Lindley, Director of Community Services/7,10 DATE: August 20, 2001 (CC Meeting of September 5, 2001) SUBJECT: Consider Adoption of Resolutions Approving Future Applications for Safe Neighborhood Parks, Clean Water, Clean Air, and Coastal Protection Bond Act of 2000 Funds. BACKGROUND The Safe Neighborhood Parks, Clean Water, Clean Air, and Coastal Protection Bond Act of 2000 (Proposition 12) received approval by California voters on March 7, 2000. Proposition 12 has a number of provisions that provide funding to local governments to develop, improve, and maintain parks. Of significance to Moorpark is the Roberti- Z'Berg- Harris Urban Open Space and Recreation Grant and two Block Grants. Funds from these three grants will be distributed on a per capita basis. It is expected that they will generate approximately $353,000 for the City of Moorpark to be used on park projects: 1. Roberti- Z'Berg- Harris Grant: $ 84,000 2. Block Grant I - Statewide: $191,000 3. Block Grant II - Small Cities: $78,000 Important facts about the grants funds include: • Grantees must have a fully executed contracts for their Per Capita projects by June 30, 2003 and for Block Grant projects by June 30, 2004. • Per Capita grants are for capital outlay only. With regards to the Block Grant, no more that 30% can be used M: \MLindley \PARKS \Prop 12 Resolutions ccagd.doc . 3 Proposition 12 Resolutions Page 2 for major maintenance or innovative recreation programs. The remainder must go toward capital outlay. • Grantees may spend up to 25% for funds for non - construction costs, including grants administration, plans, and permits. • The Per Capita Grants do not require a match, the Block Grant requires a 30% match. In addition to the per capita grants, Proposition 12 provides for some competitive grant opportunities. However, most of these grants will be awarded to low- income communities. City staff will make every effort to seek these grants out and to submit potential projects when applicable. Prior to applying for the per capita grant funds identified above, the City must adopt the attached resolutions addressing both the Roberti - Z'Berg - Harris Grant and Block Grants I and II. The Resolutions state that the City approves future filings for grant funds, certifies that the City will have sufficient funds to operate and maintain improvements it constructs using grant funds, indicates that the City understands the grant procedures, and .appoints the City Manager as the designated position to conduct all negotiations and execute and sign all documents. The City's Parks and Recreation Commission will spend the next several months discussing proposed uses for the $353,000 from a list of existing park improvement projects, as well as any new projects that may be identified as a result of public input. It is expected that a recommendation will be forwarded to the City Council for consideration by March 2002. RESOLUTION NO. 2001- RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, APPROVING THE APPLICANT TO APPLY FOR GRANT FUNDS FOR THE PER CAPITA GRANT PROGRAM UNDER THE SAFE NEIGHBORHOOD PARKS, CLEAN WATER, CLEAN AIR, AND COASTAL PROTECTION BOND ACT OF 2000. WHEREAS, the people of the State of California have enacted the Per Capita Grant program which provides funds to meet the urgent need for safe, open and accessible local park and recreational facilities for increased recreational opportunities that provide positive alternatives to social problems; and WHEREAS, the California Department of Parks and Recreation has been delegated the responsibility of the administration of the grant program, setting up necessary procedures; and. WHEREAS, said procedures established by the California Department of Parks and Recreation require the Applicant's Governing Body to certify by resolution the approval of the Applicant to apply for the Per Capita Allocation; and WHEREAS, the Applicant will enter into a Contract with the State of California; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: 1. Approves the filing of an Application for local assistance funds from the Per Capita Grant Program under the Safe Neighborhood Parks, Clean Water, Clean Air, and Coastal Protection Bond Act of 2000; and 2. Certifies that the Applicant has or will have sufficient funds to operate and maintain the project(s); and 3. I apologize for any confusion this may have caused. cc: Steve Kueny, City Manager Debbie Traffenstedt, ATCM /City Clerk RESOLUTION NO. 2001 - RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, APPROVING THE APPLICANT TO APPLY FOR GRANT FUNDS FOR THE ROBERTI- Z'BERG- HARRIS URBAN OPEN SPACE AND RECREATION PROGRAM UNDER THE SAFE NEIGHBORHOOD PARKS, CLEAN WATER, CLEAN AIR, AND COASTAL PROTECTION BOND ACT OF 2000 WHEREAS, the Legislature and Governor of the State of California have approved a grant for the above Program; and WHEREAS, the California Department of Parks and Recreation has been delegated the responsibility for the administration of the grant program, setting up necessary procedures; and WHEREAS, said procedures established by the California Department of Parks and Recreation require the governing body to certify by resolution the approval of approval of the Grantee to apply for the Roberti- Z'Berg- Harris allocation; and WHEREAS, the Grantee will enter into a Contract with the State of California for subject Project(s); NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: 1. Approves the filing for local assistance funds from the Roberti- Z'Berg- Harris Urban Open Space and Recreation Program under the Safe Neighborhood Parks, Clean Water, Clean Air, and Coastal Protection Bond Act of 2000; and 2. Certifies that Grantee has or will have sufficient funs to operate and maintain the Project(s); and 3. Certifies that Grantee has or will have available, prior to commencement of any work on the Project (s) included in this Application, the required Match; and 5. Appoints the City Manager as agent to conduct all negotiations, execute and submit all documents including, but not limited to Applications, agreements, payment requests and so on, which may be necessary for the completion of Project(s). 7. The City Clerk shall certify to the adoption of the resolution and shall cause a certified resolution to be filed in the book of original Resolutions.
