Staff Recommendation: 1) Prior to a motion to adopt the revised Salary Plan Resolution, the Mayor or Mayor Pro Tempore shall make an oral summary report as follows: “Staff is recommending the City Council approve a revised Salary Plan Resolution that includes increasing the salary ranges for all employees by a cost-of-living adjustment of 1% effective with the pay period beginning July 6, 2019. All of the Non-Competitive Service employee positions are consistent with the local agency executive definition in Section 3511.1(d) of the Government Code, requiring an oral summary report, and the estimated total annual cost of the proposed 1% cost-of-living raise for all of the Non-Competitive Service positions is $40,944 for the next fiscal year. The estimated total annual cost of the proposed 1% cost-of-living raise for just the City Manager position is $2,290. MOORPARK CITY COUNCIL AGENDA REPORT TO: Honorable City Council FROM: Deborah Traffenstedt, Assistant City Manager DATE: 06/05/19 Regular Meeting SUBJECT: Consider Resolution Amending the City’s Salary Plan and Rescinding Resolution No. 2019-3788 BACKGROUND AND DISCUSSION Attached to this report is a draft resolution amending the City’s Salary Plan, with changes shown with the use of legislative format. The amended Salary Plan Resolution includes a one percent (1%) cost-of-living increase for all employees. The Salary Schedules attached to the Salary Plan Resolution are divided into four separate sections: Hourly Positions, Competitive Service Positions, Non-Competitive Service Positions, and City Manager Position. The Salary Schedule tables for the Hourly Positions, Competitive Service Positions, and Non-Competitive Service Positions have Hourly, Bi-weekly, and Monthly salary tables for each established salary step and range. The City Manager schedule includes the hourly rate and an annual rate consistent with the draft Employment Agreement Amendment No. 2 that is a separate agenda item for the June 5, 2019 regular meeting. The overall estimated cost of the proposed changes to the Salary Plan for all employees is approximately $67,642. Of this total cost, approximately $40,944 is for Non- Competitive Service (local agency executive) positions that include the City Manager, $22,574 is for Competitive Service positions, and $4,124 is for the Hourly (temporary part-time) positions. GOVERNMENT CODE SECTION 54953(C)(3) ANNOUNCEMENT Consistent with Section 54953(c)(3) of the Government Code and Section 2.5 of the City Council Rules of Procedure, the Mayor, Mayor Pro Tempore, or other presiding officer shall orally report a summary of a recommendation for a final action on the salaries, salary schedules, or compensation paid in the form of fringe benefits of a local agency executive, as defined in Section 3511.1(d) of the Government Code, during the open regular meeting in which the final action is to be taken and prior to the motion to approve. The City’s Non-Competitive Service employees are considered local agency executives per the State law definition, which includes a chief executive officer, a deputy and assistant chief executive officer, a department head, and a position held by an Item: 9.C. 171 Honorable City Council 06/05/2019 Regular Meeting Page 2 employment contract. All of the City’s Non-Competitive Service employees have an employment agreement, and this includes the City Manager and the Assistant City Manager. The announcement to report a summary of the increased compensation to be paid to Non-Competitive Service employees has been added to the staff recommendation in this report to occur prior to a motion to adopt the revised Salary Plan Resolution. With adoption of the revised Salary Plan Resolution, the City would be providing a 1% cost-of-living increase in salaries for all of the City’s Non-Competitive Service employees, including the City Manager position, and this increase is salary is proposed to become effective in the first full pay period in the next fiscal year, which pay period begins on July 6, 2019, and has a pay date of July 26, 2019. The overall estimated annual cost of the proposed changes to the Salary Plan for Non-Competitive Service employees for Fiscal Year 2019-2020 is $40,944. The overall estimated annual cost for just the City Manager 1% cost-of-living increase for Fiscal Year 2019-2020 is $2,290. In Section 4 of the revised Salary Plan Resolution, there is an increase to the City Manager deferred compensation benefit per pay period from 3% to 4% of gross base salary. This change has been made for consistency with Amendment No. 2 to the City Manager Employment Agreement, which is a separate agenda item on the June 5, 2019 regular meeting. Disclosure of the City Manager deferred compensation benefit increase is disclosed in the Amendment No. 2 to the Employment Agreement agenda report. FISCAL IMPACT The overall estimated cost of the proposed changes to the Salary Plan for all employees is approximately $67,642. Of this total cost, approximately $40,944 is for Non- Competitive Service (local agency executive) positions, $22,574 is for Competitive Service positions, and $4,124 is for the Hourly (temporary part-time) positions. The Fiscal Year 2019-2020 Budget that is proposed to be adopted at the June 19, 2019 regular meeting, and which was considered by the City Council at its special Budget workshop meeting on May 29, 2019 does incorporate the 1% cost-of-living increase for all employees. The effective date of the attached draft Salary Plan Resolution is the first pay period in Fiscal Year 2019-2020, which pay period begins on July 6, 2019. The revised Salary Plan Resolution is consistent with the next Fiscal Year Budget for Fiscal Year 2019-2020 that is scheduled for adoption on June 19, 2019, prior to the effective date of the attached revised Salary Plan Resolution. Attachment: Draft revised Salary Plan Resolution including Attachment A, Salary Schedules 173 RESOLUTION NO. 2019- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, AMENDING THE SALARY PLAN FOR COMPETITIVE SERVICE, NON-COMPETITIVE SERVICE AND HOURLY EMPLOYEES, AND RESCINDING RESOLUTION NO. 20189-37788 WHEREAS, the City Council at its regular meeting on June 5, 2019, considered and adopted an amended Salary Plan to incorporate a one percent (1%) cost-of-living salary increase for all positions in the attached Salary Schedule Tables, to add a Competitive Service Landscape Maintenance Inspector position at Range 49, and to incorporate an increase in the City Manager deferred compensation benefit contribution from three (3) percent of gross base salary to four (4) percent of gross base salary, as described in an agenda report for the June 5, 2019, regular City Council meeting. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The corresponding salaries for the ranges established in Section 1 of this resolution are attached hereto and incorporated herein as the “Hourly Salary Schedule” Table. The Bi-Weekly Salary for each range may be calculated by multiplying the Hourly Salary by two thousand eighty (2,080) hours and dividing that calculation by twenty six (26) pay periods. The Monthly Salary for each range may be calculated by multiplying the Hourly Salary by two thousand eighty (2,080) hours and dividing that calculation by twelve (12) months. The Annual Salary for each range may be calculated by multiplying the Hourly Salary by two thousand eighty (2,080) hours. The “Bi-Weekly Salary Schedules”, and “Monthly Salary Schedules”, and City Manager Annual Salary Schedule attached to this resolution are for information purposes, only, since calculations are approximate due to rounding differences. SECTION 3. The Salary Plan is based on ranges of two and one-half percent (2.5%) and step increases of two and one-half percent (2.5%) with a total of thirteen (13) steps, not including the City Manager Salary Schedule. SECTION 4. City shall continue to pay a deferred compensation contribution into a City approved deferred compensation program, for enrolled regular full-time and regular part-time employees, and the contribution amount shall be as follows: City Manager - ThreeFour percent (34.0%) of gross base salary, Department Head positions – two and one-half percent (2.5%) of gross base salary, and all other Management and Competitive Service regular full-time and regular part-time positions – Two percent (2.0%) of gross base salary. Gross base salary is defined as wages paid as described in the Salary Plan Schedule (reference Section 2, herein) and including longevity pay; and excluding bilingual pay, in-lieu insurance payment, uniform cleaning allowance, leave cash-out, overtime pay, car and cellular telephone allowances, and deferred compensation payment. A Retired Annuitant is not eligible for a deferred compensation contribution. SECTION 5. Bilingual pay compensation for Spanish language bilingual skills shall be paid to qualified regular full-time and part-time employees, consistent with the qualification requirements approved in a Memorandum of Understanding (MOU) between the City of Moorpark and the Service Employees International Union CTW , CLC, Local 721, and to qualified non-competitive service employees consistent with a City Council adopted management benefits resolution. Qualification for bilingual pay shall be determined by the City Manager at his or her sole discretion. The current rates per an approved MOU and management benefits resolution are: forty cents ($.40) per hour for verbal bilingual pay, for all hours actually worked, and including annual leave, vacation leave, City holidays, and sick leave, but not for disability leave or other unpaid leave, for up to forty (40) hours per week; and fifty cents ($.50) per hour for combined verbal/written bilingual pay, for all hours actually worked, and including annual leave, vacation leave, City holidays, and sick leave, but not for disability leave or other unpaid leave, for up to forty (40) hours per week. A Retired Annuitant is not eligible for bilingual pay compensation. 177 Resolution No. 2019-____ Page 5 SECTION 6. Longevity pay compensation shall be paid to qualified regular full-time employees hired prior to January 1, 2015, consistent with the qualification requirements approved in a Memorandum of Agreement between the City of Moorpark and the Service Employees International Union CTW , CLC, Local 721 as follows: 121 to 180 Months of service – one-percent (1%), 181 to 240 Months of service – one and one-half percent (1.5%), 241 to 300 Months of service – two percent (2.0%) 301 or more Months of service – two and one-half percent (2.5%); and Longevity pay compensation shall be paid to qualified Non-Competitive Service employees hired prior to January 1, 2015, consistent with the qualification requirements approved in a City Council adopted management benefits resolution as follows: Department Heads 61 to 120 Months of service – one percent (1.0%) 121 to 180 Months of service – one and one-half percent (1.5%) 181 to 240 Months of service – two percent (2.0%) 241 to 300 Months of service – two and one-half percent (2.5%) 301 or more Months of service – three percent (3.0%) Management Employees 121 to 180 Months of service – one percent (1.0%) 181 to 240 Months of service – one and one-half percent (1.5%) 241 to 300 Months of service – two percent (2.0%) 301 or more Months of service – two and one-half percent (2.5%). Retired Annuitant Not eligible for longevity pay compensation. SECTION 7. Implementation of salary adjustments for positions noted in Section 1, herein, shall be limited by the performance review system. Employees shall be evaluated prior to their anniversary date, and approved salary adjustments shall be effective as of the first day of the pay period in which the anniversary date or revised anniversary date occurs. A Retired Annuitant is not eligible for merit raise salary adjustments pursuant to a performance review system, based on the limited term of the Retired Annuitant appointment. SECTION 8. Resolution No. 20189-37788 shall be rescinded in its entirety, and this revised Salary Plan shall become effective with the pay period beginning February 1July 6, 2019, subject to City Council adoption of a resolution approving the Fiscal Year 2019-2020 Budget that includes funding for the one percent (1%) cost-of-living increase for all positions, and for the City Manager position also subject to the City Council approving an amendment to the City Manager Employment Agreement at a regular meeting prior to July 6, 2019 that is consistent with this revised Salary Plan Resolution. The effective dates on the attached Exhibit A Salary Schedule Tables have not been revised, since no changes have been made to the salary information shown on those tables. 178 Resolution No. 2019-____ Page 6 SECTION 9. The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original resolutions.
