SUBJECT: Consider Fee Reduction Request From Life Spring Church
DISCUSSION
The City is in receipt of a letter from Life Spring Church
requesting a reduction in facility rental fees (see Attachment
A). Currently, the Church rents Arroyo Vista Recreation Center
(AVRC) each Sunday from 7 a.m. to 11 a.m. The Church rents all
of AVRC which includes the multi purpose room, activity room,
kitchen and lobby (the lobby is 7 a.m. to 10 a.m.) . City staff
performs room set -up and clean up. Staff is on duty during the
entire time of the rental, which is standard procedure for all
rentals.
As a local non - profit group, Life Spring Church falls in our
lowest rental category. The City's rental fees and policies are
set by a resolution adopted by the City Council. The hourly
rental rate is based on rental category (i.e., resident /non
profit, non resident, for profit) and the number of individuals
in attendance. Life Spring Church has approximately 180 people
in attendance on Sundays. The rental fee schedule has been
attached for your information (see Attachment B).
The rental rate for Life Spring Church is as follows:
Multi Purpose Room - 4 hrs @ $40 /per hour
Activity Room - 4 hrs @ $40/ per hour
Kitchen - 4 hrs @ $10 /per hour
Lobby - 3 hrs @ $10 /per hour
After hour fee for staff - 3 hrs @ $18 /per hour

The room fees are for basic use of a room, which includes
utilities (electricity, gas, and water), clean -up and general
wear and tear of the room, tables and chairs. The "after hours"
fee covers the cost to bring in staff when the facility would
otherwise be closed and the City would not be incurring
personnel costs. ,Since the Church's rental includes three hours
before AVRC opens to the public, the City incurs additional
staff cost. Each rental agreement includes an optional set -up
fee. Renters can either pay the City to set up the room or
perform the set up themselves. In the case of Life Spring
Church, they have elected to have the City perform set -up.
In an effort to work with Life Spring Church and to make the
rental cost easier for them to pay, staff agreed to spread their
attendance number over two rooms, so that their rate is based on
an attendance of 90 people rather than the total number of 180.
The City has not done this for any other group, but staff felt
the action could be justified. This lowered their rate by $10
per hour and saved the church $80 per day. Additionally, the
Church agreed to reduce their rental period by 30 minutes, which
also helped reduce their cost.
The City's building rental policy gives local non profit groups
the ability to rent a City facility at a significantly reduced
cost once each calendar year. Eligible groups only pay for
direct costs that will be incurred by the City as a result of
the rental, such as staff time. The types of events that qualify
are those that have a community benefit such as fundraisers that
enhance a non profit group's ability to serve the community.
The City has had at least two other long -term church rentals in
the past. One rented the Community Center and the other rented
AVRC on an ongoing basis over a one to two -year period. Both of
these rental were handled in the same manner as Life Spring
Church and neither included fees waivers nor any other reduced
rate other than what is identified in the City's fee schedule.
It is staff's position that Life Spring Church's rental does not
meet the threshold criteria for any additional rate reduction.
The City has received numerous requests for building rental
waivers from each of the youth sports organizations and from
other non profit groups such as Cub Scout and Girl Scout groups,
and each of these requests have been denied unless they served a

community benefit. Should, however, the City Council wish to
grant the one -time non profit rental waiver (charging only
direct City costs), it should be granted for one Sunday rental
only so as not to set a significantly new precedent.
Additionally, staff can continue to work with the Church to find
ways to reduce the overall rental cost by possibly reducing the
number of rooms used and considering shorter rental hours.
STAFF RECOMMENDATION
Deny the request.

Thank you so much for your time on the phone yesterday. Let me summarize our
situation. Our Church had been meeting at the Regal movie theater. Its closing on
January 28 took us quite by surprise. Like many people in Moorpark, we expected
it to occur at some point but we were hoping for more time. January 1, we began
making plans to move into an industrial building on Kazuko Court and have been
making the necessary improvements but were not at a point where we could move
in yet and probably will not be until, April 811 at the earliest, and it could be as
late as May 6th. As a contingency plan, we have been renting the Arroyo Vista
Community Center. Initially, we were paying $540 a week. In working with the
personnel there, we are now paying $444 a week. This is approximately two to
three times what we were paying at the movie theater and with the added costs of
rushing our building project, we are experiencing a minor cash flow problem. We
are currently putting the Arroyo Vista expenses on a credit card with the hopes
of paying that off once we are in the new building.
What we are asking for, is a reduction in the rent at Arroyo Vista if that is
possible. We certainly want to pay any direct costs associated with our using the
facilities and that may be the full rent. But if there is some margin, would the
city consider a one time reduction considering our circumstances.) Thank you for
