Traffenstedt, ATCM /City Clerk May 11, 2001 (CC Meeting of 616101) SUBJECT: Consider Resolution No. 2001- Establishing Holidays to be Observed by the City and Rescinding Resolution No. 85 -182 BACKGROUND AND DISCUSSION Section 2.52.010 of the Municipal Code requires that holidays observed by the City shall be set by resolution of the City Council. In 1985, the City Council adopted Resolution No. 85 -182, fixing the holidays to be observed by the City. Resolution No. 85- 182 is no longer current, due to subsequent Memorandum of Agreement negotiations with the Local 998 union pertaining to holidays (for example, a March 31 holiday was recently approved by Council) . Staff is recommending that Resolution No. 85 -182 be rescinded and a new' resolution adopted to incorporate an updated list of holidays. STAFF RECOMMENDATION Adopt Resolution No. 2001- Attachment: Draft Resolution COO RESOLUTION NO. 2001- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, ESTABLISHING HOLIDAYS TO BE OBSERVED BY THE CITY AND RESCINDING RESOLUTION NO. 85 -182 WHEREAS, Section 2.52.010 of Chapter 2.52 of Title 2 of the Moorpark Municipal Code provides that holidays observed by the City shall be set by resolution of the City Council; and WHEREAS, the City Council last adopted a holiday resolution in 1985, Resolution No. 85 -182, which resolution is no longer current, and an updated resolution listing all of the holidays now observed by the City should be adopted. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. Excluding those offices, which must remain open for the continuation of essential public services, such as police and fire protection, the public offices of the City shall be closed on the following holidays: 1. New Year's Day, January 1; 2. Martin Luther. King's Birthday, the third Monday in January; 3. Washington's Birthday celebration, the third Monday in February; 4. Cesar Chavez day, March 31, as follows: a) If March 31 falls on a Sunday, Monday, Tuesday, or Wednesday, then the holiday will be observed on Monday; b) If March 31 falls on a Thursday, Friday, or Saturday, then the holiday will be observed on Friday. 5. Memorial Day, the last Monday in May; 6 July 4; 7. Labor Day, the first Monday in September; 8. Veteran's Day; 9. Thanksgiving Day, the fourth Thursday in November; 10. The day after Thanksgiving; 11. Christmas Day, December 25; 12. Christmas Eve (December 24) as follows: a) Four hours if this date falls on Tuesday, Wednesday, Thursday or Friday; b) Eight hours if this date falls on Monday; IC" 0037 Resolution No. 2001 - Page 2 c) No hours if this date falls on Saturday or Sunday. 13. And every day appointed by the President of the United States or Governor of this State for public feast,', Thanksgiving or holiday, when specifically authorized by the City Council. Except numbers 12. or 13., above, if a paid assigned' holiday falls on a Saturday, the preceding Friday shall be the holiday in lieu of the day observed. Except numbers 12. or 13., above, if a paid assigned holiday falls on a', Sunday, the following Monday shall be the holiday in lieu of the day observed. For those employees regularly scheduled to work Saturday and /or Sunday, the paid assigned holiday shall be the day on which the holiday actually occurs. SECTION 2. Resolution No. 85 -182 is hereby rescinded. SECTION 3. The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original Resolutions. PASSED AND ADOPTED this day of , 2001.
