SUBJECT: Consider Conditional Approval to Haul 28,093
Cubic Yards of Soil to Tract 5161 - Cabrillo.
BACKGROUND
The tentative map for Tract 5161 - Cabrillo was conditionally
approved by the City Council by Resolution 99 -1631 on July 7,
1999. Condition number 31 of this tentative map approval states
that the project is to be balanced on site and requires import
operations of more than 100 truckloads to be approved by the
City Council. The grading plan indicates a total soil import
amount of 28,093 cubic yards will be required to complete the
project. Because the soil import quantity exceeds the amount
allowed by the conditions of approval and the discretion of
staff, the City Engineer has not approved the grading plan for
the tract at this time.
DISCUSSION
Cabrillo Economic Development Corporation, the project
developer, has requested permission to haul 28,093 cubic yards
of soil from Tract 4975 - Lennar, to Tract 5161 - Cabrillo.
Specific information regarding the haul from Tract 4975 has been
provided to staff. Because soil for import is subject to
availability, the soil from Tract 4975 - Lennar may not be
available when the Developer is ready to commence an import
operation. In that set of circumstances staff, if authorized by
the City Council, is ready to review and approve or, if
necessary, to modify or reject other export sites and haul
routes. Staff has weighed the conditions of approval, the
quantities to be hauled, the overall significance of the haul
operation, the requested export site, the circumstance that an

alternate import site may be needed and the developer's proposal
for the haul operation and requests direction in this matter
from the City Council. Should the City Council determine that
it wishes to authorize staff to review and approve the soil
import operation staff has prepared appropriate conditions and
included them in the staff recommendations if this report. Staff
is satisfied that the haul route, alternate haul route review
and conditions to be placed on approval of the haul operation
represent the optimum operation should the City Council approve
this soil import request.

Conditions of Approval
Haul of 28,093 Cubic Yards of Soil to Tract 5161.
The following conditions shall be appended to the encroachment
permit issued to Cabrillo Economic Development Corporation, the
project developer of Tract 5161, and its contractors,
subcontractors, assigns, heirs and successors, for the import of
soil onto the site of Tract 5161 in the City of Moorpark.
a) The route of the haul shall be from Tract 4975 onto Miller
Parkway at Shawnee Street thence; northerly on Miller Parkway to
New Los Angeles Avenue; thence westerly on New Los Angeles
Avenue to Gabbert Road thence; northerly on Gabbert Road to
Poindexter Avenue thence; westerly on Poindexter Avenue to
Geisler Road thence; southerly on Geisler Road onto Tract 5161.
Trucks returning to Tract 4975 shall do so by retracing the
preceding route. Should the Developer propose another export
site the Developer shall submit a proposed haul route from the
export site to Tract 5161 for the review of the Director of
Community Development and the City Engineer. The Director of
Community Development and the City Engineer may approve,
conditionally approve or reject the haul route at their sole
discretion.
b) The route, schedule and operation of the haul operation shall be
such as to eliminate passage of trucks in school zones during
the start and end of the school day.
c) The permission shall begin no later than twenty days after the
City approves the grading plan and shall terminate at the close
of working hours, as specified herein, a maximum of twenty -one
calendar days thereafter.
d) A copy of the permission and conditions to haul shall be on the
export and import sites during all hauling operations.
e) Prior to the start of the import operation Cabrillo Economic
Development Corporation shall obtain an encroachment permit and
shall post a cash deposit in the amount of $500.00 per working
day of the haul route approval period to pay for costs of and
associated with damage remediation, street cleaning and
administering, inspecting and monitoring this permission to
haul. Upon the certification by the City Engineer that the haul

operation is completed and that all damages to City facilities
and all costs to the City, and its agents and contractors have
been paid, the unused portion of the deposit will be refunded.
Should costs accruing to the City due to its remediation,
cleaning, administration, monitoring or inspection of the haul
operations exceed the deposit amount the developer shall cease
operations and cause additional funds to be to be deposited at
the City within 10 days of written demand by the City.
f) Truck trip counts and yardage hauled shall be tallied as the
trucks leave Tract 4975, or such export site as the Director of
Community Development and the City Engineer may approve, and
upon arriving at Tract 5161. A true copy of both of the tally
sheets shall be delivered to the City Engineer or his designee
at the end of each working day that the hauling occurred.
g) No soil shall be transported to or from any site except as
specified herein, or as approved by both the Director of
Community Development and the City Engineer.
h) The conditions of the permit, haul route, times and dates of
operation, signage or traffic control are subject to revocation,
revision or approval by both the Director of Community
Development and the City Engineer.
i) No changes to the approved haul route, times and dates of
operation, dust control, signage or traffic control shall be
made without approval by both the Director of Community
Development and the City Engineer.
j) Hauling operations shall be conducted in daylight hours only
between the hours of 9:15 a.m. and 3:05 p.m. and 3:45 p.m. and
5:00 p.m. Monday through Friday, excluding Saturday, Sunday and
City observed holidays.
k) A minimum of three minutes of headway shall be allowed between
truckloads. The maximum number of highway legal haul units used
to haul the soil shall be no more than those needed to maintain
the minimum headway.
1) Appropriate traffic warning signs and devices and a flagger
shall be provided at the entrances to Tract 5161 on Poindexter
Avenue and at the point of entry onto the public street from
Tract 4975, or such export site as the Director of Community
Development and the City Engineer may approve. The flagging

operation shall be directed to controlling the entrance of the
trucks used to haul the soil on and off the public street.
m) All operations conducted by, or at the direction of, the
developer shall conform to best management practices as mandated
by the Clean Water Act and all amendments thereto.
n) Haul operations shall be suspended on rain days. The suspension
shall continue until soils on both the export and import sites
have dried sufficiently that the haul truck tires do not pick up
soil.
o) The developer shall reduce disruption of traffic on the haul
route due to the haul operation to the maximum extent practical.
p) All portions of the haul route and intersecting streets within
500 feet of the haul route shall be swept daily. Additional
sweeping shall be done when noticeable amounts of dust are on
those streets.
q) The soil shall be wetted to optimum moisture (ASTM D -1557)
before loading. Each haul truck shall have all soil cleared
from surfaces outside the bed before traveling on a public
street. The tires of the haul trucks shall be cleaned of
adhering soil before traveling on any public street. As an
alternate to wetting the soil to optimum moisture, the soil may
be covered by tarps during the haul.
r) On -site haul routes and soil moisture conditioning measures
shall be such to eliminate tracking or blowing soil onto City
streets or adjoining property from the loading, hauling, dumping
or distributing portions of the operation. Onsite operations
shall be coordinated to avoid passage of haul trucks over wet
soils that might adhere to the tires of the haul units.
s) Excepting as specified herein, these conditions shall not
displace, vitiate or negate any condition of law, permit or
approval pertaining to any property involved, whether inside our
outside of the City of Moorpark, or the operation of vehicles on
public streets.
t) The developer shall notify the Principal of Chaparral
Middle School and all residents of Moorpark Estates living
on the east side of Sierra Avenue between Poindexter Avenue
and the driveway access to Mission Bell Plaza that heavy
equipment will be moving onto and off of Tract 5161 and

that the noise and potential dust may inconvenience the
adjacent residents. The notification shall be delivered by
the US Postal service using certified mail with a return
receipt. Copies of the return receipts shall be provided
to the City Engineer before the start of the import
operation. The notification shall have a schedule of
operations, the name of the developer, the name of a
specific contact person on the developer's staff, the
mailing address of the developer, the haul contractor's
name and address and both daytime and 24 hour telephone
contact numbers for the haul operation superintendent.
