WALL City Clerk MEMORANDUM TO: Parks and Recreation Commission FROM: Community Services Department DATE: December 7, 1988 � SUBJECT: California Wildlife, Coastal and Park Land Conservation Act of 1988 (Proposition 70) Recently, California voters approved Proposition 70, a Per Capita Grant Program under provisions of the California Wildlife, Coastal and Park Land Conservation Bond Act of 1988. Under the Per Capita Grant Program, a review of eligibility of all local government units to receive grant funds has been completed, and the allocated amounts to each eligible agency has been set according to provisions of the Act. Moorpark' s allocation under the Per Capita Program is $68,000' Applications are due January 13, 1989, for Fiscal Year 1989/90 appropriation. Grant Highlights: 1. Proposition 70 is a three year funded program. If we fail to submit an application by January 13, I989, the next two application deadlines are September 15, 1989, for fiscal year 1990/91; and September 15, 1990, for fiscal year 1991/92' 2. Projects submitted for funding must be started within three years of the date the funds are appropriated. 3. The minimum amount that an applicant may request for any individual project is $20,000. 4. Grant funds may be used for acquisition and/or development projects. 6. Up to 20% of the grant funds may be expended for nonconstruction costs such as plans and specifications, etc. Eligible Projects: 1. Acquisition: Acquisition of readily accessible open space areas is eligible. Acquisitions may include developed or undeveloped parcels, fee title, less than fee title such as easements, rights of way, riparian rights, or any interest sufficient to accomplish project goals. Priority consideration should be given to open space areas with ready access to large numbers of the immediate population. Acquisition of lands and structures to be converted to recreation use is also eligible. Projects that involve construction of new or renovation of old facilities must provide access for the disabled in accordance with applicable State statutes. 2. Development/Rehabilitation: Development of a park that meets an identifiable recreation need, or that provides recreation opportunities not now available, is eligible. Facilities may include athletic fields, courts, open playfields, tot lots, indoor facilities, picnic tables, and a variety of other facilities that provide opportunities for active and passive recreation use. Adequate tenure to the property is required for development/rehabilitation projects. Adequate tenure means the land must be owned by the applicant or subject to a lease or other long-term interest held by the applicant that is satisfactory to DPR. Rehabilitation of park, recreation, or historical facilities that are no longer fully serviceable, and that, when rehabilitated, provide expanded or additional recreation or historical opportunities, is eligible. Rehabilitation may include improvement of facilities that are inoperative, unsafe, or allow only limited use, as well as improvements to provide expanded use by the disabled, senior citizens, or other groups. 3. Historic Preservation: Projects for acquisition, preservation, reconstruction, or restoration of historic sites or structures are eliQible. Projects must appear on one of the following three registration ITM100I2. 1?/PRA8FNDA programs: 1) National Register of Historic Places; 2) California Historic Landmark Program; or, 3) Points of Historic Interest Program. Ineligible Projects: 1. Projects located on school properties that are expressly for educational purposes are ineligible. 2. Projects traditionally provided by the private, nongovernment sector or by concessionaires will be considered ineligible unless it can be shown that private entrepreneurs are unable to make such provisions and that the project is based on measurable need. 3. Master planning for park acquisition and development. 4. Highway beautification and parking for other than recreation purposes. 5. Operations and Maintenance. Listed below for your review and consideration are possible projects that are eligible for funding under Proposition 70 guidelines: 1. Monte Vista Park - Phase 2 development. 2. South Meadows Park - Add fourth tennis court and/or light three proposed tennis courts, or four courts. 3. Construct restroom facility at a City park. 4. Add picnic facility (shelter) at a park(s). 5. Purchase Star Club building from Gelco Space. 6. Add recreational equipment at a park(s). 7. Assist with Phase I development of the Community Park. Individual commissioners may have additional projects for consideration. If a list of projects can be provided to staff prior to our meeting, we can provide copies for each Commission member. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, APPROVING THE APPLICATION FOR GRANT FUNDS FOR THE PER CAPITA GRANT PROGRAM UNDER THE CALIFORNIA WILDLIFE, COASTAL, AND PARK LAND CONSERVATION ACT OF 1988 for the following project(s): WHEREAS, the people of the State of California have enacted the California Wildlife, Coastal , and Park Land Conservation Act of 1988, which provides funds to the State of California and its political subdivisions for acquiring and/or developing facilities for public recreational and open space purposes; and WHEREAS, the State Department of Parks and Recreation has been delegated the responsibility for the administration of the program within the state, setting up necessary procedures governing application by local agencies under the program; and WHEREAS, said procedures established by the State Department of Parks and Recreation require •the applicant to certify by resolution the approval of application(s) before submission of said application(s) to the state; and WHEREAS, said application(s) contain assurances that the applicant must comply with; and WHEREAS, the applicant will enter into an agreement with the State of California for acquisition or development of the project(s); NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Moorpark HEREBY: 1.
