SUBJECT: CONSIDER AN ORDINANCE TO REVISE AND UPDATE
CHAPTER 10.04 OF THE MOORPARK MUNICIPAL CODE
REGARDING PARKING PROHIBITIONS
BACKGROUND
Parking prohibitions such as red curbs and sign - posted
zones are a public safety tool used to keep traffic lanes
open, improve sight distance, and prevent vehicles from
obstructing bicycle or emergency lanes. Currently, all
parking prohibitions are submitted to the City Council for
review and approval. This occasionally presents a problem
when a safety issue requires immediate action. Staff
recommends that subsection "J" of Moorpark Municipal Code
Section be amended to permit the City Engineer, with the
approval of the City Manager, to establish parking
restrictions where the stopping of a vehicle would
constitute a traffic hazard or endanger life or property.
The City of Ventura ordinance gives their staff latitude to
make changes when immediate action is required, while
retaining the balance of the authority with the City
Council. This is the model for the proposed change to the
Moorpark Municipal Code. A draft ordinance is attached as
Exhibit A. The City Attorney has reviewed the attached
ordinance.

Through the authority of California Vehicle Code section
22507 (a), Moorpark Municipal code Section 10.04.190 is
titled, `Prohibited parking or stopping areas - Designated."
While the full text is included as Exhibit "B ", the opening
paragraph states:
"No person shall park, stop or leave standing any
vehicle, trailer, or camper, whether attended or
unattended, except when necessary to avoid
conflict with other traffic or in compliance with
the directions of a peace officer or official
traffic - control device in any of the following
places:"
Subsection "J" states:
"Any area or zone where parking or stopping of a
vehicle for all or any part of any day is
restricted or prohibited by a resolution of the
city council; provided, any such area or zone is
designated by signs or markings giving notice of
such parking restriction or prohibition."
The proposed change adds the following sentence to
subsection J:
"Parking or stopping of a vehicle may be
restricted or prohibited in any area where the
City Engineer, with the approval of the City
Manager, determines that the parking or stopping
of a vehicle would constitute a traffic hazard or
would endanger life or property, when such area
is indicated by appropriate signs or by red paint
upon the curb surface."

ORDINANCE NO.
AN ORDINANCE OF THE CITY OF MOORPARK,
CALIFORNIA, AMENDING MUNICIPAL CODE CHAPTER
10.04, TRAFFIC CODE
WHEREAS, Ordinance No. 20 was enacted by the Moorpark City
Council to established traffic standards for the City of
Moorpark; and
WHEREAS, Ordinances 73 and 178 amended this Municipal Code
section; and
WHEREAS, the Moorpark City Council has determined that it
is appropriate to delegate to staff authority for the
establishment of parking and stopping prohibitions.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
MOORPARK DOES ORDAIN AS FOLLOWS:
SECTION 1. Section 10.04.190 of Chapter 10.04, Article
III, of the Moorpark Municipal Code is hereby amended by
deleting paragraph J and adding a new paragraph J to read as
follows:
"J. Any area or zone where parking or stopping of
a vehicle for all or any part of any day is restricted or
prohibited by a resolution of the city council; provided,
any such area or zone is designated by signs or markings
giving notice of such parking restriction or prohibition.
Parking or stopping of a vehicle may be restricted or
prohibited in any area where the City Engineer, with the
approval of the City Manager, determines that the parking
or stopping of a vehicle would constitute a traffic hazard
or would endanger life or property, when such area is
indicated by appropriate signs or by red paint upon the
curb surface."
SECTION 2. If any section, subsection, sentence, clause,
phrase, part or portion of this Ordinance is for any reason held
to be invalid or unconstitutional by any court of competent
jurisdiction, such decision shall not affect the validity of the
remaining portions of this Ordinance. The City Council declares
that it would have adopted this Ordinance and each section,
subsection, sentence, clause, phrase, part or portion thereof,
irrespective of the fact that any one or more section,

subsections, sentences, clauses, phrases, parts or portions be
declared invalid or unconstitutional.
SECTION 3. This Ordinance shall become effective thirty (30)
days after its passage and adoption.
SECTION 4. The City Clerk shall certify to the passage and
adoption of this ordinance; shall enter the same in the book of
original ordinances of said City; shall make a minute of the
passage and adoption thereof in the records of the proceedings of
the City Council at which the same is passed and adopted; and
shall, within fifteen (15) days after the passage and adoption
thereof, cause the same to be published once in the Moorpark Star
a newspaper of general circulation, as defined in Section 6008 of
the Government Code, for the City of Moorpark, and which is hereby
designated for that purpose.

Section 10.04.190 Prohibited parking or stopping areas -- Designated.
No person shall park, stop or leave standing any vehicle, trailer or camper, whether
attended or unattended, except when necessary to avoid conflict with other traffic or in
compliance with the directions of a peace officer or official traffic - control device in any
of the following places:
A. Within an intersection;
B. On a crosswalk, except that a bus engaged as a common carrier or a taxicab may
stop in an unmarked crosswalk to load or unload passengers;
C. Between a safety zone and the adjacent right -hand curb or within the area
between the zone and the curb as may be indicated by a sign or red paint on the curb;
D. Within fifteen (15) feet of the driveway entrance to or exit from any fire station.
This subsection shall not apply to any vehicle owned or operated by a fire department and
clearly marked as a fire department vehicle;
E. Within fifteen (15) feet of a fire hydrant, except when such vehicle is attended by
a licensed driver who is seated in the front seat and who can immediately move such
vehicle in case of necessity. This subsection shall not apply in respect to any vehicle
owned or operated by a fire department and clearly marked as a fire department vehicle;
F. In front of a public or private driveway, except that a bus engaged as a common
carrier, school bus or taxicab may stop to load or unload passengers;
G. On a sidewalk, except as permitted by ordinance;
H. Alongside, opposite, or within any street or highway excavation, obstruction or
construction when such stopping, standing or parking would obstruct traffic or
construction operations;
1. On the roadway side of any vehicle stopped, parked or standing at the curb or
edge of a highway;
J. Any area or zone where parking or stopping of a vehicle for all or any part of any
day is restricted or prohibited by a resolution of the city council; provided, any such area
or zone is designated by signs or markings giving notice of such parking restriction or
prohibition;
K. On any roadway in such a position as to obstruct the normal movement of traffic
or in such a condition as to create a hazard to other traffic upon the street;
L. Parking across or over the parallel lines of a designated space;
M. Parking across the parallel lines into the aisle so as to cause a traffic hazard;
N. Alongside curb space authorized for the loading and unloading of passengers of a
bus engaged as a common carrier in local transportation when indicated by sign or red
paint on the curb erected or painted by the city pursuant to a resolution of the city
council;
O. Upon a bridge, except vehicles of the authorities in charge, being used in the
repair, maintenance or inspection of the facility;
P. In front of that portion of a curb which has been cut down, lowered or constructed
to provide wheelchair accessibility to the sidewalk and which is designated for
wheelchair access by either a sign or red paint on the curb pursuant to a resolution of the
