Traffenstedt, Acting Community Development Director Laura Stringer, Senior Management Analysts Date: December 6, 2001 (CC Meeting of 12/19/01) Subject: Consider Authorizing the City Manager tol Sign an Extension to the Revised Agreement with the Planning and Consulting Firm of Cotton /Bridges /Associ.aies, Inc. (previously Cotton /Beland /Associates) for the'Update of the Housing Element of the General Plan DISCUSSION On September 1, 1999, the City Council authorized the City Manager to sign the initial contract for the update of the Housing Element of the General Plan. This contract agreement with the planning and consulting firm of Cotton /Bridges /Associates, Inc. (CBA) (previously Cotton /Beland /Associates) also included preparation of an updated Safety Element. The City Council on March l'121, 2001, adopted the revised Safety Element, completing one (1) phase of the consulting agreement. Due to changes in the Regional Housing Needs Allocation (RHNA) process and affordable units alloclation and comments from a review by the Department of Housing andlCommunity Development (HCD), the Housing Element became more complicated. To accommodate the additional work required, an amendment to the Revised Agreement was approved by the City Council on September 5, 2001. The amendment increased the contract for the Housing Element portion by $10,750 and extended the term of the contract to December 31, 2001 On August 27, 2001 the Planning Commission, after conducting a workshop and duly noticed public hearing, recommended approval of the draft Housing Element Update to the City Council. At that time it was deemed appropriate to re- submit the document to HCD, so that HCD comments could be included in City Council's consideration of the document. December 19, 2001 Page 2 anticipated, requiring the consultant to provide services over a longer period of time. It is now anticipated that response to HCD comments and review and adoption by the City Council should occur by the end of January or early February. No additional work effort by the consultant is anticipated at this time, only extension of the time period in which to complete the document is required. It is requested that the City Council consider authorizing the City Manager to extend the term of the Service Agreement with CBA to February 28, 2002, with further authority to extend the term as deemed necessary to accommodate the review process. STAFF RECOMMENDATION Authorize the City Manager to extend the term of the Agreement for Professional Services to February 28, 2002, with further authority to extend the term as deemed necessary. Attachments: 1) Amendment to Revised Agreement. 41 4 f S: \Community Development \Everyone \Consultants \cc011219 stf rpt.Cotton Bridges.doc AMENDMENT TO REVISED AGREEMENT FOR PROFESSIONAL SERVICES This Amendment, made and entered into this ?3rci day of .� , 2001, between the CITY OF MOORPARK, a municipal corporation, hereinafter referred to as "CITY" and COTTON /BRIDGES /ASSOCIATES, 144'C., (formerly Cotton /Beland /Associates, Inc.), a California Corporation, hereinafter referred to as "CONSULTANT." WHEREAS the City and Consultant entered into a REVISED AGREEMENT FOR PROFESSIONAL SERVICES, hereinafter referred to "Agreement," dated February 24, 2000, including contract planning services for updating the General Plan Housing Element; and WHEREAS the City and Consultant have determined that additional tasks are required to complete the update of the General Plan Housing Element; NOW, THEREFORE, in consideration of the mutual covenants, benefits and premises herein stated, the parties hereto agree as follows: Sections I and III of the Agreement are hereby amended: I. Compensation The fees in full compensation to Consultant services rendered to Update the General Plan Housing Element, shall be increased by Ten Thousand Two Hundred Fifty Dollars ($10,250), for a total compensation not to exceed Thirty Nine Thousand Eight Hundred Eighty Dollars ($39,880). The additional tasks for completing the Housing Element shall be as set forth in Exhibit A. All other provisions of Section I shall remain in full force and effect. III. Term The term of the Agreement shall be extended to December 31, 2001, unless sooner terminated as provided for in the Agreement. All other provisions of Section III shall remain in full force and effect. All other provisions of the Agreement will remain in full force and effect.
