It was created to collect improvement fees from developers of projects located south of the Arroyo Simi to provide for the construction of certain street and related improvements. A copy of the County's 1981 report is attached as Exhibit A. It included construction of 4 -lane bridges and medians for Tierra Rejada Road and Spring Road as well as a number of traffic signals. The City of Moorpark updated the STR AOC in December 1985. A copy of the staff reports prepared for the November 18, 1985, and December 10, 1985, Council meetings are attached as Exhibit B. This update included then current cost estimates, current projections for residential /commercial /industrial land uses, and the addition of more traffic signals. It also extended the Tierra Rejada Road median from Spring Road easterly to the east city limits and reduced the Spring Road Bridge from 4 to 2 lanes. In June 1986, the STR AOC was again updated by the City Council to add one -third of the cost for the Arroyo Simi pedestrian bridge. At that time, the STR AOC fee was set at $1,965 per dwelling unit and $11,000 per acre of commercial /industrial property. A copy of the August 1, 1988, staff report (action was taken by the City Council on August 17, 1988) is attached as Agenda Report Re: STR AOC Fees May 9, 2001 (CC Meeting of 5/16/2001) Page 2 Exhibit C. The STR AOC fees were increased to $3,168 per dwelling unit and $17,736 per acre of commercial /industrial property. On March 21, 1990, the City Council adopted Resolution No. 90 -638 (Exhibit D) updating the STR AOC. The fees increased to $3,553 per residential unit and $19,892 per acre of commercial /industrial property. The fees were increased by Engineering News Record (ENR) Highway Bid Price Index based on the index for the third quarter of 1989. This resulted in an increase of 12 percent (12 %). The STR AOC fees have not been updated since this time. The March 1990 STR AOC was based on an increase in the Engineering News Record Highway Bid Index (ENR). The third quarter 1989 was used. The ENR Index had increased 12.16 percent (12.16 %) since the third quarter of 1988. For your information, the ENR Index has increased 37.64 percent from the third quarter 1989 to the fourth quarter of 2000. DISCUSSION: Since 1990, the City along with Urban West Communities and Carlsberg have worked to construct many of the improvements including the widening of Tierra Rejada Road east of Spring Road to four lanes, including a raised median and street lights, a number of traffic signals, the construction of Spring Road including a landscaped median consistent with the approved Carlsberg Specific Plan (approved in 1994) and the reconstruction of the Spring Road Bridge. The following items were added to the STR AOC by various City Council actions since 1990 including the 1991 Settlement Agreement and subsequent First Amended Settlement with Urban West Communities: 1. Widening of Tierra Rejada Road east of Spring Road; 2. Intersection Improvements at Tierra Rejada Road and Spring Road including temporary signalization; 3. Tierra Rejada Road /Moorpark Road traffic signal; 4. Reimbursement to UWC for 8 -feet of pavement on north side of median in Tracts 2865, 3019, and 3525; 5. Widening of Spring Road at Christian Barrett Drive; 6. Sidewalk on south side of Tierra Rejada Road from Spring Road west to Tract 2865 boundary. 0301:14 Agenda Report Re: STR AOC Fees May 9, 2001 (CC Meeting of 5/16/2001) Page 3 A complete list of items constructed as part of the STR AOC is included in Exhibit E. As of May 8, 2001, the STR AOC has a cash balance of $1,419,987 but owes the Los Angeles Avenue Area of Contribution Fund (LA AOC) $1,675,105. This is a fund balance of ($255,118). In addition, Carlsberg constructed certain STR AOC items and is due a reimbursement of about $600,000. The actual reimbursement needs to be verified by the City. The items constructed by Carlsberg are the Spring Road median and landscaping from Tierra Rejada Road to the Spring Road Bridge, upgrades to the Spring Road /Peach Hill Road traffic signal, and construction of the Tierra Rejada Road /Miller Parkway traffic signal. The STR AOC advanced funds for the widening of Peach Hill Road east of Spring Road in the amount of $82,000. The City Council took action authorizing Mitigation Fees collected pursuant to the Carlsberg Settlement Agreement be used to reimburse these costs. As of May 8, 2001, this reimbursement has not occurred. At this time, the STR AOC has a balance of an estimated ($773,118). From May 8, 2001, through August 6, 2001 (anticipated effective date if STR AOC fees were to be revised), an additional 72 dwelling units are projected to have building permits issued with payment of STR AOC fees at the current rate. This would provide $255,816 in revenue. The 72 units are as follows: Tract 4980 (Western Pacific) 26 DU; Tract 4975 (Greystone) 12 DU; Tract 4976 (Greystone) 17 DU; and Tract 4977 (Richmond American) 17 DU. Tierra Rejada Road Median Landscaping $ 250,000 4. Administrative, accounting, engineering, legal, and miscellaneous costs $ 120,000 5. Interest Payments on Loans $ 200,000 TOTAL: $1,670,000 A complete, updated list of all items in the STR AOC is included in Exhibit E. Exhibit F is a recap of the projected revenues and expenditures, loans to and from the STR AOC, and calculation of the remaining fees. The calculation results in an estimated $37,891 projected surplus. This is an equivalent of about $72.00 per dwelling unit and $403 per acre of commercial /industrial. No fee adjustment is recommended. The approximate $38,000 can be considered an additional contingency. In any event, the build out of the commercial, industrial, and institutional properties could extend beyond five years so fees may be adjusted in the future if construction costs increase. The non - residential properties represent about 75 percent of the remaining revenue. If a balance remains in the STR AOC after collection of all fees, the Government Code addresses how refunds of the fees shall be processed. Based on estimated needs of $4_,875,000 it will be necessary to impose a gee of $1200 on each unit. The 1981 cost of $1200 per unit shall be adjusted on a biennial basis to account for i.n-411ation. The biennial adjustment will be equal to the increase or decrease in the Engineering News Record Highway Bid Price Index for California during the same period. This index is a nationally recognized indicator of changes in highway construction costs. Dennis Delzeit, City En ineer�'`" �- City Council Meeting of December 16, 1985 SUBJECT: Update of Tierra Rejada Road /Moorpark Road Area of Contribution Report BACKGROUND INFORMATION: In response to City Council comments and further discussions with the City Manager, we have made the following changes to the ACC Report update that was submitted to the Council at its December 2, 1985 meeting: Median Construction For this draft of the AOC Report update, two changes were made regarding the Tierra Rejada Road median. The first change was made at the suggestion of the City Manager, and consists of extending the limits of the Tierra Rejada. Road median from Moorpark Road to the east City limits at the Route 23 Freeway. The second change was made at the direction of the City Council, and consists of deleting the Tierra Rejada Road median within the limits of Tract 2865. Section 22525 of the 1972 Lighting and Landscaping Act enables the City to fund construction of this median by assessing the Tract 2865 property owners, for which the assessment would be approximately $370 per home. If the City Council is EXHIBIT 8• 799 Moorpark Avenue Moorpark, California 93021 (805) 529 -6864 Page -2- interested in pursuing this approach, we recommend that the City minimize the financial impact by spreading the assessment over a period of at least 4 years. However, the median could be constructed in advance by AOC fees (cash flow permitting). In addition, the Council should consider whether interest should be charged for this time period. Development Projections Two changes have been made regarding development projections. The first change was to include a 3.34 acre commercially zoned lot that was previously though to be part of Tract 2865. The second change was to modify the PC -4 projected development to conform with existing zoning. Although the developer is currently requesting a GPA, it was felt that analysis based on existing zoning would be more appropriate, as well as more conservative. Spread of Costs - Residential vs Commercial /Industrial The assessment structure was changed in that one acre of commercial or industrial development was considered equivalent to 5.6 dwelling units. To arrive at this ratio, relative traffic generation calculations were made based on certain development density assumptions. One of these assumptions was that residential density in this area is approximately 2 -3 units per acre, which is probably why the County originally used a ratio of 3 units per acre being equivalent to 1 acre of commercial or industrial development. However, the calculations indicate that industrial development generates approximately 5.6 times as much daily traffic per acre per acre as residential development. It is felt that a fee structure based on a 60 :1 basis is unreasonable. However, because the City Council has expressed interest in a ratio higher than 3:1, we have based our fee calculation on the highest ratio that our calculations could justify, which is 5.6:1. Fees The total estimated cost of the anticipated improvements is $6,820,000 and projected development consists of 2,800 dwelling units and 37.34 acres of commercial /industrial land. At an equivalence ratio of 5.6 :1, the resulting fees are $1,930 per dwelling unit and $10,815 per acre of commercial /industrial land. City Council Meeting of November 18, 1985 Update of Tierra Rejada Road /Moorpark Road Area of Contribution Report Approve the revision of the Tierra Rejada Road /Moorpark Rc,ad Area of Contribution Report. The Tierra Rejada Road /Moorpark Road Area of Contribution Report was prepared by the County in 1981. This report estimated the total cost of foreseen improvements, and determined the corresponding contribution that would be required of developers. These fees have been periodically adjusted based on the Engineering News Record Highway Bid Price Index. It is appropriate to update the entire report at this time, however, to allow for changes which have occurred in the last four years. The original report is attached, and is marked up to indicate the proposed changes. These revisions reflect not only construction cost changes, but changes in the type and quantity of development projected. Also, the need for additional traffic signals is anticipated, and approximate overhead costs have been included. Exhibits "A" and "B" indicate the locations of the foreseen improvements. The revised report, incorporating the proposed revisions, will be prepared upon approval by the Council. 799 Moorpark Avenue Moor ark, Cali I orniu 93021 2 ° Page -2- One notable assumption made when preparing this update was that the existing two lane Moorpark Road bridge over the Arroyo Simi will remain and be supplemented by an additional two lane bridge. Replacement of the existing structure with a new four lane bridge would cost an additional $1.5 million to $2 million dollars. The revised cost projections for the foreseen improvements total $8,070,000 and the current A.O.C. fund balance is $841,710. The number of projected dwelling units has been decreased to reflect A) the units that have been constructed in the last four years and B) changes in development plans. Similarly, approximately 111 acres of land is now expected to develop commercially or industrially, although none was provided for in the 1981 report. When the necessary revenues are rounded off and apportioned among the projected developments, the results indicate that the existing fees of $1,200 per dwelling unit and $3,800 per acre of industrial or commercial land be increased to $2,400 per dwelling unit and $7,100 per acre of commercial or industrial land. That the November 18, 1985 revisions to the Tierra Rejada Road /Moorpark Road Area of Contribution Report be approved, and the City Engineer be directed to prepare the final report incorporating the approved revisions. GENOVESE City Treasurer SUBJECT: Consider Revision to the Tierra Rejada Road /Moorpark (Spring) Road Area of Contribution Report Background Information The purpose of the AOC is to provide a mechanism for future development to finance specific improvements generally located within the defined area. This AOC is for the area south of the Arroyo Simi and was established in 1981. At that time, the list of improvements totalled $4,875,000. For example, the Tierra Rejada Road Bridge was _estimiate to cost $1;900;000, as compared to the _. current estimate of $3,750,000. The fee per dwelling unit was $1,200. No fee amount was specified for commercial and industrial acreage. In December, 1985, the City adopted a major revision of the AOC Report. The list of improvements were modified and the total cost of improvements was estimated at $6,820,000. In June, 1986, the Council again revised the AOC Report to include one -third of the estimated cost of the Arroyo Simi Pedestrian Bridge. This added $100,000 to the estimated cost of AOC improvements. (The other two - thirds of the estimated cost was placed in the Los Angeles Avenue AOC) . The current fee is $1, 965 /dwelling unit and $11, 000 /acre of commercial /industrial land. Analysis When the AOC was established in 1981, the County planned to review and adjust the cost estimates on a bi- annual basis to adjust for anticipated cost increases. Prior Council action to transfer` the City's one -half share of the Los Angeles Avenue at Tierra Rejada Road traffic signal and the median between the Tierra Rejada Road Bridge and Tract 2817 from this AOC to the Los Angeles Avenue AOC at an estimated cost of $70,000 and $40,000 respectively. 2. An increase in costs for the Tierra Rejada Road Bridge from the $2,750,000 in the current AOC Report to an estimated $3,750,000. 3. An increase in costs for the Spring Road Bridge over the Arroyo Simi. Previous reports assumed the existing two -lane bridge would remain and be supplemented with a second two -lane bridge. A recent study (done by PD 966 - Mash) indicates that the existing structure does not pass 100 year storm flows. For this AOC report, we assumed that the existing structure would remain with remedial work in the channel to accommodate necessary storm flows. Additional study will need to be done. For this report, an estimate of two - thirds of the cost for the Tierra Rejada Road Bridge is used as the cost estimate. This is an increase from $1,570,000 to $2,500,000. 4. An increase in the cost of all required traffic signals to an estimated cost of $130,000 for each location. Currently eight (8) of the signals need to be increased by either $10,000 or $20,000 for a total increase of $100,000 to reflect this change. 5. This AOC's portion of the Arroyo Simi Pedestrian Bridge cost estimate needs to be increased from $100,000 to $134,000. 6. Pursuant to conditions of approval for the three PC -3 West Village Tracts and RPD permits, the wideiLrig improvements for Tierra Rejada Road south of the center line, east of Tract 2865, are to be incorporated into the AOC. The Assistant City Engineer has provided a preliminary cost estimate of $600,000 for about 3,500 feet east of the Spring /Tierra Rejada Road intersection and $150,000 for about 550 feet west of the intersection. This does not include the parking lane, curb, gutter or sidewalk. The median curb is already included in the report. The necessary right -of -way (ROW) is expected to be dedicated so I haven't included any cost estimate for this item. I have included $10,000 to process the ROW acquisition. 7. The Council has authorized that the Specific Plan process be initiated for the area referred to as Carlsberg (formerly PC -4) . The maximum number of dwelling units and commercial /industrial acreage is different from that allowed under the prior general plan land use designation and current zoning. In the prior AOC Report, the fee was calculated based on 678 residential units and 23 acres of commercial /industrial land for this property. In this i O14 The Honorable City Council August 1, 1988 Page 3 proposed revision, we have used 448 residential units and 68.6 acres of commercial /industrial land. This is an approximate 3% increase in the amount of development. The revised, estimated cost of improvements totals $9,624,000. A copy of the revised list is attached. To determine the amount of the revised fee, we subtracted the estimated AOC fund balance from the cost of improvements and divided this total by the number of dwelling units and commercial acres projected for development within the AOC boundaries. Since the Tierra Rejada Road Bridge project was initiated in the 1987 -88 FY and is still in progress, we used the projected June 30, 1988 AOC fund balance including 1987 -88 revenue and included the Bridge project as part of the improvements to be made. The revised fee is recommended to be $3,168 per residential. unit and $17,736 per acre of corrimercial /industrial land. This is an approximate 61% increase in the fee. Staff Recommendation 1. Adopt the revised fees of $3,168.00 per residential unit and $17,736.00 per commercial /industrial acre effective August 1, 1988. 2.
