HomeMy WebLinkAboutAGENDA REPORT 2001 0321 CC REG ITEM 11DITEM 1,s D' i;-,- C \.rte' nt - 3-al -aooi ACT'.')',': " } ',••2Ut/ED - -- MOORPARK CITY COUNCIL AGENDA REPORT Rv: To: Honorable City Council From: Nancy Burns, Senior Management Analyst Date: March 14, 2001 (CC Meeting of March 21, 2001) Subject: CONSIDER REPORT ON THE PROGRESS OF MOUNTAIN VIEW DEVELOPMENT BY CABRILLO ECONOMIC DEVELOPMENT CORPORATION (TRACT NO. 5161, RESIDENTIAL PLANNED DEVELOPMENT NO. 98 -7) BACKGROUND A Disposition and Development Agreement (DDA) was executed July 8, 1998, for the construction of fifty -nine (59) homes on the Gisler Field site, fifteen (15) of which are to be affordable to low and very low income households. The project has been delayed considerably; the Amended Schedule of Performance calls for the Final Map to have been recorded in March 2000. Updates have been provided regularly to the Moorpark Redevelopment Agency or the City Council since February 7, 2001. DISCUSSION Staff continues to work with legal counsel, the developer, and construction lender to resolve issues relating to various loan documents, the proposed amendment to the DDA and its attachments, and the Suhordi.nati.on Agreement with the lender. The owner of property required for right -of -way has requested a driveway to access the north /south street through the project; this request has been denied, as staff believes adequate access to the owner's property is available via two (2) existing driveways onto Poindexter Avenue. When this matter is resolved, escrow can close on the acquisition of that strip of land by the developer., and subsequent transfer of title to the City. Honorable City Council Date 03/14/01 Page 2 The City Engineer continues to work with the developer's engineer to complete the resolution of issues such as acceptance of the legal. description of the property needed as right -of -way for the north /south street (without driveway easement); storm water detention; National Pollutant Discharge Elimination System (NPDES) requirements; and sight distance requirements at the northern terminus of the north /south street through the development. An update memo from the City Engineer is attached to this report. STAFF RECOMMENDATION Receive and file this report. Attachments City of Moorpark MEMORANDUM March 14, 2001 To: Wayne Loftus, Director of Community Development Nancy Burns, Sr. Administrative Assistant From: Walter Brown, City Engineer Gv'7f) Subject: Tract 5161, Cabrillo — Status, Revised with Final Map Recording Date Sight Distance at Poindexter and `A' Street (Leta Yancy Road) Ramseyer Engineering has shown the relocation of the north perimeter wall of the subdivision. We have reviewed the plans. They meet the sight distance requirements. The plans have minor corrections. I anticipate that the plans can be corrected within one week. NPDES Compliance The plans show the use of `structural treatment' `Best Management Practices' (BMP's) consisting of proprietary filters to satisfy the `National Pollutant Discharge Elimination Standards' ( NPDES) requirements. We have reviewed the plans and are satisfied that the filters will meet the NPDES requirements. The improvement plans show the specific model of filter units and details for their installation. Storm Water Peak Flow Mitigation The conditions of approval for the subdivision require that the developer construct improvements such that drainage will be detained on -site when the drainage amount is between the ten year and fifty year storm event. The developer's engineer, Mr. Bob Warren, has not shown that the rainfall peak flow from the project will be no more than the pre - development flow. He has shown that the increase in flow is negligible, one cubic foot per second (equal to 449 gallons per minute), and close enough to enable us to make a finding of substantial compliance for the condition of approval. Street Right -of -Way at North -east Corner of Subdivision (`A' Street) The metes - and - bounds description is satisfactory. The description attached to the deed is required to be signed and sealed by the professional who prepared it. The acceptability of the right -of -way has been clouded by the developer's commitment to provide a driveway, at a specific location, to the granting owner. The developer's engineer has shown the driveway on the improvement plans. The engineer -of -work will have the driveway removed from the plans. Approving the proposed driveway location is inappropriate at this time. The driveway location and size will be considered at the time the granting property owner submits a development proposal. Grading Quantities The developer has submitted a request to import 25,000 cubic yards of fill for the project. The grading plans show an import amount of 3,300 cubic yards. The conditions of approval of the Tract 5161 — Status Report tentative map for the project state that the project is to be balanced on site and requires import operations of more than 100 truckloads to be approved by City Council. I have discussed this issue with Robert Warren, the engineer -of -work for the project. Mr. Warren was unaware of the 25,000 cubic yard import request and is looking into the issue. Prediction of Recordation of Final Map Recordation of the Final map is dependent on completion of the improvement plans and receipt of bonds and documents required to satisfy the conditions of approval. Presently the final map is being reviewed by the Engineering Department. As noted, above, the improvement plans will need to be corrected before they can be approved. The Final Map and grading/improvement plans have gone through five plan check reviews. Upon receipt of complete and correct plans, we will need approximately twenty -five working days to obtain City Council approval of the final map. The schedule is: ❑ Review of plans and documents 10 days ❑ Preparation, review and modification of agenda report 5 days ❑ Median period for agenda report processing 10 days Based on the performance of the developer's team I estimate that we will not be able to recommend the final map to City Council in less than 45 days from today, say the meeting of May 2, 2001. The condition of the recent plans and map submitted by the applicant has prompted us to maintain that date from our last progress report.
