Gilbert, Director of Public Works DATE: November 20, 2001 (Cont. from 11/7/01 to 12/5/01) SUBJECT: Resolution No. 2001- Approving the Mitigated Negative Declaration / Environmental Assessment for the Los Angeles Avenue Widening Project: Spring Road to Moorpark Avenue [Project 80131 DISCUSSION A. Background 1. In August of 2000, the City Council approved the selection of a consultant [Boyle Engineering] to prepare the design for the subject project. 2. In May of 2001, the City Council approved the conceptual design for the project. 3. The subject document was sent to the State Clearinghouse on October 15, 2001. The public review period ended on November 15, 2001. 4. On November 7, 2001, the City Council held a public hearing to consider public input regarding the subject document. The public hearing was continued to December 5, 2001, a date subsequent to the end of the public review period. B. Project Scope & Description The proposed street widening project is consistent with, and is being constructed in order to partially implement, the Circulation Element of the Moorpark General Plan. Attached as Exhibit 1 is a description of the full purpose and scope of the project. Mitiqated Negative Declaration A copy of the subject draft environmental document was previously provided to the City Council under separate copy. D. Changes Suggested changes to the document, partially in response to comments received, are attached as Exhibit 2. E. Mitigation Monitoring Program The proposed Mitigation Monitoring Program is attached as Exhibit 3. F. Future Efforts When Caltrans approval of the conceptual design is obtained, the design consultant and /or City staff will proceed with project implementation, which will include the following: 1. Right -of -Way Legal Descriptions: The design consultant will proceed with the preparation of legal descriptions for the right -of -way parcels to be acquired. 2. Preparation of Final Draft Design Plans and Specifications: The design consultant will proceed with the preparation of the final draft plans and specifications for the project. 3. Utility Coordination / Relocation: The design consultant and City staff will work with all affected utilities to accomplish any needed utility relocations. 4. Right -of -Way Acquisition: Staff will retain the services of a consultant to assist City staff in the acquisition of the required street rights -of -way. All of the acquired rights - of -way will eventually be conveyed to Caltrans. 5. Caltrans Permit: Staff will seek and obtain a Caltrans Encroachment Permit for the project. 6. Construction: When all of the above tasks have been completed, the City will be in a position to advertise for the receipt of bids for the construction of the project. The City Council will be asked to approve the project plans and authorize staff to advertise for bids. Public Review Period The subject document was sent to the State Clearinghouse on October 15, 2001. The public review period ended on November 15, 2001, subject to receipt of final comment closure confirmation by the State Clearinghouse. I. Resolution Attached as Exhibit 4 is the draft Resolution approving the subject document. Attached as Exhibit A to that Resolution is the required Statement of Findings. STAFF RECOMMENDATION Adopt Resolution No. 2001- (Exhibit 4) approving the Mitigated Negative Declaration and Expanded Initial Study / Environmental Assessment, finding that the document is an accurate and complete representation of the environmental effects of the project. Exhibit 1 Project Description October 22, 2001 Page 1 A. General Project Scope 1. Purpose: The purpose of the project is to widen Los Angeles Avenue between Spring Road and Moorpark Avenue to accommodate six (6) lanes of traffic. 2. Project Limits: The limits of the project extend from Moorpark Avenue easterly to a point approximately five hundred feet (500') east of Spring Road. The total length of the project is approximately 2300 feet. 3. Existing Right -of -Way and Travel Lanes: The existing right - of -way width along this segment of street varies from eighty feet (80') to one hundred nine feet (109'). The street is striped for four (4) twelve feet (121) wide travel lanes, plus a fourteen feet (141) wide painted median. 4. Design Standard: The design standard for Los Angeles Avenue calls for a curb -to -curb width of one hundred two feet (1021) within a street right -of -way of one hundred eighteen feet (1181). Accordingly, the "half- street" dimensions require fifty -one feet (51') from the centerline to the curb face, within a "half street" right -of -way of fifty - nine feet (59'). 5. Project Objectives: The object of the project is to construct full -width street improvements within the project area, generally described as follows: - one 14' painted median; - six -12' travel lanes; - two- 8'emergency lanes (unpainted bicycle lanes); - two -8' sidewalk / parkways; and - free right turn lanes where necessary. B. Shifted Centerline Due to certain existing improvements along the north side of the street west of Spring Road (see below for details) , the Conceptual Plan calls for an eleven feet (111) shift of the centerline to the south, between Spring Road and Millard Street. East of Spring Road and west of Millard Street there will be a tapered transition from the "shifted" centerline back to the existing centerline at the east and west project limits. The "shifted" centerline is necessary in order to provide for the required fifty -one feet (51') dimension between the centerline and the north curbface. Exhibit 1 Project Description October 22, 2001 Page 2 C. Project Constraints and Desiqn Solutions 1. North Side - West of Spring Road a) Constraints: • Current half- street R -O -W width: fifty feet (501); • Curb location: forty feet (401) from the center line; • Existing Improvements: - Existing residential rear yards; - a ten feet (101) high block wall; - parkway landscaping; and - power poles. b) Design Solution: Due to the high cost of right -of -way acquisition, and the removal and reconstruction of the existing improvements on the north side of the street just west of Spring Road, the Conceptual Plan calls for all required street widening in this area to occur on the south side of the street. To achieve the required street width, the centerline will be shifted to the south. 2. South Side - East of Moorpark Avenue a) Constraints: The south side of the street just east of Moorpark Avenue has been improved to its full width (fifty -one feet [511] from centerline to curb, within fifty -nine feet [591] wide half- street right -of -way). There are substantial existing improvements in this area, generally summarized as follows: • existing properties already developed for multi- family land use; • decorative block walls and monument signs; and • meandering sidewalks and parkway landscaping. b) Design Solution: Due to the relative higher cost of right -of -way acquisition and reconstruction along the south side of the street in this area, the Conceptual Plan calls for the centerline to remain at its present location. Certain widening, relocation and improvement will be required along the north side of the street in this area. D. Other Desiqn Elements 1. East -End Transition: As mentioned above, the centerline will taper from the "shifted" centerline [eleven feet (11')] at the west side of Spring Road, back to the current centerline to the east. The length of this transition will be approximately five hundred feet (500'). It will be necessary to acquire additional street right -of -way and reconstruct certain street and off -site improvements in this area [Chevron Station and Bank of America]. West -End Transition: At Millard Street the centerline will also transition from the "shifted" centerline back to the existing centerline to the west. Here too the length of the tapered transition will be approximately five hundred feet (5001). a) Additional street right -of -way will have to be acquired on the north side of the street in the transition area, ranging from zero at the Millard Street to nine feet (91) wide at the west end of the transition. b) The transition to the north will also require the reconstruction of the curb, gutter and sidewalk in this area. 3. North Side West of the Tapered Transition: In order to achieve a fifty -nine feet (59') wide half - street west of the westerly transition, it will be necessary to acquire an additional nine feet (91) of street right -of -way and to reconstruct street improvements in this area. 4. Power Poles & Underground Utilities: The project will require the relocation of the power poles and certain modifications to some of the recently installed underground utility vaults. 5. South Side R -O -W at 148 Los Angeles Avenue: There is an existing residential structure located between the Le Club Apartments and the Regal Condominiums. The street right -of- way required at that location will probably require acquisition of the entire property. 6. East -to -North Left -Turn Lane at Spring Road: The existing double left -turn lane will be changed to a single left -turn lane. 7. West -to -South Left -Turn Lane at Moorpark Avenue: The existing left -turn lane will be lengthened. The plans do not call for a double left -turn lane at this location. E. Right Turn Lanes 1. Westbound at Moorpark Avenue: The Conceptual Plan calls for an additional right -turn lane for Moorpark Avenue, to be constructed west of Flory Avenue. It is anticipated that the additional street right -of -way and street improvements required for these improvements will be six feet (61) wide. Eastbound at Spring Road: The Conceptual Plan also calls for additional street widening on the south side of the street just west of Spring Road, to provide for a free right turn lane on to Spring Road. Once the additional street width for this feature is determined by Caltrans, the impacts of this design element on the off -site and on- site improvements in the area will be assessed and a report on this element of the project design will be presented to the City Council. . r. Permits and Approvals Adoption of Mitigated Negative Declaration, Required: Cal -Trans Encroachment Permit, Approval of Utility Relocation by Ventura County Public Works. City Council Approval of Additional Right -of -Way Acquisition Jurisdiction: City of Moorpark Proposed Construction and Structures: The widening of Los Angeles Avenue will involve obtaining 118 feet of right -of -way along the entire length of the project. The proposed curb to curb width will be 102 feet. Between Moorpark Avenue and Flory Avenue however, the proposed curb to curb width will be 108 feet due to the addition of a dedicated right turn lane on the north side of the street at Moorpark Road and the south side of the street at Spring Road. The final configuration of Los Angeles Avenue will include six 12 foot wide travel lanes, a 14 foot wide painted median, two 8 foot wide shoulders that may also serve as Class III bicycle lanes, and an 8 foot wide sidewalk/parkway on both sides of the street. Due to the high cost of right -of -way acquisitions and reconstruction along the length of the project, street improvements will occur on either the north or south sides of Los Angeles Avenue, where the relative cost is less and the relocation of public utilities will be minimized. The widening of the roadway will result in the acquisition of right -of -way at the east end of Los Angeles Avenue in the Gateway Plaza Shopping Center. The proposed construction will impact the Los Angeles Avenue frontage of the shopping center by removing all of the existing landscaping, constructing an 8 foot wide sidewalk, constructing a retaining wall and hand rail, modifying the existing parking, and removing the existing fountain. The design consultant and City Staff will work with all affected Design consultant and City One time activity during City Public Works Director utilities to accomplish any needed utility relocations. shall properly relocate construction phase utilities as needed Initial Date City of Moorpark Page 4 RESOLUTION NO. 2001 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, ADOPTING A MITIGATED NEGATIVE DECLARATION AND EXPANDED INITIAL STUDY / ENVIRONMENTAL ASSESSMENT AS WELL AS THE MITIGATION MONITORING PLAN FOR A PROJECT TO WIDEN LOS ANGELES AVENUE BETWEEN MOORPARK AVENUE AND SPRING ROAD WHEREAS, the City intends to construct a project to realign, widen and improve Los Angeles Avenue between Moorpark Avenue and a point east of Spring Road; and WHEREAS, at a duly noticed public hearing on November 7, 2001, the City Council considered the content of a Draft Mitigated Negative Declaration /Expanded Initial Study / Environmental Assessment for said project; and WHEREAS, the City Council opened the public hearing on November 7, 2001, and took testimony from all those wishing to testify and continued the public hearing to December 5, 2001; and WHEREAS, the Draft Mitigated Negative Declaration and Expanded Initial Study / Environmental Assessment was made available to the public for the required review period set forth in the City and State CEQA Guidelines and NEPA requirements; and WHEREAS, responses to comments on the adequacy of the Draft Mitigated Negative Declaration and Expanded Initial Study / Environmental Assessment were presented to the City Council; and WHEREAS, a mitigated monitoring plan conforming with City and State guidelines was prepared and distributed to the public and decision - makers prior to taking action on the sufficiency of the environmental analysis of the project; and WHEREAS, the City Council has determined that based on the record as a whole the proposed street improvement program will not result in any significant impacts that have not been fully and completely mitigated; and WHEREAS, appropriate findings concerning the impacts of the project have been prepared (attached to this resolution). e00n'1_i Resolution No. 2001 - Page 2 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES RESOLVE AS FOLLOWS: SECTION 1. The City Council hereby determines that the Mitigated Negative Declaration and Expanded Initial Study / Environmental Assessment prepared for the proposed widening, realignment and improvement of Los Angeles Avenue between Moorpark Avenue and a point east of Spring Road, is accurate and complete and has been prepared in compliance with CEQA and NEPA. SECTION 2. The City Council hereby approves the Mitigation Monitoring Plan prepared to implement the Mitigation Measures set forth in the Mitigated Negative Declaration and Expanded Initial Study / Environmental Assessment for this project. SECTION 3. On the basis of the record as a whole, the City Council hereby determines that the impacts of the proposed project, with the adoption of Mitigation Measures, will not have a significant adverse effect on the environment. SECTION 4. The City Council, therefore, hereby approves the Mitigated Negative Declaration /Expanded Initial Study / Environmental Assessment and Mitigation Monitoring Plan subject to the attached findings. SECTION 5. The City Clerk shall certify to the adoption of this Resolution and shall cause a certified Resolution to be filed in the book of original Resolutions. Traffenstedt, City Clerk Exhibit "A ": CEQA Findings Patrick Hunter, Mayor Resolution Number 2001- EXHIBIT A STATEMENT OF FINDINGS LOS ANGELES AVENUE WIDENING: MOORPARK AVENUE TO SPRING ROAD Legal Requirements The California Environmental Quality Act (CEQA) section 15074 and 15704.1, which specify procedures for the consideration and approval of a Mitigated Negative Declaration, requires the preparation of certain findings. These findings, as applicable to the proposed project, include: (1) Based on the record as a whole, the decision - making body, the City of Moorpark City Council (Lead Agency), has determined that there is no substantial evidence that the proposed project will result in significant effects on the environment; (2) The Mitigated Negative Declaration /Expanded Initial Study reflects the independent judgement and analysis of the Lead Agency; (3) The analysis of the data contained in the Mitigated Negative Declaration /Expanded Initial Study was subjected to properly noticed public review and comment; (4) All comments on the Draft Mitigated Negative Declaration /Expanded Initial Study were considered and responses, in writing, to each comment were prepared by the Lead Agency; (5) The record of the proceedings are available for review upon request from the City of Moorpark City Clerk; (6) The City has adopted a Mitigation Monitoring and Reporting Program to ensure proper implementation of mitigation measures; and, (7) The mitigation measures that have been adopted will not themselves cause any significant effects on the environment.
