Chudoba, Senior Management Analyst DATE: September 12, 2001 (CC Meeting of 9/19/01) ke- SUBJECT: PUBLIC HEARING TO CONSIDER USE OF LOCAL LAW ENFORCEMENT BLOCK GRANT FUNDS FOR 2001/2002 FISCAL YEAR BACKGROUND The federal Bureau of Justice Assistance approved the City of Moorpark's application for a 2001 Local Law Enforcement Block Grant (LLEBG). The City is eligible to receive $10,665. A 10 percent cash match is required. The goal of LLEBG is to reduce crime and improve public safety. Program funds may be used for any of seven purpose areas: 1. Support law enforcement (hire new staff, pay overtime, and procure equipment), 2. Enhance security in special risk areas, 3. Establish or support drug courts, 4. Adjudicate cases involving violent offenders, S. Create multi - jurisdictional task forces, 6. Set up community crime prevention programs, and 7. Provide indemnification insurance for peace officers. LLEBG awards are meant to supplement, not replace, operating funds. Recipients must spend the grant within 24 months, or return the unused portion. In the past, the City used LLEBG money for a DARE Officer, increased police presence during peak crime periods, overtime, training, equipment, and computers. Last year, the City Council obligated the 1999 and 2000 LLEBG awards to partially fund a new 40 -hour patrol officer in the 2001/2002 fiscal year. DISCUSSION Before committing LLEBG funds, the City must meet the following requirements: Honorable City Council September 12, 2001 Page 2 1. Establish an advisory board (with representatives from law enforcement, prosecutor's office, court system, public school system, and nonprofit group active in crime prevention) to make non - binding recommendations to the City Council on the use of LLEBG funds. 2. Hold a public hearing to consider the use of LLEBG funds. The following representatives serve on the LLEBG advisory board: James Ellison, Senior Deputy District Attorney, Ventura County District Attorney's Office; Robert LeMay, Captain, Ventura County Sheriff's Department; Gary Lowenberg, President, Rotary Club of Moorpark; Juanita Suarez, District Coordinator for Preschool and Prevention Programs, Moorpark Unified School District; and Carolyn Wright, Deputy Probation Officer, Ventura County Probation Agency. The 2001/2002 budget includes a new 40 -hour patrol officer for 10 months only. This position will cost about $106,948, of which $25,351 will be funded with previous LLEBG awards. (As you know, these funds have been adjusted to reflect revised award amounts.) The balance was funded with general funds and expected LLEBG money in the adopted budget, pending federal and state action on grants. Staff recommends that the City use the 2001 LLEBG award ($10,665) and a portion of the 2001 Supplemental Law Enforcement Services Grant ($70,932) to fund the balance. The LLEBG advisory board concurs. STAFF RECODMENDATION (ROLL CALL VOTE) 1. Conduct a public hearing, accepting testimony regarding the Local Law Enforcement Block Grant (LLEBG) as necessary; 2. Accept the 2001 LLEBG award and direct staff to use the grant to partially fund a new 40 -hour patrol officer in the 2001/2002 fiscal year; and 3. Adopt Resolution 2001- amending the 2001/2002 budget to reflect the use of the 1999, 2000, and 2001 LLEBG funds. RESOLUTION 2001- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, AUTHORIZING AN AMENDMENT TO THE 2001/2002 FISCAL YEAR ADOPTED OPERATING BUDGET FOR THE 2001/2002 LOCAL LAW ENFORCEMENT BLOCK GRANT WHEREAS, on June 20, 2001, the City Council adopted the operating budget for the 2001/2002 fiscal year; and WHEREAS, the City Council has conducted a public hearing and accepted testimony concerning the use of Local Law Enforcement Block Grant (LLEBG) funds for the 2001/2002 fiscal year; and WHEREAS, the City Council now wishes to amend the adopted budget to reflect its direction concerning the use of LLEBG funds for the 2001/2002 fiscal year. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. A budget amendment as described in Exhibit "A" attached hereto is hereby approved. SECTION 2. The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original resolutions. Chudoba, Senior Management Analyst SUBJECT: Local Law Enforcement Block Grants DATE: September 12, 2001 CC: Steven Kueny, City Manager Dana Shigley, Director of Administrative Services Last year, the City of Moorpark received two Local Law Enforcement Block Grants ( LLEBG) from the federal Bureau of Justice Assistance (BJA): $15,230 for 1999 and $12,938 for 2000. The City Council obligated the grants to partially fund a new 40 -hour patrol officer in the 2001 /2002 fiscal year. At the time of application, staff certified in good faith that the City complied with the Public Safety Officers Health Benefits ( PSOHB) Provision. The PSOHB Provision requires a unit of government to give a public safety officer who retires or is separated from service, due to a line -of -duty injury suffered during an emergency situation or hot pursuit, the same level or better level of health benefits at separation as s/he received on active duty. If a unit of government does not comply with the PSOHB Provision, it must forfeit 10 percent of the LLEBG award. Staff learned via a recent claim for damages (which the City Council subsequently rejected) that the City, through our contract for law enforcement services with the County, does not comply with the PSOHB Provision. Therefore, staff will return 10 percent of the 1999 grant ($1,523) and 10 percent of the 2000 grant ($1,294). BJA adjusted the 2001 grant to reflect the 10 percent reduction. On September 19, 2001, the City Council will consider a resolution to amend the 2001/2002 budget to reflect the revised grant amounts, as well as the 2001 grant money.
