SUBJECT: Consider Adoption of An Ordinance to Rescind Existing
Chapter 15.24 and Replace with New Chapter 15.24
Regarding Flood Damage Prevention (Continued open
Public Hearing from January 16,2002)
BACKGROUND
The Federal Emergency Management Agency (FEMA) administers the
National Flood Insurance Program (NFIP). The NFIP was established
in 1968 to mitigate flood damage and provide property owners with
flood insurance protection at reasonable premium rates. FEMA
regulations require that local agencies adopt ordinances that
implement various provisions to minimize exposure to flood
damages.
Chapter 15.24, "Flood Damage Prevention" of the Moorpark
Municipal Code was last modified in 1988. In the past few years,
FEMA has adopted additional regulations. The additional
regulation changes impacting city ordinances include additional
definitions, severability provisions, appeal and variance
procedures and minor editorial changes.
DISCUSSION
FEMA staff has reviewed the proposed "Flood Damage Prevention"
Ordinance and provided their written approval. Additional City
Attorney comments necessitate changes to be incorporated in the
Ordinance. The Ordinance is in the final preparation stage, and
staff recommends that the public hearing be continued open to
March 6, 2002.
STAFF RECOMMENDATION
Continue to take public testimony, and continue the public
hearing open to March 6, 2002.
