In FY one -time to cities Moorpark received Use of these funds requires the Moorpark City Council to adopt a Maintenance of Effort (MOE) resolution, in compliance with Government Code Section 14556.26. This MOE certifies that Moorpark will maintain its current level of General Fund expenditures for transportation purposes, which is calculated on the average over the last three years (1996 -97, 1997 -98, and 1998 -99) of city expenditures from the General Fund for street, road, and highway purposes. This is a condition of continued funding for the new monies or the city will lose the funding. During the years 1996 - 1999, the City of Moorpark did not spend any General Fund monies for street, road, or highway purposes. All expenditures have come from other City funds. DISCUSSION The City of Moorpark received a check in the amount of $211,888. These funds were applied to the "2000 Asphalt Honorable City Council 5/4/01 for CC meeting of 5/16/01 Page 2 Overlay Project." This project is currently under construction. General Funds were not used in the original funding plan for this project, so use of AB 2928 funding for the project does not affect the General Fund requirements of the MOE. AB 2928 funding is estimated to continue according to the following schedule: 2001 -2002 $58,000 2002 -2003 $58,000 2003 -2004 $62,000 2004 -2005 $67,000 2005 -2006 $74,000 STAFF RECOMMENDATION Adopt Resolution No. 2001- (Exhibit A). Attachments: Exhibit A: Resolution No. 2001- StaffReports /AD2928KOE A J 0 0,6, E RESOLUTION NO. 2001 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, CERTIFYING THE CITY WILL SUSTAIN ITS LEVEL OF EXPENDITURES FOR TRANSPORTATION PURPOSES WHEREAS, AB 2928 known as the Transportation Congestion Relief Fund, provides approximately $1 billion directly to cities and counties for preservation, maintenance and rehabilitation of the local street and road system; and WHEREAS, the City of Moorpark is in receipt of $211,888 for FY 2000 -2001; and WHEREAS, use of these funds imposes an MOE provision (per Government Code Section 14556.26) which requires cities to maintain their current level of General Fund expenditures for transportation purposes; and WHEREAS, the formula is calculated on the average over the last three years (1996 -97, 1997 -98, and 1998 -99) of city expenditures from the General Fund for street, road and highway purposes. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City of Moorpark will sustain its level of General Fund expenditures for transportation purposes in compliance with Government Code Section 14556.26. SECTION 2. The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original resolutions. PASSED AND ADOPTED this day of , 2001.
