OORPARK, CALIFORNIA City Council NfeetinLy of 3- 7 -0da/ _ ACTION: MOORPARK CITY COUNCIL BY: AGENDA REPORT To: Honorable City Council From: Nancy Burns, Senior Management Analyst l� Date: February 27, 2001 (CC Meeting of March17, 2001) Subject: CONSIDER REPORT ON THE PROGRESS OF MOUNTAIN VIEW DEVELOPMENT BY CABRILLO ECONOMIC DEVELOPMENT CORPORATION (TRACT NO. 5161, RESIDENTIAL PLANNED DEVELOPMENT NO. 98 -7) BACKGROUND A Disposition and Development Agreement (DDA) was executed July 8, 1.998, for the construction of fifty -nine (59) homes on the Gisler Field site, fifteen (15) of which are to be affordable to low and very low income households. The project has been delayed considerably; the Amended Schedule of Performance calls for the Final Map to have been recorded in March 2000. LJpdates have been provided regularly to the Moorpark Redevelopment Agency or the City Council since February '7, 2.001. DISCUSSION At its February 7, 2001, regular meeting, the Council heard testimony from a resident who had applied for one of the Affordable Units, requesting the Council examine the pricing and selection procedures used by the developer. The developer also addressed the Council on these issues. The developer was asked to copy the Council on letters to be sent to applicants who have expressed concerns about these matters. The concerns expressed include the following: 1. Applicant selection process; 2. Change in anticipated pricing of homes; Honorable City Council Date 02/27/01 Page 2 3. Change in required down payment, due to increased house price; 4. Lack of selection of lot and /or size of house; and 5. Overall. communication with applicants throughout the marketing and selection process. Staff met with the developer to review these issues and related matters pertaining to the project. The developer offered to prepare a letter which addresses stated general concerns expressed by potential buyers of Affordable Units (attached). In addition, the developer will send a letter to the residents who have sent letters of concern to the City or testified at the last Council meeting; this letter will address each applicant's individual concerns. Staff continues to work with legal counsel and the developer to resolve issues relating to various loan documents and the proposed amendment to the DDA and its attachments. The City Engineer has met with the developer's engineer to resolve issues such as acceptance of the legal description of the property needed as right -of -way for the north /south street; storm water detention; National Pollutant Discharge Elimination System (NPDFS) requirements; and sight distance requirements at the northern terminus of the north /south street through the development. See attached letter dated March 21, 2000 regarding the application process for the affordable homes. Applications were accepted for the 15 affordable homes on April 2, 2000. We accepted applications cn a first come first served basis. Zile first 63 of 145 applications .received have been reviewed so far. we have given preference to those applicants with a Moorpark address. No o.:her preference has been given. Cn June 27, 2000, we sent out the attached letter (narned blanked out) to applicants who, based on the informaticn they had presented to us, did not appear to be eligible; the letter gave them. an opportunity to respond. Scrr.e did so. Based on the initial review and the availability of homes in Phase 1, tievFn applicants were submitted for approval to Washington Mutual Bank, the first Mortgage lender. All have been approved. upon approval, the seven were asked to indicate their lot preference. For the one family who was approved for a very low income t;!ree bed-rcam home and the ore fLanily who was approved for a very low income four bedroom home, there is only one of each available in. Phase 1. The : T_-. ly who was approved for the very low income three bedroom home did not qualify based on income for the higher priced four bedroom home. Since the criginal marketin^, we did in May 2000 increase our Affordable prices '.cased on actual construction bids, increased school district fees, higher city fees than originally projected, added interest on L•he RDA loan, and other factci's. Attached is a chart showing the sales prices. At this time we anticipate being able to not increase the affordable prices further if we are able to start construction as anticipated. The long periods between initial application and projected purchase is clearly the major source of frustration fox all concerne3. We have sent letters to the Staceys, the Hendersons, and isabe' Huerta responding specifically to their situations. With their p::rmission, we would be happy to share copies of these letters with you. We have also asked Joanne Seaton of Trcop Realty to contact rho Staceys and the Hendorscns to review with them their alternatives. Tn'e will have one of our Homeownership Counselors contact mrs. Gar:ia Cc: Appl :=. rik h C L rt 1 j CID Q �NighborWorkr,, a. jOx�:, "s A uruld way A^yancy City of Moorpark MEMORANDUM February 28, 2001 To: Wayne Loftus, Director of Community Development Nancy Burns, Sr. Administrative Assistant From: Walter Brown, City Engineer Subject: Tract 5161, Cabrillo — Status, Revised with Final Map Recording Date Sight Distance at Poindexter and `A' Street (Leta Yancy Road) Bob Warren, of Ramseyer Engineering, has shown us exhibits for the relocation of the north perimeter wall of the subdivision and the changes necessary to meet the sight distance criteria. We have reviewed his exhibits. They show the adequacy of his proposal to meet the sight distance requirements. We have not received modified improvement plans that show the changes. I anticipate that when received the plans will be correct and will be approvable. NPDES Compliance Mr. Warren has proposed the use of `structural treatment' `Best Management Practices' (BMP's) consisting of proprietary filters to satisfy the `National Pollutant Discharge Elimination Standards' ( NPDES) requirements. We have had discussions with Mr. Warren and are satisfied that he is proposing a viable, although maintenance intensive, solution to the NPDES requirements. He has not prepared improvement plans that show the specific model of filter units or the details for their installation It is our understanding that Mr. Warren will provide construction plans showing the use of AbTech Industries series CO2000 filters. The model is adaptable to standard curb inlets. Storm Water Peak Flow Mitigation The conditions of approval for the subdivision require that the developer construct improvements such that drainage will be detained on -site when the drainage amount is between the ten year and fifty year storm event. The developer's engineer, Mr. Bob Warren, has not shown that the rainfall peak flow from the project will be no more than the pre - development flow. He has shown that the increase in flow is negligible, one cubic foot per second (equal to 449 gallons per minute), and close enough to enable us to make a finding of substantial compliance for the condition of approval. Street Right -of -Way at North -east Corner of Subdivision (`A' Street) The metes - and - bounds description is satisfactory. The description attached to the deed is required to be signed and sealed by the professional who prepared it. Prediction of Recordation of Final Map Recordation of the Final map is dependent on completion of the improvement plans and receipt of bonds and documents required to satisfy the conditions of approval. Presently none of those materials are being reviewed by the Engineering Department. It is possible that these submittals will need corrections before they can be approved. The Final Map has gone through four plan check Tract 5161 — Status Report reviews. Upon receipt of complete and correct plans, we will need approximately twenty -five working days to obtain City Council approval of the final map. The schedule is: • Review of plans and documents 10 days • Preparation, review and modification of agenda report 5 days ❑ Median period for agenda report processing 10 days Based on the performance of the developer's team I estimate that we will not be able to recommend the final map to City Council in less than 60 days from today, say the meeting of May 2, 2001. A recent submittal by the applicant has prompted us to set the date as shown.
