MOORPARK CITY COUNCIL AGENDA REPORT TO: Honorable City Council FROM: Shaun Kroes, Program Manager DATE: 02/06/2019 Regular Meeting SUBJECT: Consider Approval of Map and Cover Letter for Submittal to Los Angeles Regional Water Quality Control Board Confirming Location of Full Capture Devices for Compliance with Statewide Trash Provisions BACKGROUND On August 18, 2017, the City received a letter from the Los Angeles Regional Water Quality Control Board (Regional Board) regarding Water Code Section 13383 Order to submit method to comply with Statewide Trash Provisions. As described in the letter, the State Water Resources Control Board adopted an Amendment to the Water Quality Control Plan for Ocean Waters of California on April 7, 2015 (Trash Amendment). The Trash Amendment established a statewide water quality objective for trash for MS4 permittees (such as the City of Moorpark) that are not already required to comply with a trash Total Maximum Daily Load. On November 1, 2017, the City selected Track 1 for compliance with the Trash Amendment. The options were: Track 1: Install, operate, and maintain Full Capture Systems for the storm drain network that capture runoff from the Priority Land Uses in their jurisdiction. Track 2: Install, operate, and maintain any combination of Full Capture Systems, Multi-Benefit Projects, other Treatment Controls, and/or Institutional Controls within either the jurisdiction of the MS4 permittee or the jurisdiction of the MS4 permittee and contiguous MS4 permittees. A Full Capture System is defined as a treatment control, or series of treatment controls, including but not limited to, a multi-benefit project or a low-impact development control that traps all particles that are 5 mm or greater, and has a design treatment capacity that is either: a) of not less than the peak flow rate, Q (which represents “peak flow rate” 287 Honorable City Council 02/06/2019 Regular Meeting Page 2 measured in volume over time), resulting from a one-year, one-hour, storm in the subdrainage area, or b) approximately sized to, and designed to carry at least the same flows as, the corresponding storm drain. Priority Land Uses are defined as high density residential (10 units/acre or more), industrial, commercial, mixed urban, and public transportation stations. Pictures of a sample Full Capture Device are provided in Attachment 1. It should be noted that per the Trash Amendment, selection of Track 2 does not mean that the City would not have to install any Full Capture Systems. The expectation is that Full Capture Systems would be installed to the extent that is not cost prohibitive, in addition to establishing additional Multi-Benefit Projects, other Treatment Controls, and/or Institutional Controls. On November 2, 2017, the City submitted an approved response letter, confirming that the City intended to comply with Track 1. After submittal of the letter, the City has until February 18, 2019 to submit to the Regional Board a map identifying the designated catch basins and Priority Land Uses. The preferred map format is a GIS file. On December 19, 2018, the City Council approved amending the City’s Geographical Information Services (GIS) contract with Nobel Services (Nobel) to produce the GIS file. DISCUSSION Nobel has completed the GIS map (Attachment 2) and City staff has drafted a cover letter (Attachment 3). The map identifies 158 City catch basins that will require a Full Capture System. Pursuant to the Trash Provisions, the City is required to complete installation of the proposed Full Capture Systems within ten years from the effective date of the new Ventura Countywide MS4 Permit (which has not yet been approved) or not later than December 2, 2030. There is a completion milestone of 10% implementation per year. In the City’s case, the milestone target would be installation of at least 16 Full Capture Systems installed ever year, for ten years. Depending on funding, the City may install more Full Capture Systems in a given year. The new Ventura Countywide MS4 Permit is expected to be issued soon, maybe in 2019, but the date has not been determined yet. Staff also notes that because the Trash Amendment requires Full Capture Systems for specific land uses, the City would be responsible for any discharges from private storm drain inlets that connect to the City’s storm drain system. For example, if a private storm drain inlet in a commercial parking lot connects to a City storm drain pipe downstream, the City would have to identify a location where a Full Capture Device could be installed to capture that discharge. Where feasible, City staff has identified catch basins “downstream” from an applicable private development to capture the trash. In some circumstances, the private catch basin may directly discharge to a Caltrans-owned, or County-owned system. It is staff’s understanding that in those situations the City would not be required to install any Full Capture Systems. Staff is currently exploring options for 288 Honorable City Council 02/06/2019 Regular Meeting Page 3 establishing new conditions of approval for new development and redevelopment projects that would require the installation of Full Capture Systems for private storm drain inlets in an effort to reduce the amount of trash that is discharged from private property into the City’s storm drain system or directly into the Arroyo Simi. FISCAL IMPACT None at this time; however, future expenditures will be necessary. Estimated costs of individual Full Capture Systems range from $600 to $1,200 per device (includes materials and installation). For installation of 158 catch basins, installation costs are estimated to be $94,800 to $189,600 over the course of ten years. Maintenance costs for the Full Capture Systems range from $40 per catch basin per cleaning to $110 per catch basin per cleaning. Catch basins with Full Capture Systems will likely be required to be cleaned a minimum of three times per year but more likely four times per year at an estimated cost of $25,280 to $69,520 per year, assuming all 158 catch basins receive a Full Capture System. Potential funding sources for the Full Capture Devices include the City’s Oil Payment Program; potential grant applications for litter reduction or stormwater quality improvements; funding sources for street improvements when/if the City performs street improvements on streets that include catch basins that will require a Full Capture System. Also, SB 231, recently signed into law by Governor Brown, permits establishment of stormwater fees without the voter-approval requirements of Proposition 218. This law may be subject to litigation. STAFF RECOMMENDATION Approve submittal of map and letter to Regional Board identifying City storm drains proposed to receive installation of Full Capture Systems. Attachments: 1. The City is now submitting with this letter, a jurisdictional map required by the LARWQCB’s 13383 Order dated August 18, 2017. This map identifies the Priority Land Use areas in the City, the associated storm drain network, and proposed locations for approximately 158 catch basins proposed to receive certified Full Capture System installations.
