Gilbert, Director of Public Works May 23, 2001 (Council Meeting 6 -6 -01) Consider Updating the Los Angeles Avenue Area of Contribution [L. A. Ave. AOC] DISCUSSION A. Background On May 16, 2001, the City Council set June 6, 2001, as the date of a public hearing to consider increasing the fees for the Los Angeles Avenue Area of Contribution [L. A. Ave. AOC] and the Gabbert Road - Casey Road Area of Contribution [ Gabbert Road - Casey Road AOC]. Notice of the public hearing was posted and published in accordance with the requirements of the Government Code. This report pertains only to a proposed adjustment to the Los Angeles Avenue AOC fees. A proposed adjustment to the Gabbert Road -Casey Road AOC fees is the subject of a separate report to also be considered by the City Council at the June 6 public hearing. B. Los Angeles Avenue Area of Contribution: History Prior to the incorporation of the City, the County of Ventura created the subject Areas of Contribution in order to provide a mechanism for future development within a certain specified geographical areas, to finance improvements to the Los Angeles Avenue / New Los Angeles Avenue corridor. L A AOC- 010521 L. A. Avenue AOC Update May 23, 2001 Page 2 C. Prior Adjustment E. The subject fees were last adjusted adoption of Resolution No. 90 -638. A and related staff report attached as L. A. Ave. AOC fees, as set forth in follows: • Residential (per dwelling unit) • Commercial / Industrial (per acre) in March of 1990 by the copy of that Resolution Exhibit 1. The current those documents, are as $ 2,771.67 $15,519.10 The 1990 adjustment was based on the increase in the Engineering News Record (ENR) Highway Bid Price Index from the date of the last prior adjustment in 1986, through the fourth quarter of 1989. A summary of the data used to calculate that adjustment is set forth in the chart attached as Exhibit 2. Tnfl a1 -inn Staff has determined that there has been changes to the ENR Highway Bid Price Index since the subject fees were last adjusted for inflation in 1990. The change to that Index between September 1989 and January 2001, as also set forth in Exhibit 1, was a 37.63% increase. Also set forth in Exhibit 1 is the change to the subject fees which would result from a 37.63% increase to the fee. The fee increases recommended herein are not based on this increase to the ENR Highway Bid Price Index. The recommended fee increase is based on a summary analysis of the funds required to construct the list of identified projects to be funded by the L. A. Ave. AOC. Analysis of Revenue Requirements Staff has performed an analysis of the funds currently available in the L. A. Avenue AOC Fund [Fund 25011 and the estimated costs of implementing a list of known future street improvement projects to be funded by the L. A. Ave. AOC Fund. The purpose of that analysis was to determine the total additional L. A. Ave. AOC fee revenues required to fully fund the construction of all of the projects on the list. L A AOC 010523 e 1 L. A. Ave. AOC boundary, along with the identification of the number of residential units and commercial / industrial acres proposed to be developed by each of those projects. The purpose of that effort was to determine the total number of future units (dwelling units or acres) subject to payment of L. A. Ave. AOC fees. Finally, staff has prepared a calculation of the per unit (dwelling unit or acre) L. A. Ave. AOC fee required to be paid by each of the remaining land development projects within the boundaries of the L. A. Ave. AOC. F. Funds Available G. A summary of the current funds available, and certain future anticipated receipts, for the L. A. Ave. AOC Fund [Fund 2501], is as follows: Description Cash in Fund (5/30/01) Plus Receiveables from: Spring Road / Tierra Rejada Road AOC Fund Mission Bell Plaza Properties on the South Side of L. A. Ave. E/O Leta Yancy Road per AD92 -1 Total Funds Available Amount ($) 7,307,535 1,675,105 42,461 279,427 9,304,528 Note: No provision has been made for future interest income as it is anticipated that any such interest income would be off - set by a comparable rise to the cost of engineering and construction as the result of inflation. Future Project Costs [Exhibit 3 Attached as Exhibit 3, is a chart listing all of the future street improvement projects to be funded by the L. A. Ave. AOC Fund, along with the estimated cost of each project. The total project cost estimates includes costs for design engineering, right -of -way acquisition, construction and construction engineering. Additional Funds Required Based on the above figures, the future L. A. Estimated Future Land Development Projects [Exhibit 41 Attached as Exhibit 4, is a chart listing all of the future land development projects within the boundaries of the L. A. Ave. AOC, along with an estimate of the number of units (dwelling units / acres) proposed by each of those land development projects. The fees established by the Los Angeles Avenue AOC provided for a conversion factor of 5.6 dwelling units per acre to compute the per acre fee for commercial / industrial properties. Based on the total number of units set forth in Exhibit 4, the resultant total number of EDU (equivalent dwelling units) required for the calculation of revised fee is as follows: Description Number Total Acres Commercial / Industrial 179.2 Multiplied by the Conversion Factor x 5.6 Number of EDUs for Comm. / Ind. Avenue AOC Update May 23, 2001 Page 5 It should be noted that merely adjusting the fee based on the change to the ENR Highway Bid Price Index (Exhibit 1) would yield fees as follows: • Residential (per lot) $ 3,607.98 • Commercial /Industrial (per Acre) $20,201.78. K. Public Hearing As stated above, a Public Hearing on this matter was set for June 6, 2001. Notice of that hearing has been posted and published as required by law. Also, a copy of this staff report, the attached Resolution and the public hearing notice has been provided to the Building Industry Association (BIA). L. Resolution The attached is a Resolution (Exhibit 5), if adopted, will revise the Los Angeles Avenue AOC fees to be as indicated above. M. Effective Date of Fee Increase Any approved fee increase will not become effective until sixty (60) days after the date the action was taken to increase the fee. STAFF RECOMMENDATIONS Staff recommends that the City Council take the following actions: 1. Open the public hearing on the proposed adjustment to the Los Angeles Avenue AOC fees, receive all input regarding said proposed fee increase and close said public hearing. 2. Adopt the attached Resolution increasing the fees for the Los Angeles Avenue AOC. Subject: AREA OF CONTRIBUTION (AOC) REVISIONS FOR THE TIERRA REJADA ROAD /SPRING ROAD AOC, THE LOS ANGELES AVENUE AOC, AND THE GABBERT ROAD /CASEY ROAD AOC BACKGROUND IN - ORMATION The purpose of an Area of Contribution (AOC) is to provide :a. mechanism for future development to finance specific improvements generally located within the defined area. The AOC fees are periodically reevaluated to determine if adjustments are required to compensate for inflation. The Engineering News Record (ENR)'` Highway Bid Price Index (see Exhibit "A"), a nationally recognized indicator of changes in highway construction costs, is used for this purpose. Based on the Index, it is recommended that the fees for the Tierra Rejada Roa=: ",1Spring Road AOC, the Los Angeles Avenue AOC, -and the Gabbert Road /Casey Road AOC be updated. The. procedure that was used to update each of the AOC fees is summarized as follows: 1. The dollar amount of the current AOC fee and the date of the most recent update to that fee was determined. 2. The ENR Highway Bid Price Index associated with the date of the most recent update to the AOC fee was determined. 3. The ENR Highway Bid Price Index associated with the third quarter of 1989, the most recent index available, was determined. 4. The revised AOC fee was increased proportional to the increase in the ENR Highway Bid Price Indexes identified in steps 2 and 3. - 030104 799 Moorpark Avenue Moorpark, California 93021 (805) 529-6864 Page 2 A summary of the current AOC fees and revised AOC fees is provided in Exhibit "B ". Note that the ENR Index fluctuates over time. Consequently, the AOC fee percentage increase's are not identical. Pursuant to Government Code Section 54992, the City should hold a public meeting to allow oral or written presentations. Such meeting is to be a part of a regularly scheduled Council meeting and will be scheduled for the Council's March 21, 1990 meeting. The fee increase needs to be adopted by Resolution. A notice of the March 21, 1990 meeting will be mailed to Ventura County Chapter of Building Industry Association. In addition, the Gabbert /Casey AOC should be completely updated with a new project list and Cost estimates after the City -wide Circulation Element is completed. RECOMMENDED ACTIO Receive and file this report and set March 21, 1990 as the public meeting to'consider the proposed fee revision. B May be considered for a change in land use but will require GPA & Zone Change L A AOC 010523 107 476 600 250 216 284 100 22 100 79 5 59 0 8 50 2,356 No. Acres 34.53 8.79 13.75 4.00 2.30 2.50 4.00 17.70 32.30 7.40 1.70 0.76 21.44 0.22 1.98 0.31 0.82 8.40 10.00 6.27 179.17 3 _°1 - 1 Exhibit 5 RESOLUTION NO. 2001- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, REVISING THE SCHEDULE OF FEES FOR THE LOS ANGELES AVENUE AREA OF CONTRIBUTION WHEREAS, the County of Ventura established certain areas of contribution in 1981 to provide a method of collecting fees from future development projects and to promote orderly growth, such fees to be used to finance specific street improvements; and WHEREAS, upon incorporation of the City of Moorpark, the County of Ventura transferred responsibility for the administration of these Areas of Contribution to the City; and WHEREAS, since the incorporation of the City, the City has periodically made adjustments to these fees and the improvements to be funded by said fees; and WHEREAS, said fees were last adjusted by the City by adoption of Resolution No. 90 -638, on March 21, 1990; and WHEREAS, the City Council received and considered a report, dated May 25, 2001, setting forth certain justification for the approval of an increase to the fees for the LOS ANGELES AVENUE AREA OF CONTRIBUTION and the GABBERT ROAD /CASEY ROAD AREA OF CONTRIBUTION; and WHEREAS, Government Code Section 66000 et. seq. requires the City to hold a public hearing as part of a regularly scheduled meeting to consider written or oral presentations concerning any proposed increase in fees; and WHEREAS, the City Council held such a public hearing on June 6, 2001, and duly considered any input provided regarding said proposed fee increase; and WHEREAS, by City Council Resolution No. 2001 - adopted on June 6, 2001, the City Council rescinded Resolution No. 90 -638, effective August 6, 2001; and WHEREAS, said Resolution No. 2001 re- established the Spring Road / Tierra Rej ada Road AOC fees unchanged from those fees previously set forth in Resolution No. 90 -638; and C.1 Resolution No. 2001 - Page 2 WHEREAS, said Resolution No. 2001- also took action to revise the Gabbert Road / Casey Road AOC fees; and WHEREAS, on June 6, 2001, the City Council considered a report regarding certain changes to the basis upon which the Los Angeles Avenue AOC fees should be calculated; and WHEREAS, said report set forth certain findings indicating the need and necessity to adjust the amount of the L. A. Avenue AOC fees. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That, pursuant to Government Code Section 66017, this resolution shall become effective sixty (60) days following the public meeting held on June 6, 2001, implementing those changes to the fees described herein, upon the effective date of August 6, 2001. SECTION 2. That the fees for the Los Angeles Avenue AOC are hereby revised to be as follows: Per Fee Description Residential Unit Los Angeles Avenue AOC $3,760.00 Per Commercial / Industrial Acre $21,057.00 SECTION 3. The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original resolutions.
