Subject: CONSIDER ACCEPTING INTEREST IN REAL PROPERTY FOR RIGHT
OF WAY NEEDED FOR DEVELOPMENT OF TRACT NO. 5161,
RESIDENTIAL PLANNED DEVELOPMENT NO. 98 -7, TO BE
DEVELOPED BY CABRILLO ECONOMIC DEVELOPMENT CORPORATION
(CEDC)
BACKGROUND
Condition No. 60 of the Conditions of Approval for Tentative
Tract Map No. 5161, Resolution No. 99 -1631, approved July 7,
1999, requires the developer to acquire any land needed for
right of way in this development at its own expense.
DISCUSSION
Resolution No. 85 -163 authorizes the City Clerk to consent to
the recordation of a deed conveying interest in property to the
City, providing the Council has approved.
Land needed for right of way along the eastern side of the
north /south street through this development has been identified
by the developer. The map for this strip of land has been
reviewed and the legal description approved by the City
Engineer. The property has been placed in escrow.
Once the City Clerk has accepted this interest in the property
in question, the escrow can close.

STAFF RECOMENDATION
Direct City Clerk to accept interest in the property as shown on
attached map and consent to the recordation of the Grant Deed.
