various elements and components of that proposed
Assessment District, as requested by the developer. A general
summary of the proposed Assessment District is as follows:
1. Improvements to be Included: The developer has requested
that certain improvements be included in the areas to be
maintained by the District. Said improvements are generally
shown on the map attached as Exhibit 3 and listed as
follows:
• median landscaping;
• parkway landscaping within the street right -of -way;
• parkway landscaping outside of the street right -of -way;
• certain slope landscaping adjacent to the street right -
of -way on Street "C ";

• certain slope landscaping along the east side of Grimes
Canyon Road;
• the Equestrian Trail running along the south side of
Street "C and the east side of Grimes Canyon Road; and
• the Equestrian Staging Area located on the east side of
Grimes Canyon Road.
None of the landscape improvements to be maintained by the
Assessment District will be:
• located within or adjacent to any of the private streets
intersecting Street "C";
• located within any street right -of -way on Walnut Canyon
Road to be conveyed to Caltrans; or
• located within any street right -of -way along Grimes
Canyon Road which is owned or maintained by the County of
Ventura.
Any of the areas to be maintained which are outside of the
street right -of -way for Street "C" will be included within
one or more easements to be conveyed to the City.
2. Benefit Spread Formula: The developer has proposed a
tentative Benefit Spread Formula which calls for one -third
of the total annual assessment to be spread to the Golf
Course properties. This spread is supported by the fact that
approximately one -third of the front footage of Street "C"
is Golf Course property.
3. Estimated Annual Assessment: The actual amount of the
assessment will be determined by the Assessment Engineer
based on the input provided by staff regarding the
anticipated annual budget for the maintenance of the above
described improvements. However, based on the above
described formula, at this point the annual maintenance
assessment is generally estimated to be as follows:

4. Delinquent Assessments: The Engineer's Report will have
provisions which will allow the City to collect delinquent
assessments in any given year from other properties within
the District. With these safeguards, should the Golf Course
or any other property fail to pay its assessment for any
reason, that uncollected assessment could be added to the
budget in a future year. In such case the assessment amount
for the residential or golf course properties would be
increased. Such increase would not require approval via Mail
Ballot.

H. Entry Statements
It should be mentioned that the specialty improvements which
the developer wishes to construct at the two entrances to the
development, are not proposed to be included in the list of
improvements to be maintained by the City. The maintenance of
those specialty improvements, which are to be constructed
within the street right -of -way, will not be funded by this or
any other City assessment district. It is the intent of the
developer to request approval of an encroachment permit to
allow for the construction and maintenance of these specialty
improvements. Said future maintenance would be provided by the
future Homeowners' Association for the area.
I. Resolution
Attached as Exhibit 4 is a Resolution stating the intent of the
City Council to form this new assessment district. That
Resolution also designates Shilts Consultants to be the
Assessment Engineer for these matters and directs said firm to
prepare the Engineer's Report required for the formation of
this new assessment district.
J. Schedule
The Engineer's Report [and Petition /Waiver] for AD01 -2 is
expected to be presented to the City Council for approval
within the next sixty (60) days. If the Engineer's Report is
approved by the City Council, a public hearing will be set for
June 6, 2001, to consider the formation of the district and the
approval of the total assessment amount. As stated above, the
actual amount levied for Fiscal Year 2001/2002 may be less than
the approved assessment amount, depending upon the amount of
the actual City costs anticipated to be incurred in FY01 /02.
STAFF RECOMMENDATIONS
1. Review, revise (if deemed necessary) and approve the scope of
improvements to be maintained by the assessment district, as
that described in Section G of this report.
2. Adopt Resolution No. 2001- initiating the process required
for the formation of Assessment District AD01 -2.
3. Authorize the City Manager to negotiate and execute a contract
amendment with Shilts Associates for the assessment engineering
services required for said district formation.

RESOLUTION NO. 2001 -
A RESOLUTION INITIATING PROCEEDINGS FOR THE FORMATION OF
THE CITY OF MOORPARK LANDSCAPING AND LIGHTING
MAINTENANCE ASSESSMENT DISTRICT NO. AD -01 -2 PERTAINING
TO THE PROPERTIES WITHIN TENTATIVE TRACT 4928 (TOLL
BROTHERS] AND DIRECTING PREPARATION OF ANNUAL REPORT
WHEREAS, the City of Moorpark provides for the maintenance and
improvement of parks, setback landscaping, drainage systems and
street lighting services through the City's Landscape and Lighting
Assessment Districts.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES
HEREBY RESOLVE AS FOLLOWS:
SECTION 1: The City Council hereby proposes the formation of a
landscaping and lighting assessment district to encompass the
properties within Tentative Tract 4928 (Toll Brothers) , pursuant
to Article XIIID of the California Constitution, and the
Landscaping and Lighting Act of 1972 (the "Act ") , Part 2 of
Division 15 of the California Streets and Highways Code
(commencing with Section 22500 thereof).
SECTION 2: The purpose of the landscaping and lighting
district shall be for the installation, maintenance and servicing
of improvements to the City of Moorpark described in Section 3
hereof.
SECTION 3: Within the landscaping and lighting district, the
existing and proposed improvements are generally described as the
installation, servicing, and maintenance of turf, ground cover,
shrubs, trees, irrigation systems, drainage systems, lighting,
fencing, statuary, fountains, and other ornamental structures and
facilities, entry monuments and all necessary appurtenances, as
applicable, for certain property owned or maintained by the City
of Moorpark located in or adjacent to the properties contained
within Tentative Tract 4928. Maintenance means the furnishing of
services and materials for the ordinary and usual maintenance,
operation and servicing of said improvements, including repair,
removal, or replacement of all of part of any improvement;
providing for the life, growth, health and beauty of landscaping;
and cleaning, sandblasting and painting or walls and other
improvements to remove or cover graffiti. Servicing means the
furnishing of electric current or energy, or other illuminating
agent, for the operation or lighting of any improvements,
maintaining, operating and servicing street and traffic safety
lighting, and water for irrigation of any landscaping or the
maintenance of any other improvements.

SECTION 4: The landscaping and lighting district proposed in
this Resolution is hereby given the distinctive designation of the
"City of Moorpark Landscaping and Lighting Maintenance Assessment
District Number AD- 01 -2."
SECTION 5: Shilts Consultants, Inc. is hereby designated as
Engineer of Work for purpose of these proceedings and is hereby
ordered to prepare an Engineer's Report in accordance with Article
4 of Chapter 1 of the Act and Article XIIID of the California
Constitution. Upon completion, the Engineer shall file the
Engineer's Report with the City Clerk for submission to the City
Council.
SECTION 6: The City Clerk shall certify to the adoption of
this resolution and shall cause a certified resolution to be filed
in the book of original resolutions.
