Subject: CONSIDER REPORT ON THE PROGRESS OF MOUNTAIN VIEW
DEVELOPMENT BY CABRILLO ECONOMIC DEVELOPMENT
CORPORATION (TRACT NO. 5161, RESIDENTIAL PLANNED
DEVELOPMENT NO. 98 -7)
BACKGROUND
A Disposition and Development Agreement (DDA) was executed July
8, 1998, for the constriction of fifty -nine (59) homes on the
Gisler Field site, fifteen (15) of which are to be affordable to
low and very low income households. The project has been
delayed considerably and updates have been provided regularly to
the Moorpark Redevelopment Agency or the City Council since
February 7, 2001.
DISCUSSION
Staff continues to work with legal counsel, the developer, and
construction lender to resolve issues relating to various loan
,documents, the proposed amendment to the DDA and its
attachments, and the Subordination Agreement with the lender.
Staff anticipates bringing a proposed Second Amendment to the
DDA to the Agency for consideration at its April 18, 2001,
meeting.
An update memo from the City Engineer is attached to this
report.

Subject: Tract 5161, Cabrillo — Status, Revised with Final Map Recording Date
Sight Distance at Poindexter and `A' Street (Gisler Road)
There has been no change from my last report. The item is resolved.
NPDES Compliance
There has been no change from my last report. The item is resolved pending formation of an
assessment district to fund the maintenance of the NPDES facilities.
Storm Water Peak Flow Mitigation
There has been no change from my last report. The item is resolved.
Street Right -of -Way at North -east Corner of Subdivision (`A' Street)
There has been no change from my last report. The developer has agreed to remove the driveway
from Gisler Road to the property to the east.
Gisler Road — Street Name
The developer's engineer is placing "Gisler Road" at the appropriate locations on the final map and
grading/improvement plans.
Grading Quantities
The developer has submitted a request to import 25,000 cubic yards of fill for the project. The
grading plans show an import amount of 3,300 cubic yards. The conditions of approval of the
tentative map for the project state that the project is to be balanced on site and requires import
operations of more than 100 truckloads to be approved by City Council. I have continued my
discussed this issue with Robert Warren, the engineer -of -work for the project. Mr. Warren is
insistent that the 25,000 cubic yard import request is not required. Staff is preparing an agenda
report to present the issue of import to the City Council. Staff's recommendation to the City
Council will be to approve the quantity requested subject to conditions that will mitigate the impacts
of the haul.
Prediction of Recordation of Final Map
Recordation of the Final map is dependent on completion of the improvement plans and receipt of
bonds and documents required to satisfy the conditions of approval. Presently the final map and
improvement plans are being corrected by the developer's engineer. The Final Map and

grading /improvement plans have gone through five plan check reviews. Upon receipt of complete
and correct plans, we will need approximately twenty -five working days to obtain City Council
approval of the final map. The schedule is:

❑ Preparation, review and modification of agenda report 5 days
❑ Median period for agenda report processing 10 days
Based on the performance of the developer's team I estimate that we will not be able to recommend
the final map to City Council in less than 35 days from today, say the meeting of May 2, 2001. The
applicant must submit the final map and improvement plans within 10 daysto allow us to maintain
that date from our last progress report.
