BACKGROUND: On January 17, 2001 the City Council considered a recommendation from staff to develop an Artistic Rock Fountain /Waterscape Presentation at southwest corner of Tierra Rejada and Mountain Trail (Mountain Meadows Plaza) as a part of the City's Art In Public Places Program. On February 7, the City Council established an Ad Hoc Committee to work with staff on the development of the project. The Council directed the Ad Hoc Committee to proceed with the development of a recommended project at the corner of Tierra Rejada and Mountain Trail. DISCUSSION: After consultation with the Council's Ad Hoc Committee (Mayor Pro -Tem Harper, Councilmember Millhouse) concerning design criteria and artist selection procedure, staff began negotiations with the owner of the corner property for any necessary easements, utility connections, site preparation and future maintenance. On April 19, 2001, a Request for Qualifications was issued, fourteen artists received the RFQ and one artist, Rock Designs, Pools and Waterscapes, Inc., responded. Rock Design's conceptual proposal, including several alternative designs, was reviewed by the Ad Hoc Committee on September 11 and a design was selected for recommendation to the City Council. r� `. The cost for the proposed project is $88,500 excluding utility connections, demolition hauling, grading, equipment enclosure and city permits. Staff estimates the total overall cost for the project to be $100,000. The current cash balance in the City's Art In Public Places Fund is $197,021. The City's Tree and Landscape Fund has a current cash balance of $127,630. STAFF RECOMMENDATION: 1) Approve a proposed Artistic Rock Fountain /waterscape Presentation at southwest corner of Tierra Rejada and Mountain Trail (Mountain Meadows Plaza as submitted by Rock Designs, Inc. and recommended by the Ad Hoc Committee) and; 2.) Riley, Assistant City Manage DATE: January 10, 2001 (City Council Meeting of 1/17/01) SUBJECT: Consider Development of Artistic Rock Fountain /waterscape Presentation at southwest corner of Tierra Rejada and Mountain Trail (Mountain Meadows Plaza) as a part of the City's Art In Public Places Program DISCUSSION: In June, 1997, during the approval process for Minor Modification No. 5 to Major Modification No. 1 of CPD 90 -2 (American Stores Properties, Inc.) the City Council rejected the submittal of the applicant's architect for an artistic presentation to be installed at the southwest corner of Tierra Rejada and Mountain Trail (Mountain Meadows Plaza) as a part of the City's Art In Public Places Program. Prior to the issuance of the Zoning Clearance for the construction of the shopping Center, the applicant paid to the City a fee of $11,323.80 for the city's Art In Public Places Fund as required by the project's conditions of approval. When the proposed artistic presentation was rejected by the City Council, the City retained the developer's contribution. Since this action, the American Stores Properties' position has been that the fee paid should release them from the condition calling for the installation of an artistic presentation at the location. No further action has been taken by either the developer or the city regarding this matter. The current cash balance in the City's Art In Public Places Fund is $182,930. The City's Tree and Landscape Fund has a current cash balance of $109,773. It is estimated that an acceptable presentation installed at this corner would cost between $50,000 and $75,000 including site demolition, preparation, and new construction and landscaping. 1,14 11:11C City Council Agenda Report January 10, 2001 Page 2 If the City develops an artistic presentation at this location the responsibility for ongoing utility costs and maintenance will need to be determined. The developer is currently maintaining this particular site because it is private property. However, because the City has retained the payment -in -lieu fee, the developer may object to taking on the responsibility for maintenance. The Art In Public Places participation condition does not address the responsibility for ongoing maintenance of a facility erected by the City. It may be advisable to seek a partnership with the developer for this project. Staff is presenting this item to the City Council at the request of Mayor Pro Tem Harper in order to seek direction for obtaining design -build proposals for the development of an artistic presentation at the Mountain Meadows Plaza location. The current discussion has concentrated on the concept of a rock fountain, pool and waterscape design similar those installed by other cities such as Cerritos and to the installation shown in the attached print. Such a presentation would be consistent with the landscaping emphasis of the overall Mountain Meadows development. The construction /installation of artistic presentations such as statues, sculpture, and fountains may be exempt from the Public Contracts Code with regard to the requirements for excepting the lowest responsible bid under certain circumstances. However, in compliance with the code, the city would be required to obtain competitive design -build proposals. It may also be beneficial to separate the artistic work from the site demolition and foundation preparations include utility connections and concrete sidewalks. There typically is a charge or fee associated with the preparation of proposals by artists because the proposal involves the creative application of their particular skills with these materials and techniques. In one example obtained by staff from Rock Designs in Woodland Hills the proposed fee would be $2,000. In this example, 50% of the fee would be credited toward the installation cost if the artwork submitted is actually commissioned by the City. A copy of Rock Designs' correspondence is attached. Direct staff to obtain design -build proposals with total costs not to exceed $75,000. 2. Negotiate with American Properties to secure any necessary easement, utility connections, site preparation and future maintenance. The City anticipates that the artist's budget for design and construction of the project will not exceed $75,000. An honorarium of $1,000 will be paid for the final three artists' proposals. Artists will be required to present project budgets if chosen as a finalist. Artist Selection Process The City will compile a list of all artists based upon responses to the advertising of the project. The City will then invite three finalists to develop proposals, and will ultimately choose one artist. Artist' qualifications and specific proposals will be reviewed by City staff and the Public Arts Advisory Committee with recommendations to be made to the City Council for final approval. Project Location and Description The project site is located on the northwest corner of Mountain Trail and Tierra Rejada Road. (Mountain Meadows Plaza) The site includes a circular concrete area approximately 50 feet in diameter, with a raised circular planter approximately 18 feet in diameter. (See Exhibit A) Materials The materials to be used for the rock sculpture /fountain should be outdoor, granite rock forms compatible with the area surrounding the site. The project may include both natural and man-made elements in combination. Plans for ground lighting the work should be included. Application Process All artists are asked to submit the following: 1. A one page cover letter describing your interest in the project, relevant previous experience, and your preliminary thoughts on how you might execute a project.* 2. A one -page artist statement pertaining to previously completed projects.* 3. Current professional resume (up to three pages) and include at least 2 professional references. * 4. Color Photos, 8x10 in size, of a minimum of three previous works appropriate to the project.* 5. An annotated one page photo list with your name, the art works title, date, size, location, media, and cost. * 6. Self- addressed, stamped envelope for the return of the photos. * Provide 10 copies of cover letter, artist statement, resume and photo list. All responses to the RFQ must be received by 5:00p.m. on Friday May 25, 2001. A model or drawing of a proposed project, detailing it's installation and materials. 2. A written description of the proposed project, including it's method of fabrication, installation, proposed boundaries of the project, any special operational requirements, maintenance requirements, and a description of how the project will interface with the architects design. 3. An itemized budget for design, construction, transportation, or installation (including liability insurance during the period of installation) of the project 4. Identification of any consultants, contractors, subcontractors, fabricators or other design professionals whom the artist might retain to develop, construct, transport, or install any part of the landscape art project. 5. The projected timeline for construction, transportation, and installation of work of art. Selection of Finalists It is the intent of the Public Arts Advisory Committee to select an artist from the finalists to create a specific work. 2. Up to three finalists will be selected to develop proposals. Each will receive a $1,000 honorary proposal fee to cover the costs or proposal requirements. The model or drawings and all inherent rights of the proposed art become the property of the City of Moorpark. 3. The finalist's design proposals will be publicly displayed at each public meeting concerning recommendation of the project. Upon selection of one artist proposal, the Committee will forward its recommendation to the City Council for final approval. 4. Criteria to be utilized by the Public Arts Advisory Committee in reviewing the design proposal shall include, but not be limited to, aesthetic quality, site suitability, budget, durability, risk assessment, level of maintenance, technical feasibility of the project, and general appropriateness. 5. The final selection of an artist and a design proposal is wholly within the discretion of the City. The City Council may accept or reject a design proposal for any reason. The City is under no obligation to commission a work of art from any submitted proposal if that proposal is not deemed satisfactory and acceptable to the City. Contracts Artist's selected to create a finished work of art will be required to enter into an agreement with the City prior to commencing the work. No selection shall be deemed final until an agreement has been properly executed and signed by the artist and the City. The terms of the agreement will include, among other things, insurance requirements established by the City. All contractors are required to have Workers Compensation coverage (or a written statement declaring they have no employees), General Liability limit of not less than $ 1,000,000 per occurrence naming the City as additional insured (a separate additional Insured Endorsement document is required) and provide for a 30 -day notice of cancellation, and automobile and property damage insurance in an amount not less than $100,000 and $ 300,000, respectively, naming the City as additional insured and provide for a 30 -day notice of cancellation. If the contractor does not have automobile insurance, the General Liability policy must include non -owned and hired autos. v,00 r.4 Additionally, the artist is also required to get a City of Moorpark business registration. May 23, 2001 City of Moorpark Art in Public Places Program 799 Moorpark Avenue Moorpark, CA 93021 Re: Stone Sculpture /Fountain Art Project for the Mountain Meadows Plaza Artist's Interest in the Project Rock Designs was headquartered in Moorpark's Mountain Meadows from1988 to 1999, when we relocated to Woodland Hills to be closer to the center of our customer base. Our home was near the proposed project site, and we are familiar with the area, the clientele of the shopping center and the neighborhood. As the contractor and president of Rock Designs Pools and Waterscapes, Inc., I am excited by the creative challenge of creating a sculptured water feature in the round, that would be attractive acid appealing frorr; every direction of approach, whether by foot or car. Relevant Previous Experience Since 1984, Rock Designs has designed and built many fountains, elaborate Koi ponds, swimming pools and contemporary water features. Over the years, we have received many design awards. In Spring 2001, Rock Designs was the recipient of the "Cornerstone of Excellence" award, first place in the category of decorative exterior. The project: new swimming poo! and spa with rock and water features, including a cave, waterfalls, wafter slide and hand- sculpted rock deck. A commercial project in Oxnard features multiple waterfalls and a 150 foot long stream; we are currently constructing an additional lunch park area with waterfalls f Cyr the sal ne cci riipar ty. Preliminary Thoughts on Executing the Project Rock Designs has already completed four preliminary drawings for this project: 1) Man -made rock and water feature with sculpted rock deck ti 2) Man -made rock and water feature with combination flagstone and scored concrete decking 3) Masonry rock and water feature utilizing various elevations and shapes with stacked stone on vertical finish surface. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. A budget amendment as described in Exhibit "A" attached hereto is hereby approved. SECTION 2.
