SUBJECT: Resolution Establishing Permit Only Parking on Benwood
Drive, Bambi Court and Pecan Avenue
OVERVIEW
This presents, at a public hearing, a request for the
establishment of Permit Only Parking zones on the subject streets
(see the map of the affected areas which is a part of Exhibit 1).
DISCUSSION
A. No Overnight Parking Program
City Council Resolution No. 93 -970 established a program to
allow residents to request establishment of "No Overnight
Parking" restrictions in their neighborhood. This program was
created in order to empower residents to address problems they
believe to be associated with the parking of an excessive
number of vehicles in their neighborhood. When such problems
are believed to exist, those concerned may circulate a
Petition requesting that a Public Hearing be convened before
the City Council to consider the establishment of a No Parking
restriction between the hours of 2:00 a.m. and 6:00 a.m. on
all of the streets within their neighborhood. If signatures
in favor exceed ten per cent (10 %) of the lots in the
neighborhood, a public hearing is scheduled. If the request
is approved by the City Council, signs would be installed
enacting the parking restriction.
B. Neighborhoods
In order to discourage the "migration" of a particular parking
problem to another nearby area, Resolution No. 93 -979
identifies pre - determined areas or neighborhoods which would be
subject to the proposed parking restriction. The intent of the
Resolution was to require any request for such parking

restrictions to be accompanied by a Petition circulated to all
of the properties within a particular pre- designated area. The
intent was also to then make the Parking Restriction, if
approved, applicable to the entire pre- designated area or
neighborhood.
C. Parking Problem
Apparently certain individuals who reside on the south side of
Campus Park Drive, are choosing to park their vehicles
overnight on Pecan Avenue and possibly other adjacent streets.
Mr. Thomas Flitsch of 6607 Pecan Avenue, contacted staff about
this apparent problem. Mr. Flitsch was advised of the above
described program.
D. Petition
Staff prepared a Petition (Exhibit 1) for Mr. Flitsch to
circulate to all of the properties within his neighborhood, as
defined by Resolution No. 93 -970 (see map attached to the
Petition) . The Petition was circulated and then presented to
the City in late January. The Petition indicates favorable
support for the proposed parking restrictions by eight (8)
properties - the minimum number required by the Resolution.
E. Hearing Notice
On February 9, 2001, a Public Hearing Notice (Exhibit 2) was
mailed to all of the property owners and residents of the
affected area. The notice invites written or oral input on the
proposed parking restriction.
F. Affected Area
If approved, the proposed "NO PARKING 2:00 a.m. to 6:00 a.m. -
PERMITS EXEMPT" parking restrictions would be established on
the street segments within the area shown on the map attached
to the Petition (Exhibit 1) and listed as follows:
the southerly portion of Pecan Avenue [Note: In the
northerly "panhandle" of the affected area (see Map) only
the west side of the street will have the parking
restriction.]
Benwood Drive; and
Bambi Court.
G. Non - Neighborhood Vehicles
The program created by Resolution No. 93 -970 [No Overnight
Parking] was established primarily to address problems of
overcrowding and the excessive number of vehicles parked on the

street as the result of overcrowding. As such, that program
provided for the issuance of Parking Permits, only when more
than four (4) vehicles were registered to a given address.
The problem described above is of a different nature -- that of
the parking of non -local vehicles in a given neighborhood. It
was determined that it might be possible to address such a
problem if the No Overnight Parking program was modified to
eliminate the four (4) vehicle minimum for the issuance of
Parking Permits. This revised program is essentially a
combination of the No Overnight Parking program and the "Permit
Only Parking" program established in the neighborhoods near
Moorpark College.
Accordingly, the above Petition states that Parking Permits
would be issued to any vehicle registered to an address within
the affected area. In this way, only local residents would be
allowed to park on the street overnight.
H. Fiscal Impact
1. signs: It is estimated that the cost of installing the
required NO PARKING signs will be approximately $500.
2. Permits: The administration of the issuance of Parking
Permits will require the re- direction of staff time to that
effort. No estimate of the time or cost for those efforts
has been developed.
3. Budget: The above anticipated costs can be funded without
the need for any additional appropriation or Budget
amendment.
STAFF RECOMMENDATION
Adopt the attached Resolution.

PETITION FOR (AGAINST) PERMIT ONLY PARKING
1, the signer of this petition, am in favor of, or opposed to, as indicated below, the City of
Moorpark establishing a "NO PARKING 2:00 A.M. TO 6:00 A.M. — PERMITS EXEMPT"
zone on the southerly portion of Pecan Avenue, Benwood Drive and Bambi Court (see map on
reverse side). I reside or own property at the address noted adjacent to my signature. I
understand the intent of this proposed action is to alleviate vehicle overcrowding in this
neighborhood.
If the proposed parking restriction is approved, parking on the southerly potion of Pecan
Avenue, Benwood Drive and Bambi Court will be prohibited between the hours of 2:00 a.m. to
6:00 a.m. daily. Permits exempting certain vehicles from these parking restrictions may be
issued to any vehicle registered to individuals residing at an address within the affected area.
Possession of a permit does not exempt a vehicle from any other parking restriction — including
street sweeping parking restrictions.
There is no fee for a parking permit. Permits must be renewed annually.

To Consider Establishing Parking Restrictions
In Your Neighborhood as Follows:
No Parking 2:00 a.m. to 6:00 a.m.
(Permits Exempt)
Dear Property Owner and/or Resident:
Public Hearing
A Public Hearing has been scheduled before the City Council for 6:30 p.m., Wednesday, March
7, 2001, in the City Council Chambers, at City Hall, 799 Moorpark Avenue, Moorpark CA
93021. You are welcome to provide any written comments to the City Clerk on or before that
time. You are also welcomed to be present and to present oral testimony at the Public Hearing.
Be advised that this Public Hearing Notice has been sent to only the owners and residents of the
properties within the affected area as shown on the enclosed map.
Purpose of Hearing
The purpose of the Public Hearing is to allow the City Council to consider the establishment of
"Permit Only" parking zones on certain streets in your neighborhood. Residents affected by this
parking restriction would be issued Parking Permits, on request, exempting their vehicle(s) from
this parking restriction. The affected streets are shown on the enclosed map and listed as
follows:
• the southerly portion of Pecan Avenue,
• Benwood Drive; and
• Bambi Court.
Background: Permit Only Parking Zones
The City has established a program which allows for the establishment of "No Overnight
Parking" in any residential neighborhood in the City. This program was created to empower
residents to address problems they believe to be associated with the parking of an excessive
number of vehicles in their neighborhood. When such problems are believed to exist in a
particular neighborhood, an organization or individual representing that neighborhood may
request that the City Council schedule a Public Hearing to consider the establishment of a No
Parking restriction between the hours of 2:00 a.m. and 6:00 a.m, on all of the streets in that
neighborhood. If the request is approved, signs will be installed enacting the parking restriction.

Parking Problem
Apparently certain individuals who reside on the south side of Campus Park Drive, are choosing
to park their vehicles overnight on one or more of the above mentioned streets. This parking of
non -local vehicles on streets in your neighborhood, is perceived to be a problem by a number of
your neighbors.
Request / Petition
The City is in receipt of a Petition, signed by a number of your neighbors, in support of
establishing a "Permit Only" parking program on the above cited streets. A re -print of the
language in the Petition is as follows:
"I, the signer of this petition, am in favor of, or opposed to, as indicated below,
the City of Moorpark establishing a "NO PARKING 2:00 A.M. TO 6:00 A.M. —
PERMITS EXEMPT" zone on the southerly portion of Pecan Avenue, Benwood
Drive and Bambi Court. I reside or own property at the address noted adjacent to
my signature. I understand the intent of this proposed action is to alleviate vehicle
overcrowding in this neighborhood.
If the proposed parking restriction is approved, parking on the southerly potion of

Proposed Action
The City Council will consider this request at the subject Public Hearing. If the City Council
determines that the public interest would be served by enacting these parking restrictions, a City
Council Resolution will be adopted directing that signs be installed to read: "NO PARKING 2:00
A.M. TO 6:00 A.M. -- Permits Exempt." Said parking restriction would be effective every day.
Exemption: Parking Permits
The proposed parking restriction program provides that, upon request, a no cost Parking Permit
will be issued to residents within the affected area, for any vehicle registered to an address within
the affected area. In addition, there are provisions for the issuance of Gust Permits to addresses
within the affected area, for periods not to exceed fourteen (14) days, and up to a maximum of
four (4) times per year.

Public Input
Again, the purpose of the Public Hearing is to receive testimony for or against this proposal. If
you have views on this matter you are encouraged to provide written and/or oral input at or prior
to the hearing. Written testimony should be addressed to the Moorpark City Clerk. Oral
testimony should be provided at the public hearing.

RESOLUTION NO. 2001 -
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF MOORPARK, CALIFORNIA, ESTABLISHING NO
PARKING 2:00 A.M. TO 6:00 A.M. ON PECAN
AVENUE, BENWOOD DRIVE AND BAMBI COURT
WHEREAS, Section 22507 of the California Vehicle Code (CVC)
provides for the establishment of parking restrictions on any
local street; and
WHEREAS, said CVC Section also provides for the establishment
of preferential parking privileges for residents adjacent to any
street upon which parking restrictions have been placed, which
exempt any vehicle displaying a permit issued by the local agency,
from said parking restrictions; and
WHEREAS, Pursuant to those provisions, the City Council
adopted Resolution No. 93 -970 establishing policies and procedures
providing for the establishment of No Overnight Parking
restrictions within any residential neighborhood of the City; and
WHEREAS, said Resolution also sets forth policies and
procedures for the issuance of permits exempting certain vehicles
from those parking restrictions; and
WHEREAS, the City is in receipt of a petition prepared and
compiled in accordance with the requirements of Resolution No. 93-
970, requesting the prohibition of parking between the hours of
2:00 a.m. and 6:00 a.m, on those streets identified in the
petition; and
WHEREAS, public hearing notices have been mailed to all
residents and property owners affected by such action, advising
them of the above mentioned request and of the possible action of
the City Council to establish the above described parking
restrictions; and
WHEREAS, a public hearing was convened before the City
Council on March 7, 2001, to consider the above mentioned petition
and to accept testimony in favor or against the proposed parking
restrictions; and
WHEREAS, the City Council has determined that it is necessary
and appropriate to establish said parking restrictions; and
WHEREAS, the City Council has also determined that it is
necessary and appropriate that provisions of Resolution No. 93 -970
which limit the issuance of parking permits should be revised.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES
HEREBY RESOLVE AS FOLLOWS:
SECTION 1. "NO PARKING 2:00 A.M. to 6:00 A.M." zones are
hereby established on Benwood Drive, Bambi Court and a portion of
Pecan Avenue, as shown on the map attached as Exhibit 'A'.
Section 2. Said parking restrictions shall not apply to any
vehicle displaying a permit issued by the City exempting said
vehicle from said parking restrictions.
SECTION 3. Such parking permits may only be issued in
accordance with the applicable policies and procedures set forth
in Resolution No. 93 -970, except that such provisions, as they
apply to the parking permits issued pursuant to Section 2 of this
Resolution, are hereby revised to allow for the issuance of
parking permits to any vehicle registered to any owner or resident
of any property fronting the street segments identified in Section
1 of this Resolution.
SECTION 4. Any vehicle issued such a parking permit shall not
be exempt from any other parking restriction applicable to the
streets subject to the parking restrictions set forth herein, or
any parking restrictions applicable to any other street in the
City.
SECTION 5. The City Manager is hereby directed to have placed
and maintained the appropriate signs giving notice of these
parking restrictions and regulations.
SECTION 6. The City Clerk shall certify to the adoption of
this Resolution and shall cause a certified resolution to be filed
in the book of original Resolutions.
