EJ fzeeornrnenofi -non BY- MOORPARK CITY COUNCIL AGENDA REPORT The Honorable City Council Gwen Indermill, Recreation Superintendent April 10, 2001 (CC Meeting of April 18, 2001) SUBJECT: Approve Request From Moorpark Girl's Softball Association to Waive Park Rental Fees for Softball Tournament SUMMARY The City Council is being asked to approve an amendment to the City's Use Agreement with Moorpark Girl's Softball Association (MGSA). The proposed Amendment would include additional dates to incorporate the annual MGSA softball tournament in June. By approving the amendment, the Council would be incorporating the Association's annual tournament request to waive certain park rental use fees into the Use Agreement. DISCUSSION In December 1997, the City entered into a Use Agreement with MGSA for use of the three ballfields March 1 through July 31 for Spring Season, and September 1 through December 31 for Winter Season league games and practices, at a cost of $1.00 per year. Additionally, MGSA has use of the AVCP concession stand for the Spring Season at a cost of $1,000 per year. When MGSA, or any other youth sports organization that has a Use Agreement with the City, wishes to use park facilities outside their previously authorized dates, they are charged appropriate park rental fees set by the City Council. MGSA Softball Tournament Historically, MGSA has held a girl's softball tournament in conjunction with the American Softball Association (ASA). This tournament serves as their major fundraiser. This year MGSA plans to conduct the tournament using ballfields at Miller Park, Mountain Meadows Park, Peach Hill Park and Arroyo Vista Community Park between the hours of approximately 7 a.m. and dusk. To limit the inconvenience to neighboring residents, staff proposes to restrict play at Mountain Meadows Park from 9:00 a.m. to 5:00 p.m. This action is consistent with the action taken by City Council in previous tournament arrangements ( Kiwanis and MGSA) and is consistent with the City's Park Rental Rules. Additionally, MGSA will be instructed to place its youngest age groups at Mountain Meadows Park in an effort to reduce the likelihood that foul balls will stray onto adjacent residential property. This is similar to the restriction placed on the MGSA last year and Kiwanis for its tournament last November. As has been the case in the past, MGSA plans to perform all field preparations using both their own and City equipment. Last year, for the first time, the City Council waived MGSA tournament rental fees for all non direct costs. However, MGSA was responsible for costs associated with scheduling one staff person assigned to monitor park activities and to service the restrooms and trash cans and use of ballfield lights. Without an approved waiver, MGSA's tournament would total approximately $2,230.00 in park rental fees. On March 21, 2001, the City Council approved an amendment to its Use Agreement with AYSO, which addressed similar tournament arrangements regarding the waiver of non direct fees and direct fees. Therefore, staff is proposing that the Council approve of an amendment to MGSA's Use Agreement that would eliminate the need for the organization to request annual fee waivers. STAFF RECOMMENDATION Direct staff to prepare an Amendment to Moorpark Girls Softball Association's Use Agreement incorporating the annual softball tournament, consistent with the provisions outlined in the Agenda Report, and authorize the City Manager to sign the Amendment.
